En la resolución de concesión ocupa el nº41 de orden con derecho a ayuda. De su puntuación se desprende que obtiene 25 puntos por titular de explotación prioritaria. Siendo el total de la puntuación obtenida de 70 puntos. Los beneficiarios que no obtuvieron derecho a ayuda tenían una puntuación de 50 puntos</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.El día 8 de marzo de 2023 se inscribe parte del director gerente del FOGAIBA la solicitud como explotación preferente en la explotación de AGROMART BALEAR SL con CIF B57683419, expediente de RIA 16347, desistiendo por tanto de la inscripción al Catálogo de Explotaciones Agrarias Prioritarias de las Islas Baleares como explotación prioritaria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Dado el punto anterior, no mantiene la puntuación obtenida en la concurrencia, siendo actualmente de 45 puntos, por lo que no tiene derecho a ayuda.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. El 10 de juny de 2024 es notifica a l'interessat mitjançat publicació a la web del FOGAIBA la proposta provisional de revocació total de l'ajuda.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. El 25 de junio de 2024 el beneficiario presenta escrito de alegaciones a la propuesta provisional de revocación total de la ayuda en el que expone que en el momento de la solicitud de ayuda se cumplían todos los puntos por los que se solicitaba la puntuación de concurrencia y que ha mantenido los requisitos generales durante todo el proceso de concesión y pago y que son los indicados en el apartado Tercero de la convocatoria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">10. El apartado Décimo de la convocatoria expone que son obligaciones del beneficiario entre otros:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">. Someterse a los controles que lleve a cabo la administración, necesarios para comprobar la correcta concesión de la ayuda y posterior mantenimiento de los compromisos. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">. Cumplir con los compromisos adquiridos para la concesión de la ayuda.Mantener los requisitos y condiciones exigibles respecto a la explotación y la persona beneficiaria, a los que hace referencia el apartado tercero de esta Resolución.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto legislativo 2/2005, de 28 de diciembre, dispone que corresponde a la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades indebidamente percibidas”.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">12. Ante todo ello, se propone la revocación total debido al incumplimiento total de las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención, ya que el beneficiario no mantiene la puntuación obtenida en la concurrencia, siendo actualmente de 45 puntos, por lo que no tiene derecho a la ayuda.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fundamentos de derecho:</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Resolución de 26 de octubre de 2021 del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para el año 2021, subvenciones para inversiones en las explotaciones del sector de los frutos secos, modificada mediante resolución de 14 de diciembre de 2021</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020 .</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Propuesta de Resolución</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Considerando los hechos, se desestiman las alegaciones formuladas por el interesado y se propone al vicepresidente en materia agraria del FOGAIBA que dicte resolución en los siguientes términos:</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.&nbsp;Revocar totalmente la ayuda concedida al beneficiario, mediante la Resolución del vicepresidente en materia agraria del FOGAIBA de 17 de abril de 2023, por el importe y con los datos detallados en el anexo de esta resolución, que es un total de 1 expediente y que comienza y termina con agromart balear, s.l, y que suma un importe total de 120.784,30 euros, relativa a la línea de ayuda “Inversiones en las explotaciones agrarias”. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Finalizar el procedimiento y archivar el expediente INEA2020_1/050. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.
