    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Antecedentes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;1. La Ley 10/2022, de 23 de diciembre, de ocio educativo para niños y jóvenes de las Illes Balears, establece que corresponde a los consejos insulares velar por que se garantice el derecho al ocio, prestado en las condiciones de calidad y de seguridad exigidas en esta ley y en las disposiciones de desarrollo, en su territorio (art. 6.2 b) y también llevar a cabo la actividad de fomento en materia de ocio en el ámbito insular (art. 6.2 f).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;2. El derecho y la obligación de los poderes públicos de tomar medidas para facilitar la corresponsabilidad y conciliación en la vida laboral, familiar y personal están recogidos en la Constitución española (art. 9.2); el Estatuto de autonomía (art. 17.2); la Ley orgánica 3/2007, de 22 de marzo, por la igualdad efectiva entre hombres y mujeres; la Ley 11/2016, de 28 de julio, de igualdad de mujeres y hombres (título IV, cap. 5), y el Plan de Conciliación y Corresponsabilidad de las Illes Balears 2021-2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Uno de los ámbitos en los que debe implementarse la responsabilidad del Consejo Insular de Menorca para promover la corresponsabilidad y conciliación es en el de la juventud y el ocio, dadas las competencias que asumió mediante la Ley 21/2006, de 15 de diciembre, de atribución de competencias a los consejos de Menorca y de Eivissa y Formentera en materia de juventud y ocio y ejerce en la actualidad de acuerdo con la Ley 5/2022, de 8 de julio, de políticas de juventud de las Illes Balears, y la Ley 10/2022, de 23 de diciembre, de ocio educativo para niños y jóvenes de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;3. El Consejo Insular de Menorca tiene capacidad para financiar los compromisos que se detallan en la convocatoria y así está previsto en el presupuesto 2023 prorrogado en 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Si bien el Plan Estratégico de Subvenciones del año 2024 no tiene en cuenta estas ayudas, el presupuesto del Consejo Insular de 2023 prorrogado para el año 2024 prevé en el programa 33450, en el Departamento de Cultura, Educación, Juventud y Deportes, la línea de ayudas a las familias para financiar la participación en las actividades de educación en el tiempo libre infantil y juvenil; así como crédito adecuado y suficiente para atender a quienes se concedan; además, en el momento actual se considera necesario emprender esta actividad de fomento para el interés social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Por todo lo expuesto, y de conformidad con la normativa básica aplicable al Consejo Insular de Menorca en materia de subvenciones, en el marco de lo que establecen las bases de ejecución del presupuesto de esta administración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;El artículo 17 y 17.3 de la Ley 4/2022, de 28 de junio, de consejos insulares, atribuye al Pleno, entre otras atribuciones, aprobar las bases reguladoras de las subvenciones, atribución que puede delegar en favor del presidente, del Consejo Ejecutivo o de las comisiones reguladas en el artículo 18.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;El Acuerdo del Pleno del Consejo Insular de Menorca de carácter extraordinario de 31 de julio de 2023 (BOIB núm. 109 de 5/08/2023) delega en el Consejo Ejecutivo la aprobación del Plan Estratégico y las bases reguladoras de las subvenciones, en el marco de lo que establecen las bases reguladoras del presupuesto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;El artículo 28.1 y 28.2 de la Ley de consejos insulares atribuye al Consejo Ejecutivo, entre otras atribuciones, aprobar las convocatorias de ayudas y subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Dada la propuesta del consejero ejecutivo del Departamento de Cultura, Educación, Juventud y Deportes, en ejercicio de las competencias atribuidas por el artículo 33 de la Ley 4/2022, de 28 de junio, de consejos insulares, en relación con el Decreto de presidencia núm. 91/2023, de 10 de julio, de creación de los departamentos (BOIB núm. 95 de 11 de julio de 2023);&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;El Consejo Ejecutivo, por unanimidad y en votación ordinaria, adopta los siguientes acuerdos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Primero.&lt;/strong&gt; Aprobar las bases que rigen la concesión de ayudas del Consejo Insular de Menorca a las familias para financiar la participación de menores de edad en las actividades de ocio educativo, que se transcriben en el anexo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Segundo.&lt;/strong&gt; Aprobar simultáneamente la convocatoria correspondiente al año 2024 de las ayudas del Consejo Insular de Menorca a las familias para financiar la participación de menores de edad en las actividades de ocio educativo, con las siguientes condiciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;a)&lt;/em&gt; Importe global máximo de las ayudas y crédito presupuestario. Las ayudas concedidas serán atendidas con cargo a las partidas presupuestarias y con los importes máximos que se indican más abajo, sin perjuicio de que los importes puedan ser ampliados de acuerdo a las disponibilidades presupuestarias:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;b)&lt;/em&gt; El importe máximo que puede concederse, siempre que haya crédito suficiente para esta convocatoria, es de 300 € por cada menor de edad beneficiario que participe en una o más actividades de ocio educativo en Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;c)&lt;/em&gt; El plazo de presentación de solicitudes empezará el 1 de septiembre de 2024 y finalizará el 30 de septiembre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;d)&lt;/em&gt; La composición de la comisión evaluadora será la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Tercero.&lt;/strong&gt; Remitir a la Base de Datos Nacional de Subvenciones información sobre esta convocatoria en los términos establecidos en el artículo 20.8 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, de forma previa a la publicación en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt; (BOIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Cuarto.&lt;/strong&gt; Las sucesivas publicaciones del procedimiento de concesión deben llevarse a cabo en la sede electrónica del Consejo Insular de Menorca, en el tablón de anuncios de la página web oficial (http://www.cime.es), con los efectos previstos en el artículo 45.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y la resolución finalizadora debe publicarse, además, en el &lt;em&gt;Boletín Oficial de las Illes Balears a &lt;/em&gt;efectos de notificaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Primera. Objeto de las ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;El objeto de las ayudas es la prestación de ayudas para los gastos derivados de la participación de niños y jóvenes en actividades de ocio educativo infantil y juvenil en 2024 en Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Segunda. Finalidad&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;La finalidad de estas ayudas es facilitar la participación en las actividades de educación en el ocio educativo infantil y juvenil de niños y niñas con rentas más bajas para favorecer la integración social de los colectivos más vulnerables, el aprendizaje en valores y las relaciones entre las personas participantes, en ejecución de un proyecto educativo y con la participación de jóvenes referentes preparados para esta labor socioeducativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;También persiguen estas ayudas la voluntad de facilitar la conciliación de la vida personal, familiar y laboral, promoviendo la igualdad de oportunidades en el acceso y la permanencia en el empleo de mujeres y hombres, y superar obstáculos que pueden dificultar las responsabilidades en el ámbito familiar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Las subvenciones otorgadas en el marco de esta convocatoria no se consideran ayudas de estado, de acuerdo con el artículo 107.1 del Tratado de funcionamiento de la UE, dado que los destinatarios no son empresas sino personas físicas en la calidad de padres, madres o tutores y, en consecuencia, no entran en el ámbito de aplicación de dicho precepto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Tercera. Financiación e importe máximo&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Las ayudas que se otorguen en el marco de estas bases deben pagarse con cargo a las partidas presupuestarias que se establezcan en la convocatoria y por los importes máximos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;- 300 € por cada menor de edad que participe en una o más actividades de ocio educativo en Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Cuarta. Actividades subvencionables: requisitos y condiciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Son ayudas para el abono de parte de los gastos para participar en actividades de educación en el ocio educativo infantil y juvenil que cumplan los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;1º. Estar reguladas por la normativa vigente que regula las actividades de ocio educativo infantil y juvenil en las Illes Balears, que actualmente es el Decreto 23/2018, de 6 de julio, por el que se despliegan diversos aspectos de la normativa de juventud y de ocio. De acuerdo con el artículo 37.4 del Decreto 23/2018, estas actividades son en concreto:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;a) Acampada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;b) Campo de trabajo, de voluntariado o de aprendizaje.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;c) Escuela de verano o de vacaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;d) Colonia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;e) Estancia, casal, campus y otras actividades de carácter deportivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;f) Actividades en una granja escuela.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;g) Actividades en un aula de naturaleza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;h) Marcha por etapas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;I) Actividades en centros infantiles o juveniles de ocio educativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;j) Actividades de educación en el ocio educativo infantil y juvenil de carácter mixto: que incluyan actividades de tipo académico y otras propiamente de ocio educativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;k) Actividades extraordinarias de aventura o de deportes de riesgo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;l) Cualquier otra actividad asimilable, cualquiera que sea su denominación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;2º. La actividad de ocio educativo debe tener lugar en Menorca entre el 26 de diciembre de 2023 y el 15 de septiembre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;3º. Sólo se subvencionará la participación en las actividades de ocio educativo que las personas o entidades organizadoras hayan declarado ante el Consejo Insular en la forma prevista en la normativa vigente en materia de actividades de ocio educativo infantil y juvenil en las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Quinta. Naturaleza de la ayuda. Compatibilidad con otras ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Las subvenciones que se rigen por estas bases son de carácter voluntario y eventual, pudiendo anularse, revocarse y reintegrarse en cada momento por las causas previstas en la ley o en estas bases; no generan ningún derecho a la obtención de otras subvenciones en años posteriores y no pueden alegarse como precedente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Estas ayudas son compatibles con otras ayudas, subvenciones, ingresos o recursos para llevar a cabo la misma actividad que se puedan recibir de otras administraciones o entidades, sin perjuicio de la obligación de las personas beneficiarias de comunicarlo de la forma establecida en estas bases, siempre que su cómputo no supere el importe total de la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Sexta. Requisitos de las personas beneficiarias&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;1. Pueden ser beneficiarias de las ayudas las personas físicas mayores de edad que cumplan los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;a)&lt;/em&gt; Tener residencia legal en algún municipio de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;b)&lt;/em&gt; Tener la consideración de unidad familiar para tener a su cargo en calidad de progenitor/a, tutor/a o un vínculo de acogimiento permanente a niños y jóvenes que cumplan el año de la convocatoria entre 3 y 17 años, ambos incluidos, que participen en actividades de ocio educativo y que convivan en el mismo domicilio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;c)&lt;/em&gt; Haber obtenido durante el ejercicio 2023 unos ingresos brutos anuales que, conjuntamente, no superen los siguientes umbrales:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Estos umbrales corresponden al siguiente cálculo: IPREM 2023 14 pagas (8.400 €)*3 = 25.200 €, con un aumento de 8.400 € por el resto de miembros de la unidad familiar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Para calcular la renta se suman las casillas 435 y 460 del modelo 100 de la declaración del impuesto sobre la renta de las personas físicas (IRPF) de 2023 que son las cuantías de la base imponible general y del gasto reguladas correspondiente a la declaración o declaraciones presentadas por la persona física solicitante y por cada uno de los miembros computables de la unidad familiar, de conformidad con la normativa reguladora del impuesto sobre la renta de las personas físicas. De este resultado se resta la cuota resultante de la autoliquidación (casilla 595).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Es decir: &lt;strong&gt;(casilla 435 + casilla 460) - casilla 595&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;En caso de no estar obligados y no haber hecho la declaración del IRPF, se tendrán en cuenta las imputaciones de la renta y rendimientos que constan en la Agencia Estatal de la Administración Tributaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Miembros de la unidad familiar&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;1. Se consideran miembros computables de la unidad familiar:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;- El padre, la madre o tutores/as.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;- El menor de edad que participa en la actividad de educación en el tiempo libre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;- Los hermanos y hermanas que convivan en el mismo domicilio y no hayan cumplido los 18 años día 31 de diciembre del año anterior a la presente convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;- Los hermanos y hermanas mayores de 18 años a día 31 de diciembre del año anterior que cumplan los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;a) Convivir en el domicilio familiar (se incluye a los que residan fuera de la isla durante el curso escolar por estudios).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;b) Tener unos ingresos económicos inferiores a los indicados en la base sexta de estas ayudas, que toman por referencia el IPREM 2023 anual (14 pagas).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;En caso de divorcio, separación legal o de hecho de los padres, sólo se considera miembro computable el que tenga la custodia del/de la menor solicitante. Si el padre/madre que no convive con el/la menor solicitante pasara una pensión compensatoria o por manutención del hijo/a también debe acreditarse mediante sentencia de divorcio o declaración jurada, y se tendrá en cuenta a la hora de calcular la renta familiar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Cuando el régimen de custodia de los hijos sea compartida, se considerarán miembros computables el padre y la madre del/de la solicitante de la ayuda, y sus hijos comunes que justifiquen su residencia en cualquiera de los domicilios de los anteriores con el certificado municipal correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;2. En cualquier caso, no pueden ser beneficiarias:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;a)&lt;/em&gt; Las personas físicas o jurídicas en las que concurra alguna de las prohibiciones establecidas en el art. 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, y en el art.10 del Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;b)&lt;/em&gt; Las personas físicas o jurídicas que, en el momento de dictarse la propuesta de resolución definitiva de la convocatoria, por parte del órgano instructor, no estén al corriente en el cumplimiento de sus obligaciones tributarias y con la Seguridad Social ante la Administración General del Estado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;c)&lt;/em&gt; De conformidad con lo que dispone el artículo 27 de la Ley 12/2006, de 20 de septiembre, para la mujer, tampoco pueden ser beneficiarias de las subvenciones previstas en estas bases, las personas físicas o jurídicas sancionadas o condenadas por resolución administrativa o sentencia judicial firmes por discriminación salarial, acoso moral o cualquier tipo de trato desigual, por razón de sexo, en el ámbito de las relaciones laborales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;d)&lt;/em&gt; Tampoco pueden ser beneficiarias de las subvenciones que regulan estas bases las personas o entidades en las que se dé alguna de las circunstancias recogidas en el artículo 11 de la Ley 11/2016, de 28 de julio, de igualdad de mujeres y hombres, ni las que hayan sido sancionadas mediante resolución firme con la pérdida de la posibilidad de obtener una subvención, de acuerdo con la Ley 87/2016, de 30 de mayo, para garantizar los derechos de lesbianas, gays, trans, bisexuales e intersexuales y erradicar la LGTBI-fobia, o cualquier otra aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Séptima. Presentación de las solicitudes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;1. Las solicitudes deben presentarse formalizadas mediante el modelo normalizado que se adjunta como anexo 1 de estas bases y que se encuentra en la sede electrónica &lt;em&gt;https://seuelectronica.cime.es.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;2. Documentación a presentar con la solicitud:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;De acuerdo con el artículo 28.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común a las administraciones públicas, con la disposición adicional octava de la Ley orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de los derechos digitales, y con la 95.1 letra k de la Ley 58/2003, de 17 de diciembre, general tributaria, el Consejo Insular de Menorca podrá verificar la exactitud de los datos declarados. También podrá consultar o recabar los documentos elaborados por cualquier Administración de forma electrónica mediante sus redes corporativas o consulta a las plataformas de intermediación de datos u otros sistemas electrónicos habilitados al efecto, siempre que no conste en el expediente la oposición expresa en la citada consulta o cuando la ley especial que sea aplicable al caso requiera su consentimiento expreso, en este último caso será obligatorio que la Administración lo requiera y que el interesado lo preste.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;A) Documentación administrativa general&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;a) Copia del documento de identificación fiscal (NIF/DNI/NIE/CIF), tan sólo en caso de que se oponga a la consulta por parte del CIM.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;b) Acreditación de la representación si la solicitud se presenta en nombre de otro (anexo 4).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;c) Declaración responsable firmada por el solicitante o por su representante legal de no estar incurso en ninguna de las circunstancias que determinan la imposibilidad de obtener la condición de beneficiario o entidad colaboradora de las subvenciones públicas recogidas en el art. 13.2 de la Ley 38/2003, de 17 de noviembre, general de subvenciones (BOE núm. 276 de 18 de noviembre de 2003) y en los apartados 1 y 2 del artículo 10 del Texto refundido de la Ley de subvenciones, aprobado por medio del Decreto legislativo 2/2005, de 28 de diciembre, y otras leyes que resulten de aplicación (anexo 1, punto 7).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;d) Declaración responsable firmada por el solicitante o por su representante legal relativa a las subvenciones o ayudas obtenidas y/o solicitadas de otras instituciones públicas o privadas para realizar la misma actividad (anexo 1).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;e) Documento de designación de cuenta bancaria según modelo facilitado por el Consejo Insular de Menorca, salvo que ya consten en la Tesorería General del CIM, lo que debe hacerse constar expresamente en la solicitud (anexo 2).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;f) En caso de no autorizar al Consejo Insular de Menorca a comprobar el cumplimiento de las obligaciones tributarias de acuerdo con lo que establece el artículo 28.2 de la Ley 39/2015, del procedimiento administrativo común a las administraciones públicas, y en el artículo 95.1 letra k de la Ley 58/2003, general tributaria, la persona interesada deberá aportar un certificado en el que conste que está al corriente de las obligaciones tributarias; con la Seguridad Social frente a la Administración del Estado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Se exime de presentar la documentación a que se refieren las letras a, b y e en caso de que ésta ya conste en los archivos del Consejo Insular. En este caso debe hacerse constar expresamente en la solicitud e indicar en qué expediente o registro de entrada consta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;B) Documentación específica requerida para la concesión de las ayudas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;a) Declaración responsable relativa a la relación de parentesco o análoga que le une con el resto de convivientes, incluida en la solicitud (anexo 1).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;b) Certificado de convivencia, en caso de que la persona solicitante esté empadronada en un municipio que no dispone de convenio para su comprobación telemática o que no autorice su consulta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;c) Certificados de ingresos de la persona solicitante (en caso de que no se autorice la consulta en el anexo 1) y de su unidad familiar (en caso de que no se autorice la consulta en el anexo 1) 3), del año fiscal 2023 o certificado de imputación de rentas en caso de no estar obligado a presentar la declaración de la renta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;d) Justificante de pago de la matrícula de la actividad de ocio educativo o la factura de la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;3. De acuerdo con el art. 28.3 y el art. 53 c de la Ley 39/2015, de 1 de octubre de procedimiento administrativo común de las administraciones públicas (LPACAP), las personas interesadas no tienen la obligación de presentar documentos originales, salvo que con carácter excepcional la normativa reguladora aplicable exija lo contrario. En cualquier caso, las personas interesadas son responsables de la veracidad de los documentos que presenten (art. 28.7 del LPACAP).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;De acuerdo con el art. 28.5 del LPACAP, excepcionalmente, cuando la relevancia de un documento del expediente aportado por el interesado así lo exija, o existan dudas derivadas de la calidad de la copia, el CIM puede solicitar de forma motivada la autenticación de las copias aportadas por la persona interesada, por lo que puede requerir la exhibición del documento o de la información original.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;4. Las solicitudes y toda la documentación transcrita en el punto 2 de la base séptima deben presentarse, dentro del plazo establecido en la convocatoria, por medios electrónicos, o de forma presencial en la sede del Consejo Insular de Menorca en Maó y Ciutadella y en cualquier otro registro y lugar de los establecidos en el artículo 16.4 de la Ley 39/2015 de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;5. Si la solicitud o la documentación fueran incorrectas o incompletas, el Consejo Insular de Menorca requerirá la rectificación o el complemento necesarios. Si en el plazo de diez días hábiles, contados desde el día siguiente a la publicación en el tablón de anuncios de la página web oficial del Consejo Insular de Menorca (http://www.cime.es) del requerimiento de subsanación de la solicitud, la persona interesada no realiza la rectificación reclamada o no presenta la documentación requerida, se entenderá que ha desistido de su petición de conformidad con el artículo 68 de la LPACAP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Octava. Gastos subvencionables, presupuesto del proyecto y presupuesto subvencionable&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;1. Son gastos subvencionables la matrícula y las cuotas por participar en actividades de educación en el ocio educativo infantil y juvenil en Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;En los justificantes de los pagos de la matrícula y las cuotas debe constar el nombre de la persona beneficiaria o participante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Los comprobantes de los gastos deben ir a nombre del menor de edad por el que se solicita la ayuda o debe aportarse la documentación acreditativa justificativa que acredite que el menor de edad es quien hace la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;2. De acuerdo con lo que establece el artículo 31 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, es gasto subvencionable el que responda a la naturaleza de la actividad subvencionada y se haga dentro del plazo establecido en estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Novena. Determinación del importe de la subvención&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Para determinar el importe de la subvención se tendrá en cuenta el coste del gasto subvencionable justificado en la documentación presentada por la persona solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;En ningún caso el importe de la subvención podrá exceder del límite máximo establecido en la cláusula tercera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Cuando el importe de las solicitudes de ayudas sea superior a la cantidad máxima fijada en la convocatoria, este importe global máximo previsto en la convocatoria se prorrateará entre los solicitantes que cumplan los requisitos para ser beneficiarios, en función de los gastos individuales subvencionables, de forma que se aplique el mismo porcentaje de gastos subvencionables a todos los beneficiarios que tengan derecho.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Décima. Procedimiento y órganos competentes para la concesión de las ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;1. Las ayudas se concederán, de acuerdo con los principios de objetividad, transparencia, igualdad, no discriminación y publicidad, mediante el procedimiento de concurrencia no competitiva en atención al cumplimiento de los requisitos establecidos en esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;2. El inicio del expediente se efectuará mediante la aprobación de la correspondiente convocatoria. El texto de la convocatoria y el resto de documentación que se requiera se comunicará a la Base de Datos Nacional de Subvenciones (en adelante, BDNS) y se publicará el extracto de la convocatoria en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;, en cumplimiento del art. 20.8 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;3. La instrucción corresponderá al técnico que se indique en la convocatoria correspondiente, que coordinará de oficio todas las actuaciones necesarias para la determinación, conocimiento y comprobación de los datos en virtud de los cuales debe dictarse resolución sobre la concesión de las ayudas.4&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;4. Todas las solicitudes presentadas dentro del plazo establecido en la convocatoria se someterán al examen del instructor del expediente o de la comisión evaluadora, que verificará todas las solicitudes presentadas a fin de emitir un informe que servirá de base para elevar la correspondiente propuesta de resolución al órgano competente, que en este caso es el consejero ejecutivo competente, quien dictará resolución provisional de admitidos y excluidos, en la que se indicará la causa de exclusión así como las deficiencias que puedan presentar las solicitudes y abrirá un plazo de 10 días hábiles a partir de la publicación en la sede electrónica de Consejo Insular www.cime.es, apartado tablón de anuncios, para que puedan presentar alegaciones a la exclusión o enmendar las deficiencias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Si la persona interesada no realiza la rectificación o no presenta la documentación requerida, se entenderá que ha desistido de su petición de conformidad con el artículo 68 de la LPACAP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;5. Una vez examinadas las alegaciones y la documentación aportada, después de comprobar que se cumplen los requisitos para la obtención de las ayudas por el instructor o la comisión evaluadora correspondiente, y después de que ésta haya emitido su informe, el instructor elevará la correspondiente propuesta de resolución de concesión o denegación de las ayudas a el órgano competente, que en este caso es el consejero ejecutivo de Cultura, Educación, Juventud y Deportes, quien dictará resolución sobre la concesión o denegación de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;La resolución del expediente de otorgamiento de las subvenciones debe ser expresa y motivada, y fijar, con carácter definitivo, la cuantía específica de cada una de las subvenciones concedidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;6. El plazo máximo para dictar y notificar la resolución expresa de concesión de subvención será de seis meses contados desde la fecha de finalización del plazo de presentación de solicitudes. No obstante, este plazo podrá reducirse si se establece expresamente en la convocatoria de las ayudas. El silencio administrativo tendrá carácter desestimatorio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;7. La notificación de la resolución de las ayudas se efectuará mediante su publicación en el &lt;em&gt;Boletín Oficial de las Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;8. La resolución del expediente de concesión o denegación de las ayudas se remitirá a la BDNS en cumplimiento del art. 20.8 de la LGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Undécima. Comisión Evaluadora&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;1. La comisión evaluadora es el órgano colegiado al que le corresponde examinar las solicitudes presentadas y emitir el informe que debe servir de base para elaborar la propuesta de resolución que debe formular el órgano instructor competente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;2. La comisión evaluadora estará formada por los siguientes miembros:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;- Presidente/a&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;- Secretario/a&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;- Vocales (un número no inferior a tres)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;3. La comisión evaluadora debe constituirse obligatoriamente cuando el importe global de los fondos públicos previstos en la convocatoria sea superior a los 50.000 euros, o bien cuando el importe individual máximo de la subvención sea superior a 7.000 euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;4. Cuando no sea preceptiva su constitución, la existencia de la comisión evaluadora sólo será necesaria si se prevé expresamente en la resolución de la convocatoria correspondiente, en la que deberá fijarse en todo caso cuál es el órgano que debe examinar las solicitudes y emitir el informe que debe servir de base para elaborar la propuesta de resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Duodécima. Abono de las ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;1. Las ayudas se abonarán cuando el beneficiario haya justificado la realización de la actividad subvencionada de conformidad con lo establecido en estas bases, siempre que la disponibilidad de tesorería lo permita.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;2. En la fase de comprobación del gasto realizado, se solicitará al beneficiario la presentación de los justificantes que se crean oportunos a fin de obtener una evidencia razonable sobre la adecuada aplicación de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;3. No se podrá pagar la subvención mientras el/la beneficiario/a no se encuentre al corriente en el cumplimiento de sus obligaciones tributarias del Estado y ante la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;4. Las subvenciones que se paguen a personas físicas estarán sujetas a retención de acuerdo con la normativa que regula el impuesto sobre la renta de las personas físicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Decimotercera. Justificación de los gastos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;1. Las personas beneficiarias quedan obligadas a justificar los gastos de la participación de niños y jóvenes en actividades de ocio educativo infantil y juvenil, junto con la solicitud, entre el 1 y el 30 de septiembre del año en curso. Si existieran causas excepcionales que lo impidan, los beneficiarios deben alegarlas por escrito y, a la vista de estas causas, el órgano competente para otorgar las ayudas podrá ampliar el plazo de justificación de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;2. Se considerarán justificadas las ayudas cuya solicitud (incluida la documentación presentada) cumpla todos los requisitos de esta convocatoria, y por tanto no será necesario presentar ninguna otra documentación adicional para justificar la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;3. Si el gasto justificado excede del importe concedido, la posible desviación presupuestaria irá a cargo de la persona beneficiaria. Si por el contrario, el gasto justificado es inferior al importe subvencionado, se reducirá de forma proporcional la subvención concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;4. Son gastos subvencionables los efectivamente realizados entre el 26 de diciembre de 2023 y el 15 de septiembre de 2024 y pagados antes de que termine el plazo de justificación de las ayudas, el 30 de septiembre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;5. La documentación acreditativa para justificar los gastos será la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;- Justificantes de los pagos de la matrícula y las cuotas de la actividad de ocio educativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;6. En los justificantes de los pagos de la matrícula y las cuotas debe constar el nombre del menor de edad participante (o debe aportarse una declaración jurada que acredite que el menor de edad es quien hace la actividad subvencionada).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;7. Si se detecta que la documentación presentada es incorrecta o incompleta, requerirá la rectificación o el complemento necesarios, en el plazo de diez días hábiles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;8. El Consejo Insular de Menorca podrá inspeccionar las actividades subvencionadas, sin perjuicio de las competencias que pudieran corresponder, por normativa legal o reglamentaria, a otros organismos o instituciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Decimocuarta. Obligaciones las personas beneficiarias&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Son obligaciones de las personas beneficiarias:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;a)&lt;/em&gt; Comunicar al CIM la aceptación de la subvención en los términos en los que ésta se conceda. En cualquier caso la subvención se entenderá aceptada tácitamente una vez transcurridos quince días hábiles desde la notificación de la concesión de las ayudas en el &lt;em&gt;Boletín Oficial de las Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;b)&lt;/em&gt; Realizar la actividad objeto de subvención en el plazo máximo establecido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;c)&lt;/em&gt; Llevar a cabo las actividades que fundamentan la concesión de las ayudas y justificar su realización en los plazos y condiciones establecidos en estas bases y en la resolución de concesión de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;d) Acreditar, cuando el Consejo se lo solicite, que están al corriente de las obligaciones tributarias con la Seguridad Social. La acreditación no será necesaria en caso de que se haya autorizado expresamente el Consejo Insular a consultarlo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;e)&lt;/em&gt; Proporcionar la información sobre la actividad subvencionada que le requiere el Consejo Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;f) Someterse a las actuaciones de comprobación que efectúen el Consejo Insular de Menorca y demás organismos competentes para la fiscalización de las cuentas públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;g)&lt;/em&gt; Conservar los documentos justificativos de la aplicación de los fondos percibidos, incluidos los documentos electrónicos, durante 4 años, en tanto puedan ser objeto de actuaciones de comprobación y control.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;h)&lt;/em&gt; Comunicar al Consejo Insular de Menorca, en cualquier momento la solicitud o la obtención de otros ingresos, subvenciones, recursos o ayudas para la misma actividad. Asimismo, la ayuda obtenida más las cuantías obtenidas de otras ayudas nunca podrán superar el coste de la actividad de ocio educativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;i)&lt;/em&gt; Hacer constar de forma expresa el apoyo del Consejo Insular de Menorca en la realización de las actividades subvencionadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;j)&lt;/em&gt; Comunicar inmediatamente al Consejo Insular de Menorca cualquier eventualidad que altere o que dificulte gravemente el desarrollo del proyecto subvencionado, en particular si se pueden derivar retrasos en la ejecución o si pueden afectar al coste total, y solicitar el autorización previa y expresa del Consejo Insular para realizar cualquier modificación sustancial del proyecto objeto de ayuda. Las solicitudes de modificación deben ser motivadas, deben formularse inmediatamente a la aparición de las circunstancias que la justifiquen y deben especificar las repercusiones presupuestarias que impliquen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;k)&lt;/em&gt; Reintegrar los fondos percibidos en los supuestos previstos en el artículo 37 de la Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;l)&lt;/em&gt; Destinar el importe de la ayuda a la finalidad para la que se ha concedido, entendiendo que esto se cumple cuando los niños y jóvenes han participado en actividades de ocio educativo infantil y juvenil y la persona beneficiaria ha pagado los gastos de la participación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Decimoquinta. Revocación y reintegro de las ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;En cuanto a la revocación y el reintegro de las subvenciones, se aplicará lo dispuesto en la Ley 38/2003, de 17 de noviembre, general de subvenciones y demás normativa aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Decimosexta. Infracciones y sanciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;1. El régimen de infracciones y sanciones administrativas aplicables será el establecido en el título V del Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de subvenciones, y en el título IV de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;2. El órgano competente para imponer las sanciones que se deriven de infracciones de lo establecido en estas bases y de la normativa aplicable en materia de subvenciones es el consejero ejecutivo competente por razón de la materia en el caso de infracciones leves y graves y el Consejo ejecutivo en caso de infracciones muy graves, de conformidad con lo establecido en el art. 69 de la Ley 4/2022, de 28 de junio, de consejos insulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Decimoséptima. Otras disposiciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;Recursos administrativos&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Los acuerdos del Consejo Ejecutivo por los que se aprueban las bases y convocatorias no agotan la vía administrativa y son susceptibles de recibir recurso de alzada ante el Pleno del Consejo Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Las resoluciones de los consejeros ejecutivos por las que se conceden y deniegan las ayudas, no agotan la vía administrativa son recurribles en alzada ante el Consejo Ejecutivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;Normativa general aplicable&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;En todo lo no previsto expresamente en estas bases regirán las disposiciones que sean aplicables al Consejo Insular de Menorca en materia de subvenciones, especialmente las contenidas en las siguientes normas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;1. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;2. Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;3. Reglamento de la Ley General de Subvenciones (Real Decreto 887/2006, de 21 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;4. Decreto legislativo 2/2005, de 28 de noviembre, por el que se aprueba el Texto refundido de la Ley de subvenciones de la comunidad autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;5. &lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Los datos personales se tratarán de acuerdo con el Reglamento (UE) 2016/679 del Parlamento Europeo y del Consejo, de 27 de abril de 2016, relativo a la protección de las personas físicas en relación con el tratamiento de datos personales y la libre circulación de estos datos (RGPD), y con la Ley orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía del derecho digital.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;En el momento en que las personas solicitantes faciliten sus datos personales, el CIM facilitará la información de acuerdo con el artículo 13 del RGPD.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;Contra este acuerdo, que no agota la vía administrativa, puede interponerse un recurso de alzada ante la Comisión de Gobierno, por delegación del Pleno del Consejo Insular de Menorca (Acuerdo de 31-7-2023, BOIB núm. 109 de 5-8-2023), en el plazo de un mes a partir del día siguiente en que se haya publicado, de acuerdo con el artículo 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;El mencionado recurso se entenderá desestimado, si no se notifica la resolución correspondiente, cuando hayan transcurrido tres meses des de su interposición. Contra la desestimación del recurso de alzada por silencio administrativo se puede interponer recurso contencioso administrativo ante el Juzgado Contencioso Administrativo de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
