&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. El 16 de abril de 2024, los miembros de la Comisión Paritaria del Convenio Colectivo del sector de la Limpieza de edificios y locales de las Illes Balears se reunieron para acordar sobre la interpretación del artículo 54 del convenio colectivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. El 16 de abril, José María Muñoz Juárez, en representación de la Comisión Paritaria del Convenio colectivo, solicitó el registro, el depósito y la publicación de la citada Acta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. El artículo 90.3 del Texto Refundido de la Ley del Estatuto de los Trabajadores, aprobado por el Real Decreto Legislativo 1/1995, de 24 de marzo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. El Real Decreto 713/2010, de 28 de mayo, sobre registro y depósito de convenios y acuerdos colectivos de trabajo&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. El artículo 45 de la Ley 39/2015, de 1 de octubre, de Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Inscribir y depositar el Acta de la Comisión Paritaria del Convenio colectivo del sector de la Limpieza de edificios y locales de las Illes Balears, de 16 de abril de 2024, en el Registro de Convenios Colectivos de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Publicar el Convenio en el &lt;em&gt;Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. Ordenar la traducción del texto a la lengua catalana y hacer constar que la versión castellana del texto es la original firmada por la Comisión Paritaria y que la versión catalana es una traducción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. Notificar esta Resolución a la persona interesada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#222222"&gt;En la ciudad de Palma de Mallorca, siendo las &lt;strong&gt;12,30&lt;/strong&gt; horas del día &lt;/span&gt;&lt;span style="color:#222222"&gt;&lt;strong&gt;16 de abril de 2024&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#222222"&gt;, en la sala de juntas del &lt;/span&gt;&lt;span style="color:#222222"&gt;&lt;strong&gt;SINDICATO SITEIB&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#222222"&gt; se reúnen las personas abajo relacionadas, que comparecen en representación de las organizaciones empresariales y sindical que asimismo se citan, al objeto de atender la petición de reunión provocada por la parte social en relación a la interpretación que debe hacerse en relación a la &lt;/span&gt;&lt;span style="color:#222222"&gt;&lt;strong&gt;acumulaci&lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;ón de horas sindicales delegado sindical y miembro de comité de empresa, aclaración del Convenio&lt;/strong&gt;&lt;span style="color:#222222"&gt;, y en base a ello COMPARECEN:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;Acumulación crédito horario para miembros de Comité de Empresas o Delegados/as de Personal&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;“&lt;em&gt;Se conviene la acumulación del crédito horario que actualmente vienen detentando los miembros de los comités de empresas, Delegado/as de Personal y delegadas sindicales.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Esta acumulación se entenderá a favor de uno solo de los miembros del Comité de Empresa o Delegado/as de Personal por cada sindicato representado.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;A tal efecto, y para que dicha acumulación pueda llevarse a cabo, será preceptiva la comunicación dirigida a la dirección de las empresas por escrito del miembro o miembros del comité cedente, con una antelación mínima de un mes.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1º.- POR EL SINDICATO SITEIB:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El espíritu de la disposición normativa interpretada (artículo 54 del CC) conviene que puede llevarse a cabo la acumulación del crédito horario que vienen detentando los miembros de los comités de empresa, los delegados de personal y los delegados sindicales, ya sea entre ellos, así como en una misma persona cuando ésta ostenta la doble cualidad de miembro del comité de empresa, delegado de personal y delegado sindical. Así ha sido la práctica en el sector a lo largo de los años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2º.- POR LA PARTE EMPRESARIAL&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Asienten por la parte empresarial en que el espíritu del artículo estudiado es el manifestado por el sindicato.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;No habiendo más asuntos que tratar y siendo las 13:20 horas, se da por finalizada la reunión en el lugar y fecha indicados en el encabezamiento, levantándose la presente acta para constancia de lo tratado. Se acuerda que la misma se firme, por un representante de cada organización presente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las partes acuerdan mandatar al Sr. Muñoz, asesor empresarial, para que proceda a los trámites de inscripción y registro de la misma ante la autoridad laboral y solicitud de su publicación en el «BOIB».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
