    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El director general de Función Pública ha formulado la siguiente propuesta de resolución:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Hechos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El 2 de septiembre de 2024 (GOIBE546998) tuvo entrada en el registro de la Consejería de Presidencia y Administraciones Públicas la comunicación firmada por la alcaldesa del Ayuntamiento de Llucmajor el 2 de septiembre de 2024 en relación con el Acuerdo de Pleno adoptado el 31 de julio de 2024, «relativo a la modificación de la Relación de Puestos de Trabajo del personal funcionario del Ayuntamiento de Llucmajor, publicado en el BOIB núm. 105, de 10 de agosto de 2024, en el que se modifica el puesto de órgano de colaboración secretario/a adjunto/a F90420001 y se reserva a la subescala secretaría, categoría superior, de la escala de funcionarios con habilitación nacional. Lo que le comunico a efectos de solicitar que este puesto de trabajo de colaboración sea clasificado como clase 1.ª y se inscriba en el registro de habilitados nacionales».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En la actualidad, el puesto de colaboración de adjunto a la Secretaria del Ayuntamiento de Llucmajor está clasificado como de clase tercera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La documentación que acompaña a la citada comunicación del Ayuntamiento de Llucmajor y de la que se deja constancia en el expediente administrativo es la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) El certificado del Acuerdo del Pleno del consistorio adoptado el 31 de julio de 2024 firmado por el secretario con el visto bueno de la alcaldesa el 7 de agosto de 2024. De acuerdo con su contenido, se aprueba «la propuesta de modificación de la Relación de Puestos de Trabajo MF5-2024, relativa al cambio de clasificación del puesto del órgano de colaboración secretario/a adjunto/a, código F90420001. Todo esto según el informe de detalle que se adjunta como Anexo», porque «es necesario modificar la RPT ya que el principio de buena administración exige una adaptación continua de la organización a los cambios producidos, de forma que la misma reproduzca una imagen fiel de la realidad económica y organizativa subyacente, no pudiendo demorar, por tanto, su aprobación hasta el próximo ejercicio».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) El informe propuesta teórica de 15 de julio de 2024, de modificación de puesto del órgano de colaboración adscrito a la Unidad de Secretaría General Técnica, firmado por la jefa del Servicio de Recursos Humanos del Ayuntamiento de Llucmajor el 18 de julio de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c)La copia de la publicación en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Il&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;le&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;s Balears &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;núm. 105, de 10 de agosto de 2024, relativo al Acuerdo del Ayuntamiento Pleno relativo a la modificación de la Relación de Puestos de Trabajo del personal funcionario del Ayuntamiento de Llucmajor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) El informe técnico firmado por la jefa del Servicio de Recursos Humanos y el secretario del Ayuntamiento de Llucmajor el 19 de julio de 2024, en el que se justifica la necesidad de reclasificar el puesto de colaboración de adjunto a la Secretaría de clase tercera a primera, porque «en corporaciones locales con los puestos de secretaría y de intervención clasificados como de clase primera, como es el caso de Llucmajor, los puestos de colaboración en las funciones de secretaría podrán ser clasificados como 1.ª y ser adscritos a las subescala de secretaría, categoría superior. Por ello, se hace necesario modificar la clasificación del puesto como clase 1.ª ya que este órgano de colaboración debe realizar las funciones de colaboración inmediata y auxilio a las funciones reservadas propias de la Secretaría clasificada como clase 1.ª, siendo necesario que la persona que ocupe este puesto cuente con una categoría adecuada a las funciones propias del puesto».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El 12 de septiembre de 2024 el Servicio de Corporaciones Locales solicitó al Colegio Oficial de Secretarios, Interventores y Tesoreros de las Illes Balears un informe sobre esta reclasificación. Según el certificado firmado el 20 de septiembre de 2024 por el secretario y presidente del órgano colegiado, en la sesión extraordinaria de 19 de septiembre de 2024 de la Junta de Gobierno se acordó informar favorablemente esta reclasificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. El Servicio de Corporaciones Locales emitió el correspondiente informe el 23 de septiembre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El artículo 92 bis&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;4 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local, en la redacción dada por el apartado 25 de la Ley 27/2013, de 27 de diciembre, de racionalización y sostenibilidad de la Administración Local, dispone que el Gobierno regulará las especialidades de la creación, clasificación y supresión de puestos reservados a funcionarios de la Administración local con habilitación de carácter nacional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El artículo 8.1 del Real Decreto128/2018, de 16 de marzo, por el que se regula el régimen jurídico de los funcionarios de Administración Local con habilitación de carácter nacional, dispone que los puestos de trabajo de secretaría de las entidades locales serán clasificados por las comunidades autónomas en alguna de las clases que determina, correspondiendo la clase primera a las secretarías de ayuntamientos de municipios con población superior a los 20.000 habitantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El artículo 15 del Real Decreto 128/2018 regula los puestos de colaboración y otorga a las comunidades autónomas la potestad para su clasificación de acuerdo con los criterios &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a), b), c) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;y &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;que se recogen en el apartado tercero.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El artículo 24 del Real Decreto 128/2018 establece que corresponde a los secretarios de categoría superior el desarrollo de los puestos de trabajo mencionados en el artículo 8.1.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;)&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;de este real decreto, es decir de las secretarías de clase primera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. La disposición adicional primera del Real Decreto 128/2018 establece que las modificaciones en la clasificación o forma de provisión de puestos de trabajo efectuadas de acuerdo con este real decreto no afectarán a los destinos de los que los estuvieran desarrollando con carácter definitivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El artículo 45.1.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;)&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, establece que en todo caso los actos administrativos serán objeto de publicación, surtiendo esta los mismos efectos que la notificación, cuando tengan por destinatarios una pluralidad indeterminada de personas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. El artículo 2.2.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;)&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;del Decreto16/2023, de 20 de julio, de la presidenta de las Illes Balears, por el que se modifica el Decreto 12/2023, de 10 de julio, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears, atribuye el ejercicio de la competencia en materia de personal funcionario de la Administración Local con habilitación de carácter nacional que presta servicio en las corporaciones locales a la Consejería de Presidencia y Administraciones Públicas, mediante la Dirección General de Función Pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Propuesta de resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Propongo a la consejera de Presidencia y Administraciones Públicas que dicte una resolución en los siguientes términos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Reclasificar de clase tercera a clase primera el puesto de colaboración de adjunto a la Secretaría [25882] del Ayuntamiento de Llucmajor, para que sea ocupado por personal funcionario con habilitación de carácter estatal que pertenezca a la subescala de secretaría, categoría superior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Hacer constar que esta reclasificación no afectará al personal funcionario con habilitación de carácter nacional que ocupe este puesto con carácter definitivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Anotar esta reclasificación en el Registro Integrado de personal funcionario de la Administración Local con habilitación de carácter nacional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Publicar esta Resolución en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Il&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;les&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt; Balears &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;y notificarla al Ayuntamiento de Llucmajor y al Colegio Oficial de Secretarios, Interventores y Tesoreros de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En consecuencia, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman, Times, serif"&gt;&lt;strong&gt;RESOLUCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Manifestar la conformidad con la propuesta de resolución y dictar resolución en los mismos términos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Interposición de recursos&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta resolución, que pone fin a la vía administrativa, podrá interponerse recurso potestativo de reposición ante la consejera de Presidencia y Administraciones Públicas en el plazo de un mes a contar desde el día siguiente de su publicación en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Il&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;le&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;s Balea&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;rs&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, de conformidad con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
