50223 510 ![CDATA[Resolución del director general del Servicio de Salud de las Islas Baleares por la que se ejecuta la Sentencia núm. 158/2019, dictada por el Juzgado Contencioso-Administrativo núm. 3 de Palma]] ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Antecedentes</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El 19 de mayo de 2016 se publicó la Resolución del director general del Servicio de Salud de las Islas Baleares de convocatoria de acceso o progresión a la carrera profesional del personal del Servicio de Salud de las Islas Baleares (BOIB núm. 63).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El 11 de julio de 2017 se publicó la Resolución de la consejera de Hacienda y Administraciones Públicas por la que se ordena la publicación de las listas definitivas del personal que inicia la carrera profesional o asciende de nivel, de acuerdo con la Resolución del director general del Servicio de Salud de las Islas Baleares de 16 de mayo de 2016 por la que se convoca un procedimiento extraordinario para acceder al modelo de carrera profesional del personal del Servicio de Salud de las Islas Baleares</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El señor Albert Ríos Julià y el señor Felipe Salguero Martínez no estuvieron conformes con el nivel reconocido y los días sobrantes que les correspondían, por lo que interpusieron un recurso contencioso-administrativo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Por medio de la Sentencia núm. 158/201, de 17 de junio de 2019, el Juzgado de lo Contencioso-Administrativo núm. 3 de Palma les dio la razón en sus pretensiones y declaró que debía reconocerse:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a. Al señor Albert Ríos Julià, el nivel II (subgrupo A2, enfermero) y 1.342 días sobrantes.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b. Al señor Felipe Salguero Martínez, el nivel III (subgrupo A2, enfermero) y 990 días sobrantes.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El 21 de diciembre de 2022 el Juzgado dictó la Resolución de ejecución de la Sentencia, que fue notificada a las partes el 27 de diciembre de 2022.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. El 30 de noviembre de 2022, el Servicio de Evaluación y Carrera Profesional informó al Servicio de Retribuciones que debía ejecutar la sentencia y hacer efectivo el pago correspondiente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. El 12 de diciembre el Servicio de Retribuciones informó al Servicio de Evaluación y Carrera Profesional de que se había efectuado el pago de la deuda al señor Ríos en la nómina de noviembre y al señor Salguero en la nómina de diciembre de 2022.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. Por medio de la Resolución del director general del Servicio de Salud de las Islas Baleares de 25 de enero de 2018 se convocó un procedimiento ordinario para acceder a la carrera profesional (BOIB núm. 14, de 30 enero de 2018).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. Por medio de la Resolución del director general del Servicio de Salud de las Islas Baleares de 29 de octubre de 2019 (BOIB núm.150, de 5 de noviembre de 2019) se le reconoció al señor Salguero la consecución del nivel III del subgrupo A2 y un remanente de 990 días. En consecuencia, en aplicación de la Sentencia 158/2019 antes mencionada el señor Salguero ya tenía reconocido el nivel III en la convocatoria de 19 de mayo de 2016, por lo que debe suprimirse el reconocimiento que se le hace en esta resolución.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El artículo 103.2 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa, establece la obligación de las partes de cumplir las sentencias en la forma y términos que en ella se consignan.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Excluir al señor Felipe Salguero Martínez del anexo 1 de la Resolución del director general del Servicio de Salud de las Illes Balears, de 29 de octubre de 2019 (BOIB núm. 150 de 5 de noviembre).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Notificar a la Gerencia del 061 para que regularice el pago del complemento retributivo de carrera profesional de las personas interesadas, todo ello de acuerdo con la Ley 14/2014, de 29 de diciembre, de finanzas de la Comunidad Autónoma de las Islas Baleares referente al pago y la prescripción de las deudas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.
