    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;Por Resolución de esta Alcaldía n.º 2024003567 de día 9 de octubre de 2024, se ha dictado lo siguiente:&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Antecedentes&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primero.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Vista la convocatoria del proceso de estabilización por el sistema de concurso-oposición para cubrir una (1) plaza de Peón de la categoría personal subalterno, clase peón sin especialidad, nivel VIII del Convenio colectivo, las bases de la cual se publicaron en el BOIB n.º 156, de 1 de diciembre de 2022 y el anuncio de la cual se publicó en el BOE n.º 307, de 23 de diciembre de 2022. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segundo.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Visto el anuncio de valoración de méritos y requisitos, realizado por el Tribunal el día 22 de marzo de 2024 y publicado el mismo día. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercero.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Visto el Decreto 2024001117 de día 27 de marzo de 2024 en el cual se establece que el Sr. Pere Salvà Cerdà ha superado el proceso selectivo del concurso-oposición.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En consecuencia, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESUELVO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primero.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Ordenar la contratación del Sr. Pere Salvà Cerdà, con DNI **4713***, como personal laboral fijo Peón, categoría personal subalterno, clase peón sin especialidad, nivel VIII del Convenio colectivo, derivada de la Oferta de ocupación pública extraordinaria del Ayuntamiento de Llucmajor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segundo.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;- Publicar esta Resolución en el Boletín Oficial de las Islas Baleares. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercero.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Requerir al Sr. Pere Salvà Cerdà, para que firme contrato en el plazo máximo de tres días hábiles, a contar a partir del día siguiente a la publicación de esta Resolución en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cuarto.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Dar traslado de esta Resolución al Pleno del Ayuntamiento, así como a la Unidad de Recursos Humanos por su conocimiento y efectos oportunos.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Contra esta resolución los interesados podrán interponer un recurso potestativo de reposición ante este Ayuntamiento, en el plazo de un mes a contar del día siguiente de la publicación, de conformidad con lo dispuesto en los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;También podrán interponer alternativamente un recurso contencioso-administrativo ante el Juzgado de lo Contencioso-administrativo con sede en Palma, en el plazo de dos meses, de conformidad con lo establecido en los artículos 30, 112.3 y 114.1 c) de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y 8, 10 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;En caso de optar por interponer el recurso de reposición, no se podrá interponer un recurso contencioso-administrativo hasta que se haya notificado la resolución expresa del recurso de reposición o haya transcurrido un mes desde su interposición sin haber recibido la notificación, fecha en que se podrá entender desestimado por silencio administrativo.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Todo ello sin perjuicio de que puedan interponer cualquier otro recurso que estimen oportuno.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;​​​​​​​&lt;/p&gt;
