&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;A finales del año 2023 se inició la implementación por fases del servicio de recogida de residuos “porta a porta”, con identificación de la persona usuaria, en el municipio de Maó. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;A lo largo de los meses de junio y julio de 2024, el Ayuntamiento de Maó ha recibido los siguientes escritos: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;remitidos por diferentes personas interesadas, que manifiestan su oposición al hecho de que, según relatan, sus datos personales estén expuestos en el chip instalado en los cubos de recogida selectiva “porta a porta” de residuos; y, además, también afirman no haber sido informadas al respecto, lo cual, consecuentemente, vulnera su privacidad e intimidad. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En los mismos escritos citados solicitan la retirada inmediata de los cubos referidos, así como la destrucción de los datos introducidos en el chip que estos llevan incorporados. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Conforme al art. 45 de la Ley 39/2015, de 1&lt;/span&gt; &lt;span style="color:black"&gt;de octubre, del procedimiento administrativo común de las administraciones públicas, por el hecho de ser un acto que tiene por destinataria una pluralidad indeterminada de personas y por aconsejarlo razones de interés público, debe e&lt;/span&gt;fectuarse notificación mediante publicación&lt;span style="color:black"&gt; a todas las personas que han efectuado las alegaciones, puesto&lt;/span&gt; que la respuesta razonada es común a todas ellas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Conforme al art. 12.3 del Reglamento General de Protección de Datos (UE) 679/2016, de 27 de abril de 2016, del Parlamento Europeo y del Consejo, relativo a la protección de las personas físicas por lo que hace referencia al tratamiento de datos personales y a la libre circulación de estos datos (en adelante, RGPD), las solicitudes presentadas ante la persona o entidad responsable del tratamiento deben resolverse dentro del plazo de UN (1) MES, a contar a partir de su recepción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En consecuencia, &lt;strong&gt;DECRETO:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;PRIMERO&lt;/strong&gt;. &lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1) El Ayuntamiento de Maó es corresponsable del tratamiento de datos personales relacionados con la prestación del servicio de recogida de residuos “porta a porta”, a los efectos de lo que prevé el art. 26 del RGPD.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2) No concurren en este caso los requisitos establecidos en el art. 21 del RGPD, sobre el derecho de oposición al tratamiento ejercido por las personas solicitantes ante el Ayuntamiento de Maó (corresponsable del tratamiento).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3) No concurren en este caso los requisitos establecidos en el art. 17 del RGPD, para poder estimar el derecho de supresión del tratamiento ejercido por las personas solicitantes ante el Ayuntamiento de Maó (corresponsable del tratamiento).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;SEGUNDO&lt;/strong&gt;. Informar a las personas interesadas que pueden dirigirse a la autoridad de control competente (Agencia Española de Protección de Datos), conforme a los artículos 63 y siguientes de la LOPDGDD; a las personas delegadas de protección de datos del Consorci de Residus i Energia de Menorca; y al Ayuntamiento de Maó.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;TERCERO&lt;/strong&gt;. Efectuar notificación mediante publicación, conforme al art. 45 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, por el hecho de ser un acto que tiene por destinataria una pluralidad indeterminada de personas y por aconsejarlo razones de interés público, a todas las personas que han efectuado las alegaciones, puesto que la respuesta razonada es común a todas ellas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
