&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La Resolución de la consejera de Educación, Cultura y Universidades, de día 28 de agosto de 2013, autorizó la implantación de los ciclos formativos de artes plásticas y diseño que deben pasar de LOGSE a LOE en la Escuela de Arte y Superior de Diseño de las Illes Balears y en la Escuela de Arte de Menorca (BOIB núm. 126, de 12 de septiembre). Como consecuencia de esta modificación, el centro quedó configurado de la siguiente forma:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

En fecha 5 de abril de 2024 (VALIB 280951), el director y representante del centro, presentó una solicitud de ampliación de los estudios de la Escuela de Arte de Menorca con dos ciclos de grado superior: Il ilustración y Gráfica audiovisual. En esta solicitud justificó las necesidades de implantar estos ciclos por razones económicas y de adaptación al nuevo entorno empresarial, que pide a profesionales cualificados en tecnologías de la información y la comunicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El ciclo de Gráfica audiovisual no puede implantarse por no disponer de currículum autonómico ni orden estatal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. La jefa del Departamento del Servicio de las Enseñanzas de Régimen Especial, lenguas Extranjeras y Proyectos Internacionales emitió el día 6 de junio de 2024, un informe favorable a la implantación del título de Técnico superior de artes plásticas y diseño en Ilustración que pertenece en la familia profesional artística de Comunicación gráfica y audiovisual en la Escuela de Arte (EA) de Menorca a partir del curso 2024-2025.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. El 2 de agosto de 2024, la directora general de Planificación y Gestión Educativas propuso la modificación de la configuración de la Escuela de Arte (EA) de Menorca, con la implantación del título de Técnico superior de Artes Plásticas y Diseño en Ilustración que pertenece a la familia profesional artística de Comunicación gráfica y audiovisual en la Escuela de Arte (EA) de Menorca a partir del curso 2024-2025.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;1. La Ley orgánica 8/1985, de 3 de julio, reguladora del derecho a la educación (BOE núm. 159, de 4 de julio).&lt;/span&gt;&lt;/p&gt;

La Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 44, de 3 de abril).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La Ley 1/2022, de 8 de marzo, de educación de las Illes Balears, que establece en el artículo 102, punto 2 de creación de centros que la creación, supresión y transformación de centros privados se debe someter a la autorización administrativa correspondiente (BOIB núm38, de 17 de marzo).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Ley 1/2024, de 7 de junio, por la que se regulan las enseñanzas artísticas&amp;nbsp;superiores &amp;nbsp;y se establece la organización y las equivalencias de las enseñanzas&amp;nbsp;artísticas profesionales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El Real decreto 303/2010, de 15 de marzo, por el que se establecen los requisitos mínimos de los centros que imparten las enseñanzas artísticas reguladas en la Ley orgánica 2/2006, de 3 de mayo, de educación (BOE núm .86, de 9 de abril).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;7. El Real decreto 596/2007, de 4 de mayo, por el que se establece la ordenación general de las enseñanzas profesionales de Artes plásticas y diseño (BOE núm.125, de 25 de mayo).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. El Real Decreto 1433/2012, de 11 de octubre, por el que se establece el título de Técnico superior de artes plásticas y diseño en Ilustración que pertenece a la familia profesional artística de Comunicación gráfica y audiovisual 'aprueban las correspondientes enseñanzas mínimas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. El Decreto 15/2019, de 15 de marzo, por el que se establecen los currículos, en el ámbito de las Illes Balears, de los ciclos formativos de grado medio de técnico de Artes Plásticas y Diseño en Asistencia al Producto Gráfico Impreso y de grado superior correspondientes a los títulos de técnico superior de Artes Plásticas y Diseño en Fotografía, de técnico superior de Artes Plásticas y Diseño en Ilustración y de técnico superior de Artes Plásticas y Diseño en Cómic, pertenecientes todos a la familia profesional artística de Comunicación Gráfica y Audiovisual, y se regulan la evaluación y pruebas de acceso de los estudios profesionales de artes plásticas y diseño (BOIB núm. 35, de 16 de marzo).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. El Estatuto de Autonomía de las Illes Balears, aprobado por la Ley orgánica 1/2007, de 28 de febrero (BOE núm. 52, de 1 de marzo), que establece, en el artículo 36.2, que , en materia de enseñanza, corresponde a la Comunidad Autónoma de las Illes Balears la competencia de desarrollo legislativo y de ejecución de la enseñanza en toda su extensión, niveles y grados, modalidades y especialidades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11. El Decreto 5/2024, de 29 de mayo, de la presidenta de las Illes Balears, por el que se modifica el Decreto 12/2023, de 10 de julio, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears, modificado por el Decreto 16/2023, de 20 de julio; por el Decreto 17/2023, de 23 de agosto; por el Decreto 1/2024, de 4 de enero, y por el Decreto 4/2024, de 17 de mayo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, y de acuerdo con la propuesta formulada por la Dirección General de Planificación y Gestión Educativas en fecha 2 de agosto de 2024, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. Inscribir esta autorización en el Registro estatal de centros docentes no universitarios del Ministerio de Educación, Formación Profesional y Deportes (RCD) y en el Registro de centros de la Dirección General de Planificación y Gestión Educativas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;4. &lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer recurso potestativo de reposición ante el consejero de Educación y Universidades en el plazo de un mes a contar desde el día siguiente de la publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;También se puede interponer directamente un recurso contencioso administrativo ante la Sala de lo Contencioso Administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de la publicación, de acuerdo con los artículos 10 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
