&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;“Convenio de colaboración entre el Consejo Insular de Mallorca y el Ayuntamiento de Campos para la prestación de servicios de naturaleza informática&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Partes&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Jaume Alzamora Riera, consejero&lt;span style="display:none"&gt;&amp;lt;A[consejero|conseller]&amp;gt;&lt;/span&gt; ejecutivo del Departamento de Promoción Económica y Desarrollo Local, que actúa en nombre y representación del Consejo Insular de Mallorca (con CIF S-0711002-F), en virtud del artículo 1, letra d), del Decreto de la Presidencia del Consejo Insular de Mallorca de 9 de diciembre de 2019 y sucesivas modificaciones por el cual se determina la organización del Consejo Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;Francisca Porquer Manresa, alcaldesa presidenta del Ayuntamiento de Campos (con CIF P0701300F) como representante legal de la Corporación Local, en virtud del acuerdo del pleno del Ayuntamiento adoptado en sesión plenaria de día 15 de junio de 2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Antecedentes&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. La Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local, en su artículo 36.1, establece las competencias propias de los consejos insulares, y el artículo 10.1 determina que la Administración Local y las restantes Administraciones públicas ajustarán sus relaciones recíprocas a los deberes de información mutua, colaboración, coordinación y respeto a los ámbitos competenciales respectivos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. El Pleno del Consejo Insular de Mallorca, en sesión extraordinaria de día 3 de noviembre de 2020, adoptó el acuerdo de disolución del Consorcio TIC Mallorca (BOIB nº. 190 de 5/11/2020) que prestaba los servicios de naturaleza informática a los ayuntamientos de Mallorca.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. El Decreto de la presidenta del Consejo Insular de Mallorca, de día 9 de diciembre de 2019, por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; el cual se determina la organización del Consejo Insular de Mallorca y sucesivas modificaciones que en el artículo 9 establece las atribuciones del Departamento de Promoción Económica y Desarrollo Local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;4. El Consejo Insular de Mallorca creó el Servicio de Informática Municipal con la finalidad de desarrollar las atribuciones establecidas en el punto anterior.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;5. El Pleno del Consejo Insular de Mallorca, en sesión de día 23 de diciembre de 2021, aprobó una modificación del Texto Refundido del Reglamento de Cooperación Municipal (BOIB nº. 4, de 6 de enero de 2022) donde&lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; se incluye la cooperación técnica en materia informática.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;De conformidad con estos antecedentes, ambas partes acuerdan formalizar el presente convenio que se regirá por las siguientes:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Cláusulas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;1.- OBJETO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La finalidad de este convenio es articular la colaboración entre el Consejo Insular de Mallorca y el Ayuntamiento de Campos en materia de servicios de naturaleza informática.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;2.- SERVICIOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2.1. Los servicios de naturaleza informática incluidos en este convenio son:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;A. Los incluidos en el punto g) del artículo 36.1 de la Ley 7/1985, de 2 de abril, reguladora de las Bases del Régimen Local y en el artículo 42 del Reglamento de Cooperación Municipal del Consejo Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;B. Servicios y aplicaciones informáticas que, de prestarse de forma centralizada, mejoren la gestión municipal y reduzcan costes a los ayuntamientos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2.2. Los servicios sujetos a una contraprestación económica que prestará el Consejo Insular de Mallorca a y el Ayuntamiento de Campos en el marco de este convenio son los que figuran en el Anexo de este documento.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2.3. El Ayuntamiento podrá solicitar expresamente la prestación de los servicios en cualquier momento. No obstante, aquellos servicios sujetos a contratos externos y de carácter anual no se iniciarán hasta el siguiente ejercicio o ciclo de contratación, según cada caso.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;3.- OBLIGACIONES DE LAS PARTES&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El desarrollo de los objetivos comporta el cumplimiento&lt;span style="display:none"&gt;&amp;lt;A[cumplimiento|cumplido]&amp;gt;&lt;/span&gt; de las siguientes obligaciones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3.1 El Consejo Insular de Mallorca se compromete a:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) Prestar gratuitamente todos aquellos servicios de naturaleza informática incluidos en el punto g) del artículo 36.1 de la Ley 7/1985, de 2 de abril, reguladora de las Bases del Régimen Local y al artículo 42 del Reglamento de Cooperación Municipal del Consejo de Mallorca; eso es Administración electrónica y Servicio de Contratación centralizada para ayuntamientos de menos de 20.000 habitantes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) Prestar otros servicios informáticos, que podrán ser remunerados atendiendo a su naturaleza y su concurrencia con el sector privado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3.2 El Ayuntamiento de Campos se compromete a:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) Colaborar y cooperar con los técnicos del Consejo en la puesta en funcionamiento y el desarrollo de los servicios informáticos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) Satisfacer dentro del primer trimestre de cada año las cantidades económicas de aquellos servicios remunerados que figuran en el Anexo I que sean de carácter anual. Para el resto de servicios, el abono se tiene que hacer en el mes siguiente de prestado el servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;4. PRECIOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La remuneración económica para cada uno de los servicios a satisfacer por parte del Ayuntamiento se efectuará por resolución de la consejera&lt;span style="display:none"&gt;&amp;lt;A[consejera|consellera]&amp;gt;&lt;/span&gt; o del consejero&lt;span style="display:none"&gt;&amp;lt;A[consejero|conseller]&amp;gt;&lt;/span&gt; competente de conformidad con el Decreto de organización del Consejo Insular de Mallorca y en base al precio real del servicio y teniendo en cuenta el efecto del impuesto sobre el valor añadido.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La remuneración tendrá la consideración de precio, sin que tenga la consideración de prestación patrimonial de carácter público.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;5.- MODIFICACIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En el supuesto de que el Ayuntamiento de Campos quisiera cambiar los servicios que recibe del Consejo de Mallorca, no hará falta modificar el presente convenio. Solamente se tiene que suscribir un nuevo ANEXO entre las partes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;6.- SEGUIMIENTO, VIGILANCIA Y CONTROL&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Se constituirá una comisión paritaria de seguimiento, vigilancia y control de la ejecución del convenio y de los compromisos adquiridos por las partes. Esta comisión también resolverá los problemas de interpretación y cumplimiento&lt;span style="display:none"&gt;&amp;lt;A[cumplimiento|cumplido]&amp;gt;&lt;/span&gt; del convenio que puedan plantearse.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;7.-DURACIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Este convenio entrará en vigor al día siguiente de su publicación en el BOIB y obliga en las partes desde este momento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El convenio tendrà una duración de cuatro años y transcurrido dicho plazo podrá prorrogarse por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; el mismo tiempo por acuerdo mutuo de las partes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Podrá extinguirse por denuncia de una de las partes por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; el incumplimiento de las obligaciones de la otra parte así como por mutuo acuerdo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Como prueba de conformidad con el contenido de este convenio, las partes lo firman a un solo efecto.”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Palma, a la fecha de la firma electrónica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;Por el Consejo Insular de Mallorca&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; Por el Ayuntamiento de Campos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
