    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;span style="background-color:null"&gt;En cumplimiento de aquello que disponen los artículos 44.2 y 46.1 del Reglamento de organización, funcionamiento y régimen jurídico de las entidades locales, a continuación, se hace pública la resolución, que ha dictado la Sra. Alcaldesa, relativa a la modificación de la delegación genérica de Comercio, Trabajo, Transporte Público y Participación Ciudadana. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;span style="background-color:null"&gt;“Asunto: Delegación genérica DE COMERCIO, TRABAJO, TRANSPORTE PÚBLICO Y PARTICIPACIÓN CIUDADANA a favor de la regidora Sra. AZAHARA MACHADO TORRES&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;span style="background-color:null"&gt;Esta Batlia tiene atribuida por Ley la facultad de delegar determinadas atribuciones, de acuerdo con el que dispone el artículo 21.3 de la Ley 7/1985, de 2 de abril, reguladora de las Bases de Régimen Local (LRBRL).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;span style="background-color:null"&gt;El artículo 25 de la ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares establece que la administración municipal puede estructurarse en departamentos dirigidos por un teniente alcalde o por una teniente de alcalde o por un regidor o una regidora delegados del alcalde.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;span style="background-color:null"&gt;Por decreto de Batlia 1844/2024, de 22 de julio (BOIB n.º 98 de 25 de julio) he modificado el organigrama y estructura municipal de servicios administrativos del ayuntamiento de Alcúdia, que afecta las atribuciones a la concejalía de comercio, transporte público y participación ciudadana que fueron objeto de delegación en el decreto 1048/2023, de 27 de junio (BOIB del 29), en favor de la Sra. Azahara Machado Torres, por lo cual procede modificar dicha delegación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;span style="background-color:null"&gt;De acuerdo con los artículos 21.3 de la LRBRL, 25 de la ley 20/2006 y 43, 44, 120,121 del Real Decreto 2568/1986, de 28 de noviembre, por el cual se aprueba el Reglamento de organización, funcionamiento y régimen jurídico de las Entidades Locales (ROFJEL),&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;span style="background-color:null"&gt;Por todo esto, adopto la siguiente &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;span style="background-color:null"&gt;RESOLUCIÓN&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRIMERO. -&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Delegar en la regidora, Sra. AZAHARA MACHADO TORRES, el ejercicio de las atribuciones correspondientes a la responsabilidad de la concejalía de COMERCIO, TRABAJO, TRANSPORTE PÚBLICO Y PARTICIPACIÓN CIUDADANA.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEGUNDO. -&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Las facultades delegadas comprenden el ejercicio de las competencias relativas al sector de la actividad administrativa propia de estas áreas de gestión municipal que la legislación vigente asigna a los municipios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;span style="background-color:null"&gt;Además de estas atribuciones generales, le corresponde a título indicativo y no limitativo, el ejercicio de las competencias específicas sobre las materias siguientes: promoción y dinamización del comercio, relaciones con las asociaciones de comerciantes, ferias, taxis, galeras y alquiler de vehículos sin conductor, transporte público, albergue de la Victoria e instalaciones similares, promoción del asociacionismo y la participación ciudadana, asociaciones de vecinos, trabajo y coordinación agentes de ocupación y desarrollo local. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;TERCERO. -&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Las delegaciones mencionadas comprenden tanto las facultades de dirigir los servicios correspondientes incluidos en las respectivas áreas y, en concreto, la unidad de participación ciudadana, como las de gestionarlos en general, con inclusión de la facultad de resolver mediante actos administrativos que afecten a terceros. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;span style="background-color:null"&gt;En cualquier caso, el contenido de la delegación conferida comprende el ejercicio de las competencias generales siguientes: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;span style="background-color:null"&gt;Programar las políticas municipales en las materias de su competencia, así como la representación e inspección del área de la cual es titular. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;span style="background-color:null"&gt;Ejercer la autoridad respecto del personal de su área. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;span style="background-color:null"&gt;Garantizar el cumplimiento de las ordenanzas, los reglamentos, los bandos y otras disposiciones legales que afecten en el municipio, en el ámbito de las competencias del área. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;span style="background-color:null"&gt;Ejercer la potestad sancionadora en el ámbito de las competencias del área, salvo que sea indelegable por ley o esté atribuida a otros órganos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;span style="background-color:null"&gt;Dictar decretos e instrucciones en el ámbito de las competencias delegadas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;span style="background-color:null"&gt;Ordenar la tramitación de los expedientes relativos a su área delegada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;QUART. -&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; El ámbito de la presente delegación se corresponde con las áreas de gestión municipal señaladas, y se entiende sin perjuicio de las delegaciones específicas que el alcalde pueda conferir a otros regidores respecto de determinados servicios o secciones incluidos en el área delegada. En este supuesto el decreto de delegación especial tendrá que especificar la dependencia y coordinación que corresponda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;QUINTO. -&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Las delegaciones conferidas requerirán para su eficacia la aceptación de la regidora delegada, se publicarán al BOIB y se dará cuenta en el Pleno del Ayuntamiento en la primera sesión que se celebre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEXTO. -&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; La regidora delegada queda obligada a informar a esta Batlia sobre la gestión y las disposiciones que dicte, y previamente, de las decisiones de trascendencia en los términos previstos en el artículo 115 del ROFRJEL.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SÉPTIMO. -&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; La presente delegación sustituye y deja sin efecto la atribuida por decreto 1048/2023, de 27 de junio (BOIB del 29).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;span style="background-color:null"&gt;En todo aquello que no esté previsto en esta resolución regirán la Ley 7/1985, de 2 de abril, reguladora de bases de régimen local; la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares, la ley 40/2015, de 1 de octubre, de régimen jurídico del sector público, y el Real Decreto 2568/1986, de 28 de noviembre, por el cual se aprueba el Reglamento de organización, funcionamiento y régimen jurídico de las Entidades Locales, y, al haber, del reglamento orgánico municipal, en el marco de las reglas que para las delegaciones se establecen a dichas normas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:111%"&gt;&lt;span style="background-color:null"&gt;En Alcúdia, en la fecha de la firma electrónica que consta al margen de este documento del que, como secretario, en don fe.»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
