&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En fecha 30 de noviembre de 2023 la consejera&lt;/span&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[consejera|consellera]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; ejecutiva de Hacienda y Función Pública aprobó el Acuerdo de las bases generales que tienen que regir el procedimiento de selección de personal funcionario interino y de personal laboral temporal en el Consell de Mallorca (BOIB núm. 167, de 9 de diciembre de 2023; BOIB núm. 17, de 3 de febrero de 2024; BOIB núm. 107, de 15 de agosto de 2024). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Visto el escrito del secretario técnico de Hacienda y Función Pública, de fecha 26 de septiembre de 2024, en lo que se justifica la necesidad de la creación y constitución de una bolsa de trabajo de técnico superior especialidad oficial, para poder cubrir la plaza de Coordinador del área de emergencias creada mediante Acuerdo del Consejo Ejecutivo de aprobación de la modificación puntual de la Relación de puestos de trabajo del Consell de Mallorca y publicado en el BOIB el 1 de agosto de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Vista la Resolución de inicio del consejero&lt;/span&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[consejero|conseller]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; ejecutivo de Hacienda y Función Pública del expediente para aprobar la convocatoria de bolsas por&lt;/span&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; el procedimiento extraordinario y específico de selección de personal funcionario interino para cubrir plazas vacantes de técnico superior especialidad oficial de fecha 7 de octubre de 2024. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Consta informe jurídico favorable de 14 de octubre de 2024, a la Propuesta de Resolución del consejero&lt;/span&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[consejero|conseller]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; ejecutivo de Hacienda y Función Pública del Consell de Mallorca para aprobar la convocatoria por concurso de méritos por&lt;/span&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; el procedimiento extraordinario y específico de selección de personal funcionario interino para cubrir vacantes de técnico superior especialidad oficial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El artículo 28. e) de la Ley 4/2022, de 22 de junio de Consejos Insulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El Acuerdo del Consejo ejecutivo, de día 28 de septiembre de 2022 (BOIB núm. 128, de 1 de octubre de 2022), de delegación de determinadas competencias en el consejero&lt;/span&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[consejero|conseller]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; competente en materia de Función Pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La Disposición adicional primera de la Ordenanza reguladora de la Administración electrónica del Consell de Mallorca y de los organismos que dependen, modificada por Acuerdo del Pleno del Consell de Mallorca de día 9 de junio de 2022 (BOIB núm. 122, de 17 de septiembre de 2022), regula la obligatoriedad de usar medios electrónicos en los procesos selectivos para acceder al empleo&lt;/span&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[empleo|ocupación]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; público en el ámbito de la Administración Insular de la forma siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;“1. Las personas que participan en los procesos selectivos convocados por&lt;/span&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[para|por]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; las entidades incluidas en el ámbito de aplicación de esta Ordenanza tienen que presentar las solicitudes y la documentación y, en su caso, la subsanación, procedimientos de impugnación de las actuaciones de estos procesos selectivos, así como cualquier otra actuación relacionada con el procedimiento, por&lt;/span&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; medios electrónicos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el supuesto de personal temporal, esta obligación será exigible tanto cuando la selección se efectúe a través de convocatorias específicas como cuando se realice mediante la constitución y gestión de listas de espera, bolsas de trabajo, o mediante cualquier otro procedimiento previsto en el ordenamiento vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El deber de relacionarse con la Administración insular por&lt;/span&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; medios telemáticos comprenderá la obligación de recibir notificaciones electrónicas en el caso de aquellos actos o incidencias que requieran una comunicación personal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En cada una de las convocatorias de procesos selectivos se indicarán los medios telemáticos para la presentación y tramitación de las solicitudes y de identificación y firma admitidos. La no presentación de la solicitud en tiempo y forma supondrá la exclusión del aspirante. Asimismo, en las convocatorias mencionadas se hará referencia expresa a la posibilidad de ampliación de plazos no vencidos como consecuencia de incidencias técnicas que hayan imposibilitado el funcionamiento ordinario del sistema o de la aplicación que corresponda, según el dispuesto al artículo 32.4 de la Ley 39/2015, de 1 de octubre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Por causas excepcionales debidamente motivadas, las convocatorias podrán habilitar, en relación con el respectivo proceso selectivo, la utilización de medios no electrónicos para todo el mundo o para parte de los trámites y actuaciones. De igual manera, el órgano convocante, cuando&lt;/span&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[cuando|cuándo]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; se presenten circunstancias sobrevenidas de carácter técnico o de cualquier otra naturaleza, podrá autorizar motivadamente el uso de medios no electrónicos para la relación de las personas aspirantes con la Administración, en aquellos trámites en los cuales pueda resultar necesario, teniendo que incluirse una referencia a esta posibilidad en las convocatorias correspondientes.”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La Resolución de la consejera&lt;/span&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[consejera|consellera]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; ejecutiva de Hacienda y Función Pública que aprueba el acuerdo de las bases generales que tienen que regir el procedimiento de selección de personal funcionario interino y de personal laboral temporal en el Consell de Mallorca (BOIB núm.167 de 9 de diciembre de 2023; BOIB núm. 17, de 3 de febrero de 2024; BOIB núm. 107, de 15 de agosto de 2024).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La base 3.1.2 establece que las convocatorias se tienen que publicar en el Boletín Oficial de las Illes Balears y en la Sede electrónica del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con la Disposición adicional primera mencionada en el apartado 3 de esta resolución, la base 3.1.3 establece que “La presentación de la solicitud y la documentación, y en su caso, la subsanación, así como cualquier otra actuación relacionada con el procedimiento, se tiene que hacer mediante el trámite telemático habilidad por&lt;/span&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; tal efecto en la Sede electrónica del Consell de Mallorca. Cualquier actuación al margen de este trámite telemático será considerada como no realizada”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo eso, y visto el acuerdo del Consejo Ejecutivo de día 28 de septiembre de 2022, BOIB núm. 128, de 1 de octubre de 2022, dicto la siguiente,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;strong&gt;RESOLUCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Aprobar la convocatoria de bolsas por&lt;/span&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; el procedimiento extraordinario y específico de selección de personal funcionario interino para cubrir plazas vacantes de técnico superior especialidad oficial, mediante convocatoria pública de un concurso de méritos, de acuerdo con la Resolución de la consejera&lt;/span&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[consejera|consellera]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; ejecutiva de Hacienda y Función Pública que aprueba el acuerdo de las bases generales que tienen que regir el procedimiento de selección de personal funcionario interino y de personal laboral temporal en el Consell de Mallorca (BOIB núm.167 de 9 de diciembre de 2023; BOIB núm. 17, de 3 de febrero de 2024; BOIB núm. 107, de 15 de agosto de 2024).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Informar de los requisitos de acceso de técnico superior especialidad oficial que figuran en el anexo 1.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Designar los miembros del Órgano de selección, que figuran en el anexo 2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Disponer que el plazo para presentar solicitudes es de diez días hábiles, a contar a partir del día siguiente que se haya publicado esta convocatoria en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Establecer que la solicitud se tiene que cumplimentar electrónicamente en el modelo oficial, al cual se accede a través de la Sede electrónica del Consell de Mallorca. El trámite telemático&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;habilitado al efecto para la presentación de solicitudes es el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;https://seu.conselldemallorca.net/ca/web/seu/fitxa?key=165341 &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La no presentación de la solicitud en tiempo y forma o la presentación fuera del trámite telemático, supondrá la exclusión del aspirante del procedimiento y se tendrá por&lt;/span&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[para|por]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; no presentado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Publicar esta Resolución en el Boletín Oficial de las Illes Balears y a la Sede electrónica del Consell de Mallorca, tablón de anuncios / Recursos Humanos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Comunicar la publicación de la convocatoria a la Junta de Personal y al servicio de Empleo&lt;/span&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[Empleo|Ocupación]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; de las Illes Balears, para que haga la difusión oportuna.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta resolución, que no pone fin a la vía administrativa, se puede interponer el recurso de alzada ante la Comisión de Gobierno del Consell Insular de Mallorca, en el plazo de un mes, a contar a partir del día siguiente de recibir esta notificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra la desestimación expresa de este recurso de alzada se puede interponer el recurso contencioso administrativo ante el Juzgado contencioso Administrativo de Palma que corresponda en el plazo de dos meses, a contar desde el día siguiente a recibir la notificación de la desestimación de dicho recurso de alzada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si han transcurrido tres meses desde la interposición del recurso de alzada y no se ha recibido la notificación de resolución expresa, se entiende desestimado por silencio y se puede interponer el recurso contencioso administrativo ante el Juzgado contencioso Administrativo de Palma que corresponda, sin limitación de tiempo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
