&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consejo Ejecutivo del Consejo Insular de Menorca, mediante acuerdo adoptado en sesión ordinaria de día 4 de diciembre de 2023 aprobó las bases y la convocatoria de las ayudas del CIM para las agrupaciones de defensa sanitaria de Menorca (ADS) para el año 2023. Estas bases y la correspondiente convocatoria se publicaron en el BOIB núm. 12 de 16 de enero de 2024.Día 18 de julio de 2024 el interventor fiscaliza favorablemente la concesión y pago de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El importe global máximo de las ayudas y el crédito presupuestario es de un importe total de 65.000 € con cargo a la partida presupuestaria 2.41240.4890002 del presupuesto del CIM por el año 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El plazo de presentación de solicitudes de las ayudas finalizó día 26 de febrero de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El objeto de esta convocatoria es apoyar a las actividades que hayan llevado a cabo, desde día 1 de enero a día 31 de diciembre de 2023, para compensar el coste, de las actuaciones de vigilancia, erradicación y control de enfermedades de los animales incluidas en los programas sanitarios y zootécnicos de las ADS de ovino y vacuno de Menorca aprobados por DG de Agricultura, Ganadería y desarrollo Rural del Gobierno de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Día 24 de abril de 2024 la instructora emite un informe de concesión y pago de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Día 15 de mayo de 2024 se reunió la Comisión Evaluadora de las ayudas y comunica su propuesta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Decreto Legislativo 2/2005, de 28 de noviembre, por el cual se aprueba el Texto refundido de la Ley de subvenciones de la comunidad autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Real decreto 887/2006, de 21 de julio, por el cual se aprueba el reglamento de la Ley 38/2003.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Real Decreto 81/2015, de 30 de abril, que establece las bases reguladoras de las subvenciones estatales para las agrupaciones de defensa sanitaria ganaderas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Ley 8/2003, de sanidad animal, de 24 de abril.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Real Decreto 842/2011, de 17 de junio que establece la normativa básica que regula las agrupaciones de defensa sanitaria ganadera y crea el registro nacional de estas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. Decreto 42/2021, de 11 de octubre, por el cual se regula el funcionamiento de las agrupaciones de defensa sanitaria ganadera en el ámbito de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. Ley 39/2015, de 1 de octubre, del Procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. Ley 4/2022, de 28 de junio, de consejos insulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En conformidad con el Decreto de presidencia núm. 91/2023 de 10 de julio, de creación de los departamentos y el decreto de presidencia núm. 92/2023 de 10 de julio, de nombramiento de los miembros del Consejo Ejecutivo (BOIB núm. 95 de 11 de julio de 2023), la competencia para conocer y resolver el presente expediente corresponde a la consejera ejecutiva jefa del departamento de Economía y Servicios Generales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Atendiendo el Decreto de presidencia núm. 136/2023 de 1 de agosto, relativo al establecimiento del régimen de suplencias de los consejeros ejecutivos (BOIB núm. 108 de 3 de agosto de 2023), de acuerdo con el cual, en caso de ausencia, enfermedad o cualquier otro impedimento temporal de la consejera ejecutiva jefa del departamento de Bienestar Social tiene que suplir la consejera ejecutiva de Economía y Servicios Generales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En uso de las atribuciones que me han sido conferidas;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEGUNDO.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Remitir a la BDNS este acuerdo en cumplimiento del art. 20.8 de la LGS y publicarlo en el Boletín Oficial de las Islas Baleares a los efectos de notificación (art. 1b de la LPACAP).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra este acuerdo – que no agota la vía administrativa – se puede interponer un recurso de alzada ante el Consejo Ejecutivo en el plazo de un mes contador desde el día siguiente que se haya publicado, de acuerdo con el artículo 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El mencionado recurso se entenderá desestimado, si no se notifica la resolución correspondiente, cuando hayan transcurrido tres meses desde su interposición. Contra la desestimación del recurso de alzada por silencio administrativo podréis interponer recurso contencioso-administrativo ante el Juzgado de lo contencioso-administrativo de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
