Objeto&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Constituye el objeto de esta convocatoria coadyuvar económicamente a las personas o entidades del municipio afectadas por la borrasca&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt; Juliette&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, a sufragar los gastos en que hayan incurrido para restablecer o restituir sus bienes al estado que tenían con anterioridad a los efectos de la tormenta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;2. Beneficiarios.&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Pueden acogerse a esta convocatoria los particulares, personas físicas o jurídicas que residan o que ostenten la titularidad de bienes, fincas, edificios, elementos etnológicos o cualquier otras infraestructuras situadas dentro del término municipal de Mancor de la Vall y que hayan sufrido daños producidos por la Borrasca &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Juliette &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;durante los días 26 a 28 de febrero de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;3. Actuaciones subvencionables.&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se consideran actuaciones subvencionables a través de la presente convocatoria las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Actuaciones de limpieza de arbolado en fincas de titularidad particular. Se incluye poda, tala y replantación, siempre que sea posible de la misma especie.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Actuaciones de reparación y reconstrucción en edificios, como por ejemplo tejados, soportales, paredes, cierres, puertas y ventanas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Actuaciones de carácter etnológico: elementos construidos con materiales y técnicas tradicionales, principalmente, los vinculados a la captación, conducción, aprovechamiento, y almacenamiento del agua, y otros elementos que se detallan a continuación: canales, fuentes, pozos, norias, albañales, acequias, canaleta, aljibes, balsas, charcos y lavaderos, molinos de extracción de agua y molinos de agua, cuellos de cisterna, abrevaderos, torrentes, puentes, piedras, piedras pasadoras, vados empedrados, eras de batir, los miradores, hornos de cal, casas de nieve, hornos de carbonero, barracas de carbonero (elementos de piedra), márgenes y paredes de piedra en seco, márgenes y paredes de piedra en seco de caminos, barracas de piedra en seco, molinos de viento, etc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Desde el punto de vista temporal y a efectos de garantizar que los daños son consecuencia de la Borrasca &lt;/span&gt;&lt;em&gt;Juliette&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;, únicamente se subvencionarán las actuaciones acreditadas documentalmente entre el 26 de febrero de 2023 y el 31 de diciembre de 2023, y se deberá de hacer constar la descripción de la actuación realizada y el coste exacto que comporte o haya comportado esta.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;4. Financiación&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se destina la cantidad de ciento noventa y dos mil trescientos siete euros con sesenta y nueve céntimos (192.307,69€) a cargo de la aplicación presupuestaria 2024.01.135.78000 "&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Ayudas Borrasca Juliette”&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, a las subvenciones objeto de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La concesión de las subvenciones está condicionada a la existencia de crédito adecuado y suficiente en el momento de la resolución de la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;5. Naturaleza de la subvención y límites&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las subvenciones de esta convocatoria son de carácter voluntario y eventual, y anulables, revocables y reintegrables en todo momento por las causas previstas a la Ley 38/2003, de 17 de noviembre, General de Subvenciones y al Real Decreto 887/2006, de 21 de julio, por el cual se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, la normativa municipal de subvenciones y el resto de normativa aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Además, no generan ningún derecho a obtener otras subvenciones en años posteriores y no se pueden alegar como precedente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Sin embargo, son compatibles con otras ayudas y subvenciones que pueda recibir el beneficiario para el mismo proyecto subvencionado, así como con indemnizaciones derivadas de seguros de daños siempre que el cómputo total de las ayudas, subvenciones o indemnizaciones recibidas no supere el coste de las actuaciones que la entidad beneficiaria haya llevado a cabo&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;6. Régimen de concesión&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La&amp;nbsp;concesión de las subvenciones reguladas en la presente convocatoria pública se llevará a cabo mediante régimen de concurrencia NO competitiva de acuerdo con el artículo 55 del Real Decreto 887/2006, de 21 de julio, por el cual se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, una vez los particulares interesados hayan presentado la solicitud y el resto de documentación del apartado 8 en el registro general del Ayuntamiento de Mancor de la Vall.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De este modo serán subvencionadas hasta agotar el total del crédito asignado por la convocatoria, todas aquellas solicitudes completas que cumplan los requisitos que se establecen y, por lo tanto, no es necesaria la comparación entre las solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el número de actuaciones solicitadas, una vez finalizado el plazo de presentación de las solicitudes, el Ayuntamiento de Mancor de la Vall concederá una subvención de hasta el 100% del coste de las actuaciones subvencionadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el supuesto que el crédito presupuestario no llegue para la satisfacción del 100% del gasto justificado por parte de los particulares solicitantes, se realizará el sumatorio de la totalidad de estos gastos justificados y se otorgará a cada beneficiario la parte proporcional correspondiente del crédito presupuestario aprobado (192.307,69€).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para el supuesto que el sumatorio de la totalidad de los gastos justificados no agote el crédito asignado revertirá a la aplicación presupuestaria. Dado que la presentación de la solicitud implica la justificación de los gastos de la actuación objeto de subvención, esta derivará en el reconocimiento de la obligación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;7. Presentación de solicitudes&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El plazo para presentar la documentación prevista en el punto siguiente será quince (15) días hábiles a contar a partir del día siguiente de la publicación de esta convocatoria en el Boletín Oficial de las Islas Baleares. De ser el último día inhábil, se entenderá prorrogado hasta el primer día hábil siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los interesados que por ser personas jurídicas estén obligados a relacionarse con la administración por medios electrónicos, presentarán sus solicitudes a través del registro electrónico. Aquellos interesados que sean personas físicas no obligadas a relacionarse electrónicamente con la administración, podrán presentar sus solicitudes a través del registro físico existente en la sede de esta entidad o, en cualquier de las formas previstas en el artículo 16.4 de la Ley 39/2015, de 1 de octubre del Procedimiento Administrativo Común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si la solicitud no reúne los datos de identificación, tanto de la subvención solicitada como de la persona solicitante, o algunos de los requisitos previstos a la Ley 39/2015, de 1 de octubre, del Procedimiento administrativo común de las administraciones públicas, se requerirá a la entidad solicitante, de acuerdo con el que establece el artículo 73.2 de la ley antes mencionada, para que en un plazo de diez días hábiles, enmiende la falta o acompañe los documentos preceptivos con indicación que, si no lo hace así, se tendrá por desistido el peticionario, con una resolución expresa previa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Junto a la solicitud se deberá presentar la documentación detallada en el punto siguiente de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;8.- Formalización de solicitudes&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cada interesado presentará una única solicitud en la que indicará las actuaciones llevadas a cabo junto con la documentación exigida en la base 8 de la presente convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las solicitudes se tienen que formalizar mediante el modelo oficial (Anexo I) y se declarará que las actuaciones solicitadas no están cubiertas totalmente, por los sistemas privados de cobertura de daños. La persona solicitante es responsable de la veracidad de esta afirmación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Con la solicitud se tiene que adjuntar la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaración responsable de no incurrir en prohibiciones para ser beneficiario de subvenciones (Anexo II).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaración responsable de encontrarse al corriente en el cumplimiento de obligaciones tributarias con el Estado, con la Seguridad Social y con el Ayuntamiento de Mancor de la Vall (Anexo III).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Documento acreditativo de la titularidad del bien, edificio, finca, elemento etnológico objeto de reparación o restitución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Fotografías, videos o cualquier otro tipo de imágenes que pueda acreditar los daños sufridos por la borrasca en el bien, edificio, finca, elemento etnológico objeto de reparación o restitución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una relación de las facturas de la actuación subvencionada con los datos identificativos de cada factura donde hay de constar la descripción de la actuación realizada y el coste exacto que comporte o haya comportado esta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Justificación del pago de las facturas presentadas, que se tendrá que haber realizado antes de la finalización del plazo de justificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;strong&gt;9.- Órgano instructor y procedimiento de concesión de las subvenciones&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El órgano instructor es el Secretario de la corporación, que tiene que llevar a cabo las actuaciones establecidas en la Ley 38/2003, de 17 de noviembre, General de Subvenciones y el Real Decreto 887/2006, de 21 de julio y a la normativa municipal de subvenciones y formular la propuesta de resolución. El órgano instructor puede requerir a los particulares solicitantes los informes o las aclaraciones que considere convenientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Alcaldía es el centro gestor responsable del seguimiento de las subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cumplimiento del previsto en el artículo 18 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones se enviará a la base nacional de subvenciones información sobre esta convocatoria, y sobre las resoluciones de concesión que se deriven, y se publicará en el BOIB por conducto de la base mencionada, además de publicarse en la sede electrónica de Consejo de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El plazo máximo para resolver y notificar la resolución del procedimiento será de 6 meses. El vencimiento de este plazo sin haberse notificado Resolución, legitima a los interesados para entender desestimada por silencio administrativo negativo, la solicitud de concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La concesión se realizará a través de un procedimiento de concurrencia no competitiva en la que cuantía máxima de la subvención viene predeterminada en el apartado sexto de esta convocatoria. Los particulares tendrán que acreditar junto con la solicitud, la existencia de una serie de gastos relacionados con las actuaciones mencionadas en el apartado 3 de esta convocatoria, habiendo también de acreditar documentalmente, la existencia del daño con anterioridad al 31 de diciembre del año 2023, a través de las facturas emitidas en legal forma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Pleno es el órgano competente para aprobar, modificar y conceder esta convocatoria de conformidad con el artículo de conformidad al establecido en el artículo 22 de la Ley 7/1985, de 2 de abril, Reguladora de las bases de régimen local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;10. - Pago de la subvención&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El plazo máximo para ordenar el pago de la subvención será hasta el 20 de diciembre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El beneficiario tendrá que acreditar antes de la propuesta de resolución, en concreto en el plazo de cinco (5) días hábiles a contar desde la notificación del correspondiente requerimiento, (arte. 23 Ley 38/2003, de 17 de noviembre, General de Subvenciones), estar al corriente de las obligaciones tributarias con el Estado, la Seguridad Social, el Consejo de Mallorca y el Ayuntamiento de Mancor de la Vall y que no incurre en ninguno de las otras causas de prohibición previstas en el artículo 13 de la Ley General de Subvenciones, mediante la aportación de los certificados correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;11. Obligaciones del beneficiarios.&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los particulares a los cuales se las ha concedido la subvención estarán obligados a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Comunicar en el Ayuntamiento de Mancor de la Vall, en cualquier momento, la obtención de subvenciones o ayudas para la misma finalidad y no consignadas en la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cumplir el resto de obligaciones que se prevén en el artículo 14 de la Ley general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;strong&gt;12. Principios generales y criterios objetivos que tienen que regir el otorgamiento y cuantía de las subvenciones&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La concesión de las subvenciones de esta convocatoria se rige por los principios de publicidad, objetividad, igualdad y no discriminación, y se tiene que resolver según los siguientes criterios objetivos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La existencia de un gasto de reparación o restitución de bienes, fincas, edificios, elementos etnológicos o cualquier otras infraestructuras de conformidad cono el apartado 2 de la presente convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Que se acredite la existencia del daño que da lugar a la actuación subvencionada con anterioridad al 31 de diciembre de 2023, ya sea mediante presupuesto, factura o cualquier otro medio de prueba documental válido en derecho.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Que las actuaciones se hayan realizado entre el 26 de febrero de 2023 y 31 de diciembre de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Que se acredite documentalmente que las reparaciones coinciden con las actuaciones descritas en la convocatoria aportando una relación de gastos derivados de las mismas con los justificantes de pago correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;strong&gt;13. - Revocación&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las subvenciones son de concesión voluntaria, revocables y reducibles por las causas previstas a las leyes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14.- Normativa supletoria&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En todo el que no se haya previsto en esta convocatoria será aplicable la normativa siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ley Orgánica 2/2012, de 27 de abril, de estabilidad presupuestaria y sostenibilidad financiera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Real Decreto 887/2006, por el cual se aprueba el reglamento que desarrolla la Ley general de subvenciones;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El resto de la normativa propia del ordenamiento jurídico que esté aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;strong&gt;15.- Recursos&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra el acuerdo de concesión efectuado por el Alcalde se interpondrá de conformidad con los artículos 123 y 124 de la Ley 39/2015, recurso potestativo de reposición, que se podrá interponer dentro del plazo de un mes a contar desde el día siguiente a la publicación del acuerdo de concesión. El plazo para resolver el recurso de reposición será de un mes a contar desde el día siguiente a la fecha de su interposición. Si en este plazo no se hubiera resuelto el recurso, el mismo se entenderá desestimado por silencio administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No se podrá interponer recurso contencioso-administrativo hasta que sea resuelto expresamente o se haya producido la desestimación presunta del recurso de reposición interpuesto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;16.- Publicación&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Ayuntamiento de Mancor de la Vall, en cumplimiento del previsto en los artículos 17, 18 y 20 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, remitirá a la base de datos nacional de subvenciones información sobre la aprobación de la convocatoria de las subvenciones dentro del marco de la convocatoria de Subvenciones urgentes y excepcionales para cooperar en la reparación y restitución de los daños producidos por la Borrasca &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Juliette &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;durante los días 26 a 28 de febrero de 2023 en los bienes, elementos etnológicos, infraestructuras, equipaciones, instalaciones y servicios de los Ayuntamientos de Mallorca, así como actuaciones de limpieza de arbolado y de fincas públicas y, de las resoluciones de concesión que se deriven y se publicará en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Que, de acuerdo con la documentación presentada, el interesado/ada declara que los bienes de los que se es titular y que se encuentran al término municipal de Mancor de la Vall, han sufrido daños consecuencia de la Borrasca Juliette y, que la actuación o actuaciones realizadas para reparar o restituir estos daños no están cubiertos totalmente, por los sistemas privados de cobertura de daños.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Que como particular se quiere acoger a esta convocatoria y, por eso, acompaña la documentación prevista en su punto ocho (8) de las bases de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
