    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El apartado 9.3. de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 13 de septiembre de 2021 por la que se convocan, subvenciones para las Inversiones en la Transformación y la comercialización de productos agrícolas ecológicos, correspondientes al año 2021, especifica que la resolución expresa se notificará a los interesados mediante su publicación en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt;&lt;em&gt; &lt;/em&gt;de acuerdo con los términos previstos en el artículo 45.2 de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 59 de la Ley 30/1992, de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El vicepresidente en Materia Agraria del FOGAIBA, con fecha 4 de septiembre de 2024, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Vista la solicitud de prórroga formulada por los interesados señalados en el Anexo I, en relación con la ayuda concedida, amparada por la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 16 de septiembre de 2021, por la que se convocan, para el año 2021, subvenciones para inversiones en la transformación y comercialización de productos agrícolas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2.Orden del conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Illes Balears 2014-2020.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3.Ley 39/2015 de 1 de octubre de régimen jurídico de las administraciones públicas. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Informe-Propuesta de Resolución&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;De acuerdo con la normativa reguladora de la ayuda que tienen concedida, el artículo 20 de las bases reguladoras establece que sólo con carácter excepcional y por razones justificadas, las personas beneficiarias podrán solicitar la ampliación de los plazos establecidos en la respectiva convocatoria. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Visto el punto 11 de la convocatoria donde se especifica que, únicamente, por razones justificadas de demora en la concesión de licencias por parte de los ayuntamientos, bajas laborales e incidencias graves que no sean imputables al solicitante, los beneficiarios podrán solicitar la ampliación del plazo de realización y justificación establecido en la resolución de concesión. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Por todo lo expuesto anteriormente, se informa FAVORABLEMENTE de la concesión de un plazo de prórroga por los motivos señalados en el Anexo I, y se propone al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos: &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. Aceptar la prórroga solicitada a los interesados que figuran en el Anexo I, que comienza con RAFAEL TUR TUR y termina con RAFAEL TUR TUR, y que en total son 1, relativa a la línea de ayudas Subvenciones para inversiones en la transformación y comercialización de productos agrícolas ecológicos, para cumplir con alguno de los requisitos que se establecen en la convocatoria y que se especifican en el citado anexo. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. Notificar al interesado que, de acuerdo con lo establecido en el artículo undécimo de la convocatoria, el plazo para la justificación de las inversiones se amplía en DOCE MESES. En consecuencia, el nuevo plazo para la justificación de la inversión será de TREINTA MESES, a contar a partir del día siguiente de la fecha en la que se notificó la Resolución de concesión de ayuda a los expedientes. Fecha límite: 15 de octubre de 2025.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
