font-size:12px">El Pleno de este Ayuntamiento, en sesión extraordinaria celebrada el día 27 de marzo de 2024, acordó la aprobación de la modificación del Acuerdo regulador del precio público para la prestación del servicio de la guardería de educación infantil de primer ciclo en EI Els Molins, lo que se hace público a efectos de su general conocimiento, y que se transcribe íntegramente a continuación.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Exp: 730/2022</strong></span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>PRECIOS PÚBLICOS DE LOS SERVICIOS EDUCATIVOS PRESTADOS POR LA ESCUELA INFANTIL PÚBLICA DE PRIMER CICLO – EI LOS MOLINOS</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTÍCULO 1º OBJETO Y FUNDAMENTO</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformidad con lo que dispone el artículo 41 del Real Decreto Legislativo 2/2004, de 5 de marzo, por el que se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales, este ayuntamiento acuerda establecer en este término municipal el precio público relativo para las prestaciones de servicios de la escuela infantil pública y otros servicios educativos de 0 a 3 años.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La normativa de aplicación a este precio público es la siguiente:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Los artículos 15 al 19, 41 a 47 y 127 del Texto Refundido de la Ley Reguladora de las Haciendas Locales, aprobado por Real Decreto Legislativo 2/2004, de 5 de marzo.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Los artículos 22.2.d), 47.1, 49, 70.2 y 107 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Los artículos 24 al 27 de la Ley 8/1989, de 13 de abril, de Tasas y Precios Públicos.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTÍCULO 2º OBLIGADOS AL PAGO</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Están obligados al pago de los precios públicos contenidos en esta normativa:</span></span></p> <ol class="lower-alpha" start="1"> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las personas físicas o jurídicas (padres, madres o quien ostente la tutoría de los niños) que se benefician de los servicios educativos prestados por las escuelas infantiles públicas.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">O, en su caso, quien pueda estar obligado al pago de los alimentos de éstos con arreglo a lo previsto en el Código Civil.</span></span></li> </ol> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">* Se permitirá que la familia lleve a la escuela la merienda y la comida para los bebés de 1º, con las garantías higiénico sanitarias suficientes. En este caso, el servicio de alimentación para bebés de 1º será sin coste para las familias, que llevarán la comida correspondiente.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTÍCULO<strong> </strong>4º<strong> </strong>LIQUIDACIÓN<strong> </strong>Y<strong> </strong>INGRESO</strong></span></span></p> <ul> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las cuotas se liquidarán mensualmente y anticipadamente.</span></span></p> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las cuotas se abonarán mediante cargo en cuenta bancaria; a tal fin, el sujeto pasivo deberá de extender la correspondiente orden bancaria, y domiciliar el pago en el momento de la inscripción. Excepcionalmente​ el ayuntamiento podrá autorizar otros tipos de pago.</span></span></p> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La obligación de pago persiste fines que la persona usuaria no cause baja voluntaria del servicio y tendrá efectos el día primero del mes siguiente. Esta obligación persiste si por causas justificadas no asisten al centro, ya que la formalización de la matrícula en el centro incluye el compromiso de asistencia al centro y el pago de las cuotas mensuales. Se gestionará la cobranza mediante la domiciliación bancaria a lo largo de los primeros días del más.</span></span></p> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso de impago o de regreso de recibos domiciliados en los plazos establecidos a este efecto se podrá proceder a la tramitación de los correspondientes expedientes de apremio por a la recaudación de las cuotas devengadas informando previamente a la dirección del centro.</span></span></p> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Cuando, por causas no imputables al obligado al pago del precio público, la escuela no se desarrolle o celebre, se procederá a la devolución del importe correspondiente o bien al cambio de escuela.</span></span></p> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La inasistencia a la escuela o al servicio de alimentación no comporta derecho a devoluciones de precios públicos.</span></span></p> </li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTÍCULO 5º BONIFICACIONES DE LOS PRECIOS PÚBLICOS</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Las bonificaciones de las cuotas de los precios públicos de los servicios educativos prestados por la escuela infantil pública del Ayuntamiento de Sant Joan se establecen de acuerdo con el que dispone el artículo 44.2 del texto refundido de la Ley reguladora de las Haciendas Locales, que permite la bonificación de las cuantías de los precios públicos cuando existan razones sociales, benéficas, culturales o de interés público que así lo aconsejen.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El órgano competente para conceder las bonificaciones de los precios públicos es la Alcaldía, quien determina la concesión de las bonificaciones de las cuantías de los diferentes precios públicos cuando se dan los requisitos establecidos en los presentes precios públicos.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Requisitos económicos por a la solicitud de las bonificaciones:</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Se podrá solicitar la bonificación mediante la correspondiente solicitud por escrito, para aquellos alumnos que se matriculen en la escuela infantil pública. Se realizará una solicitud por cada alumno y la bonificación se aplicará a los precios públicos</span></span></p> <ul> <li style="list-style-type:none"> <ul style="list-style-type:disc"> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Referente a la bonificación de los precios públicos correspondientes al Servicio de escolarización básica se aplicarán el indicado a el artículo 5.4.a); quedan excluidos de bonificaciones los alumnos matriculados de 3er de educación infantil.</span></span></p> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Referente a la bonificación de los precios públicos correspondientes a los Servicios de ampliación de la escolarización básica se aplicarán el indicado a el artículo 5.4.b).</span></span></p> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Referente a la bonificación de las cuotas correspondientes al Servicio de alimentación y descanso se aplicarán el que se indica a el apartado 5.4. c).</span></span></p> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Cuando los niños sean menores de 1 año además de los requisitos económicos tendrán que cumplir los requisitos que se establecen a el apartado 5.4.d).</span></span></p> </li> </ul> </li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.a) Bonificación del Servicio de escolarización básica:</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El factor determinante será el total de renta familiar disponible asociado al número de miembros de la unidad familiar. Para establecer la base de cálculo anual de la unidad familiar y saber en qué tramo de bonificación se encuentra, se calcula la suma de los ingresos anuales que, por cualquier concepto, percibe esta unidad y se relaciona el total de ingresos con el número total de miembros de la unidad familiar.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Se computarán cómo a ingresos familiares la totalidad de los ingresos de la unidad familiar durante al año correspondiente al último ejercicio fiscal liquidado en el momento de cada convocatoria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el efecto del cálculo de los ingresos familiares, son miembros computables de la unidad familiar:</span></span></p> <ul> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El alumnado por el cual se solicita la bonificación.</span></span></p> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El padre y la madre o las personas tutoras legales del alumnado (ingresos considerados al 100%) En caso de divorcio separación legal, si la guardia y custodia del niño es compartida, se tendrán en cuenta igualmente las dos rentas. Si la guardia y custodia del niño se atribuye a una sola persona tutora, no será miembro computable aquel excónyuge que no conviva con el niño.</span></span></p> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los hermanos y las hermanas solteros menores de 25 años que convivan en el domicilio familiar el 31 de diciembre del año anterior (ingresos considerados al 50%).</span></span></p> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los hermanos y hermanas mayores de 25 años sólo con discapacidad física, psíquica o sensorial (sus ingresos, en su caso, se consideran al 50%).</span></span></p> </li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La renta se calculará del modo siguiente:</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Para los miembros de la familia que hayan presentado declaración del IRPF, se sumará la base imponible general con la base imponible del ahorro, y se excluirán los saldos netos negativos de pérdidas y ganancias patrimoniales correspondientes​ a ejercicios anteriores, así como el saldo neto negativo de rendimientos de capital mobiliario que constituyan la renta del ahorro correspondiente a ejercicios anteriores.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por a los miembros de la familia que obtengan ingresos propios pero que no hayan presentado declaración del IRPF,&nbsp; que presentarán certificado de imputaciones de Hacienda, se sumará la base imponible general con la base imponible del ahorro, excluyéndose los saldos netos negativos de pérdidas y ganancias patrimoniales correspondientes a ejercicios anteriores, así como el saldo neto negativo de rendimientos de capital mobiliario que constituyan la renta del ahorro correspondiente a ejercicios anteriores.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Sobre este cálculo de los ingresos por unidad familiar se podrán aplicar una serie de factores de corrección en los casos siguientes:</span></span></p> <ul> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Cuando haya uno niño en acogimiento, se considerará cómo miembro de la unidad familiar.</span></span></p> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si existen casos de discapacidad superior al 33 o 65% se deducirán, por cada persona afectada.</span></span></p> </li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Una vez determinado el porcentaje de bonificación que le corresponde en función del tramo asignado según los ingresos familiares (ajustado a la baja si hay personas con discapacitados en la familia), se hará uno salto de tramo si la persona beneficiaria de la bonificación cumple alguno de los requisitos siguientes:</span></span></p> <ul> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si tiene uno niño en acogimiento.</span></span></p> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si coexisten dos o más hermanos matriculados durante en el mismo curso escolar en las escuelas infantiles públicas​ del municipio.</span></span></p> </li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.b) Bonificaciones de los Servicios de ampliación del servicio de escolarización básica</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el caso de los Servicios de ampliación de los servicios de escolarización básica, se mantendrán los mismos criterios establecidos a el apartado 5.4.a) del Servicio de Escolarización básica por el procedimiento del cálculo de las bonificaciones.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.c) Bonificaciones del Servicio de alimentación y descanso</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el caso del servicio de alimentación, se mantendrán los mismos criterios establecidos a el apartado 5.4.a) del Servicio de Escolarización básica por el procedimiento del cálculo de las bonificaciones.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En relación a este servicio, debe tenerse en cuenta la convocatoria de ayudas individualizadas de comedor para alumnos escolarizados en centros docentes no universitarios de las Islas Baleares que saca cada curso escolar la Consejería de Educación y Universidades que pueden solicitar todas las familias con niños escolarizados.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.d) Cuando los niños sean menores de 1 año, además de los requisitos económicos habrán de cumplir los siguientes requisitos:</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Han de justificar documentalmente la imposibilidad de los/las tutores/as legales para atender los niños afectados en el horario de escolarización de los mismos. Lo podrán hacer mediante contratos de trabajo, certificado de horario de trabajo y vida laboral.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si la necesidad de escolarización es otra causa que el trabajo de los familiares, se habrá de justificar documentalmente según la causa:</span></span></p> <ul> <li style="list-style-type:none"> <ul> <li style="list-style-type:none"> </li> </ul> </li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso motivos educativos: informe del Equipo de Atención Temprana</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso de enfermedad: certificado médico.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso de estudios: certificado de matrícula.</span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. En los casos donde así lo manifieste uno informe de Servicios Sociales, las personas solicitantes podrán acceder a una bonificación de hasta el 100% de los precios públicos.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTÍCULO 6º TRAMITACIÓN DE LAS SOLICITUDES</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Solicitudes y documentación a presentar:</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Sin perjuicio de lo dispuesto en el art. 16 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, las solicitudes de bonificación se tendrán que dirigir al Ayuntamiento, preferentemente de modo telemático y subsidiariamente de forma presencial.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si la bonificación se solicita para más de uno miembro de la familia, se presentará uno impreso para cada miembro; pero sólo será necesario entregar un ejemplar de la documentación adjunta, siempre que el alumnado esté matriculado en el mismo municipio.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En la solicitud, o en el caso de autorización específica del solicitante a consultar los datos requeridos en poder de la administración, de la documentación siguiente:</span></span></p> <ol> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fotocopia del resguardo de la matrícula.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Certificado de convivencia.</span></span></li> </ol> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En todos los casos, si procede:</span></span></p> <ol class="lower-alpha" start="1"> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Certificado que acredite la discapacidad de los miembros del núcleo familiar y el grado de discapacidad.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Título de familia numerosa o monoparental vigente.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Sentencia o convenio de separación o divorcio.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Resolución de acogida de la Dirección General de Atención a la Infancia y la Adolescencia.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso que la familia esté atendida por los Servicios Sociales, persona y centro que los atiende (se solicitará informe y valoración directamente a los Servicios Sociales).</span></span></li> </ol> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En casos de niños menores de 1 año, si procede:</span></span></p> <ol class="lower-alpha" start="1"> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Justificantes de trabajo del tutor/es: Contrato de trabajo, certificado del horario laboral de la empresa y vida laboral.​</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso de enfermedad de alguno tutor/a legal: Certificado médico.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso de estudios de alguno tutor/a legal: certificado de matrícula.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso de motivos educativos: informe del Equipo de Atención Temprana</span></span></li> </ol> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las personas solicitantes habrán de aportar la documentación requerida y podrán añadir otros documentos que puedan justificar la suya situación. No se aceptarán declaraciones juradas ni justificaciones de gastos.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTÍCULO 7º PROCEDIMIENTO</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El ayuntamiento revisará las solicitudes y la documentación presentada, comprobará que el impreso de solicitud ha sido correctamente cumplimentado y que se ha aportado la documentación requerida, y hará un cálculo provisional del porcentaje de bonificación a otorgar a la persona solicitante en función del cumplimiento de los requisitos económicos y familiares.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el supuesto que los datos sean incompletos o falte documentación, el ayuntamiento establecerá un plazo de 15 días hábiles para efectuar las correcciones pertinentes y para que las personas interesadas puedan enmendar o completar los datos o adjuntar la documentación no presentada inicialmente.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el caso de las personas interesadas que, transcurrido este plazo, no enmienden las correcciones mencionadas se considerará que desisten de su petición, la cual se archivará sin más trámite.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El ayuntamiento, a la vista de la documentación presentada, resolverá la concesión o denegación de la solicitud de bonificación en el plazo de 15 días hábiles contados desde el momento que la documentación sea completa.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta resolución en materia de ingresos de derecho público se podrá interponer recurso de alzada ante el alcalde, con efectos de reposición, en el plazo de un mes, aplicándose el régimen jurídico del recurso regulado en el artículo 14º del texto refundido de la Ley reguladora de las Haciendas Locales, aprobado por Real Decreto Legislativo 2/2004, de 5 de marzo.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTÍCULO 8º<strong> </strong>INCOMPATIBILIDADES</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La suma de las cuantías de ayudas recibidas no podrán superar el total de las cuotas previstas con carácter general, quedando obligado el beneficiario a informar al ayuntamiento de la concesión otros ayudas por los mismos conceptos.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTÍCULO 9º SUPUESTOS DE REVISIÓN DE LOS AYUDAS Y LAS BECAS</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;1. Los requisitos económicos de las bonificaciones, establecidas a todos los efectos o en cada precio público en concreto, se tendrán que acreditar en el momento de formalizarse la solicitud, y únicamente se podrán revisar con posterioridad, cuando se dé alguna de las circunstancias siguientes:</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Cambio de la situación familiar por causa de deceso de algún progenitor o tutor/a legal de los menores no emancipados; en este caso, se habrá de presentar la solicitud junto con la copia del certificado de fallecimiento.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Cambio de la situación familiar por causa de divorcio o separación legal. Si el divorcio o la separación legal considera la guardia y custodia compartida, se computarán las rentas de los dos tutores legales (padre y madre) y no habrá revisión de las bonificaciones.</span></span></p> </li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si la guardia y custodia del niño se atribuye a un solo tutor, no será miembro computable aquel ex cónyuge que no conviva con el niño, pero sin embargo sí que será miembro computable el nuevo cónyuge unido por análoga relación, así como su renta. En este supuesto, deberá adjuntarse a la solicitud la sentencia o el convenio de divorcio y/o separación.</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contingencias económicas sobrevenidas posteriores a la matrícula reflejadas en un informe de Servicios Sociales donde se ponga de relieve el cambio socioeconómico de la unidad familiar y se establezca el correspondiente grado de calificación de la situación, siempre que se den los requisitos de umbral de renta establecidos en el apartado 3 del artículo 5 de la presente regulación en el momento de emitir este nuevo informe. Los efectos de la revisión de la correspondiente bonificación serán los de la fecha de presentación de la nueva solicitud de bonificación, acompañada del informe de Servicios Sociales, así como de toda aquella documentación que sea necesaria para acreditar los umbrales de renta de ambas personas tutoras del ejercicio en curso (hojas de salario de todos los meses, las pagas extra inclusive; indemnización por despido, en su caso; certificado de cobros o derechos de cobros hasta el final del año de rentas de inserción; prestación de desempleo, de viudedad o no contributivas, así como otra documentación que pueda requerir la Administración a el efecto de acreditar la nueva renta familiar disponible).</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Niños en acogida en centros de servicios sociales especializados, donde deberá tramitarse la solicitud con copia de la sentencia judicial, la resolución administrativa o el informe del organismo competente que determina la tutoría de el niño a los servicios sociales.</span></span></p> </li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2- En los casos en qué se planteen dudas o incógnitas respeto a la oportunidad de dar la ayuda solicitada, las familias demandantes quedan obligadas a presentar cualquier información que se les solicite. Y además, deben estar dispuestas a realizar las entrevistas necesarias con los servicios sociales municipales o el EAP para aclarar la situación familiar y económica en qué se encuentran, en cualquiera momento durante el curso escolar en qué están recibiendo ayuda.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>DISPOSICIÓN TRANSITORIA</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el caso de niños que en la fecha de entrada en vigor de esta normativa estén matriculados a la escuela infantil pública y tengan concedida una bonificación de igual naturaleza que la regulada en el presente acuerdo regulador de acuerdo con la normativa municipal vigente a la entrada en vigor de esta norma, se les mantendrá la misma hasta la finalización del curso escolar. En el caso de que quieran optar a las bonificaciones establecidas a la presente regulación, la &nbsp;concesión de las mismas comportará la renuncia a las concedidas anteriormente.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>DISPOSICIÓN<strong> </strong>ADICIONAL</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Todo lo que no esté previsto en el presente acuerdo se regirá por el texto refundido de la Ley reguladora de las Haciendas Locales, así como la Ley 58/2003, de 17 de diciembre, General Tributaria y el Real Decreto 939/2005, de 29 de julio, por el cual se aprueba el Reglamento General de Recaudación.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>DISPOSICIÓN DEROGATORIA</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Quedan derogadas cuantas disposiciones de igual o inferior rango se opongan a lo dispuesto en la presente ordenanza reguladora de precios públicos.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>DISPOSICIÓN FINAL</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Esta normativa específica se aplicará para los centros de Educación Infantil y Espacios Familiares a partir de su publicación al Boletín oficial de las Islas Baleares, y estará en vigor&nbsp; mientras el Ayuntamiento no acuerde su modificación​ o derogación.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra el presente acuerdo se podrá interponer recurso contencioso-administrativo, ante la Sala de lo Contencioso-Administrativo del Tribunal Superior de Justicia de las Islas Baleares, con sede en Palma, en el plazo de dos meses contados a partir del día siguiente de la publicación de este anuncio.</span></span></p> <p> </p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Sant Joan, a la fecha de la firma electrónica al margen (16 de agosto de 2024)</span></span><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span>El alcalde<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span>&nbsp;</strong>Richard Thompson</span></span></p> ]] 2024-08-20 text/html 690030 CAIB 38042 2024-08-20
