Las personas interesadas señaladas en el Anexo I presentaron, en tiempo y forma, la solicitud de ayuda para acogerse a las ayudas minimis al desarrollo rural de la isla de Mallorca, vinculadas a proyectos relacionados con los ámbitos agrario/o ambiental y enmarcados en la Estrategia de Desarrollo Local Participativo 2014-2020 de Mallorca.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><span style="display:inline-block">3. Los interesados ​​señalados en el Anexo I de la presente Resolución presentaron el desistimiento de la solicitud de la ayuda.</span></span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">FUNDAMENTOS DE DERECHO</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="display:inline-block">1. Acuerdo por el que se aprueban las Bases de la convocatoria, para el año 2022, de ayudas de minimis al desarrollo rural de la isla de Mallorca, vinculadas a proyectos relacionados con los ámbitos agrario y/o ambiental y enmarcados en el 'Estrategia de Desarrollo Local Participativo 2014-2020 de Mallorca.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">2. Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px">- El artículo 21.1 de la Ley antes mencionada, establece que «la Administración está obligada a dictar resolución expresa y notificarla en todos los procedimientos cualquiera que sea su forma de iniciación. En los casos de prescripción, renuncia del derecho, caducidad del procedimiento o desistimiento de la solicitud, así como de desaparición sobrevenida del objeto del procedimiento, la resolución consiste en la declaración de la circunstancia que concurra en cada caso, con indicación de los hechos producidos y normas aplicables. Se exceptúan de la obligación a que se refiere el párrafo primero los supuestos de terminación del procedimiento por pacto o convenio, así como los procedimientos relativos al ejercicio de derechos sometidos únicamente al deber de declaración responsable o comunicación en la Administración»</p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px">- Por otra parte, el artículo 94.1 de la misma Ley determina que: "todo interesado podrá desistir de su solicitud o, cuando esto no esté prohibido por el ordenamiento jurídico, renunciar a sus derechos". En el punto 4 del mismo artículo se contempla que «la Administración debe aceptar por completo el desistimiento o la renuncia, y debe declarar concluso el procedimiento, salvo que, habiéndose personado terceros interesados, éstos insten a ello la continuación en el plazo de diez días desde que fueron notificados del desistimiento o renuncia»</p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#000000">Por todo</span><span style="color:#000000"> </span><span style="color:#000000">esto</span><span style="color:#000000">, dict</span><span style="color:#000000">o</span><span style="color:#000000"> la seg</span><span style="color:#000000">ui</span><span style="color:#000000">ente<span style="color:#000000"> </span>Resolución</span></span></span></p> <p>1. Declarar concluido el procedimiento y, por lo tanto, archivar el expediente.</p> <p>3.
