&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. El título II de la Ley Orgánica 2/2006, de 3 de mayo, de educación, establece, en el artículo 71.1, que las administraciones educativas han de disponer de los medios necesarios para que todos los alumnos alcancen el máximo desarrollo personal, intelectual, social y emocional, así como los objetivos que establece esta ley con carácter general.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. El Decreto 39/2011, de 29 de abril, por el cual se regula la atención a la diversidad y la orientación educativa en los centros educativos no universitarios sostenidos con fondos públicos, pretende garantizar la igualdad de oportunidades de todos los alumnos para que puedan alcanzar el máximo desarrollo de sus capacidades. Este Decreto establece que los centros docentes tienen que llevar a cabo las actuaciones necesarias para conseguir que los alumnos alcancen los objetivos y las competencias básicas de las diversas etapas educativas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3. El 20 de julio de 2024 se publicó en el BOIB núm. 96, la Resolución provisional del director general de Personal Docente y Centros Concertados de 8 de julio de 2024 por la cual se determina la ampliación de la dotación de personal de apoyo educativo (dotación adicional) para la atención a la diversidad en la enseñanza privada concertada para el curso 2024-2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;4. El 12 de septiembre de 2024 se publicó en el BOIB núm. 120 la Resolución definitiva del director general de Pers&lt;span style="color: rgb(0, 0, 0)"&gt;onal Docente y Centros Concertados de 5 de septiembre de 2024 por la cual se determina la dotación de personal de apoyo educativo (dotación adicional) para la atención a la diversidad en la enseñanza privada concertada para el curso 2024-2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;5. Con posterioridad a la Resolución definitiva de 5 de septiembre de 2024, &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;el &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Servicio de Recursos para la Atención a la Diversidad de Centros Concertados &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;ha emitido &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;el informe de &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;9 de octubre de &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; 2024, en sentido favorable a incrementar en &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;12&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; horas la dotación de especialista en &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;atención a la diversidad&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; (&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;AD&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;) del CC &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Jesús María&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; (código 0700&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3471&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;) para el curso 2024-2025. De acuerdo con el informe, este i&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;ncremento se justifica por la necesidad &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;de atender las nuevas &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;incorporaciones&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; de alumnado de nueva incorporación y el aumento de ratio en 1º y 2º de ESO, con un &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; 28% &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;d&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;e alumnado con NESE.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;6. Hay crédito adecuado y suficiente en las partidas presupuestarias correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. La Ley orgánica 2/2006, de 3 de mayo, de educación (BOE núm. 106, de 4 de mayo), modificada por la Ley orgánica 3/2020, de 29 de diciembre (BOE núm. 340, de 30 de diciembre).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. El Decreto 1/2024, de 4 de enero, de la presidenta de las Illes Balears, por la cual se modifica el Decreto 12/2023, de 10 de julio, de la presidenta de las Illes Balears, por la cual se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears, modificado por el Decreto 16/2023, de 20 de julio, y por el Decreto 17/2023, de 23 de agosto (BOIB núm. 3, de 5 de enero).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
