    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Antecedentes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En fecha 15 de junio de 2024, se publicó en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;(BOIB núm. 80), la Resolución del consejero de Turismo, Cultura y Deportes por la que se convocan subvenciones para fomentar la organización de festivales y certámenes cinematográficos en las Illes Balears durante el año 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En el plazo de inscripción establecido en el apartado 6.1 de la convocatoria se recibió un total de seis solicitudes. Las seis candidaturas son correctas y no hay ninguna exclusión ni denegación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. De acuerdo con el apartado 10&lt;em&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/em&gt;de las bases reguladoras, una vez finalizado el plazo de presentación de solicitudes, la Comisión Evaluadora debe valorar los proyectos presentados según los criterios de valoración que se fijan en el punto 10.2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. De conformidad con el apartado 10.1 de la convocatoria, el órgano competente debe prorratear el importe global máximo destinado a la convocatoria entre los solicitantes que cumplen los requisitos para ser beneficiarios en función de los puntos de valoración obtenidos por cada proyecto, de acuerdo con el artículo 18 del Texto Refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre. La cuantía máxima disponible debe dividirse entre el total de puntos de valoración obtenidos por todos los proyectos que cumplen los requisitos; el resultado de esta división determinará una cantidad de euros por punto que se multiplicará por la valoración de cada proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. De conformidad con el apartado 11.2 de las bases de la convocatoria, la Comisión Evaluadora se reunió el día 10 de julio de 2024 para examinar las solicitudes presentadas y, posteriormente, extendió acta de la sesión, a la que se adjuntó el informe que sirvió de base para dictar la Propuesta de resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El día 23 de julio se publicó en la Sede Electrónica de la CAIB y en la página web de la Dirección General de Cultura la Propuesta de resolución de la directora general de Cultura sobre la concesión y denegación de subvenciones para fomentar la organización de festivales y certámenes cinematográficos en las Illes Balears durante el año 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. De acuerdo con el apartado 13.3 de la convocatoria, los beneficiarios deben comunicar al órgano instructor la aceptación o la renuncia respecto de la subvención propuesta en el plazo de cinco días hábiles a contar desde la publicación de la Propuesta de resolución en la Sede Electrónica de la CAIB. En cualquier caso, la aceptación se entenderá producida automáticamente si no se hace constar lo contrario en el trámite telemático habilitado al efecto. Durante dicho plazo no se presentaron renuncias por parte de las personas propuestas como beneficiarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. De acuerdo con el apartado 13.2 de la convocatoria, una vez publicada la Propuesta de resolución, los solicitantes disponían de un plazo de cinco días hábiles para formular alegaciones. Dentro del plazo indicado no se presentaron alegaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. Durante la tramitación de este procedimiento se detectó la participación de varios solicitantes en otra convocatoria de subvenciones para la misma finalidad, concretamente la convocada por el Instituto de Estudios Baleáricos (en adelante, IEB) para apoyar ferias, festivales, ciclos de conciertos, encuentros, jornadas y premios del mundo de la cultura que fomenten la proyección exterior y se lleven a cabo en el territorio de las Illes Balears para el año 2024 (BOIB núm. 29, de 27 de febrero de 2024).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. Si bien las dos convocatorias permiten la compatibilidad con otras subvenciones para la misma finalidad, la base 21.1 de la citada convocatoria del IEB establece que los beneficiarios no podrán obtener ayudas por los mismos conceptos que se deriven de otras convocatorias de ayudas de la Consejería de Turismo, Cultura y Deportes, el propio IEB, el Instituto de Industrias Culturales de las Illes Balears o el Instituto Ramon Llull.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11. Visto lo anterior, se requirió a los beneficiarios solicitantes de las dos subvenciones para que en el plazo de diez días hábiles a contar desde el día siguiente al de la notificación del requerimiento correspondiente, especificaran cuáles de los conceptos deben imputarse a los proyectos presentados en cada una de las convocatorias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12. Transcurrido el plazo otorgado al efecto, todas las personas requeridas han presentado, en tiempo y forma, documentación en que se identifican los conceptos que deben imputarse a cada una de las convocatorias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;13. Asimismo, en la Propuesta de resolución se han detectado una serie de errores materiales referentes a las cuantías que procede corregir.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Consideraciones jurídicas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La Ley 38/2003, de 17 de noviembre, general de subvenciones (BOE núm. 276, de 18 de noviembre de 2003).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El Texto Refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre (BOIB núm. 196, de 31 de diciembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La Orden de la consejera de Educación y Cultura de 1 de julio de 2009 por la cual se establecen las bases reguladoras de las subvenciones en materia de educación y cultura (BOIB núm. 100, de 11 de julio de 2009).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La Resolución del consejero de Turismo, Cultura y Deportes por la que se convocan subvenciones para fomentar la organización de festivales y certámenes cinematográficos en las Illes Balears durante el año 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. La Propuesta de resolución de la directora general de Cultura por la que se conceden subvenciones para fomentar la organización de festivales y certámenes cinematográficos en las Illes Balears durante el año 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLUCIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Aprobar y conceder subvenciones por el importe total de 500.000 € a favor de los beneficiarios que se incluyen en el Anexo 1.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Autorizar y disponer el gasto indicado para cada uno de los beneficiarios con cargo al capítulo IV del presupuesto de la Dirección General de Cultura, con los importes que se detallan en el anexo 1.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Aceptar los gastos con personas o entidades vinculadas de la entidad FILMIN MALLORCA, SL, y denegar la solicitud de Mèdit, Asociación Cultural por tratarse de honorarios de los beneficiarios de la subvención, considerados como gasto no subvencionable en el apartado 5.2.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Informar a los beneficiarios de que la subvención debe justificarse en los términos establecidos en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Publicar esta resolución en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta resolución, que agota la vía administrativa, podrá interponerse un recurso potestativo de reposición ante el consejero de Turismo, Cultura y Deportes en el plazo de un mes a contar a partir del día siguiente al de su publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;También podrá interponerse un recurso contencioso-administrativo ante la Sala de lo Contencioso-administrativo del Tribunal Superior de Justicia en el plazo de dos meses a contar a partir del día siguiente al de su publicación, de acuerdo con el artículo 46.1 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
