    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Antecedentes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Las organizaciones sindicales “Confederación General del Trabajo” y “Sindicato ünico de Trabajadores Solidaridad Obrera”, el pasado 12 y 13 de septiembre de 2024 registraron un preaviso de huelga general que se llevará a término del día 27 de septiembre de 2024 y su duración se prolongará a lo largo de las 24 horas del día. La huelga afectara a la totalidad de los trabajadores y trabajadoras de todas las empresas privadas y públicas de España.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El Consejo de Gobierno, en la sesión del día 20 de septiembre de 2024, tomó el Acuerdo de delegar en los titulares de las consejerías de Educación y Universidades, de Salud y de Presidencia y Administraciones Públicas el establecimiento de medidas de servicios mínimos, dentro de sus ámbitos competenciales respectivos. Concretamente dispuso lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;ACUERDO&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Primero. Delegar la competencia para aprobar las medidas que garanticen los servicios mínimos durante la jornada de huelga del día 27 de septiembre de 2024 en el ámbito de la Comunidad Autónoma de las Illes Balears en los siguientes consejeros:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El consejero de Educación y Universidades con respecto a los servicios mínimos relacionados con la prestación de servicios esenciales en los centros docentes no universitarios, públicos, privados o concertados, en el ámbito de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La consejera de Salud con respecto a los servicios mínimos relacionados con la prestación de servicios sanitarios y de otros servicios esenciales relacionados con la sanidad, como los servicios de limpieza, de hostelería de los enfermos ingresados o de transporte de enfermos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La consejera de Presidencia y Administraciones Públicas con respecto a los servicios mínimos relacionados con los servicios generales de la Administración de la Comunidad Autónoma, así como con los servicios esenciales relativos al transporte, a los servicios sociales y al resto de servicios sectoriales que lo requieran.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Consideraciones jurídicas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En el artículo 28.2, la Constitución Española establece como derecho fundamental el derecho a la huelga de los trabajadores para la defensa de sus intereses, si bien matiza que la ley que regule el ejercicio de este derecho debe establecer las garantías que sean precisas para asegurar el mantenimiento de los servicios esenciales de la comunidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por otra parte, el artículo 10 del Real Decreto-ley 17/1977, de 4 de marzo, sobre relaciones de trabajo, dispone el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Gobierno, a propuesta del Ministerio de Trabajo, teniendo en cuenta la duración o las consecuencias de la huelga, las posiciones de las partes y el perjuicio grave de la economía nacional, podrá acordar la reanudación de la actividad laboral en el plazo que determine, por un período máximo de dos meses o, de modo definitivo, mediante el establecimiento de un arbitraje obligatorio. El incumplimiento de este acuerdo podrá dar lugar a la aplicación de lo dispuesto en los artículos 15 y 16.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cuando la huelga se declare en empresas encargadas de la prestación de cualquier género de servicios públicos o de reconocida e inaplazable necesidad y concurran circunstancias de especial gravedad, la Autoridad gubernativa podrá acordar las medidas necesarias para asegurar el funcionamiento de los servicios. El Gobierno, asimismo, podrá adoptar a tales fines las medidas de intervención adecuadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Teniendo en cuenta lo expuesto, cuando la huelga se declare en empresas encargadas de la prestación de servicios públicos de cualquier naturaleza o de necesidad reconocida e inaplazable, y se presenten circunstancias de gravedad especial, la autoridad gubernativa puede acordar las medidas necesarias para asegurar el funcionamiento de los servicios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A este efecto, es indiferente que el servicio se preste por medio de una relación funcionarial o simplemente mediante empleados vinculados por una relación laboral, dado que lo que es determinante es el carácter y la finalidad de las funciones ejercidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El Tribunal Constitucional, a la vez que reconoce el derecho a la huelga como un derecho constitucional, trata de delimitar el sentido del término servicios esenciales (STC 11/1981, 26/1981, 33/1981, 51/1986, 27/1989, entre otras) y dispone que, en la medida que toda la comunidad es la destinataria y la acreedora de estos servicios y los servicios son, al mismo tiempo, esenciales para esta, la huelga no puede imponer el sacrificio de los destinatarios de los servicios esenciales. El derecho de la comunidad a estas prestaciones vitales es superior respecto del derecho a la huelga.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A este efecto, se consideran servicios esenciales los destinados a garantizar el contenido esencial de los derechos constitucionales, es decir, el derecho a la vida, a la salud, a la libertad personal, a la libre circulación, a la comunicación, a la información, a la tutela judicial efectiva y a la educación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por otro lado, la doctrina del Tribunal Constitucional en relación con el establecimiento de los servicios mínimos se recoge en la Sentencia 8/1992, de 16 de enero, la cual afirma que la decisión tiene que ser motivada, y la motivación se tiene que exteriorizar de forma que los destinatarios conozcan las razones por las cuales su derecho es restringido, en la forma y con el alcance en que lo sea, y los intereses que se trata de proteger con esto, exigiendo, en definitiva, la motivación de los actos de restricción de los derechos y la proporcionalidad de las medidas adoptadas. Además , el mismo Tribunal Constitucional determina que unos de los criterios que se tienen que tener en cuenta en la adopción de las medidas que garanticen el mantenimiento de los servicios esenciales es ponderar la extensión territorial, temporal y personal de la huelga.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La Administración de la Comunidad Autónoma de las Illes Balears presta una serie de servicios que tienen que ser considerados esenciales para la comunidad porque se trata de intereses constitucionalmente protegidos, el funcionamiento de los cuales no puede quedar paralizado por el ejercicio del derecho de huelga. Por eso, es obligatorio armonizar el interés general y el derecho de huelga mediante la adopción de las medidas necesarias para asegurar el funcionamiento de estos servicios, los cuales, limitando el mínimo posible el contenido de este derecho, tienen que ser, a la vez, suficientes para garantizar las actividades de carácter esencial que se prestan en esta comunidad autónoma y permitir el ejercicio de derechos fundamentales por parte de la ciudadanía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. La Administración está obligada a garantizar el servicio sanitario público para salvaguardar el derecho a la salud y a la protección de la vida de las personas, y más teniendo en cuenta la situación de crisis sanitaria actual. Del mismo modo, se tiene que garantizar la apertura de todos los centros docentes públicos para el ejercicio del derecho al trabajo del personal que no secunde la huelga, como también del derecho a la educación de los estudiantes, porque sin la apertura de los centros se impediría de pleno e injustificadamente el ejercicio de estos derechos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Además, se ha de garantizar la prestación de un conjunto de servicios sociales, la esencialidad de los cuales deriva del hecho de garantizar la asistencia de atención especial a determinados colectivos que necesitan un conjunto de medidas protectoras para garantizar un mínimo de condiciones de vida dignas y de calidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Así mismo, se tienen que garantizar la seguridad y la protección de las personas y los bienes, lo cual supone considerar como servicios esenciales los servicios de atención de emergencias, extinción de incendios y protección del medio natural y el área de comunicaciones e informática, porque existen, precisamente, para evitar la posibilidad que una emergencia se convierta en siniestro. Del mismo modo, se tiene que garantizar la libertad de circulación, como base para hacer posible el ejercicio de otros derechos fundamentales, como por ejemplo el acceso a los servicios de salud o la libertad de elección entre el ejercicio del derecho a la huelga y el derecho al trabajo, así como el cumplimiento de la obligación que corresponde a las personas designadas para cubrir los servicios mínimos esenciales. En este sentido, también se prevé el establecimiento de servicios mínimos en el transporte regular, que, si bien no se puede considerar un servicio esencial, la idiosincrasia de nuestra comunidad hace que requiera un tratamiento especial, sobretodo en cuanto que el resto de comunicaciones también estarán afectadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. En cuanto al resto de dependencias de la Administración de la Comunidad Autónoma de las Illes Balears, se tienen que tener en cuenta dos circunstancias: por un lado, el derecho al trabajo del personal que no secunde la huelga y, por el otro, el hecho que un gran número de las relaciones entre la ciudadanía y la Administración están establecidas de forma reglada, sujetas a una serie de normas en las cuales el cómputo de los plazos puede tener una importancia capital en la defensa de sus intereses y, en último término, en el derecho a la tutela judicial efectiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. De acuerdo con la Sentencia del Tribunal Constitucional 33/1981, la alusión a la autoridad gubernativa que contiene el artículo 10.2 del Real Decreto-ley&amp;nbsp;17/1977, de 4 de marzo, sobre relaciones de trabajo, hace referencia, respectivamente, al Estado o a la comunidad autónoma con competencias en los servicios afectados, según el caso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Así, esta sentencia reconoce a las comunidades autónomas competencias dentro de su ámbito para establecer las medidas de garantía de los servicios esenciales. El Tribunal Constitucional reconoce lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cuando se trata de servicios que, considerados conjuntamente, están comprendidos en el área de las competencias autonómicas [...], velar por su funcionamiento regular corresponde a la titularidad y a la responsabilidad de las autoridades autonómicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. De acuerdo con el artículo 10.2 del Real Decreto-ley 19/1977, de 4 de marzo, en relación con el artículo 17) r de la Ley 1/2019, de 31 de enero, del Gobierno de las Illes Balears, y el artículo 5.2 o, de la Ley 3/2007, de 27 de marzo, de la Función Pública de la Comunidad Autónoma de las Illes Balears, la competencia originaria para la aprobación de las medidas que garanticen los servicios mínimos en el ámbito de los servicios públicos o esenciales corresponde al Consejo de Gobierno de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11. Por su parte, el artículo 7.1 de la misma Ley 3/2007, de 27 de marzo, en relación con el artículo 9 de la Ley 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Público, y el artículo 25 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears, resulta que, con carácter general, las competencias de los órganos administrativos —y, entre estas, las que pueda ejercer en materia de función pública el Consejo de Gobierno— pueden ser objeto de delegación en otros órganos administrativos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, visto lo dispuesto en el artículo 5.2) o de la Ley 3/2007, de 27 de marzo, de la Función Pública de la Comunidad Autónoma de las Illes Balears, así como el Acuerdo del Consejo de Gobierno de 20 de septiembre de 2024 de delegación en determinados consejeros de la competencia para la aprobación de las medidas para garantizar los servicios mínimos en la jornada de huelga del día 27 de septiembre de 2024, la consejera de Presidencia y Administraciones Públicas, la consejera de Salud , y el consejero de Educación y Universidades dictan la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLUCIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Fijar los servicios mínimos que se indican en el anexo adjunto, el cual forma parte de esta resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Establecer que la vigilancia y la designación del personal que debe atender dichos servicios mínimos corresponden a la dirección de cada centro. Los servicios mínimos serán cubiertos, prioritariamente, por el personal que no secunde la huelga. En caso de que sea insuficiente, las vacantes se cubrirán obligatoriamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Disponer que, en relación con los servicios esenciales de sectores estratégicos y de emergencias, tanto los prestados por entidades públicas como los prestados por entidades privadas, como la lucha contra incendios, energía, suministro de agua, recogida de residuos, asistencia social, accidentes laborales y otros, en todo lo que no esté previsto expresamente en esta resolución, pero que tengan esta consideración, se fijan los servicios mínimos equivalentes al funcionamiento de un domingo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el caso de los transportes de uso especial (personas con discapacidad física y psíquica), se garantizará el traslado a los servicios asistenciales previstos para el día de la huelga.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Facultar a las personas titulares de las secretarías generales de las consejerías, a las personas titulares de las gerencias de los entes del sector público y de los centros hospitalarios y a las personas responsables de centros de trabajo para designar de forma expresa y nominal a los trabajadores y trabajadoras que deban integrar los servicios mínimos en el sector público establecidos en esta resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las empresas privadas que presten servicios esenciales cuyos mínimos se fijan en el anexo de esta resolución, adoptarán las medidas necesarias para llevar a efecto los servicios mínimos de acuerdo con la legalidad vigente. En particular, lo antes posible y de forma individual y fehaciente, requerirán a cubrir los servicios mínimos a los trabajadores y trabajadoras que deban garantizarlos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Establecer que el incumplimiento de la obligación de atender los servicios mínimos implica las responsabilidades y en su caso será sancionado de conformidad con lo que prevé la normativa aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Disponer que lo que establece esta resolución no supone ninguna limitación de los derechos que la normativa reguladora de la huelga reconoce al personal en dicha situación. Asimismo, es aplicable para garantizar el libre ejercicio del derecho de huelga, lo establecido en las letras k, l y m del artículo 95.2 del Real Decreto Legislativo 5/2015, de 30 de octubre, por el que se aprueba el Texto refundido del Estatuto básico del empleado público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Establecer que si, en el proceso de negociación que se pueda llevar a cabo en cada uno de los sectores afectados, se llega a un acuerdo que no coincide con los servicios mínimos fijados en esta resolución, se aplicará lo dispuesto en ella siempre que los servicios mínimos fijados en estos sectores estén por debajo de los que se prevén en la Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. Notificar esta resolución a la central sindical convocante de la huelga.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. Publicar esta resolución en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta resolución, que agota la vía administrativa, puede interponerse recurso potestativo de reposición, ante el órgano que la dicta, de acuerdo con lo dispuesto en los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, en el plazo de un mes a contar desde el día siguiente al de su notificación o publicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;También puede interponerse, directamente, un recurso contencioso-administrativo, de acuerdo con lo establecido en el artículo 45 y siguientes de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa, ante los juzgados de lo contencioso-administrativo, en el plazo de dos meses a contar desde el día siguiente al de su notificación o publicación, sin perjuicio de que se pueda interponer cualquier otro recurso que se considere oportuno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La prestación de servicios esenciales en los centros docentes no universitarios, públicos, privados o concertados, en el ámbito de las Illes Balears, en el supuesto de situaciones de huelga que afecten al funcionamiento normal de los centros, debe ajustarse a lo que disponen el Real Decreto 417/1988, de 29 de abril (BOE de 5 de mayo), y el Decreto 16/1985, de 21 de febrero (BOCAIB de 10 de marzo).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Dichos centros docentes deben permanecer abiertos durante la situación de huelga convocada para el 27 de septiembre de 2024. Con el fin de hacer efectivo el cumplimiento de lo dispuesto en las referidas normas, se adoptarán las medidas que se indican a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.1 En todos los centros educativos: los directores y los secretarios de los centros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Adicionalmente al anterior:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;1.2 Obligaciones de los directores&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Procurando lograr el consenso entre los afectados, a los directores de los diferentes centros educativos mencionados los corresponde:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Garantizar que el centro educativo esté abierto durante toda la jornada escolar y que todo el alumnado que acuda en el centro sea atendido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Velar para que la personal que no quiera secundar la huelga pueda desarrollar su actividad con normalidad, así como controlar la asistencia al trabajo y tener cuidado del cumplimiento de las normas de organización y funcionamiento que le afecten.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Designar, nominativamente o por sorteo público, los funcionarios docentes y contratados las funciones de los cuales se establezcan como servicios mínimos, preferentemente entre los que hayan manifestado voluntariamente la voluntad de no ejercer su derecho de huelga.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Facilitar a la Administración educativa, mediante el GESTIB, la información en lo referente al seguimiento de la huelga y cualquier incidencia significativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Informar las familias que sus hijos serán atendidos adecuadamente el día de la huelga.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.3 Designación de los servicios mínimos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La dirección del centro habrá de elaborar el listado de profesores designados como servicios mínimos, por niveles educativos y por turnos (en caso de tener más de uno), a partir del personal disponible (se habrá de excluir al profesorado que el d´ía de huelga esté de baja, que este día no tenga horas lectivas en el centro -por media jornada o por reducción de jornada-, el director y el secretario que ya forma parte de los servicios mínimos), preferentemente entre el personal que haya manifestado voluntariamente la voluntad de no ejercer el derecho a la huelga, o bien por sorteo, si estos no son suficientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los centros tienen que custodiar este documento en la secretaria del centro, firmado y con el sello, a los efectos oportunos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. Sanidad&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Durante la situación de huelga se adoptarán las medidas que se indican a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.1. Deben permanecer abiertos los servicios de registro y también los servicios de atención al usuario con la cobertura mínima requerida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.2. Se considera servicio mínimo asistencial el funcionamiento normal de los servicios de urgencias tanto con respecto a la atención de pacientes externos que lleguen, como a los pacientes ingresados en las unidades de observación de urgencias que tienen que recibir asistencia plena según el criterio del médico que se encargue de ellos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.3. En el ámbito de la atención especializada:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Con carácter general, los servicios mínimos serán los equivalentes a los previstos para los domingos y para los días festivos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Servicios de oncología médica, oncología radioterápica, diálisis, hospital de día y farmacia hospitalaria: número de efectivos indispensables para garantizar el cien por cien de la asistencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Intervenciones quirúrgicas programadas de pacientes oncológicos y de otras patologías que no se puedan aplazar a causa del riesgo que implicaría para los pacientes: número de efectivos indispensables para garantizar el cien por cien de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Asistencia con cobertura de festivo o domingo de los pacientes ingresados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) Se considera servicio mínimo asistencial el funcionamiento de las unidades especiales, de las unidades de cuidados intensivos, de las unidades de vigilancia intensiva, de las unidades coronarias, de las unidades de hemodiálisis de neonatología, de las unidades de quemados, de todos los servicios que puedan ser de urgencia vital y también los partos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.4. En el ámbito de la atención primaria:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Deben permanecer abiertos los centros de salud, los cuales, a efectos de prestar la asistencia sanitaria adecuada, deben disponer de una plantilla mínima de 2 médicos, 1 pediatra, 2 efectivos de personal de enfermería y 1 auxiliar administrativo. Los centros de salud que prestan servicio como PAC a partir de las 15.00 h deben tener la cobertura de plantilla idéntica a un festivo o domingo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.5. En los servicios de urgencia y emergencia (SUAP y 061), dada su naturaleza y la de los servicios que prestan, la cobertura será del cien por cien en todos los servicios sanitarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.6. El servicio de limpieza mantendrá la actividad normal de un día festivo en las áreas de alto riesgo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Tienen esta consideración los siguientes servicios:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Zonas de riesgo alto:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Servicios de urgencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Bloques quirúrgicos, áreas de reanimación y salas de parto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Unidades de cuidados intensivos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Unidades de recién nacidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Zonas de esterilización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Unidades de hemodiálisis.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Unidades de hemodinámica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Unidades o habitaciones de pacientes trasplantados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Salas de extracciones medulares (banco de sangre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Salas de autopsias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Salas de preparación parenteral y citostáticos (farmacia).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Salas DIVAS y CPR (radiodiagnóstico).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Pacientes en régimen de aislamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Unidades de trasplante de médula ósea.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cocinas y servicios de alimentación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La limpieza de todos estos servicios incluirá la evacuación de ropa sucia y de residuos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.7. Los servicios de hostelería atenderán la dieta de todos los enfermos ingresados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.8. Las empresas dedicadas al transporte de enfermos garantizarán la atención al cien por cien de las urgencias y emergencias, los tratamientos de oncología y la diálisis. Para el resto del transporte programado establecerán unos equipos de guardia como en sábado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. Servicios generales de la Administración de la Comunidad Autónoma, salvo los servicios ligados a las competencias docentes y sanitarias&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las dependencias permanecerán abiertas durante la situación de huelga parcial, a menos que, por razones fundamentadas, el departamento, el organismo o el servicio decida cerrarlas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se consideran servicios mínimos de los servicios generales de la Administración de esta Comunidad Autónoma y de los organismos públicos que dependen de ella, salvo los servicios sanitarios y docentes, los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Registros&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se mantendrá a un funcionario en el registro general de cada consejería designado por el respectivo secretario o secretaria general. En el caso de la Agencia Tributaria de las Illes Balears, se mantendrá a una persona en el Registro General de los servicios centrales, a una persona en el Registro General de la Delegación Insular de Ibiza y a una persona en el Registro General de la Delegación Insular de Menorca. Debe mantenerse también a una persona en el registro de cada centro de trabajo de las entidades del sector público instrumental de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Recursos Humanos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se ha de mantener una persona en cada consejería y en cada centro del sector público instrumental donde se haya convocado a la huelga.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Centros públicos docentes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para garantizar el control de los accesos a los centros, en cada centro público ha de permanecer en su puesto de trabajo una persona de la conserjería del turno de mañana y otra del turno de tarde, designadas por el director del centro. También se deben establecer servicios mínimos de limpieza en aquellos centros donde solo haya personal empleado público: una personal de la categoría profesional de limpiador o empleado de servicios en turno de mañana y otra en turno de tarde, designadas por el director.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Seguridad&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se mantendrá a un trabajador o trabajadora por cada edificio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Transporte&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En relación con los transportes públicos regulares interurbanos de viajeros por carretera y los servicios ferroviarios, tal como establece el párrafo 2 del artículo 10 del Real Decreto-ley 17/1977, de 4 de marzo, así como la Sentencia del Tribunal Constitucional de 8 de abril de 1981, dado que son servicios públicos, deben establecerse unos servicios mínimos que sean compatibles con el derecho fundamental de los trabajadores a la huelga y que garanticen un mínimo de movilidad a los ciudadanos, movilidad que debe permitirles desplazarse para ejercer, si lo desean, el derecho a cumplir la jornada laboral, llegar a los centros sanitarios y moverse por cualquier otro motivo imprescindible.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Transporte ferroviario&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los servicios mínimos serán los equivalentes a los previstos para los domingos y los días festivos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cuanto al servicio de la línea de metro entre Palma y la Universidad de las Illes Balears, se establecen unos servicios mínimos equivalentes al 50 % de los servicios ordinarios programados en día laborable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Transporte marítimo&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En relación con el transporte marítimo interinsular, no es procedente establecer los servicios mínimos entre Mallorca, Menorca e Ibiza, dado que se fijan servicios mínimos para el tráfico de pasajeros en avión, por lo que habrá una comunicación mínima entre estas islas. No obstante, es necesario establecer unos servicios mínimos de transporte marítimo entre Ibiza y Formentera, dado que esta es la única comunicación posible para los habitantes de Formentera. Por esta razón, se considera que se tienen que establecer como servicios mínimos los equivalentes a los previstos para los domingos y los días festivos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Transporte regular por carretera&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Servicios mínimos de transporte público regular de viajeros en autobús de tipo interurbano: los servicios mínimos serán los equivalentes a los previstos para los domingos y los días festivos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Servicios mínimos de transporte público regular de viajeros en autobús de tipo lanzadera (líneas conectadas con el servicio de tren): los servicios mínimos serán los equivalentes a los previstos para los domingos y los días festivos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Ferrocarril de Sóller&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los servicios mínimos serán los equivalentes a los previstos para los domingos y los días festivos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
