&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En la sesión ordinaria del Ayuntamiento Pleno de día 8 de julio de 2024, se adoptó, entre otros, el siguiente ACUERDO que en su parte dispositiva dice:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;«&lt;strong&gt;Primero.&lt;/strong&gt; Tener en cuenta las recomendaciones con respecto al lenguaje empleado en la propuesta normativa presentadas por el Instituto Balear de la Mujer y que constan en el informe de impacto de género de día 24 de mayo de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Segundo.&lt;/strong&gt; Aprobar definitivamente la modificación de la Ordenanza municipal reguladora de las ferias y mercados temporales en el término municipal de Felanitx (Anexo II – Ordenanza Ferias y Mercados (Incorporadas recomendaciones. IBD)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Tercero.&lt;/strong&gt; Publicar íntegramente el presente acuerdo, junto con el texto de la Ordenanza, en el BOIB en forma legal.»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Recursos.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Contra la aprobación definitiva de la modificación de citada Ordenanza se puede interponer recurso contencioso administrativo ante la Sala de lo Contencioso Administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses contados desde el día de la presente publicación, de acuerdo con el dispuesto en los artículos 10.1.b y 46.1 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;EXPOSICIÓN DE MOTIVOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El artículo 100 de la Ley 20/2006 de 15 de diciembre, municipal y de régimen local de las Illes Balears dispone que los municipios tienen potestad normativa reglamentaria, como expresión del principio democrático en el que se fundamentan, en el ámbito de sus competencias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La misma Ley en el artículo 29.2 u) reconoce que los municipios de las Illes Balears, en el marco de las leyes, tienen en todo caso competencias propias para regular y gestionar los mercados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Esta competencia está reconocida como competencia propia por el artículo 25.2 i) de la Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local, que establece que en materia de mercados y comercio ambulante, el municipio ejercerá en cualquier caso, competencias, en los términos de la legislación del Estado y de las Comunidades Autónomas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Asimismo, en lo que se refiere a la legislación estatal específica, cabe resaltar la Ley 7/1996, de 15 de enero, de ordenación del comercio minorista.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La Comunidad Autónoma de las Islas Baleares también ha legislado sobre esta materia la venta ambulante en la Ley 11/2014, de 15 de octubre, de comercio de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Así, vistos los últimos cambios en la legislación aplicable a la venta ambulante, se considera necesario la adaptación de la normativa municipal a la nueva regulación, al tiempo que ejercer un mayor control sobre esta actividad comercial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;CAPÍTULO I&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px; width: 100%"&gt; &lt;/span&gt;ÁMBITO DE APLICACIÓN Y CLASIFICACIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo.1. Objeto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Esta Ordenanza tiene por objeto la regulación administrativa de la venta no sedentaria ejercida en los mercadillos del municipio de Felanitx, cuyo régimen de funcionamiento está bajo los principios de la libertad de mercado y salvaguarda de los derechos de la persona consumidora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 2. Concepto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Se considera venta ambulante la que se realiza fuera de un establecimiento comercial permanente, con carácter discrecional, ejercidas en instalaciones desmontables y transportables, incluidos los camiones y furgonetas tienda, y dentro de un perímetro urbano autorizado, que comprende la venta al por menor de artículos alimenticios, textiles, artesanía, ornamentación, etc., siempre que cumpla la normativa en materia de protección de la salud pública, de seguridad alimentaria y de la seguridad de los consumidores. Sólo se podrá realizar bajo los términos y condiciones que señala la Ley 7/1996 de 15 de enero de ordenación del comercio minorista, la Ley 11/2014 de 15 de octubre, de comercio de las Illes Balears y el presente reglamento. Sin prejuicio que establezcan las restantes normativas de aplicación, especialmente la reguladora de cada producto, quedando prohibida toda venta que no se ajuste a dichas normativas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las actividades de venta ambulante o no sedentaria no pierden su condición por el hecho de que se lleven a cabo sobre suelo de propiedad o titularidad privada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La Junta de Gobierno Local podrá aprobar normas o reglamentos de régimen interior propias de un determinado mercado, de desarrollo del presente reglamento, con estricta sujeción al mismo, una vez oídas por las personas usuarias y los servicios municipales correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 3. Ámbito de aplicación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Esta Ordenanza será de aplicación a toda venta ambulante no sedentaria en el municipio de Felanitx.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Esta Ordenanza también será de aplicación en cualquier tipo de venta ambulante no periódica semanalmente y que no requiera ningún tipo de instalación específica, dentro del término municipal de Felanitx.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 4. Celebración y horario de los mercados semanales&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La venta ambulante realizada fuera de un establecimiento comercial permanente, en plazas, solares o en la vía pública, sólo queda autorizada en este municipio en los siguientes días:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En Felanitx, los domingos excepto el día de Pascua, y los días 1 de enero y 25 de diciembre, si coincide.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En Portocolom, los martes y sábados excepto los días 1 de enero y 25 de diciembre si coincide.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En s&amp;apos;Horta, los sábados excepto los días 1 de enero y 25 de diciembre y Sant Isidre 15 de mayo, si coincide.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En Cas Concos, los miércoles excepto los días 1 de enero y 25 de diciembre, y Sant Nicolau 10 de septiembre, si coincide.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Con el fin de dinamizar la actividad en las zonas turísticas durante la temporada alta de verano (desde mayo a octubre) se podrá organizar los llamados mercados temporales artesanos nocturnos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El horario de ocupación de los puestos de venta será de 6.30 a 8.00 horas. Los vehículos de mercancías tendrán que ser retirados antes de las 8.30 horas y siempre, una vez que estén en el lugar asignado, serán retirados lo antes posible, se dejarán los vehículos aparcados correctamente fuera de la ubicación del mercado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El desmontaje de las instalaciones y la entrada de los vehículos queda establecido entre las 13:30 y las 15:00 horas. Aquel vendedor/a que, teniendo lugar asignado, llegue más tarde de las 8:30 horas pierde el derecho a ocupar su puesto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Se podrá modificar o ampliar los horarios y días de celebración establecidos por acuerdo de la Junta de Gobierno Local cuando existan necesidades del servicio o razones de interés general lo justifiquen, sin que las personas titulares tengan derecho a ningún tipo de indemnización por daños y perjuicios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Excepcionalmente, por razones de interés público y dinamizar la actividad comercial del edificio del Mercado Municipal se podrá autorizar venta ambulante de productos alimenticios siempre y que la línea de venta no sea el mismo de los lugares fijos, de martes a sábado, por acuerdo de la Junta de Gobierno Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;CAPÍTULO II&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px; width: 100%"&gt; &lt;/span&gt;MODALIDADES DE VENTA NO SEDENTARIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Article. 5. Venda ambulant&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Venta a la via pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Venta en camiones tienda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Esta Ordenanza también será de aplicación en cualquier tipo de venta ambulante y que no requiera ningún tipo de instalación específica, dentro del término municipal de Felanitx.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 6. Mercados semanales&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El mercado de Felanitx del domingo se diferencia en dos modalidades, dependiendo de la duración de la autorización de empleo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;6.1.a) Mercado anual, del día 1 de enero al 31 de diciembre de cada año:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Preferentemente, se ubicará: calle Mayor, Jordi Sabet, 31 de Marzo, Miquel Bordoy y edificio Mercado Municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La plaza Sa Font de Santa Margalida, se destinará preferentemente para la venta de productos artesanales y florales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La plaza Espanya, se destinará exclusivamente para actividades itinerantes Menores y Mayores, llamadas atracciones feriales. Exceptuando los días de Feria, que se podrá ampliar los tipos de actividades de venta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;6.1.b) Mercado de verano, del día 1 de abril al 31 de octubre de cada año.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Preferentemente, se ubicará: en los alrededores de la plaza Pax.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

 &lt;li style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Preferentemente, se ubicará: en la plaza de la Iglesia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Por razones de interés público, esta localización podrá modificarse por acuerdo de la Junta de Gobierno Local, sin que las personas titulares tengan derecho a ningún tipo de indemnización por daños y perjuicios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 7. Mercado de encantos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Dentro del recorrido del mercado dominical del domingo se podrá destinar una zona para celebrar un mercado de encantos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El mercado de encantos tendrá la misma consideración de mercados temporales, sin prejuicio de lo dispuesto en el apartado siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Se hará un permiso para vendedores y vendedoras ocasionales, que podrán venir al Mercado de Encantos de Felanitx hasta un máximo de un año. Para obtener este permiso, será necesario presentar:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;/ul&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La venta ambulante o no sedentaria realizada en la forma indicada en el artículo 1, 2 y 3 también queda autorizada en este municipio por la celebración de ferias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las personas interesadas en obtener la correspondiente autorización municipal para el ejercicio de la venta ambulante de las ferias indicadas, deben presentar la correspondiente solicitud en el registro habilitado para este efecto. El plazo máximo para presentar las solicitudes será de quince días antes de la celebración de la feria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El horario de las ferias diurnas será de 8.00 h a 19.00 h de las nocturnas de 18.00 h a 23.00 h y podrá ser modificado por acuerdo de la Junta de Gobierno Local atendiendo a las necesidades o circunstancias especiales de la feria y será obligatorio cumplirlo estrictamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 9. Mercadillos de verano nocturnos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Los mercadillos de verano serán semanales y concurrirán de los meses de mayo a octubre, en Cala Ferrera los viernes y en Portocolom los sábados. Tendrán a todos los efectos y consideración administrativa de mercados temporales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las personas interesadas en obtener la correspondiente autorización municipal para el ejercicio de la venta ambulante en los mercadillos de verano deben presentar, en el registro habilitado para tal efecto, la correspondiente solicitud antes del plazo que el concejal/a de Ferias y Mercados establezca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El horario de los mercadillos de verano será de 18.00 h a 23.00 h y podrá ser modificado por acuerdo de la Junta de Gobierno Local atendiendo a las necesidades o circunstancias especiales del mercado y será obligatorio cumplirlo estrictamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 10. Venta ambulante ocasional en circunstancias especiales&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Se considera como venta ambulante ocasional en circunstancias especiales, a aquella que se realice de manera puntual coincidiendo con fiestas populares y verbenas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La autorización para esta actividad tendrá la misma consideración de mercados temporales y será otorgada por la Junta de Govern Local. La vigencia de la autorización municipal para las licencias para la venta ambulante ocasional en circunstancias especiales, debe limitarse a la duración del evento específico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las personas interesadas en obtener la correspondiente autorización deben presentar, en el registro habilitado para tal efecto, la correspondiente solicitud con un mes de antelación a la fecha del evento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El horario será el que determine la Junta de Gobierno Local y será obligatorio cumplirlo estrictamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;CAPÍTULO IV&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px; width: 100%"&gt; &lt;/span&gt;&amp;nbsp;DE LOS PUESTOS DE VENTA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 11. Los puestos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La asignación del emplazamiento autorizado será realizada por la Junta de Gobierno Local, oídas todas las partes, las pautas establecidas en la normativa vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El montaje de los puestos de venta se realizará en el lugar asignado con instalaciones desmontables, entendemos como tales a quienes hayan obtenido la correspondiente autorización municipal, de acuerdo con lo dispuesto en este reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Los puestos que queden libres, por abandono o pérdida de los derechos, quedarán a disposición del Ayuntamiento, que podrá adjudicarlos de nuevo, siguiendo las normas establecidas en esta ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La persona encargada del Mercado, podrá disponer la ocupación inmediata y provisional del lugar de ese día que haya quedado vacío por parte de los vendedores y vendedoras de los trastes más cercanos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 12. Dimensiones de los puestos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Circunstancialmente la Junta de Gobierno Local, junto con informe de la persona encargada del Mercado, considerará las dimensiones de cada puesto de venta en particular, y en su caso, autorizará su ampliación o disminución de éste, siempre entre los límites de medidas autorizadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 13. Medidas y distancias de los sitios&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;a) Por motivos de seguridad, deberá dejarse un espacio de 50 centímetros por cada lado de la parada, libre de obstáculos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;b) La anchura del puesto de venta no podrá exceder de 1,5 metros lineales, en perpendicular con la acera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;c) La longitud del puesto de venta no podrá exceder de 8 metros lineales, en paralelo a la acera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;d) No se permite la venta de mercancías que se coloquen directamente sobre el suelo o pavimento. Éstas deben colocarse sobre un mostrador de una altura no inferior a 60 centímetros del nivel del suelo, salvo en los casos de artículos que, por sus características, se puedan exceptuar (ej. plantas).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;e) En caso de utilizar toldos o sombrillas, éstas se izarán sobre la rasante de la calzada un mínimo de 2 metros. En ningún caso se podrán colgar artículos fuera de la perpendicular de la superficie del mostrador.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;f) No se permite situar, exponer o depositar mercancías y otras pertenencias fuera de su puesto asignado, ni realizar operaciones de venta y servicios fuera de su puesto asignado. Queda prohibido a los vendedores y vendedoras sentarse fuera de su espacio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;g) A pesar de las medidas máximas establecidas, y en función de la anchura de las calles donde se ubiquen los lugares, éstos tendrán que estar instalados de forma suficientemente ancha respecto de la línea de fachada de las casas, de tal forma que quede habilitado un pasillo que pueda servir de acceso para servicios de emergencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 14. Número de puestos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Mediante resolución que adopte la Junta de Gobierno Local, junto con informe de la persona encargada del Mercado, establecerá tanto el número total como la extensión de puestos de venta, teniendo en cuenta las disponibilidades de espacio físico en las zonas que prevé el artículo 6 y 31. También podrá modificar la ubicación específica de cada parada o las líneas de venta según las necesidades de la población, o, en cualquier caso, cuando las circunstancias lo requieran. Para estos casos, el Ayuntamiento lo notificará a la persona titular de la licencia afectada con una antelación mínima de quince días.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 15. Lugares de animales&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Los animales de corral estarán debidamente enjaulados, teniendo en cuenta sus características y garantizando su salubridad. Las características de los puestos de animales de corral estarán exclusivamente sujetas al informe técnico de la manescalia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Dentro del recinto del mercado temporal o de las ferias, no se permitirá:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. La comercialización y venta de animales de especias exóticas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. La transmisión lucrativa (regalo, liberalidad) de cualquier tipo de animales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;CAPÍTULO V&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px; width: 100%"&gt; &lt;/span&gt;AUTORIZACIONES Y TRÁMITES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo.16. Autorizaciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La venta ambulante sólo puede ejercerse previa autorización del Ayuntamiento y tendrá una duración limitada que el Ayuntamiento determinará de acuerdo con lo que prevé el artículo 24.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Para la adjudicación de nuevas autorizaciones se seguirán los siguientes criterios orientadores sobre la distribución de las superficies acotadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La comercialización de productos no incorporados en el mercado, productos innovadores y que figuren dentro de las líneas de venta autorizadas o serlo de forma insuficiente, dada la demanda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La promoción de la comercialización de la producción agrícola autóctona singularmente la de índole estacional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La comercialización de productos de producción propia, ecológicos y hechos con dignidad, de acuerdo con los criterios de comercio justo elaborados en centros, entidades, colectivos u organismos de naturaleza benéfica y/o social, así como de los que se producen como consecuencia de actividades culturales y educativas, desarrolladas en los centros docentes públicos o privados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Disponer de Carta de Maestro Artesano.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La autorización podrá ser revocada antes del plazo por el que se otorgó por incumplimiento de la legislación vigente y/o de las ordenanzas municipales, y no dará derecho, en estos supuestos a indemnización ni compensación de ningún tipo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Su renovación no será automática, sino que será a instancia de la persona interesada, a tal efecto. Las solicitudes de renovación deberán formularse dentro del período indicado del mes de noviembre de cada ejercicio en el registro habilitado al efecto. En caso de no presentar esta solicitud significa perder automáticamente la licencia de venta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 17. Personalidad de las personas adjudicatarias&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las personas adjudicatarias podrán ser personas físicas, jurídicas o cooperativas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 18. Documentación requerida&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Para la obtención de la licencia será necesaria la presentación de una solicitud en el registro habilitado al efecto, acompañada del NIF, si es persona física, o documentación que justifique su condición y su representación legal, en el caso de personas jurídicas o cooperativas, junto con una declaración responsable en la que manifieste el cumplimiento de los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. Estar dado/a de alta en la Seguridad Social (en el régimen que corresponda).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. Estar dado/a de alta del Impuesto de Actividades Económicas, en caso de sujeción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3. Estar al corriente delante del Ayuntamiento de pago de los tributos municipales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;4. Relación del personal que atenderá a la comercialización o administración del puesto de venta, con expresión de la relación laboral existente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;5. Recibo del seguro de responsabilidad civil por posibles daños que puedan causarse en la vía pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;6. Declarar justificadamente la naturaleza de las actividades comerciales a realizar con expresión del origen de las mercancías, en el caso de productos manufacturados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;7. Cumplir el requisito del número de personas titulares por licencia exigido en el artículo 19 de este reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;8. En el caso de productos de consumo humano, deberá tenerse el carné de manipulación de alimentos y la inscripción del registro de la Consejería de Salud, si procede.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;9. Satisfacer el pago del precio público, vigente en cada momento, por ocupación de la vía pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;10. En el caso de personas extranjeras no miembros de la Unión Europea, estar en posesión de los permisos de residencia y trabajo por cuenta propia, según la legislación vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En el caso de las cooperativas, sólo se autorizará una licencia a nombre de la cooperativa, por cada epígrafe de IAE del que sea titular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En la medida en que el municipio no tenga capacidad y medios suficientes para comprobar el cumplimiento de los requisitos establecidos en este artículo por medios electrónicos y telemáticos, será necesario que el/la solicitante acompañe la documentación acreditativa del cumplimiento de dichos requisitos, junto con la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 19. Número de personas titulares por licencia&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En el mismo mercado, una misma persona sólo podrá ser titular de una licencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 20. Plazo de presentación de las solicitudes para nuevas autorizaciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El plazo de presentación de solicitudes para las nuevas licencias será de día 2 de noviembre hasta el 31 de marzo incluidos. Si al día 31 de julio no se ha obtenido resolución expresa, las solicitudes se entenderán denegadas en virtud del silencio administrativo negativo que rige en el uso del dominio público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 21 Otorgamiento de autorizaciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las autorizaciones se otorgarán directamente a las personas solicitantes que cumplan todos los requisitos establecidos en el artículo 18 de esta ordenanza. Cuando existan limitaciones en el número de licencias por falta de puesto o por cualquier otra circunstancia, las autorizaciones se otorgarán siguiendo criterios del artículo 16 de esta ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El procedimiento de autorización estará sometido a los principios de concurrencia competitiva, publicidad, claridad, sencillez, objetividad, predictibilidad, necesidad, proporcionalidad y no discriminación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 22. Lista de espera&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Existirá una relación o lista de espera en la que se inscribirán todas las personas interesadas y se valorará siguiendo el siguiente orden:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Primero: Cumplir todos los requisitos establecidos en el artículo 18.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Segundo: Criterios contemplados en el artículo 16.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Tercero: Por orden de entrada de solicitudes en el registro habilitado para tal efecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 23. Otorgamiento extraordinario de autorizaciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Se podrán presentar nuevas solicitudes fuera de los plazos indicados en el artículo 20 de la presente ordenanza y se podrán autorizar en función de las necesidades de cubrir puesto de venta en el mercado, siempre que exista un sitio disponible, si bien, las tasas devengarán con carácter anual, independientemente del momento en el que haya sido formulada la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;También las personas titulares de los comercios o establecimientos comerciales permanentes en el municipio de Felanitx, siempre que exista un puesto vacante, podrán acceder a una autorización municipal relativa al puesto de venta del mercado. Las personas titulares de estos establecimientos quedan también sujetas a la obligación de satisfacer las tasas correspondientes de la autorización. Estos casos extraordinarios de autorizaciones tendrán la misma duración que las licencias autorizadas y como máximo un año, con posibilidad de renovar siempre y que las circunstancias de otorgamiento de la autorización sean similares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 24. Duración de la autorización&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La autorización municipal debe tener duración limitada, en todo caso con la calificación de eventual, debido a la disponibilidad de suelo público habilitado. Para el ejercicio de la venta ambulante o no sedentaria en mercados periódicos la duración de la autorización no podrá ser superior a un año. Las autorizaciones corresponderán a la Junta de Gobierno Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 25. Extinción de la autorización&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las licencias se considerarán extinguidas cuando se dé alguno de los siguientes supuestos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. Jubilación de la persona titular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. Fallecimiento de la persona titular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3. Incapacidad permanente de la persona titular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;4. Renuncia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;5. Revocación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;5. Extinción del plazo de autorización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 26. Revocación de la autorización.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Serán causas de revocación regular de la autorización, por acuerdo de la Junta de Gobierno Local:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. Darse de baja del impuesto sobre actividades económicas. Darse de baja de autónomo o carencia de pago de las cotizaciones para un espacio superior a tres meses.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. Incumplir lo regulado en este reglamento con tal consecuencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3. Los vendedores y vendedoras de alimentos que corresponda y no renueven el carné de manipulación de alimentos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;4. La licencia se retirará a todos aquellos y todas aquellas que no asistan sin previo aviso durante cuatro semanas consecutivas o cinco alternativas durante el año natural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;5. Renuncia al sitio, presentada por escrito en el registro habilitado al efecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;6. No presentar la instancia de renovación de la licencia en el mes de noviembre, como contempla el artículo 16.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;7. No haber abonado las tasas o precio público en la forma y plazos determinados por la correspondiente ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;8. No abonar las sanciones durante el año natural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;9. La presencia de personas no autorizadas despachando en el puesto de venta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;10. Ceder el uso y/o disfrute del puesto de venta a terceras personas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;11. Los demás supuestos contemplados en este reglamento por infracciones graves y muy graves.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Cuando la persona titular pierda su puesto no podrá, en el plazo de un año, volver a despachar a los distintos mercados en caso de que hubiera sitios disponibles. En caso de que no hubiera puestos de venta vacantes, se inscribirá en la lista de suplentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 27. Transmisibilidad de la autorización&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- La autorización no es transmisible.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- Excepcionalmente, se podrá transmitir, previa comunicación al Ayuntamiento, únicamente en caso de fallecimiento o imposibilidad sobrevenida a la persona titular de llevar a cabo la actividad:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En favor del cónyuge o pareja de hecho, de las personas ascendientes y descendientes en primer grado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En favor del personal por cuenta de la persona titular de la autorización municipal que acrediten una antigüedad mínima de un año.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- El sustituto/a debe continuar la actividad de venta ambulante durante el resto del período de vigencia de la autorización, y sin perjuicio de la necesidad de cumplir los requisitos para el ejercicio de la venta ambulante y el resto de obligaciones que se puedan derivar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 28. Venta sin autorización&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El ejercicio de cualquier tipo de venta, en la que el vendedor o vendedora no justifique su autorización, se sancionará con la inmediata incautación de la mercancía. En el plazo de 24 horas, el vendedor o vendedora deberá presentar los documentos que acrediten estar en posesión de la licencia municipal, así como el billete o factura que ampare la procedencia de los artículos en venta. Si el vendedor o vendedora acredita estos documentos, se devolverá la mercancía intervenida, imputando como falta muy grave.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Si pasadas las 24 horas el vendedor o vendedora no presentase las citadas acreditaciones, se fijará el destino de éste que será el de centros benéficos y municipales de carácter social para mercancías fungibles o con grave riesgo de deterioro. Las restantes mercancías quedarán depositadas hasta que se acredite la posesión de la licencia y/o autorización y su legal procedencia, lo que deberá hacer en el plazo máximo de 15 días. Si así lo hiciere, se le devolverá la mercancía sin perjuicio de la sanción que se le imponga por la infracción cometida o se dará cuenta a la autoridad judicial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Agotado el plazo antes citado sin comparecencia del vendedor o vendedora, la mercancía se considerará abandonada y la Junta de Gobierno Local resolverá sobre su destino. Los gastos ocasionados por las operaciones de intervención, depósito, analítica, transporte y destrucción serán de cuenta del comerciante intervenido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;CAPÍTULO VI&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px; width: 100%"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;OBLIGACIONES DE LAS PERSONAS VENDEDORAS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 29. Obligación de pago&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las tasas municipales correspondientes deben pagarse de antemano y trimestralmente, exceptuando los mercados de verano que deben pagarse de antemano y con un único pago.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 30. Obligación de asistencia y comunicación de ausencias.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las personas titulares de las licencias están obligadas a asistir al mercado, salvo las semanas en las que el mercado no se celebre o las semanas en las que hayan solicitado vacaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La licencia se retirará a todos aquellos y todas aquellas que no asistan sin previo aviso durante cuatro semanas consecutivas o cinco alternativas durante el año natural, sin que ello suponga ningún derecho a indemnización ni reducción en la tasa trimestral.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Sin perjuicio de lo establecido en el párrafo anterior, se posibilita la ausencia puntual en el mercado semanal siempre y cuando la persona titular de la autorización avise a la persona encargada del Mercado con una antelación mínima de cinco días antes de la celebración del mercado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Aquellas ausencias no comunicadas de antemano, computarán como falta de asistencia, salvo que posteriormente pueda justificarse con suficiente evidencia (justificante médico, etc.).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 31. Destino de los puestos de venta&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las personas titulares exclusivamente podrán expedir las mercancías correspondientes a su autorización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las personas titulares se instalarán única y rigurosamente en el lugar que especifique la correspondiente autorización, sin que pueda invadir la propiedad privada, ni impedir el acceso a edificios de uso público o privado, establecimientos comerciales, o la visibilidad de los escaparates , ni en lugares que dificulten la circulación y el acceso de los peatones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Tampoco podrá utilizar ni desplazar ni modificar ningún tipo de mobiliario urbano, ni poner ningún tipo de soportes en las fachadas para efectuar su actividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 32. Exposición de licencia&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La persona titular queda obligada a colocar la vigente licencia en un lugar visible para todos los peatones, donde constará su fotografía, número de autorización, situación y dimensiones del puesto, identificación personal, producto que se vende, y el sello del Ayuntamiento que acredita la situación de estar al corriente de pago. También debe exhibir una dirección para la recepción de las posibles reclamaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 33. Exposición de precios&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las personas titulares quedan obligadas a colocar carteles con los precios indicativos de cada producto en un sitio bien visible y que no lleve a confusión. El precio indicará el coste de la unidad, o la unidad de peso y volumen, u otra medida tradicional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo 34. Vehículos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las personas titulares de las licencias están obligadas a dejar sus vehículos fuera del área del mercado durante el transcurso del mismo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En este sentido se ajustarán rigurosamente a lo dispuesto en el artículo 4 del presente reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 35. Publicidad&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;a) Queda prohibido cualquier tipo de publicidad acústica, sea de voz o emitida por aparato amplificador o similar. Se exceptúan los vendedores y vendedoras de discos o casetes, a los que se les permite la reproducción sonora de los productos que tengan a la venta, siempre que el volumen, a criterio de la persona encargada del Mercado, no sea excesivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;b) Sin la autorización pertinente queda prohibido ningún tipo de publicidad dinámica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;c) Queda prohibida cualquier publicidad estática no vinculada a la actividad de la licencia. (Ej. recojo chatarra, compro oro, etc.).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 36. Productos de consumo humano&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Queda prohibida la venta ambulante de productos de consumo humano que necesiten para su conservación cámaras frigoríficas, como puedan ser carnes y caza fresca, aves muertas, refrigerados y congelados, productos lácteos, pastelería con rellenos, pastas frescas o rellenas, pescado fresco vendido en instalación provisional no móvil, así como aquellos productos que, por sus especiales características y, a juicio de las autoridades competentes, lleven riesgo sanitario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las superficies que estén en contacto con los alimentos estarán en buen estado y permitan fácilmente su limpieza y desinfección. Las instalaciones presentarán los dispositivos necesarios para un buen mantenimiento, buena conservación y fuera ningún riesgo de contaminación de los alimentos y de las herramientas de trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 37. Obedecer las indicaciones del personal del Ayuntamiento.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En todo momento las personas titulares de las licencias atenderán a las indicaciones de la persona encargada de Mercado y de la Policía Local, con educación y respeto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 38. Indicaciones de la manescalia&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Aquellos vendedores/as de animales vivos, se estarán en todo momento a las indicaciones de la manescalía municipal. La manescalia tendrá capacidad de inspección, control, retirada y denuncia en los casos en que, desde el punto de vista zoo-sanitario, así lo encuentre pertinente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 39. Formas de huesos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Los vendedores y vendedoras y las personas usuarias del mercado usarán las buenas formas y lenguaje correcto, tanto entre sí como en el trato con el público y representantes de la Administración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 40. Cumplir el reglamento&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las personas titulares de las licencias quedan obligadas a cumplir cualquier otra de las disposiciones reguladas en la presente ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;CAPÍTULO VII&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px; width: 100%"&gt; &lt;/span&gt;DERECHOS DE LAS PERSONAS VENDEDORAS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 41. Comisión del Mercado de Felanitx&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Estará formada por el concejal/a de Ferias y Mercados, la persona encargada del Mercado y un máximo de cuatro representantes de las personas vendedoras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las personas representantes de las personas vendedoras se escogerán en votación libre, directa y secreta de las personas candidatas que se hayan presentado. Las condiciones para ser candidato o candidata son:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. Ser persona titular de una parada del mercado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. Con una antigüedad de al menos dos años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Serán personas electoras las titulares de los puestos del mercado en el momento de la votación, las cuales votarán un máximo de cuatro candidatos/as. Las personas representantes se renovarán cada cuatro años. La comisión del mercado se reunirá a petición de cualquiera de sus miembros y su misión es el seguimiento y control de la marcha del mercado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;​​​​​​​&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 42. Notificación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las personas titulares tienen derecho a ser notificadas por el Ayuntamiento con quince días por adelantado sobre cualquier cambio que le afecte (reubicación, cambio de dimensiones de su parada, horarios etc.).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 43. Reducción involuntaria de las dimensiones del puesto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En caso de que algún cambio efectuado por el Ayuntamiento comporte una reducción de las dimensiones de su puesto, el vendedor o vendedora tendrá derecho a minorar la tasa trimestral, y, en su caso, a la devolución del exceso pagado según prorrateo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 44. vacaciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. Las personas titulares de la licencia tienen derecho a un mes de vacaciones (cuatro domingos), manteniéndose sus derechos durante su ausencia. Las vacaciones podrán disfrutarlas a su discreción. Antes de ausentarse, deberán notificarlo al registro habilitado al efecto con una semana de antelación, indicando el número de mercados a los que no asistirán, así como el día inmediatamente posterior a su regreso. Este hecho no supondrá disminución alguna en las tasas municipales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. Las personas titulares que se ausenten por un período superior a dos meses del puesto de venta o la parada, perderán el lugar habitual asignado. Antes de ausentarse, deberán notificarlo al registro habilitado al efecto con una semana de antelación, indicando el número de mercados a los que no asistirán, así como para la reincorporación tienen la obligación de avisar con quince días de antelación para ser asignados a un nuevo sitio disponible. Este hecho no supondrá disminución alguna en las tasas municipales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;CAPÍTULO VIII&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px; width: 100%"&gt; &lt;/span&gt;LIMPIEZA E HIGIENE DEL MERCADO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 45. Higiene en el mercado&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;a) Los vendedores/as de productos de alimentación no podrán fumar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;b) No se permitirá el uso de prendas de vestir que no guarden la debida corrección y que no respeten las condiciones higiénicas adecuadas. (Ej. ir sin camiseta).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 46. ​​Higiene del puesto de venta&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Los vendedores/as tendrán que mantener el puesto de venta, así como su entorno, en perfectas condiciones de limpieza y orden en todo momento durante el mercado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 47. Recogida de desechos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Será deber de los vendedores/as, al finalizar el mercado, tendrán el deber de recoger todos los desechos propios y tendrán la obligación de llevárselos. Si por un caso debe dejar algún desperdicio puntual propio de la actividad, será en recipientes cerrados y adecuadamente apilados y ordenados a fin de facilitar los trabajos de recogida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 48. Animales sueltos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En el recinto del mercado no se permitirá la presencia de perros u otros animales sueltos durante el ejercicio del mismo, a excepción de lo dispuesto en la Ley de perros guía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;CAPÍTULO IX&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px; width: 100%"&gt; &lt;/span&gt;RÉGIMEN DE INFRACCIONES Y SANCIONES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 49. Corrección e incoación de infracciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La incoación de la resolución de los expedientes sancionadores corresponde en todo caso a Alcaldía. Los expedientes se tramitan según lo establecido en el Decreto 1/2024, de 5 de enero, por el que se aprueba el Reglamento del procedimiento sancionador de la Administración de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 4, de 6 de enero).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;​​​​​​​&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 50. Tipo de infracciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Este reglamento diferencia entre infracciones leves, graves y muy graves.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 51. Infracciones leves&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El incumplimiento de cualquier artículo de este reglamento que no figuren calificadas de graves o muy graves en los artículos siguientes, sin perjuicio de lo dispuesto en los siguientes apartados:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;a) La falta de colaboración en la limpieza del puesto de venta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;b) La no exhibición del carné de la persona titular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;c) Sobrepasar la señalización de la plaza que le corresponda, o infringir cualquiera de las condiciones descritas en el artículo 13.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;d) Carecer de expuestos los precios de venta al público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;e) El abandono del puesto o parada durante 2 mercados consecutivos o 3 alternos dentro de un mismo ejercicio, sin comunicarlo al Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 52. Infracciones graves&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. La comisión de dos o más faltas leves durante un mismo año natural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. Fraude en la calidad, peso, medida, capacidad, precio, envase, paquetes, etiquetas, marcas, condiciones higiénico-sanitarias y cualquier otra circunstancia análoga en perjuicio del consumidor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3. La desobediencia a la persona encargada del mercado municipal, a sus agentes o delegados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;4. La falta de colaboración en la limpieza del puesto de venta, con reincidencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;5. Cambiar de objeto de venta sin autorización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;6. El incumplimiento de las obligaciones descritas en el artículo 39 (buenas formas) y en los artículos 45 a 48 de este reglamento (Capítulo VIII Limpieza e higiene del mercado), que no suponga infracción muy grave.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 53. Infracciones muy graves&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. Aquellas que impliquen falsedad y ocultaciones en las declaraciones o documentos exigibles reglamentariamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. La comisión de dos o más faltas graves.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3. El traspaso, arrendamiento o concesión del puesto de venta sin contar con la adecuada autorización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;4. Las infracciones leves cuando concurran circunstancias de publicidad o notoriedad que afecten a la imagen del servicio público o de la corporación municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;5. Compartir un sitio de venta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;6. Venta sin autorización, o no vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;7. Las infracciones graves cuando concurra la circunstancia de reincidencia, la cual se dará cuando la persona infractora haya sido sancionada por dos o más faltas graves durante un mismo año natural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;8. Cuando exista alteración o flagrante vulneración de las condiciones mínimas de seguridad y sanidad del servicio público de mercados y las de sus usuarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;9. El incumplimiento de las obligaciones descritas en el artículo 26 de este reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;10. La desobediencia a la autoridad municipal, a sus agentes o persona encargada del mercado, cuando las órdenes se hayan cursado por escrito.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;11. Provocar altercados y alteración del orden público en el mercado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;​​​​​​​&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Artículo. 54. Sanciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Como consecuencia de las infracciones mencionadas en los artículos anteriores, podrán imponerse las siguientes sanciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Para infracciones leves:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Multa de 100 euros fins a 300 euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Suspensión temporal de la actividad por un plazo máximo de un mes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Por infracciones graves:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Multa de 301 euros a 600 euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Suspensión temporal de la actividad por plazo de entre uno a seis meses. La sanción de la multa puede imponerse conjuntamente con la de suspensión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Por infracciones muy graves:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Multa de 601 euros fins a 3.000 euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Extinción de la autorización para ejercer la venta sin derecho a devolución de tasa ni de indemnización de ningún tipo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La sanción de la multa puede imponerse conjuntamente con la extinción de la autorización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Disposición Complementaria&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las personas titulares que no sean ciudadanos o ciudadanas de la UE, que por motivos personales deban ausentarse durante más de 8 mercados consecutivos (4 de vacaciones y 4 como número máximo de ausencias consecutivas para revocación de licencia), tendrán que comunicarlo por escrito a la persona encargada del mercado, y adjuntarán la fotocopia de los billetes de avión de ida y vuelta. No podrán ceder sus derechos temporalmente a nadie durante su ausencia en virtud del artículo 28 de este reglamento, su puesto quedará vacío y a disposición de la persona encargada del mercado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;No tendrá derecho a ningún tipo de reducción de la tasa trimestral. Deberán acudir al mercado inmediatamente posterior a la fecha de regreso del billete de avión. En caso contrario, se le retirará la licencia de acuerdo con el artículo 30.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Disposición Transitoria&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Las licencias municipales de venta ambulante que existan en el momento de la entrada en vigor de esta Ordenanza, mantendrán su vigencia hasta el 31 de diciembre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Disposición derogatoria única. Normas que se derogan.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Quedan derogadas cuantas normas municipales se opongan, contradigan o sean incompatibles con lo dispuesto en esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Disposición final. Entrada en vigor.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Esta Ordenanza entrará en vigor cuando se haya publicado íntegramente en el Boletín Oficial de las Islas Baleares y haya transcurrido el plazo previsto en el artículo 113 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares.»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;]]</env:contingut>
