    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 27 de febrero de 2015 por la cual se convocan subvenciones para el Fomento de la Producción Integrada, para el año 2015, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt; de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Los expedientes han sido tramitados por el Fondo de Garantia Agraria y Pesquera de las Islas Baleares (FOGAIBA), en cumplimiento del que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El vicepresidente del FOGAIBA, con fecha de 3 de setiembre de 2024, dicta lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

FRANCISCO BARCELO ORDINAS con NIF ***8988**, en nombre y representación de la entidad SON PONS AGRÍCOLA C.B, presentó en el registro del FOGAIBA una solicitud de ayuda para poder acogerse a la línea de ayudas para prorrogar los compromisos asumidos para el fomento de la producción integrada al amparo de la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares de día 3 de febrero de 2020, publicada en el BOIB nº16 día 6 de febrero de 2020. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;4.Con fecha 10 de junio de 2021 el vicepresidente en materia agraria del FOGAIBA dictó resolución de denegación a los beneficiarios de las ayudas, Rd7 de fecha 10 de junio de 2021. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;5.Con fecha 17 de mayo de 2021, y con número de registro GOIBE186359/2021, SR. ANTONIO COLOMAR ROIG con NIF ***5902** presentó en el registro del FOGAIBA una solicitud de ayuda para acogerse a la línea para prorrogar los compromisos asumidos para el fomento de la producción integrada al amparo de la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares de día 24 de enero de 2021, publicada en el BOIB núm. 13 día 30 de enero de 2021. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;6.La citada ayuda se concedió mediante Resolución del vicepresidente del FOGAIBA de día 19 de abril de 2022, por un importe anual de CUATRO MIL DOS CIENTOS-NUEVE EUROS Y CINCUENTA Y CÉNTIMOS (4.209,50 €) (prórroga anualidad 2021 ). &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;16.Ley 3/2019, de 31 de enero, Agraria de las Islas Baleares. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;17.Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), a la comunidad autónoma de las Islas Baleares BOIB núm. 082 de 2007; en virtud de la Orden de la consejera de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de Garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero , a partir del 1 de enero&lt;em&gt; &lt;/em&gt;de 2006.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;18.Llei 39/2015, d'1 d'octubre, del procediment comú de les administracions públiques .&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Propuesta de Resolución de Revocación de la Resolución de Denegación&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Por todo ello, se informa favorablemente y propongo al vicepresidente del FOGAIBA que dicte resolución en los siguientes términos:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;1. Revocar la Resolución de denegación de la prórroga 2020 de la ayuda para el fomento de producción integrada para el beneficiario SON PONS AGRÍCOLA, CB con NIF E57550253 por error administrativo.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;2. Notificar la resolución de concesión de la prórroga 2020 al interesado en el Boletín Oficial de las Islas Baleares. Anexo I.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
