&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El vicepresidente en materia agraria del FOGAIBA en fecha 31 de julio de 2024 firmó la siguiente resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. En fecha 15 de abril de 2023 se publicó en el BOIB núm. 48, la Resolución de la Presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 12 de abril de 2023, por la que se aprueba la convocatoria para el año 2023 de las ayudas destinadas al pago compensatorio en zonas de montaña en las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. De conformidad con el apartado sexto de la resolución antes mencionada, y de la Resolución de modificación de la Presidenta del Fogaiba, para el año 2023, de determinadas ayudas comunitarias directas y al desarrollo rural en la Agricultura y en la Ganadería , de fecha 25 de mayo de 2023, publicada en el boib 71 de 30 de mayo de 2023, el plazo de presentación de solicitudes de la convocatoria terminó el 30/6/23, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 274 solicitudes de ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. Una vez evaluadas las solicitudes de ayuda por los órganos gestores, y de acuerdo con los criterios de elegibilidad establecidos y el estudio correspondiente, se constata que ES MOLINET SAT , con NIF V57051005, que tiene los recintos 12/11/ 39/1 y 12/9/24/1 tienen el uso no admisible de “matorral”. La exclusión de estos recintos implica la reducción de lasuperficie auxiliable que reduce el importe por debajo de los 300€ (requisito del punto 3 del apartado quinto de la convocatoria).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5. En fecha 9 de julio de 2024 se notifica, mediante publicación en la página web http://www.caib.es, el informe desfavorable y la propuesta provisional de denegación de la ayuda, emitida por Servicio de Ayudas al Desarrollo Rural a los interesados, concediéndoles un plazo de 10 días para presentar las alegaciones oportunas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;6. Dentro del plazo establecido, los interesados ​​indicados en el Anexo I adjunto no han presentado alegaciones.ç&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Real Decreto 1054/2022, de 27 de diciembre, por el que se establece y regula el Sistema de información de explotaciones agrícolas y ganaderas y de la producción agraria, así como el Registro autonómico de explotaciones agrícolas y el cuaderno digital de explotación agrícola.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Real Decreto 147/2023, de 28 de febrero, por el que se establecen las normas para la aplicación de penalizaciones en las intervenciones previstas en el Plan estratégico de la política agrícola común, modificándose varios reales decretos por los que se regulan distintos aspectos relacionados con la aplicación en España de la política agrícola común para el período 2023-2027. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;13. Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;14. Orden 10/2023 de la consellera de Agricultura, Pesca y Alimentación, de 5 de abril de 2023, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco de las intervenciones para el desarrollo rural de las Islas Baleares 2023-2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;15. La ley 3/2019, de 31 de enero, agraria de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El resto de normativa de desarrollo y aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Propuesta de resolución/ Resolución de denegación&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Por todo ello, se informa desfavorablemente y propongo al vicepresidente en Materia Agraria del FOGAIBA que dicte resolución en los siguientes términos: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Denegar las solicitudes presentadas por los interesados ​​relacionados en el Anexo I, por incumplimiento del requisito indicado. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Declarar concluido el procedimiento y archivar los expedientes detallados en el Anexo I. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. Notificar la resolución a los interesados ​​del Anexo I mediante su publicación en el boib. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Interposición de recursos &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Contra esta resolución - que no agota la vía administrativa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Se puede interponer recurso de alzada ante el consejero de Agricultura, Pesca y Medio Natural, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La jefa de Servicio de Ayudas PDR &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
