&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;DILIGENCIA para hacer constar:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Que la Junta Rectora del Consorcio Museo Marítimo de Mallorca en la sesión extraordinaria y urgente celebrada el 4 de octubre de 2024 aprobó por unanimidad la propuesta que se transcribe a continuación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Que el texto definitivo queda sujeto a los términos que resulten de la aprobación del acta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;PUNTO TERCERO DE LA ORDEN DEL DÍA. Aprobación de la composición de la mesa permanente del Consorci. Expte. 1094472A.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se da cuenta de la siguiente propuesta de la presidenta del Consorcio Museo Marítimo de Mallorca:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;«PROPUESTA DE ACUERDO DE CREACIÓN Y REGULACIÓN DE LA MESA DE CONTRATACIÓN PERMANENTE DEL CONSORCIO MUSEO MARÍTIMO DE MALLORCA.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ANTECEDENTES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.- El 3 de octubre de 2017 la Comisión Europea adoptó la Recomendación (UE) 2017/1805 sobre la profesionalización de la contratación pública. Las políticas de profesionalización de la contratación pública son fundamentales para garantizar que los poderes adjudicadores tengan las capacidades, conocimientos e integridad necesaria en el ámbito de la contratación pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.- Por otra parte, a efectos de garantizar una mayor eficacia, racionalización y transparencia en la gestión de la contratación del Consorcio Museo Marítimo de Mallorca, es conveniente la creación y regulación de la Mesa de Contratación Permanente del Consorcio Museo Marítimo de Mallorca, como órgano especializado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.- El 18 de julio de 2024 la presidencia del Consorcio Museo Marítimo de Mallorca resolvió iniciar el expediente para la creación y regulación de la Mesa de Contratación permanente del Consorcio Museo Marítimo de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.- El 26 de julio de 2024 la Secretaría General del Consejo de Mallorca ha informado favorablemente esta propuesta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;FUNDAMENTOS DE DERECHO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.- El artículo 326.1 de la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público, por la que se transponen al ordenamiento jurídico español las Directivas del Parlamento Europeo y del Consejo 2014/23/UE y 2014/24/UE, de 26 de febrero de 2014 (en adelante, LCSP) regula las Mesas de Contratación que tendrán que dar asistencia técnica especializada a los órganos de contratación en el desarrollo de sus funciones, determinando el carácter preceptivo o potestativo de la su constitución por razón del tipo de procedimiento que se siga:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;“&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1.- Salvo en el caso en que la competencia para contratar corresponda a una Junta de Contratación, en los procedimientos abiertos, abierto simplificado, restringidos, de diálogo competitivo, de licitación con negociación y de asociación para la innovación, los órganos de contratación de las Administraciones Públicas estarán asistidos por una mesa de contratación.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;En los procedimientos negociados en que no sea necesario publicar anuncios de licitación, la constitución de la mesa será potestativa para el órgano de contratación, salvo cuando se funde en la existencia de una imperiosa urgencia prevista en la letra b) 1.º del artículo 168 , en lo que será obligatoria la constitución de la mesa. En los procedimientos a que se refiere el artículo 159.6 será igualmente potestativa la constitución de la mesa.”2.- La Disposición Adicional Segunda apartado 7 de la LCSP regula las particularidades de las Mesas de Contratación para las Entidades Locales&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;«La Mesa de contratación estará presidida por un miembro de la Corporación o un funcionario de la misma, y ​​formarán parte de ella, como vocales, el Secretario o, en su caso, el titular del órgano que tenga atribuida la función de asesoramiento jurídico, y el Interventor, o, en su caso, el titular del órgano que tenga atribuidas la función de control económico-presupuestario, así como aquellos otros que se designen por el órgano de contratación entre el personal funcionario de carrera o personal laboral al servicio de la Corporación, o miembros electos de la misma, sino que su número, en total, sea inferior a tres. Los miembros electos que, en su caso, formen parte de la Mesa de contratación no podrán suponer más de un tercio del total de miembros de la misma. Actuará como Secretario un funcionario de la Corporación.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;En las Entidades locales municipales, mancomunidades y consorcios locales, podrán integrarse en la Mesa personal al servicio de las correspondiente Diputaciones Provinciales o Comunidades Autónomas uniprovinciales.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;En ningún caso podrá formar parte de las Mesas de contratación ni emitir informes de valoración de las ofertas, personal eventual. Podrá formar parte de la Mesa personal funcionario interino únicamente cuando no existan funcionarios de carrera suficientemente calificados y así se acredite en el expediente.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;La composición de la Mesa se publicará en el perfil de contratante del órgano de contratación correspondiente. Se podrán constituir Mesas de Contratación permanentes&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3.- Los artículos 21 y 22 del RD 817/2009, de 8 de mayo, por el que se desarrolla parcialmente la Ley 30/2007, de 30 de octubre, de Contratos del Sector Público.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.- El art. 15.1.g) de los Estatutos del Consorcio Museo Marítimo de Mallorca (BOIB núm. 2 de 4 de enero de 2018) dispone como funciones de la Junta Rectora el resolver las contrataciones y concesiones de toda clase cuando el importe supere el 10% de los recursos ordinarios del presupuesto, así como los contratos y concesiones plurianuales cuando tengan una duración superior a cuatro años y, en todo caso, los plurianuales de duración inferior cuyo importe acumulado supere el porcentaje indicado referido a los recursos ordinarios del presupuesto del primero ejercicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.- El Decreto del presidente del Consejo Insular de Mallorca por el que se delegan las funciones de secretaría del Consorcio Museo Marítimo de Mallorca (BOIB núm. 18 de 7 de septiembre de 2024) resuelve autorizar la delegación de las funciones de la Secretaría del Consorcio Museo Marítimo de Mallorca en Dª. Nieves Rodríguez Verdú, como titular ya Dª. Paula Baltasar Cozar, como suplente, secretarias delegadas de este Consejo Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La presidenta por delegación propone elevar a la Junta rectora la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PROPUESTA DE ACUERDO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRIMERO.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;CREAR la Mesa de Contratación Permanente como órgano de asistencia al Consorcio Museo Marítimo de Mallorca, para todos los procedimientos de contratación en los que resulte preceptiva o potestativa su constitución. Con las siguientes características:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La Mesa de Contratación Permanente ejercerá las atribuciones establecidas al efecto en el artículo 326 LCSP así como en el artículo 22 del RD 817/2009, de 8 de mayo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La Mesa de Contratación Permanente estará integrada por los siguientes miembros:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Presidencia: Cristina Gómez Peralta, técnica jurídica del Consorcio Museo Marítimo de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Vocales:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de vacante, ausencia, enfermedad o imposibilidad material, así como en los casos en que se haya declarado su abstención o recusación, los miembros titulares serán suplidos por los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Presidencia: Sr. Andrés Felipe Naranjo Mejía, técnico superior economista del Consorcio Museo Marítimo de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Vocal Intervención: Sra. Yolanda M. Anguera de Francisco, Interventora Delegada La Misericordia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los vocales designados por el servicio o departamento promotor del contrato serán sustituidos por personal funcionario designado por aquél.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;SEGUNDO&lt;/strong&gt;.- PUBLICAR este acuerdo en el Boletín Oficial de las Islas Baleares y en la Plataforma de Contratación del Sector Público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;TERCERO&lt;/strong&gt;.- Este Acuerdo entrará en vigor el día siguientëente al de la publicación en el Boletín Oficial de las Illes Balears.
