&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. El 28 de diciembre de 2023, se publicó, en el &lt;em&gt;Boletín&lt;/em&gt; &lt;em&gt;Oficial de las Illes Balears,&lt;/em&gt; la Orden 25/2023 del consejero de Turismo, Cultura y Deportes por la que se establecen las bases reguladoras y se aprueba una nueva convocatoria de las ayudas &lt;em&gt;de minimis&lt;/em&gt; para la modernización y la innovación en la higiene y en la limpieza de los establecimientos de alojamiento turístico, destinada a la compra de mecanismos de elevación de camas, en el marco del Plan de Recuperación, Transformación y Resiliencia financiado por la Unión Europea con Next Generation EU.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. El 8 de febrero de 2024, se publicó, en el &lt;em&gt;Boletín&lt;/em&gt; &lt;em&gt;Oficial de las Illes Balears,&lt;/em&gt; la Orden 6/2024 del consejero de Turismo, Cultura y Deportes por la que se modifica la Orden 25/2023 para aptarla al nuevo régimen &lt;em&gt;de minimis&lt;/em&gt; que prevén los artículos 2.2 y 3.2 del Reglamento (UE) 2023/2831 de la Comisión Europea, de 13 de diciembre de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(206, 24, 30)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;3.&lt;/span&gt;&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;De acuerdo con la nueva redacción del artículo 10 de la Orden 25/2023 y del punto 8 de la convocatoria, esta está sometida al régimen &lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;de minimis &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;establecido en el Reglamento (UE) 2023/2831 de la Comisión Europea, de 13 de diciembre de 2023, publica&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;do&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; en el DOUE nº 2831, de 15 de diciembre de 2023, de las páginas 1 a 12.&lt;/span&gt;&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;En consecuencia, las ayudas previstas son compatibles con el mercado interior y, a la vez, quedan exentas de la obligación de notificación establecida en el artículo 108, apartado 3, del Tratado de funcionamiento de la Unión Europea.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;4. El plazo para presentar solicitudes se inició el 29 de diciembre de 2023 y finalizó el 30 de junio de 2024, de acuerdo con lo establecido en el punto 11 de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;5. El artículo 16.2 de la Orden 25/2023 establece que, dado que el objeto de la subvención es la financiación de actuaciones que no requieren la valoración comparativa con otras propuestas, se pueden dictar las resoluciones de concesión una vez que se haya comprobado el cumplimiento de los requisitos establecidos en la convocatoria, aunque no haya finalizado el plazo de presentación de propuestas. La convocatoria no prevé la intervención de ninguna comisión evaluadora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El 2 de mayo&lt;span style="background-color: rgb(255, 255, 255)"&gt;,&lt;/span&gt; &lt;span style="background-color: rgb(255, 255, 255)"&gt;el&lt;/span&gt; &lt;span style="background-color: rgb(255, 255, 255)"&gt;25 de junio y el 28 de septiembre de 2024, se han&lt;/span&gt; &lt;span style="background-color: rgb(255, 255, 255)"&gt;publicado, en el&lt;/span&gt; &lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Boletín&lt;/span&gt;&lt;/em&gt; &lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Oficial de las I&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;lles&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; Balear&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;s&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;,&lt;/span&gt;&lt;/em&gt; &lt;span style="background-color: rgb(255, 255, 255)"&gt;respectivamente, la primera, la segunda y la tercera&lt;/span&gt; propuestas de resolución por las que se conceden subvenciones en esta convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;6. Con posterioridad a la publicación de las propuestas de resolución mencionadas en el punto anterior y en el plazo de presentación de solicitudes, &lt;span style="background-color: rgb(255, 255, 255)"&gt;la persona solicitante del expediente&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; TUR&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;_&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;AJDLLITS&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;_&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;A&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;42&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;/&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;2024,&lt;/span&gt;&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;ha&lt;/span&gt;&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;presenta&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;do&lt;/span&gt;&lt;/span&gt; &lt;span style="background-color: rgb(255, 255, 255)"&gt;una &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;ampliaci&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;ó&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;n&lt;/span&gt;&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;de la solicitud&lt;/span&gt;&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;a fin&lt;/span&gt;&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;de aumentar el n&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;úmero&lt;/span&gt;&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;de elementos subvencionables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Por otro lado, la persona solicitante del expediente &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;TUR&lt;/span&gt;_&lt;span style="color: rgb(0, 0, 0)"&gt;AJDLLITS&lt;/span&gt;_&lt;span style="color: rgb(0, 0, 0)"&gt;A&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;47&lt;/span&gt;/&lt;span style="color: rgb(0, 0, 0)"&gt;2024 &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;ha desist&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;ido parcialmente del importe inicialmente propuesto y mantiene la solicitud solo para una parte del importe.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Por todo ello, se hace&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;necesario&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;modificar&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;las&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;cuantías&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;inicialmente propuestas &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;en los expedientes anteriores&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;.&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;En consecuencia, &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;por lo que respecta&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; a estos expedientes, se dej&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;a&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;n &lt;/span&gt;sin efecto los importes expresados en la propuesta de resolución publicada el 2 de mayo de 2024 en el &lt;em&gt;Boletín Oficial de las I&lt;/em&gt;&lt;em&gt;lles&lt;/em&gt;&lt;em&gt; &lt;/em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Balea&lt;/em&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;rs&lt;/em&gt;&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;porque&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;en esta propuesta de resolución se incluyen los importes finalmente solicitados&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;y propuestos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(206, 24, 30)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;7.&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;Vistas&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;las solicitudes presentadas y&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;en aplicación de los criterios para la adjudicación de las ayudas&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;previstas en la convocatoria,&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;se&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;relacionan las personas solicitantes que cumplen los requisitos&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;para poder ser beneficiarias de la ayuda y la cuantía individual de esta, calculada&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;de acuerdo con los puntos 5 y 6 de la convocatoria.&lt;/span&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(206, 24, 30)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Por lo tanto,&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;de acuerdo con el punto 6 de la convocatoria,&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;la intensidad de la subvención se establece según el esquema siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;a)&lt;/em&gt;&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;Para los establecimientos de hasta 50 habitaciones, se subvenciona el 50 % del gasto elegible.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;b)&lt;/em&gt;&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;Para los establecimientos de entre 51 y 150 habitaciones, se subvenciona el 40 % del gasto elegible.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;c)&lt;/em&gt;&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;Para los establecimientos de más de 150 habitaciones, se subvenciona el 30 % del gasto elegible.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El gasto elegible de la ayuda es del 100 % del precio unitario de compra del mecanismo de elevación de camas, con un importe máximo de 380 euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En consecuencia, el anexo 1 de esta propuesta de resolución contiene una relación de las personas propuestas como beneficiarias de las ayudas, con indicación de la cuantía individual de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;8. Analizada la solicitud presentada por HORT SANT PATRICI, SL (expediente &lt;/span&gt;&lt;/span&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;TUR_AJD_EL_66/2024), resulta que no consta inscrito en el correspondiente registro insular de empresas, actividades&lt;/span&gt; &lt;span style="background-color: rgb(255, 255, 255)"&gt;y establecimientos turísticos de las Illes Balears, tal como se establece en el punto 3.3 de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Analizada la solicitud presentada por GESTIÓN TURÍSTICA EMAR, SL&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; (expediente TUR_AJD_EL_756/2024), resulta que no se encuentra al corriente de sus obligaciones tributarias con la ATIB, tal como se establece en el artículo 6.3.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;b)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; 2 de la Orden 25/2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Analizada la solicitud presentada por &lt;/span&gt;&lt;/span&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;TERENTE Y WERNICKE, SL (expediente TUR_AJD_EL_808/2024), resulta que no aporta la factura proforma o factura de compra de los mecanismos de elevación de camas, tal como se establece en el punto 10.3.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;i)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Analizada la sol·licitud presentada por AMARE BEACH HOTEL IBIZA, SL (expediente TUR_AJD_EL_827/2024), resulta que no aporta la factura proforma o factura de compra de los mecanismos de elevación de camas, tal como se establece en el punto 10.3.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;i)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;En consecuencia, de acuerdo con el artículo 17 de la Orden 25/2023, corresponde denegar las solicitudes que se relacionan en el anexo 2 por incumplimiento de los requisitos previstos en la Orden 25/2023 y en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;9.&lt;/span&gt; De&lt;span style="background-color: rgb(255, 255, 255)"&gt; conformidad con el artículo 17.1 de la&lt;/span&gt; &lt;span style="background-color: rgb(255, 255, 255)"&gt;Orden&lt;/span&gt; &lt;span style="background-color: rgb(255, 255, 255)"&gt;25&lt;/span&gt;/&lt;span style="background-color: rgb(255, 255, 255)"&gt;2023,&lt;/span&gt; &lt;span style="background-color: rgb(255, 255, 255)"&gt;la&lt;/span&gt; &lt;span style="background-color: rgb(255, 255, 255)"&gt;persona instructora, a la vista del expediente,&lt;/span&gt; &lt;span style="background-color: rgb(255, 255, 255)"&gt;tiene que formular la propuesta de resolución.&lt;/span&gt; Esta se tiene que notificar a la persona interesada, mediante la publicación en el &lt;em&gt;Boletín Oficial de las Illes Balears,&lt;/em&gt; y se tiene que abrir un trámite de audiencia de diez días hábiles a fin de que pueda formular las alegaciones que considere oportunas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;10. Consta en los expedientes administrativos el compromiso de las entidades beneficiarias del cumplimiento de las obligaciones asumidas por la aplicación del principio DNSH, en el marco del Reglamento 2021/241 del Parlamento Europeo y del Consejo, de 12 de febrero de 2021, por el cual se establece el mecanismo de recuperación y resiliencia; el Reglamento (UE) 2020/852 del Parlamento Europeo, y la Guía técnica de la Comisión Europea (2021/c58/01) sobre la aplicación de este principio. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;11. Consta en el expediente administrativo que todas las personas propuestas como beneficiarias se encuentren al corriente de las obligaciones tributarias y con la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;13. El Reglamento (UE) 1407/2013 de la Comisión, de 18 de diciembre de 2013, relativo a la aplicación de los artículos 107 y 108 del Tratado de funcionamiento de la Unión Europea en las ayudas &lt;em&gt;de&lt;/em&gt; &lt;em&gt;minimis&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Propuesta de resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Propongo al consejero de Turismo, Cultura y Deportes que dicte una resolución en los términos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. Conceder una subvención para la compra de mecanismos de elevación de camas a las entidades indicadas en el anexo y por el importe que se señala, dentro de la nueva convocatoria para la modernización y la innovación en la higiene y en la limpieza de los establecimientos de alojamiento turístico, destinada a la compra de mecanismos de elevación de camas, para dar cumplimiento al artículo 37 bis de la Ley 8/2012, del Turismo de les Illes Balears, en el marco del Plan de Recuperación, Transformación y Resiliencia financiado por la Unión Europea Next Generation EU.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2.&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;Autorizar y disponer un gasto global de &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;69.775,09 € a favor de las personas beneficiarias que figuran en el anexo y por los importes individuales que se indican, con cargo a la partida presupuestaria 12201/G/751C01/77000/00/MR071 de los presupuestos de la Comunidad Autónoma de las Illes Balears para el año 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3. Denegar las solicitudes de subvención que se indican en el anexo 2, ya que se incumplen los requisitos previstos en la Orden 25/2023 y en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;4.&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;Hacer constar que, de acuerdo con el punto&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;12&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;de la convocatoria, el periodo de ejecución de las actuaciones subvencionables, entendi&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;das&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; como la compra de los mecanismos de elevación de camas, finaliza&lt;/span&gt; al cabo&lt;span style="color: rgb(0, 0, 0)"&gt; de&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;dos meses de&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;sde&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; la publicación en el&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;de la resolución de concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;5.&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;Hacer constar que, de acuerdo con el punto&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;13&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;de la convocatoria,&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;e&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;l plazo para la justificación de la subvención finaliza &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;al cabo&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; de&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;tres meses de&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;sde&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; la publicación en el&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;de la resolución de concesión de la subvención.&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;De acuerdo con el artículo 20 de la Orden, la justificación de la ayuda consiste en la presentación de la documentación siguiente: factura y relación de los correspondientes justificantes bancarios o análogos que acrediten el pago de los mecanismos de elevación de camas por los cuales se ha solicitado la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La presentación de la justificación&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;tiene que&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;hacer&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;se&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;exclusivamente de forma telemática, a través del trámite específico&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;puesto a disposición&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;de&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;las&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;personas&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;interesadas&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;en el portal de la Dirección General de Turismo y en la Sede Electrónica de la CAIB.
