&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. En el Boletín Oficial de las Islas Baleares (BOIB) núm. 58, de 6 de mayo de&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2023, se publicó la Resolución del presidente del Instituto de Industrias&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Culturales de las Illes Balears de 2 de mayo de 2023 por la que se convocan las&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;subvenciones para apoyar las inversiones que favorezcan la modernización,&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;innovación y desarrollo tecnológico de las industrias culturales para el año&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2023.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Dentro del plazo de inscripción establecido en el apartado 6.1 de la&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;convocatoria, el Instituto de Industrias Culturales de las Illes Balears (en&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;adelante, ICIB) recibió un total de ochenta solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. En el BOIB núm. 151, de 7 de noviembre de 2023, se publicó Resolución del&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;presidente del ICIB por la que se conceden y deniegan las ayudas destinadas a&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;apoyar las inversiones que favorezcan la modernización, la innovación y&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;desarrollo tecnológico de las industrias culturales para el año 2023.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. En fecha 9 de febrero de 2024, la entidad Pauxa, SC, comunicó al ICIB la&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;renuncia a la subvención concedida. Por otra parte, una vez revisada toda la&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;documentación justificativa presentada por las personas beneficiarias y&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;liquidados todos los expedientes, se comprobó que le quedaba un remanente&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;de un importe de 26.309,27 €, con motivo de las minoraciones efectuadas como consecuencia de las justificaciones insuficientes de algunas&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;subvenciones otorgadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. De acuerdo con el apartado 10.3 de la convocatoria, en caso de que algún&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;beneficiario renuncie a la subvención, el importe de la ayuda puede&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;adjudicarse, correlativamente, a los expedientes denegados por falta de&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;crédito presupuestario en la resolución de concesión. Por otra parte, el&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;apartado 17.4 también dispone que, en caso de que algún beneficiario&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;renuncie a la subvención, o en caso de que se produzca una minoración en el&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;importe final justificado, el importe de la ayuda se puede adjudicar a otros&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;expedientes siguiendo el mismo criterio establecido en el apartado 9.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. En fecha 5 de septiembre, se publicó en la Sede Electrónica de la CAIB la&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;propuesta de modificación de la resolución de la convocatoria, a fin de que las&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;personas interesadas y inicialmente excluidas por falta de crédito&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;presupuestario pudieran aceptar o renunciar a la concesión de la subvención&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;en el plazo de 10 días hábiles desde el día siguiente de esta publicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Dentro del plazo establecido anteriormente, se presentaron las siguientes&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;aceptaciones de la ayuda: MID 5/2023 Mallorca Video Servicios Audiovisuales,&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;SL; MID 34/2023 Diabolus In Opera, SL; MID 7/2023 Sonoteque, SL; MID&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;62/2023 Auditorium de Palma de Mallorca, SL; MID 35/2023 Musical Balear, SL.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dentro de este mismo plazo, también se presentó una renuncia por parte de&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Bastera Films, SL (REG MID 77/2023).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. El personal del ICIB ha comprobado que las entidades beneficiarias cumplen&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;los requisitos que la normativa establece para poder recibir subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La Ley 38/2003, de 17 de noviembre, general de subvenciones (BOE núm. 276,&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;de 18 de noviembre de 2003).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Texto refundido de la Ley de subvenciones (BOIB núm. 196, de 31 de&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;diciembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La Orden de la consejera de Educación y Cultura de 1 de julio de 2009 por la&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;que se establecen las bases reguladoras de las subvenciones en materia de&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;educación y cultura (BOIB núm. 100, de 11 de julio de 2009). De acuerdo con el&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;artículo 10.4, “&lt;em&gt;si alguno de los beneficiarios renuncia a la subvención o incumple sus&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;obligaciones con la consecuente pérdida del derecho al cobro total o parcial de la&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;subvención, el órgano concedente tiene que acordar, sin necesidad de hacer una nueva&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;convocatoria, la concesión de la subvención al solicitante o solicitantes siguientes a aquél&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;por orden de puntuación, siempre que con la renuncia o incumplimiento por parte de&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;alguno de los beneficiarios, se haya liberado bastante crédito para atender como mínimo&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;una de las solicitudes denegadas. El órgano competente para resolver tiene que comunicar&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;esta opción a los interesados, a fin de que accedan a la propuesta de subvención y, si es el&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;caso, la acepten, en el plazo de diez días. Una vez aceptada la propuesta por parte del&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;solicitante o solicitantes, tiene que dictarse el acto de concesión y tiene que notificarse”.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El Decreto 50/2018, de 21 de diciembre, por el que se aprueban los Estatutos&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;del ICIB (BOIB núm. 160, de 22 de diciembre de 2018; corrección de erratas,&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;BOIB núm. 6, de 12 de enero de 2019).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Los apartados 10.3 y 17.4 de la Resolución del presidente del ICIB por la que&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;se convocan las subvenciones para apoyar las inversiones que favorezcan la&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;modernización, la innovación y el desarrollo tecnológico de las industrias&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;culturales para el año 2023. (BOIB núm. 58, de 6 de mayo de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Modificar el anexo de la Resolución del presidente del ICIB por la que se&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;conceden y deniegan las ayudas destinadas a apoyar las inversiones que&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;favorezcan la modernización, la innovación y el desarrollo tecnológico de las&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;industrias culturales para el año 2023 en los siguientes términos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
