    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;El apartado 8.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 30 de enero de 2018, por la cual se convocan subvenciones para el Fomento de la Agricultura Ecológica, especifica que la Resolución se notificará a las persones interesadas mediante su publicación al Boletín Oficial de las Illes Balears de acuerdo con los términos que prevé el artículo 45.2 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones publicas.&lt;/p&gt;

&lt;p&gt;El expediente ha sido tramitado por el Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) en cumplimiento del que dispone el artículo 43 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones p&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;úblicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Co&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;n fecha 6 de abril de 2023, se publica en el BOIB núm. 43, la Orden de la consejera de Agricultura, Pesca y Alimentación por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco de las intervenciones para el desarrollo rural de las Islas Baleares 2023-2027. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2.&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Co&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;n fecha 15 de abril de 2023, se publica en el BOIB núm. 48, la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria, para el año 2023, de las ayudas destinadas para el fomento de la agricultura ecológica. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3.&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Co&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;n fecha 30 de mayo de 2023, se publica en el BOIB núm. 71, la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se modifica la Resolución de la presidenta del FOGAIBA de 27 de febrero de 2023, de convocatoria, para el año 2023, de las ayudas correspondientes a las intervenciones en forma de pagos directos que prevé el Plan estratégico de la PAC (PEPAC), así como otras resoluciones de convocatoria de ayudas que prevén las intervenciones en el desarrollo rural. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;4.&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Co&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;n fecha 30 de junio de 2023, se han recibido 551 solicitudes por la ayuda destinada para el fomento de la agricultura ecológica. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;5. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;6.&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Co&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;n fecha 20 de febrero de 2024, se publica en el BOIB núm. 25 la Resolución de denegación a los beneficiarios de las ayudas, Rd1conjunta de la Sección II, por el incumplimiento del requisito previsto en el apartado 7 del punto tercero de la convocatoria de estar al corriente de las obligaciones tributarias. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;7.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Co&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt;n fecha 6 de abril de 2024, se publica en el BOIB nº. 46 la Resolución de revocación parcial de la denegación al solicitante Finca Savantry CB con número de expediente 04003976 y NIF E57990400, en fecha 4 de mayo de 2024 se publica en el BOIB núm. 59 la Resolución de revocación parcial de la denegación al solicitante AOVE Artà SL, con número de expediente 04004999 y NIF B57770125, respectivamente. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;8. Con fecha 25 de mayo de 2024, se publica en el BOIB núm. 69 la Resolución de concesión de las ayudas destinadas al Fomento de la Agricultura Ecológica. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;9. Con fecha 17 de junio de 2024 se notifica, mediante publicación en la página web del FOGAIBA, la propuesta provisional de resolución de revocación y se concede un plazo de 10 días hábiles para presentar alegaciones. Los expedientes que así lo han hecho aparecen en el anexo I de esta resolución, indicando la estimación favorable o no de estas alegaciones. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;10. Con fecha 4 de julio de 2024, se publica en el BOIB núm. 88 la Resolución de modificación de concesión de las ayudas destinadas al Fomento de la Agricultura Ecológica. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;11. Por otra parte, se comprueba de oficio un error detectado por parte de la Administración, en referencia a los expedientes 0236, 0244, 0318, 0402, 0472 y 0542. En estos casos concretos, corregidos en el anexo de ésta resolución, el importe a revocar es menor puesto que se había establecido erróneamente la penalización a aplicar. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;12. Por último, se comprueba también de oficio, un error detectado por parte de la Administración, en lo que se refiere al expediente 0367, por el incumplimiento de monitorización y que no se tuvo en cuenta a la hora de publicar el Informe/Propuesta provisional de resolución, de 17 de junio. Concretamente, por este expediente se reduce un 1% el importe propuesto en la notificación de resolución de modificación de concesión publicado en el BOIB núm. 88 en fecha 4 de julio de 2024. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;13. Se ha considerado el informe propuesta provisional de resolución, de 17 de junio de revocación parcial de la resolución de concesión de los expedientes señalados en el anexo II, al no cumplir con alguno de los requisitos de la convocatoria, con las incidencias y motivos correspondientes que se señalan en el anexo III, y por tanto el importe a percibir por la anualidad 2023 es inferior.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1. Con fecha 6 de abril de 2023, se publica en el BOIB núm. 43, la Orden de la consejera de Agricultura, Pesca y Alimentación por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco de las intervenciones para el desarrollo rural de las Islas Baleares 2023-2027. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2. Resolución de la Presidenta del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 12 de abril de 2023 por la que se aprueba la convocatoria para el año 2023 de las ayudas destinadas para el fomento del agricultura ecológica, publicada en el BOIB núm. 48 de día 15 de abril de 2023. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3. Punto tercero de la convocatoria referente a los requisitos de las personas beneficiarias y de las explotaciones, apartado 1 letra a) en lo que se refiere a seguir las prácticas y métodos que define el Reglamento (UE) 2018/848 del Parlamento Europeo y del Consejo, de 30 de mayo de 2018, sobre producción ecológica y etiquetado de los productos ecológicos. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;4. Artículo 13 del Real Decreto 147/2023, de 28 de febrero, por el que se establecen las normas para la aplicación de penalizaciones en las intervenciones contempladas en el PEPAC, y se modifiquen diferentes reales decretos por los que se regulan distintos aspectos relacionados con la aplicación en España de la PAC para el período 2023-2027, referente a la omisión de parcelas. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;5. Artículo 18 del RD 147/2023, de 28 de febrero. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;6. Artículo 31 del RD 147/2023, de 28 de febrero. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;7. Artículo 23 del Real Decreto 1047/2022, de 27 de diciembre, por el que se regula el sistema de gestión y control de las intervenciones del PEPAC y otras ayudas de la PAC. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;8. Artículo 105.7 del Real Decreto 1048/2022, de 27 de diciembre, sobre la aplicación, a partir de 2023, de las intervenciones en forma de pagos directos y el establecimiento de requisitos comunes en el marco del Plan Estratégico de la Política Agraria Común, y la regulación de la solicitud única del sistema integrado de gestión y control. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;11. Artículo 111 del RD 1048/2022, de 27 de diciembre. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;12. Punto 4 del apartado III del anexo VI del RD 1048/2022, de 27 de diciembre. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:0.18cm"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Informe y Propuesta de Resolución &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Por todo ello, se informa &lt;em&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/em&gt;y se propone al vicepresidente en Materia Agraria del FOGAIBA que dicte resolución en los siguientes términos: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1.&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Revocar parcialmente la Resolución de &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;conces&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;ión publicada en el BOIB núm. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;69 del 25 de mayo de 2024, tal y como se detalla en el anexo II de esta Resolución para la anualidad 2023&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2. Notificar la Resolución a los interesados en el Boletín Oficial de las Islas Baleares. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante la consellera de Agricultura, Pesca y Medio Natural, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del Procedimiento administrativo común de las Administraciones Públicas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
