&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El 27 de junio de 2024 tuvo entrada en la Subdirección de Contabilidad y Análisis la documentación para tramitar la aceptación de la cesión temporal de mobiliario (valorado en 6.967,20 €) de la Asociación Española Contra el Cáncer a favor del Servicio de Salud de las Islas Baleares, destinado al Servicio de Oncología del Hospital Universitario Son Espases. La documentación es la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Escrito con fecha 9 de mayo de 2024 del representante de la Asociación Española Contra el Cáncer en el que se establece la cesión de mobiliario de la tienda Trends Home Calvià en las condiciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Espacio interior:&lt;/span&gt;&lt;/span&gt;

	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Valor económico del mobiliario: 6.967,20 €.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La cesión no necesita material fungible.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Periodo de la cesión: diez años, transcurridos los cuales el Hospital Universitario Son Espases debe retornar el mobiliario al cedente si la cesión no se prorroga expresamente por acuerdo de las partes.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Informe justificativo de la necesidad de la cesión del mobiliario emitido por el jefe del Servicio de Oncología del Hospital Universitario Son Espases.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Documentación acreditativa del cedente y de su representante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d) Certificado de titularidad de los bienes que se ceden por medio de un compromiso de donación en especie entre Rotary Club Palma Ramón Llull y la Asociación Española Contra el Cáncer.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;e) Renderización del mobiliario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El 5 de julio de 2024, el director general del Servicio de Salud dictó la resolución de inicio de la tramitación para aceptar la cesión temporal del mobiliario en cuestión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El 15 de julio de 2024, el subdirector de Presupuestos y Control del Gasto emitió un informe favorable a la cesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El Código civil, aprobado por el Real decreto de 24 de julio de 1889.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. La Ley 6/2001, de 11 de abril, de patrimonio de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. La Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. La Ley 5/2003, de 4 de abril, de salud de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. La Ley 33/2003, de 3 de noviembre, de patrimonio de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. La Ley 7/2010, de 21 de julio, del sector público instrumental de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. El Real decreto 1373/2009, de 28 de agosto, por el que se aprueba el Reglamento general de la Ley 33/2003.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10. El Decreto 127/2005, de 16 de diciembre, por el que se aprueba el Reglamento de desarrollo de la Ley 6/2001.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;11. El Decreto 39/2006, de 21 de abril, por el que se aprueban los estatutos del ente público Servicio de Salud de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;12. El Decreto 63/2019, de 2 de agosto, por el que se establece la estructura orgánica básica del Servicio de Salud de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;13. El Decreto 8/2023, de 10 de julio, de la presidenta de las Islas Baleares, por el que se determina la composición del Gobierno y se establece la estructura de la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;14. El Decreto 12/2023, de 10 de julio, de la presidenta de las Islas Baleares, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares, modificado por el Decreto 16/2023, de 20 de julio, de la presidenta de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;15. El Decreto 43/2023, de 10 de julio, por el que se dispone el nombramiento de los altos cargos y directores generales de las consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares, en el que se nombra al director general del Servicio de Salud de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;16. El Decreto 79/2023, de 22 de septiembre, por el que se establece la estructura orgánica básica del Servicio de Salud de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;17. El resto de disposiciones aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Aceptar la cesión temporal y gratuita de uso de mobiliario de la Asociación Española Contra el Cáncer a favor del Servicio de Salud por un periodo de diez años, destinado al Servicio de Oncología del Hospital Universitario Son Espases.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Notificar esta resolución al cedente y publicarla en el &lt;em&gt;Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
