    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;A fecha de la firma electrónica, el director general de Economía Circular, Transición Energética y Cambio Climático ha formulado la siguiente propuesta definitiva:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Hechos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. El 11 de septiembre de 2021, en el BOIB nº.125, se publicó la convocatoria pública de subvenciones para la realización de instalaciones de autoconsumo con fuentes de energía renovable, con o sin almacenamiento, y la incorporación de almacenamiento en instalaciones de autoconsumo con fuentes de energía ya existentes, en el sector residencial, las administraciones públicas y el tercer sector, en el marco del Plan de Recuperación, Transformación y Resiliencia europeo, mediante la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 6 de septiembre de 2021, modificada por la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 19 de octubre de 2022 (BOIB nº.137, de 22 de octubre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. Las personas que figuran en el anexo&amp;nbsp; de esta Propuesta obtuvieron una subvención para la implantación de instalaciones renovables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. Las personas que figuran en el anexo de esta Propuesta presentaron la documentación justificativa de las actuaciones realizadas, en que se acredita que el importe de la actuación ha sido inferior al previsto inicialmente o se ha reducido la instalación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. Los servicios técnicos competentes han informado favorablemente sobre el pago de las subvenciones descritas en el anexo, en que se incluye una aminoración del importe proporcional a las modificaciones realizadas, las cuales se han calculado de acuerdo con la Resolución de convocatoria de estas ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:black; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;5. El 19 de julio de 2024, se dictó la Propuesta de resolución provisional del director general de Economía Circular, Transición Energética y Cambio Climático por la cual se aminora la cantidad de la ayuda (BOIB nº. 97, de 23 de julio de 2024) y se ha agotado el plazo que se concedía para presentar alegaciones sin que se hayan presentado.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El La Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones (BOIB n.º 196, de 31 de diciembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El Decreto 75/2004, de 27 de agosto, por el que se desarrollan determinados aspectos de la Ley de Finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Illes Balears (BOIB n.º 122, de 2 de septiembre de 2004).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. La Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la cual se establecen las bases reguladoras para la concesión de subvenciones en materia de energía (BOIB n.º 72, de 24 de mayo de 2008).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. El Real Decreto 477/2021, de 29 de junio, por el que se aprueba la concesión directa a las comunidades autónomas y en las ciudades de Ceuta y Melilla de ayudas para la ejecución de varios programas de incentivos ligados al autoconsumo y al almacenamiento con fuentes de energía renovable, así como a la implantación de sistemas térmicos renovables en el sector residencial, en el marco del Plan de Recuperación, Transformación y Resiliencia europeo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. La Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 6 de septiembre de 2021 por la que se aprueba la convocatoria pública de subvenciones para la realización de instalaciones de autoconsumo con fuentes de energía renovable, con o sin almacenamiento, y la incorporación de almacenamiento en instalaciones de autoconsumo con fuentes de energía ya existentes, en el sector residencial, las administraciones públicas y el tercer sector, en el marco del Plan de Recuperación, Transformación y Resiliencia europeo (BOIB n.º 125, de 11 de septiembre de 2021).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. La Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática por la cual se modifica y amplía el crédito de la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 6 de septiembre de 2021 por la cual se aprueba la convocatoria pública de subvenciones para la realización de instalaciones de autoconsumo con fuentes de energía renovable, con o sin almacenamiento, y la incorporación de almacenamiento en instalaciones de autoconsumo con fuentes de energía ya existentes, en el sector residencial, las administraciones publicas y el tercer sector, en el marco del Plan de Recuperación, Transformación y Resiliencia europeo NextGenerationEU (BOIB núm.137, de 22 de octubre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;9. La Orden HFP/1030/2021, de 29 de septiembre, por la que se configura el sistema de gestión del Plan de Recuperación, Transformación y Resiliencia, así como la Orden HFP/1031/2021, de 29 de septiembre, por la que se establece el procedimiento y formato de la información a proporcionar por las entidades del sector público para el seguimiento del cumplimiento de los hitos y objetivos y de ejecución presupuestaria y contable de las medidas de los componentes del Plan de Recuperación, Transformación y Resiliencia.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Propuesta de resolución definitiva&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Propongo al consejero de Empresa, Empleo y Energía que dicte una resolución en los términos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Reconocer la obligación y proponer el pago de una subvención a los beneficiarios que figuran en el anexo, de acuerdo con el importe que también se indica en él.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Revocar parcialmente la subvención concedida ya que la cantidad de coste elegible ha sido inferior al previsto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Establecer que los beneficiarios están obligados a cumplir lo que dispone el apartado decimoséptimo de la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 6 de septiembre de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Disponer que toda alteración de las condiciones establecidas para la concesión de la subvención, como también la obtención concurrente de subvenciones o ayudas otorgadas por otras administraciones públicas o entes públicos, nacionales o internacionales, da lugar a la revisión parcial o total de la subvención y, por lo tanto, al reintegro de la cantidad correspondiente más los intereses de demora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;5. Publicar esta Resolución en el &lt;/span&gt;&lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Manifestar la conformidad con la propuesta de resolución y dictar resolución en los mismos términos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta Resolución, que agota la vía administrativa, cabe interponer un recurso potestativo de reposición ante el consejero de Empresa, Empleo y Energía en el plazo de un mes contando desde el día siguiente al de su publicación, de acuerdo con los artículos&amp;nbsp;123 y 124 de la Ley&amp;nbsp;39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo&amp;nbsp;57 de la Ley&amp;nbsp;3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;También cabe interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses contados desde el día siguiente al de la publicación de la resolución, de acuerdo con el artículo&amp;nbsp;46 de la Ley&amp;nbsp;29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa.&lt;/span&gt;&lt;/p&gt;
