&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. El 9 de abril de 2024, se publicó, en el &lt;em&gt;Boletín Oficial de las Illes Balears,&lt;/em&gt; la Orden 11/2024 del consejero de Turismo, Cultura y Deportes por la cual se establecen las bases reguladoras y se aprueba la convocatoria &lt;span style="color: rgb(0, 0, 0)"&gt;para la concesión de ayudas &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;para&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;financiar proyectos innovadores a través de la cooperación, con el objetivo de buscar, implementar y digitalizar soluciones innovadoras sostenibles &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;en los&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt; establecimientos turísticos de las Illes Balears en el marco del PRTR financiado por la Unión Europea Next Generation EU.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El punto 6 de la convocatoria dispone:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;6. Distribución de los fondos por programas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

La asignación del remanente&lt;/span&gt;&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;se tiene que hacer&lt;/span&gt;&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;de acuerdo con &lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;el&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; orden de prelación establecido según la puntuación obtenida. La resolución de la modificación &lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;citada,&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; salvo que se establezca otra cosa, no implica que se amplíe el plazo&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;para presentar solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. De acuerdo con lo establecido en el punto 14.1 de la convocatoria, el plazo para presentar las solicitudes era de dos meses desde el día siguiente al de su publicación en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;, la cual se llevó a cabo el 9 de abril de 2024 (BOIB núm. 47). Por lo tanto, finalizó el 10 de junio de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3. Analizadas las solicitudes presentadas, resulta que las hay por un importe máximo de 12.864.355,70 €. De este, 10.995.164,54 € son para el Programa I y 1.869.191,18 €, para el Programa II. La convocatoria dispone la posibilidad de incorporar crédito de un programa al otro mediante una resolución de modificación de la convocatoria, en el supuesto de que quede remanente en uno de los programas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En consecuencia, para poder atender todas las solicitudes que cumplen los requisitos de la convocatoria, es necesario transferir 2.842.862,33 € del Programa II al Programa I. Así, el crédito destinado a cada programa sería suficiente para atender todas las solicitudes que cumplen los requisitos de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. El Decreto Legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el Texto refundido de la Ley de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

El Real Decreto 887/2006, de 21 de julio, por el cual se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;4. &lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;6. La La Ley 4/2021, de 17 de diciembre, de medidas extraordinarias y urgentes para ejecutar las actuaciones y los proyectos que se tienen que financiar con fondos europeos en el marco del PRTR.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;7. El Decreto Ley 3/2021, de 12 de abril, de medidas extraordinarias y urgentes para ejecutar las actuaciones y los proyectos que se tienen que financiar con fondos europeos en el marco del PRTR.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;8. El Decreto 75/2004, de 27 de agosto, de desarrollo de determinados aspectos de la Ley de finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;9.&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;El&lt;/span&gt; Decreto 1/2024, de 4 de enero, de la presidenta de las Illes Balears, por el que se modifica el Decreto 12/2023, de 10 de julio, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears, modificado por el Decreto 16/2023, de 20 de julio, y por el Decreto 17/2023, de 23 de agosto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

La Orden HFP&lt;/span&gt;/&lt;span style="color: rgb(0, 0, 0)"&gt;1031&lt;/span&gt;/&lt;span style="color: rgb(0, 0, 0)"&gt;2021, de 29 de septiembre, por la que se establecen&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;el procedimiento y&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;el&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;formato de la información&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;que tienen que&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;proporcionar las&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;entidades del&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;sector&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;público&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;estatal,&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;autonómico y&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;local para el seguimiento del cumplimiento de hitos y objetivos y de ejecución presupuestaria y contable de las medidas de los componentes del PRTR.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;15. La Orden HFP&lt;/span&gt;/&lt;span style="color: rgb(0, 0, 0)"&gt;55&lt;/span&gt;/&lt;span style="color: rgb(0, 0, 0)"&gt;2023, de 24 de enero, relativa al análisis sistemático del riesgo de conflicto de interés en los procedimientos que ejecutan el PRTR.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;16. La Resolución de 4 de enero de 2022 de la Secretaría de Estado de Turismo por la que se acuerda la distribución de los créditos en las comunidades autónomas y se formalizan los compromisos financieros derivados del Acuerdo de la Conferencia Sectorial de Turismo de 21 de diciembre de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;18. La Resolución de 11 de abril de 2022 de la Secretaría de Estado de Turismo por la que se publica el Acuerdo de la Conferencia Sectorial de Turismo de 29 de marzo de 2022 por el que se fijan los criterios de distribución y el reparto resultante para las comunidades autónomas del crédito destinado a la financiación de actuaciones de inversión en el marco del C14.I1 del PRTR.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;19. La Resolución de 19 de diciembre de 2022 de la Secretaría de Estado de Turismo por la que se publica el Acuerdo de la Conferencia Sectorial de Turismo por el que se fijan los criterios de distribución y el reparto resultante para las comunidades autónomas del crédito destinado a la financiación de actuaciones de inversión de entidades locales, en el marco del componente 14, inversión 1, del PRTR de la anualidad de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

La asignación del remanente&lt;/span&gt;&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;se tiene que hacer&lt;/span&gt;&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;de acuerdo con &lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;el&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; orden de prelación establecido según la puntuación obtenida. La resolución de la modificación &lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;citada&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;, salvo que se establezca otra cosa, no implica que se amplíe el plazo &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;para&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;presentar solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. Publicar esta Resolución en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Turismo, Cultura y Deportes en el plazo de un mes a contar desde el día siguiente al de su notificación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;También se puede interponer directamente un recurso contencioso-administrativo ante la sala contenciosa-administrativa del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente al de su publicación, de acuerdo con el artículo 46 de la Ley 29&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;/19&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;98, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
