&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;DILIGENCIA para hacer constar:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;Que la Junta Rectora del Consorcio Museo Marítimo de Mallorca en la sesión extraordinaria celebrada el 26 de julio de 2024 aprobó por unanimidad la propuesta que se transcribe a continuación. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;Que el texto definitivo queda sujeto a los términos que resulten de la aprobación del acta. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;PUNTO SEGUNDO DEL ORDEN DEL DÍA. Aprobación de la PROPUESTA DE ACUERDO DE CAMBIO DE COMPOSICIÓN DE LA MESA DE CONTRATACIÓN RELATIVA A LA CONTRATACIÓN MIXTA DE SUMINISTRO CON INSTALACIÓN Y OBRA PARA PODER EJECUTAR EL PROYECTO MUSEOGRÁFICO PARA EL NUEVO MUSEO MARÍTIMO DE MALLORCA EN EL CENTRO CULTURAL SES VOLTES, ESPACIO GESTIONADO POR EL CONSORCIO MUSEO MARÍTIMO DE MALLORCA. LOTES 1 Y 2, MEDIANTE PROCEDIMIENTO ABIERTO, EXPEDIENTE 931519C.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;Se da cuenta de la siguiente propuesta de la presidenta del Consorcio Museo Marítimo de Mallorca: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;«&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PROPUESTA DE ACUERDO DE CAMBIO DE COMPOSICIÓN DE LA MESA DE CONTRATACIÓN RELATIVA A LA CONTRATACIÓN MIXTA DE SUMINISTRO CON INSTALACIÓN Y OBRA PARA PODER EJECUTAR EL PROYECTO MUSEOGRÁFICO PARA EL NUEVO MUSEO MARÍTIMO DE MALLORCA EN EL CENTRO CULTURAL SES VOLTES, ESPACIO GESTIONADO POR EL CONSORCIO MUSEO MARÍTIMO DE MALLORCA. LOTES 1 Y 2.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;ANTECEDENTES&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;1.- El 3 de octubre de 2017 la Comisióń Europea adoptó la Recomendacióń (UE) 2017/1805 sobre la profesionalizacióń de la contratacióń pública. Las políticas de profesionalizacióń de la contratacióń pública son fundamentales para garantizar que los poderes adjudicadores tengan las capacidades, los conocimientos y la integridad necesaria en el ámbito de la contratacióń pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;2.- Por otro lado, a efectos de garantizar una mayor eficacia, racionalizacióń y transparencia en la gestióń de la contratación mixta de suministro con instalación y obra para poder ejecutar el proyecto museográfico para el nuevo Museo Marítimo de Mallorca en el Centro Cultural &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Ses Voltes&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, espacio gestionado por el Consorcio Museo Marítimo de Mallorca, Lotes 1 y 2, se considera conveniente el cambio de composición de la mesa de Contratacióń.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;3.- El 28 de mayo de 2024 la presidenta por delegación del Consorcio aprobó la composición de mesa de contratación de la mencionada licitación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;4.- El 23 de julio de 2024 la presidencia del Consorcio Museo Marítimo de Mallorca resolvió iniciar el cambio de composición de la mesa de contratación relativa a la contratación mixta de suministro con instalación y obra para poder ejecutar el proyecto museográfico para el nuevo Museo Marítimo de Mallorca en el Centro Cultural &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Ses Voltes&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, espacio gestionado por el Consorcio Museo Marítimo de Mallorca, Lotes 1 y 2, mediante procedimiento abierto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;FUNDAMENTOS DE DERECHO&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;1.- El artículo 326.1 de la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público, por la que se trasponen al ordenamiento jurídico español las Directivas del Parlamento Europeo y del Consejo 2014/23/UE y 2014/24/UE, de 26 de febrero de 2014 (en lo sucesivo LCSP) regula las Mesas de Contratación que tendrán que dar asistencia técnica especializada a los órganos de contratación en el desarrollo de sus funciones, determinando el carácter preceptivo o potestativo de su constitución por razón del tipo de procedimiento que se siga.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;2.- La Disposición Adicional Segunda apartado 7 de la LCSP regula las particularidades de las Mesas de Contratación para las Entidades Locales:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;«&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;La Mesa de contratación estará presidida por un miembro de la Corporación o un funcionario de la misma, y formarán parte de ella, como vocales, el Secretario o, en su caso, el titular del órgano que tenga atribuida la función de asesoramiento jurídico, y el Interventor, o, en su caso, el titular del órgano que tenga atribuidas la función de control económico-presupuestario, así como aquellos otros que se designen por el órgano de contratación entre el personal funcionario de carrera o personal laboral al servicio de la Corporación, o miembros electos de la misma, sin que su número, en total, sea inferior a tres. Los miembros electos que, en su caso, forman parte de la Mesa de contratación no podrán suponer más de un tercio del total de miembros de la misma. Actuará como Secretario un funcionario de la Corporación.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;em&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;En las Entidades locales municipales, mancomunidades y consorcios locales, podrán integrarse en la Mesa personal al servicio de las correspondientes Diputaciones Provinciales o Comunidades Autónomas uniprovinciales.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;em&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;En ningún caso podrá formar parte de las Mesas de contratación ni emitir informes de valoración de las ofertas, personal eventual. Podrá formar parte de la Mesa personal funcionario interino únicamente cuando no existan funcionarios de carrera suficientemente cualificados y así se acredite en lo expediente.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;em&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;La composición de la Mesa se publicará en el perfil de contratante del órgano de contratación correspondiente. Se podrán constituir Mesas de Contratación permanentes&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;3.- Los artículos 21 y 22 del RD 817/2009, de 8 de mayo, por el que se desarrolla parcialmente la Ley 30/2007, de 30 de octubre, de Contratos del Sector Público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;4.- El art. 15.1.g ) de los Estatutos del Consorcio Museo Marítimo de Mallorca ( BOIB n.º 2 de 4 de enero de 2018) dispone como funciones de la Junta Rectora las de resolver las contrataciones y concesiones de toda clase cuando el importe supere el 10% de los recursos ordinarios del presupuesto, así como los contratos y las concesiones plurianuales cuando tengan una duración superior a cuatro años y, en todo caso, los plurianuales de duración inferior el importe acumulado de los cuales supere el porcentaje indicado referido a los recursos ordinarios del presupuesto del primer ejercicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;La presidenta por delegación propone elevar a la Junta rectora la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;PROPUESTA DE ACUERDO&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt;PRIMERO.-&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:null"&gt; El siguiente cambio de composición de la mesa de contratación relativa a la contratación mixta de suministro con instalación y obra para poder ejecutar el proyecto museográfico para el nuevo Museo Marítimo de Mallorca en el Centro Cultural &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Ses Voltes&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, espacio gestionado por el Consorcio Museo Marítimo de Mallorca. Lotes 1 y 2, mediante procedimiento abierto:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
