    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El Pleno del Ayuntamiento de Porreres, en sesión celebrada el 27 de mayo de 2024, aprobó inicialmente la modificación de la Ordenanza municipal n.º 6 reguladora de convivencia, defensa y protección animal al entorno humano.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;De acuerdo con el que establecen los artículos 49 y 70.2, con relación en el artículo 65.2 de la Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local, se sometió la Ordenanza aprobada en un periodo de información pública, mediante la publicación del presente edicto en el BOIB, dando audiencia a los interesados para que en un plazo de treinta días pudieran presentar las reclamaciones y sugerencias que estimaran oportunas, habiéndose presentado y estimado una reclamación que fue resuelta por el Pleno de la Corporación en sesión celebrada el 22 de julio de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Contra la aprobación definitiva de esta ordenanza se puede interponer recurso contencioso-administrativo ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia de las Islas Baleares en el plazo de dos meses contadores desde el día de la presente publicación, de acuerdo con el dispuesto en los artículos 10.1.b y 46.1 de la Ley 29/1998, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;EXPOSICIÓN DE MOTIVOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El Ayuntamiento de Porreres reconoce a los animales como seres dotados de sensibilidad tanto física como psíquica y, por tanto, con capacidad para sufrir física y psíquicamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La presencia de animales de compañía ha aumentado considerablemente en los últimos años en los núcleos urbanos y, concretamente, en el municipio de Porreres. La tenencia de estos animales exige una responsabilidad especial, tanto en lo que se refiere a sus derechos como a los deberes de sus tenedores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Los animales de compañía ayudan a mejorar la calidad de vida de las personas y a fomentar el respeto hacia la naturaleza, y aportan muchos beneficios personales y sociales. Debemos tener presente la responsabilidad que implica la tenencia de animales en casa, y hay que ser conscientes de que debemos facilitarles todo el bienestar que necesitan y velar por evitar molestias para la convivencia ciudadana.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El hecho de integrar a un animal de compañía en un hogar significa que se cuenta con el comportamiento responsable y racional de la persona que se responsabiliza, y que esta persona cumple las obligaciones que ello conlleva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Tener un animal significa aceptar una responsabilidad hacia un ser vivo que dependerá de nosotros durante un largo período de nuestra vida (cuidado, identificación, vacunación, hábitat, educación, salud en general, control de la natalidad, ciudadanía).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La educación en la convivencia con los animales debe partir del principio básico de respeto hacia estos seres vivos con capacidad de sentir y sufrir, y del principio de respeto al entorno y a las personas, compartan éstas o no la misma afinidad por los animales. Esto comporta desarrollar un trabajo de pedagogía social en el que todos estamos implicados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Cabe destacar también que esta normativa regula y limita la cría de perros y gatos por particulares, con el fin de disminuir su número y evitar una proliferación indiscriminada sin ninguna casta de control, ya que en muchas ocasiones, estos animales sufren las consecuencias del abandono.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Por otro lado, hay que tener en cuenta no sólo a los animales llamados de compañía sino, en general, a todos los animales domésticos, salvajes y salvajes en cautividad que viven en nuestro entorno urbano y rural y que merecen un trato y una vida digna.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Esta ordenanza Municipal tendrá como principal referente la Ley 7/2023, de 28 de marzo, de protección de los derechos y bienestar de los animales, además de la ley 1/1992 de 8 de abril de los animales de la Comunidad Autónoma, la Declaración Universal de los Derechos del Animal, proclamada el 15 de octubre de 1978 por la Liga Internacional de los Derechos del Animal y aprobada por la UNESCO y posteriormente por la ONU.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Capítulo I&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px; width: 100%"&gt; &lt;/span&gt;&amp;nbsp;Objeto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 1.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La presente ordenanza se circunscribe al municipio de Porreres y tiene por objeto la protección de los animales y la defensa y vigilancia de sus derechos, así como de los deberes y derechos de sus tenedores y la regulación de la convivencia armónica entre los animales que viven en entorno urbano y rural y las personas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;También es objeto de esta Ordenanza la regulación de las actividades comerciales, industriales, profesionales, asistenciales y de servicios que estén relacionadas, en el marco de las competencias y obligaciones municipales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 2. Definiciones&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;A efectos de esta Ordenanza, se entiende por:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;a) Animales domésticos: los que pertenecen a especies que habitualmente se crían, se reproducen y conviven con personas y que no pertenecen a la fauna salvaje. Tienen también esta consideración los animales que se crían para la producción de carne, de piel o de algún otro producto útil para el ser humano, los animales de carga y los que trabajan en la agricultura.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;b) Animales de compañía: los animales domésticos que las personas mantienen generalmente en el hogar con el fin de darse mutua compañía. A efectos de esta Ordenanza gozarán siempre de esta consideración los perros y gatos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;c) Animales salvajes: los autóctonos y no autóctonos que viven habitualmente en estado salvaje.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;d) Animales salvajes en cautividad: los animales autóctonos y no autóctonos salvajes que, de forma excepcional, viven en cautiverio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;e) Animales exóticos: los animales de compañía, domésticos y salvajes pertenecientes a especies originarias de territorios externos al ámbito geográfico mediterráneo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 3.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La competencia funcional de esta materia queda atribuida al área de medio ambiente y la vigilancia del cumplimiento de la presente Ordenanza en la Policía Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Capítulo II&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px; width: 100%"&gt; &lt;/span&gt;Actividades relacionadas con los animales de compañía y domésticos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 4.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Constituyen actividades comerciales, industriales, profesionales, asistenciales y de servicios sujetos a la presente ordenanza, las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;a) Viveros de animales de compañía&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;b) Guarderías de animales de compañía&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;c) Servicios de acicalamiento&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;d) Consultorías, clínicas y hospitales veterinarios&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;e) Exposiciones, exhibiciones, fiestas y concursos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;f) Centros de adiestramiento&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;g) Refugios y recintos de custodia, municipales o privados de animales, dependientes o no de una asociación para la defensa y protección de los animales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;h) Cementerios de animales&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;i) Granjas o recintos particulares dedicados a la cría de animales domésticos de utilidad para las personas (caballos, asnos, ovejas, gallinas, cerdos, etc.)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;j) Agrupaciones zoológicas o parques para la exhibición de animales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;k) Centros hípicos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 5.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las actividades detalladas en el artículo 4 tendrán que cumplir todas las medidas establecidas sobre licencias de instalaciones iniciales, así como cumplir los requisitos de Núcleo Zoológico, Ley de Bienestar Animal y de otras leyes y reglamentos existentes al respecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Con el fin de controlar y asegurar el cumplimiento de las medidas, estas actividades estarán sujetas a la inspección por parte de la Policía Local. Si del resultado de las inspecciones practicadas se detectasen anomalías, la alcaldía podrá adoptar las resoluciones y sanciones pertinentes. La resolución que en este sentido adopte la alcaldía estará en función del informe efectuado por la Policía, como resultado de la inspección practicada, todo ello sin perjuicio de la incoación del procedimiento sancionador si procede.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 6.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Todos los locales e instalaciones adscritos a las actividades a que se refiere el artículo 4 de la presente ordenanza deben cumplir las condiciones estructurales y de servicios que se adapten, como mínimo, a la normativa de la Ley 7/ 2023, de 28 de marzo, de bienestar animal y en la ley de protección animal de la CAIB 1/1992. Los titulares de las actividades a que se refiere el artículo 4 de la presente tendrán la obligación de mantener a los animales en buenas condiciones higiénicas y sanitarias, realizar cualquier tratamiento preventivo que haya sido declarado obligatorio así como procurarles un trato digno y velar por su bienestar tanto físico como psíquico. Se tendrán que cumplir las obligaciones citadas en los artículos de la mencionada ley de la CAIB, título I (disposiciones generales), artículos 1 al 11.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 7.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Referente al título I, artículos 4 y 5 de la mencionada ley 1/1992 de la CAIB esta ordenanza manifiesta su rechazo a todas las fiestas y exhibiciones que puedan suponer un&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;sufrimiento para los animales. Quedan prohibidos todos estos actos en el término municipal de Porreres. Excepcionalmente, se podrá autorizar, vía acuerdo plenario, la realización de alguna actividad (ejemplo: Tirada de pichones y codorniz) siempre que cuente con informe favorable de la Conselleria de Medio Ambiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Capítulo III&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px; width: 100%"&gt; &lt;/span&gt;De la tenencia y trato de los animales&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 8.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Con carácter general se autoriza la tenencia de animales domésticos y de compañía en las viviendas urbanas, tenencia que queda condicionada a las circunstancias higiénicas óptimas para su alojamiento, a la ausencia de riesgo en el aspecto sanitario y de seguridad y a la inexistencia de molestias graves o continuadas para los vecindarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 9.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La tenencia de un animal de compañía o un animal doméstico comporta una serie de obligaciones ineludibles. Se les debe proporcionar de manera adecuada alimento, agua, alojamiento con condiciones ambientales favorables de espacio, ventilación, humedad, temperatura, luz, cobijo así como los cuidados necesarios para evitar que el animal sufra ningún sufrimiento físico ni psíquico y por satisfacer sus necesidades vitales, higiénicas y sanitarias. Además, debe cumplirse con las obligaciones relativas a la identificación, vacunación y de aseguramiento obligatorios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 10.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;De conformidad con la legislación aplicable, se prohíbe expresamente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1) Maltratar o agredir física o psíquicamente a los animales o someterlos a cualquier tipo de humillación o práctica que pueda causarles sufrimientos o daños.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2) Sacrificar a los animales de compañía de forma no eutanásica. El sacrificio de estos animales sólo podrá ser realizado por un facultativo veterinario y con procedimientos eutanásicos, sin sufrimiento para el animal. Sólo se podrá sacrificar a un animal de compañía en caso de que éste sufra una enfermedad dolorosa e incurable o que presente un comportamiento peligroso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3) Abandonar a cualquier animal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;4) Mantener a los animales en instalaciones inadecuadas desde el punto de vista higiénico y sanitario o inadecuadas para sus características y necesidades fisiológicas y etológicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;5) Usar toda clase de artefactos destinados a limitar o impedir la movilidad de los animales que les produzcan daños o sufrimientos o que les impida mantener la cabeza en posición normal. Se podrán utilizar sólo temporalmente por prescripción facultativa. Queda prohibida, por tanto, la costumbre de atar las patas en el cuello de los animales herbívoros para evitar que depreden las especies vegetales o por cualquier otra finalidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;6) Tener a los animales de compañía atados en terrenos rústicos no habitados. Si por algún motivo justificado, un perro tuviera que permanecer ocasionalmente atado se tendrán que cumplir las disposiciones del artículo 12.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;7) Tener en el pueblo animales que ocasionen problemas a los vecinos, con malos olores o ruidos, como cerdos, ovejas o cabras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;8) Mantener a los animales en estado de aislamiento, sin que la especie o raza lo requiera, sin recibir los cuidados y el contacto social necesarios por parte de sus cuidadores, para satisfacer sus necesidades etológicas, afectivas y de socialización. Por este motivo no pueden tener como alojamiento habitual, los vehículos, patios de luces, balcones, solares, ni cualquier lugar que quede deshabitado la mayor parte del tiempo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;9) Mutilar total o parcialmente orejas, colas, dientes u otras partes u órganos, extirpar uñas o cuerdas vocales. Se exceptúan las intervenciones, controladas por los veterinarios, destinadas a garantizar la salud del animal, a anular su capacidad reproductiva, a identificar los gatos sanados o para mantener las características de la raza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;10) Mantener a los animales en estado de desnutrición o deshidratación sin que la medida obedezca a prescripción facultativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;11) Mantener a los animales sin proporcionarles la atención sanitaria adecuada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;12) El uso de animales en espectáculos, luchas y otras actividades que impliquen el sufrimiento, burla, humillación, degradación y tratamiento antinatural de los animales o que puedan herir la sensibilidad de las personas que las contemplan.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;13) La posesión o tenencia en cautividad de animales salvajes o considerados invasores de nuestros ecosistemas, fuera de los establecimientos zoológicos autorizados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;14) Molestar, capturar o comercializar los animales salvajes urbanos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;15) Adiestrar animales con el fin de reforzar su agresividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;16) La tenencia o comercio de primates y su cesión entre particulares, los centros de cría y suministradores de primates por experimentación y los centros de cría de animales salvajes en cautividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;17) La experimentación con cualquier tipo de animal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;18) Practicar la caza fuera de los espacios denominados coto de caza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;19) Capturar perros y gatos asilvestrados con el uso de armas de fuego.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;20) El transporte de animales con vulneración de los requisitos establecidos en la legislación vigente balear, española o de la Comunidad Europea.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;21) Cualquier otra acción u omisión no mencionada en la presente ordenanza contenida en la Ley de bienestar animal o en la ley 1/1992 de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;22) Depositar en las vías y espacios libres de pública concurrencia cualquier tipo de suministro alimentario (comida y agua) destinado a perros, gatos y otros animales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;23) En caso de fallecimiento de un animal de compañía, no llevar los restos al veterinario o gestor autorizado por su incineración por parte del poseedor del mismo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 11. Alojamiento&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. Si, por motivos justificados, un perro debe permanecer atado o cerrado no podrá hacerlo de forma permanente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. No podrán retenerse en cautividad, como animales domésticos o de compañía los que pertenecen a especies protegidas o en riesgo de extinción, ni aquellos que no puedan adaptarse al cautiverio, bien por sus condiciones naturales, bien por representar un peligro para la salud y seguridad de las personas y de los animales con los que convivan.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3. Aquellas personas que, en la publicación de esta ordenanza, ya tengan en propiedad algún animal salvaje o animal exótico (tortugas, papagayos, iguanas, reptiles, arácnidos, etc…), deberán notificarlo, presentando la documentación en el Ayuntamiento, donde se les dará de alta en el censo municipal, exceptuando aquellos animales que la Ley de bienestar animal prohíba su tenencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;4. Cuando un animal salvaje o exótico no haya sido declarado y censado en el plazo establecido o, se compruebe que no se han adaptado las condiciones de su tenencia, el Ayuntamiento podrá decomisarlo y llevarlo a un núcleo zoológico adecuado dónde quedará en custodia hasta que el propietario adapte su situación a esta ordenanza. Los gastos de custodia y mantenimiento del animal en este centro correrán a cargo del propietario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 12. Circulación&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En la vía y en los espacios públicos incluyendo también las partes comunes de los inmuebles colectivos, en los transportes públicos y en los lugares y en los espacios de uso público en general, los perros deben cumplir los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;a) Estar provistos de la identificación con microchip y documento identificativo (véase el anexo 1)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;b) Tener la cartilla sanitaria al día.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;c) Ir atados por medio de un collar o arnés y una cadena o correa que no ocasionen lesiones al animal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;d) Estar provistos del seguro obligatorio de responsabilidad civil (artículo 30.3 de la ley de bienestar animal). Los conductores de los animales de compañía serán los responsables de los daños que puedan realizar. Por eso, los perros de reconocida peligrosidad según la ley de tenencia de animales peligrosos, tendrán que llevar un bozal adecuadamente colocado, una correa de una longitud máxima de 1,5 m y podrán circular por la calle un animal por persona, además de disponer del seguro obligatorio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El uso de este morral podrá ser ordenado por alcaldía cuando un perro en concreto sea un peligro público. También podrá ordenarse el uso de morral en todos los perros si así lo aconsejan las circunstancias sanitarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Queda prohibida la presencia de perros y animales domésticos en las zonas destinadas a juegos infantiles y allí donde el Ayuntamiento por causas extraordinarias lo estime oportuno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Queda prohibido lavar en la calle a los animales de compañía, así como dejarles beber agua directamente de la boca de fuentes o bebedores públicos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Queda prohibida la circulación por las vías y espacios públicos o privados, de concurrencia pública, de animales de especies salvajes, incluso domesticados, sin excepción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Queda prohibida la entrada de animales de compañía en locales destinados a la fabricación, venta, almacenamiento, transporte o manipulación de alimentos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Los perros lazarillos podrán circular libremente en los transportes públicos urbanos, siempre que vayan acompañados de su dueño y cumplan las condiciones higiene-sociosanitarias y de seguridad que prevén las ordenanzas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 13.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Queda prohibido el abandono de heces que puedan producir los perros, gatos y otros animales en las vías y espacios libres públicos o privados de pública concurrencia. Los propietarios o portadores de los animales están obligados, bajo su responsabilidad, a la inmediata recogida de las heces que puedan producirse mediante la utilización de artilugios o envoltorios que permitan recogerlos y guardarlos de forma hermética, y a depositarlos de forma higiénicamente aceptable en los contenedores o recipientes de residuos sólidos urbanos. Estos envoltorios los tendrán que llevar los portadores de los animales, y la Policía Local podrá comprobar en todo momento si se cumple con esta obligación, siendo motivo de sanción el pasear a un animal sin contar con los mismos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Queda prohibido, bajo responsabilidad del conductor del animal doméstico, permitir que haga micciones en las fachadas, puertas, vallas y tanques de edificios y mobiliario urbano. Los propietarios de perros tendrán que llevar un recipiente con agua y echarlo a la micción, para evitar la degradación del patrimonio y de los bienes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En caso de que se produzca la infracción de esta norma, los agentes de la autoridad podrán requerir al propietario o a la persona que conduzca el animal que retire las deposiciones; de no hacerlo, los agentes podrán imponer la sanción pertinente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Capítulo V&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px; width: 100%"&gt; &lt;/span&gt;&amp;nbsp;De los animales vagabundos y abandonados&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 14.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Queda prohibido el abandono de animales, tanto en el medio natural como en los núcleos urbanos. Los propietarios de los animales que no quieran seguir teniéndolos están obligados a buscar por ellos un hogar donde estén bien tratados o, en último término, darlos a una asociación protectora de animales legalmente reconocida, en el servicio municipal encargado de su acogida o a la entidad que tenga delegado el servicio, pagando las correspondientes tasas, en su caso. Se exceptúa el siguiente caso:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La liberación de especies autóctonas en el medio natural, siempre y cuando se haga con conocimiento y autorización de la Alcaldía, mediante un informe favorable de la Consejería de Medio Ambiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 15.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Se considerará que un animal está perdido cuando se encuentra en la vía pública y no vaya acompañado por ninguna persona, pero se pueda identificar a su propietario, ya sea por medio de microchip, medalla o placa. El ayuntamiento recogerá a este animal y le comunicará al propietario la obligatoriedad de recogerlo. El ayuntamiento quedará en custodia del animal durante un tiempo prudencial por la rápida recuperación del propietario., después será cedido a la entidad delegada del servicio, donde se continuarán las gestiones por la recuperación del animal por parte del propietario. Si después de las comunicaciones pertinentes, el propietario no quisiera recuperar su animal, podrá ser sancionado por abandono y el animal podrá ponerse en adopción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Se considera un animal vagabundo, cuando se encuentra en la vía pública y no vaya acompañado por ninguna persona, no lleve microchip ni identificación alguna de su origen o de su propietario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 16.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Los animales vagabundos serán delegados a la entidad de servicio de acogida, mantenimiento y gestión, desde donde se promocionará el hallazgo por la recuperación por parte del posible propietario y donde cumplirán su período legal de espera que marcan la Ley de Bienestar Animal y la Ley 1/1992 de protección animal de la CAIB. Una vez transcurrido este plazo sin que el propietario haya comparecido, el animal se considerará legalmente abandonado y podrá ser dado en adopción a un particular, una vez vacunado, identificado con microchip o en acogida a alguna asociación protectora de animales legalmente constituida. Si finalmente se hace cargo del animal una entidad protectora sin ánimo de lucro, estos gastos correrán a cargo del Ayuntamiento o según estipule el convenio firmado por ambas entidades, previa autorización del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Si el animal no lleva ningún sistema identificativo y es reclamado por su propietario, éste deberá demostrar que el animal es suyo, mediante una fotografía o documento que lo demuestre y deberá identificar al animal obligatoriamente con micro chip.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El propietario deberá abonar los gastos originados por su mantenimiento en la entidad de servicio de acogida, además de presentar la cartilla sanitaria con las vacunas al día y el seguro obligatorio. Si no la tuviera o no estás actualizada, estará en la obligación de darla de alta o ajustarla a la legislación vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Si al cabo de dos días del encuentro del animal hubiera sido imposible localizar al propietario, el Ayuntamiento utilizará todos los medios a su alcance para difundir la fotografía y la descripción del animal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Si se trata de animales salvajes o exóticos, domesticados o no, serán derivados a entidades protectoras específicas de recuperación de especies, pero, en ningún caso, ofrecidos en adopción a particulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;No está permitida la tenencia de especies protegidas, en vías de extinción, prohibidas o peligrosas declaradas por normativa, sin la pertinente autorización y/o licencia emitida por la autoridad competente. Si el propietario no justifica su tenencia autorizada, el animal no será devuelto y será gestionado en instalaciones adecuadas a la naturaleza de la especie.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las actuaciones sanitarias que fueran necesarias durante el tiempo de permanencia en el recinto municipal se realizarán siempre bajo control veterinario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;No se sacrificará ningún animal siempre que no sufra una enfermedad grave, dolorosa e incurable, y nunca sin prescripción de un veterinario, se gestionarán respetando los plazos que marca la Ley 7/2023 y la Ley 1/1992. Aunque el Ayuntamiento y la Policía Local tiene potestad de solicitar a la entidad o profesional, el sacrificio de emergencia de un animal por causas de Seguridad Ciudadana ponga en peligro a terceras personas o a otros animales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 17.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Los animales, en general, y particularmente los perros, calificados como vagabundos serán recogidos por los servicios que dependan del Ayuntamiento o por la asociación o entidad que el Ayuntamiento designe y conducidos al recinto municipal que se hará cargo o retendrá hasta que éste sea reclamado por el propietario, cedido o adoptado. Durante la estancia de los animales recogidos por los servicios municipales en sus dependencias éstos recibirán un trato digno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La Policía Local o el Ayuntamiento se encargará de informar a través de las redes sociales a la población sobre los animales hallados y custodiados en sus dependencias. Los animales serán custodiados durante un máximo de 24 horas, antes de ser entregados a la entidad colaboradora en caso de no ser recogidos o reclamados. Por eso tendrá la obligación de informar, divulgar y fomentar la responsabilidad y la adopción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 18.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El Ayuntamiento se encargará de entregar (lo antes posible) los animales que haya encontrado abandonados (siempre y cuando no se pueda localizar al propietario) a la entidad colaboradora con quien tenga firmado un convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En líneas generales, se podrán ceder a los animales a centros, refugios o sociedades protectoras y de defensa animal legalmente constituidas que procuren un trato digno al animal, que no los sacrifiquen y fomenten su adopción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El Ayuntamiento o la entidad colaboradora con quien tenga convenio firmado decidirá a quién y en qué términos dar en adopción a los animales. En el momento de dar al animal el nuevo propietario deberá abonar los gastos de vacunación, desparasitación, cartilla sanitaria, castración, identificación del animal y contratar el seguro obligatorio de responsabilidad civil.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En todos los casos se exigirá un trato digno y el cumplimiento exhaustivo de la ordenanza municipal (alojamiento, cuidados sanitarios, vacunas, identificación, inscripción censal, control de la natalidad, educación, responsabilidad y ciudadanía), firmando un contrato de adopción, que será automáticamente definitiva al cabo de un mes de tenencia del animal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El Ayuntamiento o la entidad colaboradora con quien tenga convenio firmado, podrán realizar tareas de inspección para comprobar el cumplimiento de estos compromisos y retirar al animal en caso de incumplimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El Ayuntamiento debe colaborar en la promoción y la divulgación de las vacunaciones y/o los tratamientos obligatorios, al mismo tiempo que vigila el cumplimiento de lo que ordena.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 20.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Los poseedores de perros, gatos y otros animales domésticos estarán obligados a vacunarlos y realizar los tratamientos contra aquellas enfermedades objeto de prevención. Entre estas vacunas obligatorias se incluye la vacunación antirrábica, con carácter anual.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Cada propietario deberá disponer de la correspondiente cartilla sanitaria, en la que se especificarán las características del animal, su estado sanitario y los datos necesarios sobre la identidad del propietario. También deberá disponer del seguro obligatorio por responsabilidad civil, previsto en el artículo 30.3 de la Ley de bienestar animal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Capítulo VII&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px; width: 100%"&gt; &lt;/span&gt;Censo municipal&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 21.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Los veterinarios de la administración pública, las clínicas y los consultorios veterinarios deben tener un archivo con la ficha técnica clínica de los animales objeto de vacunación o de tratamiento obligatorio, la cual debe estar a disposición de la autoridad competente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Los veterinarios están obligados a comunicar cualquier enfermedad transmisible del animal al Área de Medio Ambiente del Ayuntamiento de Porreres y otras Administraciones competentes, para que, independientemente de las medidas zoo sanitarias individuales, se pongan en marcha las correspondientes medidas higiénicas y sanitarias de protección cívil.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Si es necesario sacrificar al animal, deberá realizarse bajo el control y la responsabilidad de un veterinario y utilizar métodos que impliquen el mínimo sufrimiento y que le provoquen una pérdida de conciencia inmediata.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 22.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Los propietarios de perros tendrán que disponer del documento identificativo de la mascota (ver anexo I), donde constará el nombre del animal, el nombre del propietario, el núm. de chip, identificar si se trata de un animal PPT, el nº. de tarjeta, así como la fecha de expedición y su vigencia. Los documentos identificativos serán expedidos en las oficinas municipales y la policía local podrá requerir a los propietarios la identificación de las mascotas en cualquier momento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 23.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Los propietarios de los animales de compañía que hayan agredido y lesionado alguna&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;persona están obligados a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. Facilitar los datos del animal agresor, de su seguro obligatorio, y los propios a la persona agredida, a sus representantes legales y a las autoridades competentes que lo soliciten.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. Comunicarlo al Área de Medio Ambiente del Ayuntamiento en un plazo máximo de 24 horas después de los hechos y ponerse a disposición de las autoridades municipales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3. Someter al animal agresor a observación veterinaria obligatoria, que deberá realizarse en el mismo domicilio del propietario del animal si las condiciones de infraestructuras lo permiten o en las instalaciones municipales, y seguir las disposiciones que determine el veterinario .&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;4. Presentar, en el Área de Medio Ambiente o donde ésta determine, la documentación sanitaria del animal y el certificado veterinario de la observación veterinaria en un plazo no superior a las 48 horas de haberse producido la lesión y no superior a los 14 días de haberse iniciado la observación veterinaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;5. Comunicar al Área de Medio Ambiente del Ayuntamiento cualquier incidencia que se produzca (muerte del animal, robo, pérdida, desaparición, traslado, etc.) durante el período de observación veterinaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;6. Cuando las circunstancias lo aconsejen y la autoridad sanitaria municipal lo considere necesario, se podrá obligar a recluir al animal agresor para someterlo al período de observación veterinaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Si el animal tiene propietario conocido, los gastos de mantenimiento irán a su cargo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Si el propietario del animal agresor carece de la documentación adecuada, se podrá iniciar el correspondiente expediente sancionador.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 24.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Los propietarios de perros y gatos deben censar a los animales en el correspondiente censo municipal. La inscripción en el censo municipal se realizará a través de las oficinas municipales. Los documentos necesarios son el pasaporte con núm. de microchip del animal y DNI del propietario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 25.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las personas que transfieran la propiedad de un animal o que cambien de dirección o de población están obligados a comunicar este hecho y los datos del nuevo propietario y la nueva dirección en el censo municipal en un plazo no superior a 15 días.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 26.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La identificación de los animales de compañía debe realizarse obligatoriamente, mediante la implantación del microchip, que se adaptará en todo caso a la normativa de la Unión Europea&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Del mismo modo, todos los caballos del municipio tendrán que tener este sistema de identificación de microchip.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El microchip consta de un código alfa-numérico que permite, en todo caso, identificar al animal y garantizar la no duplicidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El microchip debe implantarse en el lado izquierdo del cuello del animal. En caso de que por una circunstancia justificada no sea posible su implantación en el lado izquierdo del cuello del animal, deberá implantarse en la zona de la cruz, entre los dos hombros y se hará constar expresamente en el documento acreditativo .&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La implantación del microchip debe realizarla un facultativo veterinario en condiciones de asepsia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La persona o entidad responsable del marcado del animal debe entregar al propietario del animal el documento acreditativo de este hecho donde deben constar, al menos, los siguientes datos: el sistema de identificación utilizado, los datos de la persona o entidad que realiza este marcado, especie animal y raza, sexo y fecha de nacimiento del animal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En cualquier transacción del animal de compañía, deberá entregarse al nuevo propietario del animal el documento acreditativo de su identificación y asegurar el cambio de los datos que sea pertinente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 27.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En el momento del registro en el correspondiente censo municipal se entregará al propietario la tarjeta censal municipal, la cual deberá renovarse periódicamente con carácter anual (según vigencia) (o notificar su fallecimiento).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Capítulo VIII&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px; width: 100%"&gt; &lt;/span&gt;Sacrificio de animales y recogida de los animales heridos, sus cadáveres y restos.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El sacrificio de animales de compañía, a todos los efectos, sólo podrá ser efectuado por un facultativo veterinario por procedimientos eutanásicos que aseguren la previa sedación y anestesia del animal para evitar su sufrimiento físico y psíquico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Queda totalmente prohibido todo procedimiento que ocasione la muerte de cualquier otra forma (envenenamiento, armas de fuego, etc...).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Capítulo IX&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px; width: 100%"&gt; &lt;/span&gt;Vigilancia e inspección&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El Ayuntamiento es el responsable de la retirada de los animales muertos en las vías públicas. Esta recogida se efectuará de forma que impida la contaminación del personal afecto al servicio y, en todo caso, en bolsas o recipientes precintados. Los restos y cadáveres serán eliminados mediante los servicios del Centro Sanitario Municipal de Son Reus (Palma), de acuerdo con la legislación vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Quienes tuvieran conocimiento de la existencia de un cadáver o restos de animales en los espacios públicos o privados, de concurrencia pública, deberán comunicarlo a las oficinas municipales, facilitando los datos necesarios para su localización y recogida, de forma inmediata.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 30.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El Ayuntamiento es el responsable de la retirada de animales heridos o enfermos en los espacios públicos o privados, de concurrencia pública en las mejores condiciones posibles de transporte y trato y derivados a un centro veterinario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Un facultativo veterinario decidirá las actuaciones pertinentes: curarle o sacrificarle, si no queda otra opción para evitar su sufrimiento y agonía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Los animales heridos o enfermos pasarán a ser tutelados por el Ayuntamiento o asociación con quien tenga convenio firmado, para difundir su recogida e intentar encontrar al propietario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Si no se puede encontrar al propietario del animal éste quedará sujeto a lo que se desarrolla en el capítulo V de esta ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Capítulo IX&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px; width: 100%"&gt; &lt;/span&gt;Vigilancia e inspección&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 31.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Albergar a estos animales, siempre dentro del término municipal de Porreres, durante los períodos de tiempo mínimos establecidos en la presente y de acuerdo con la infraestructura y condiciones detalladas en el capítulo III de esta ordenanza. Si las instalaciones no están en condiciones o llenas se podrán derivar a otros lugares donde exista convenio de colaboración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 32.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;A efectos de esta ordenanza, tendrán la consideración de asociaciones para la protección y defensa de los animales aquellas que estén legalmente constituidas, inscritas en el Registro Oficial de la Consejería que tenga atribuidas las competencias, sin ánimo de lucro y tengan como finalidad la protección y defensa de los animales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Capítulo X&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px; width: 100%"&gt; &lt;/span&gt;Infracciones y sanciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 33.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Serán infracciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;a) No recoger o abandonar heces en las vías y espacios libres públicos o privados de concurrencia pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;b) No limpiar las micciones con agua.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;c) No llevar la tarjeta censal del animal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;d) La posesión de un perro no censado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;e) Incumplir cualquier norma o prescripción señalada en esta Ordenanza que no se encuentre contemplada en una norma de rango superior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;f) La circulación por la vía pública y propiedades privadas ajenas al propietario sin su autorización, de perros que no vayan acompañados y conducidos por una persona y bajo su responsabilidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 34.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las infracciones cometidas contra los preceptos de la presente ordenanza, serán sancionadas de la siguiente manera, sin prejuicio de las infracciones y sanciones que contempla la Ley 7/2023 de Bienestar animal y la Ley 1/1992, de 8 de abril, de la CAIB:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;a) Las infracciones serán sancionadas con multa de 60 a 500 euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;b) Adicionalmente, si ha sido necesaria la recogida del animal por parte de los servicios municipales, el infractor deberá abonar 30 euros en concepto de gastos de recogida y mantenimiento. En caso de que el animal haya recibido servicios veterinarios o de otro tipo, éstos se abonarán aparte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 35.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Los establecimientos que cometan infracciones de forma reiterada podrán ser objeto del cierre temporal o definitivo según las leyes y normativas vigentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 36.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La imposición de sanciones corresponderá a Alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 37.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las conductas susceptibles de sanción administrativa, una vez tipificada, y si son objeto de sanción o multa, se graduarán según los siguientes criterios:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;a) La trascendencia social y el prejuicio causado por la infracción cometida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;b) El ánimo de lucro ilícito y la cuantía del beneficio obtenido en la comisión de la infracción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;c) La reiteración. Habrá reiteración cuando existan dos resoluciones firmes por hechos de la misma naturaleza en el período de dos años, o tres de distinta naturaleza en el mismo período.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 38.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La imposición de cualquier sanción prevista por la presente ordenanza no excluye la responsabilidad civil y penal y la eventual indemnización de los males y prejuicios que puedan corresponderle al infractor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 39.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Para imponer las sanciones previstas por la presente ordenanza así como por la Ley de protección de los animales 1/92 de 8 de abril de la CAIB será necesario seguir el procedimiento sancionador regulado por la Ley de Procedimiento administrativo y por el Decreto 14/1994 de 10 de febrero de la administración de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Artículo 40.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La administración local podrá retirar a los animales siempre que existan indicios de infracción de las disposiciones de la presente ordenanza con carácter preventivo, mientras no se resuelva el expediente sancionador que corresponda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;DISPOSICIONES FINALES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Primera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Todo lo que no se prevé en la presente ordenanza se ajustará a lo dispuesto en la Ley 7/2023, de 28 de marzo de protección de los derechos y bienestar de los animales, la Ley 1/1992 de 8 de abril de la CAIB y en su reglamento así como a toda legislación y normativa de rango superior existentes y las que puedan legislarse posteriormente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Segunda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Quedan derogadas cuantas normas municipales de igual o de inferior rango se opongan a la presente ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Tercera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;De acuerdo con el artículo 102 de la Ley 20/2006, Municipal y de Régimen Local de las Illes Balears y el artículo 70.2 de la Ley 7/85 de 2 de abril, reguladora de las bases del régimen local, esta Ordenanza entrará en vigor, una vez sea aprobada definitivamente por la corporación a partir de la fecha en que se publique su texto íntegro en el Boletín Oficial de la Comunidad Autónoma de las Illes Balears (BOIB) y siempre que haya transcurrido el plazo previsto en el artículo 65.2 de la ley reguladora de las bases del régimen local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;]]</env:contingut>
