&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El 2 de octubre de 2017, la consejera de Hacienda y Administraciones Públicas dictó una resolución por la cual se autorizó la aceptación de la cesión de uso gratuita y temporal por parte de la Universidad de les Illes Balears de unos espacios determinados en el edificio de Ca n'Oleo, situado en la calle de la Almudaina, 4, en Palma, con el objeto de ubicar la Dirección General de Cultura de la Administración de la Comunidad Autónoma de las Illes Balears. Los espacios cedidos serían los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Planta Baja: 90,12 m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;2&lt;/span&gt;&lt;/sup&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Entresuelo: 90,46 m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;2&lt;/span&gt;&lt;/sup&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Primer piso: 252,63 m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;2&lt;/span&gt;&lt;/sup&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Segundo piso: 211,56 m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;2&lt;/span&gt;&lt;/sup&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La duración de esta cesión de uso gratuita y temporal era de 5 años, a contar desde el acta de entrega y recepción, que se firmó día 5 de junio de 2018, y prorrogable tácitamente en iguales condiciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El número del activo en el Inventario General de Bienes y Derechos de la Comunidad Autónoma de las Illes Balears es el 100000015968-0, con referencia catastral 9901602DD6890B0001QE.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El 2 de julio de 2020, se firmó un convenio de colaboración entre la Consejería competente en materia de Cultura, el Instituto de Estudios Baleáricos (IEB), el Instituto de Industrias Culturales de las Illes Balears (ICIB) y la UIB para acordar el uso compartido de las dependencias antes mencionadas y la distribución de gastos, entre las diferentes instituciones firmantes sin la participación de la Dirección General competente en materia de Patrimonio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Actualmente la Consejería de Turismo, Cultura y Deportes, mediante la Dirección General de Cultura, el Instituto de Estudios Baleáricos y el Instituto de Industrias Culturales de las Illes Balears continúan haciendo uso de estos espacios en el edificio manifestando su interés en continuar ocupándolo. Es por eso que esta Dirección General, para reflejar instrumentalmente esta realidad, les requirió para que soliciten formalmente la petición de adscripción de estos espacios a su favor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. El 22 de julio de 2024 tuvo entrada a la Dirección General del Tesoro, Política Financiera y Patrimonio (VALIB núm. identificador 313251), un oficio del consejero de Turismo, Cultura y Deportes y presidente del IEB y el ICIB, solicitando la adscripción del edificio de Ca n'Oleo para ubicar las dependencias de la Dirección General de Cultura, del Instituto de Estudios Baleáricos y del Instituto de Industrias Culturales de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. En 31 de julio de 2024, el Servicio de Patrimonio emitió un informe favorable sobre el expediente de referencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Los artículos 24 y 88 c de la Ley 6/2001, de 11 de abril, del Patrimonio de la Comunidad Autónoma de las Illes Balears (BOIB núm. 49, de 24 de abril).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Los artículos 28, 154 y 156 del Decreto 127/2005, de 16 de diciembre, por el que se aprueba el Reglamento de desarrollo de la Ley 6/2001, de 11 de abril, del Patrimonio de la Comunidad Autónoma de las Illes Balears (BOIB núm. 192, de 24 de diciembre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El Decreto 8/2023, de 10 de julio, de la presidenta de las Illes Balears, por el que se determina la composición del Gobierno y se establece la estructura de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 94, de 10 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Decreto 16/2023, de 20 de julio, de la presidenta de las Illes Balears, por el que se modifica el Decreto 12/2023, de 10 de julio, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 102, de 20 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Decreto 56/2023, de 21 de julio, por el que se dispone el nombramiento de altos cargos de la Consejería de Economía, Hacienda e Innovación (BOIB núm. 103, de 22 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo esto, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLUCIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Autorizar la adscripción de la Dirección General de Cultura, el Instituto de Estudios Baleáricos y el Instituto de Industrias Culturales de las Illes Balears al edificio de Ca n'Oleo, situado en calle de la Almudaina, 4, en Palma, para ubicar sus dependencias. Las referencias del inmueble son las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Activo fijo 100000015968-0&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Referencia catastral 9901602DD6890B0001QE&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;2. Manifestar que se trata de una adscripción de carácter temporal, motivada por la necesidad de espacio y sujeta, en último término, al nuevo acuerdo entre la Comunidad Autónoma de las Illes Balears y la Universidad de las Illes Balears de cesión de espacios del inmueble.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;3. Las condiciones de esta adscripción son las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.1. La Consejería de Turismo, Cultura y Deportes, mediante la Dirección General de Cultura, la IEB y el ICIB tienen el uso de los espacios siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Se destinan al uso compartido entre las partes, además de los espacios comunes, que son la entrada, el patio, las escaleras, los baños de las zonas compartidas, los sótanos y los jardines, los espacios siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Planta baja: sala de actos, de 87,83 m2&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Planta baja: conserjería, de 20,00 m2&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Entresuelo: espacio docente, de 60,39m2&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Primer piso: sala noble de reuniones, de 90,38 m2&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.3. La Consejería de Turismo, Cultura y Deportes asume los gastos derivados de los servicios y suministros de todo el edificio, que son los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El suministro de la energía eléctrica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los gastos de los servicios de limpieza del inmueble.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El servicio de telefonía y datos. Cada parte se tiene que hacer cargo del mantenimiento de sus instalaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Consejería asume, también, la contratación de un seguro que dé cobertura a la posible responsabilidad civil por daños a personas o cosas producidas por las actividades de las entidades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El pago de la prima del contrato de seguro por responsabilidad va a cargo de la Consejería. Esto sin perjuicio que cada ente es responsable del buen funcionamiento de las actividades y del buen uso de los equipamientos y espacios asignados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las incidencias, los desperfectos o los accidentes que se produzcan como consecuencia del uso de los espacios son responsabilidad de la entidad que hace uso. En caso de que se produzcan en los espacios de uso compartido, la responsabilidad es de la entidad que lleve a cabo la actividad en el momento en que se produzcan.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.4. El IEB asume los gastos de la prestación del servicio de vigilancia y seguridad de lunes a viernes (excepto festivos) de 7 a 22 horas y los sábados (excepto festivos) de 9 a 22 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.5. El ICIB asume los gastos del servicio de suministro municipal de agua de todo el edificio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.6. La Consejería se hace cargo de los gastos de adquisición del equipamiento necesario -audiovisual, de iluminación y de cortinas- para la sala de actos y la sala de reuniones de la planta noble, así como del equipamiento necesario para la conserjería de la planta baja y los espacios compartidos del entresuelo, el patio y los espacios comunes. En general, cada entidad se tiene que hacer cargo del equipamiento de los espacios que ocupe.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.7. Los gastos derivados de actos o acontecimientos concretos van a cargo de la entidad organizadora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las entidades tienen que gestionar coordinadamente el calendario de las actividades que se tengan que llevar a cabo en los espacios comunes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;4. Notificar esta Resolución a las partes interesadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;5. Publicar esta Resolución en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;6. Anotar el contenido de esta Resolución en el Inventario General de Bienes y Derechos de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta Resolución —que agota la vía administrativa— se puede interponer recurso potestativo de reposición ante la directora general del Tesoro, Política Financiera y Patrimonio en el plazo de un mes a contar desde el día siguiente de la publicación en &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;el Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;También se puede interponer directamente un recurso contencioso administrativo ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de la publicación, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
