    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Habiéndose aprobado definitivamente la modificación de la ordenanza fiscal reguladora de la tasa por la prestación del servicio de agua , cuyo texto íntegro se hace público para su general conocimiento y en cumplimiento de lo previsto en el artículo 70.2 de la Ley de Bases del Régimen Local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ACUERDOS,&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;PRIMERO.&lt;/strong&gt; Aprobar provisionalmente la modificación de la ordenanza fiscal reguladora de la tasa por la prestación del servicio de agua en los términos del proyecto que se anexa al expediente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;SEGUNDO.&lt;/strong&gt; Exponer al público el anterior Acuerdo mediante anuncio que se insertará en el tablón de anuncios municipal durante el plazo de treinta días hábiles, a contar desde el siguiente al de publicación de este anuncio en el Boletín Oficial de la Provincia, dentro del que los interesados podrán examinar el expediente y presentar las alegaciones que estimen oportunas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Asimismo, estará a disposición de los interesados en la sede electrónica de esta entidad https://banyalbufar.sedelectronica.es/info.0 &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;TERCERO. &lt;/strong&gt;Considerar, en caso de que no se presentaran reclamaciones al expediente, en el plazo anteriormente indicado, que el Acuerdo es definitivo, en base al artículo 17.3 del Texto Refundido de la Ley Reguladora de las Haciendas Locales, aprobado por Real Decreto Legislativo 2/2004, de 5 de marzo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;CUARTO.&lt;/strong&gt; Facultar a la Alcaldía para suscribir los documentos relacionados con este asunto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ORDENANZA FISCAL REGULADORA DE LA TASA POR LA PRESTACIÓN DEL SERVICIO DE AGUA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 1. Fundamento y naturaleza&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En uso de las facultades concedidas por los artículos 133.2 y 142 de la Constitución y por el artículo 106 de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local, y de conformidad con lo dispuesto en los artículos 15 al 19 del Real Decreto Legislativo 2/2004, de 5 de marzo, texto refundido de la ley reguladora de las haciendas locales, y la Ley 25/1998, de 13 de julio, de modificación del Régimen Legal de las Tasas Estatales y Locales y de Reordenación de las Prestaciones Patrimoniales de Carácter Público, este Ayuntamiento establece la “Tasa por la prestación del servicio de agua potable y alcantarillado”, la cual se regirá por la presente Ordenanza Fiscal, cuyas normas se ajustan a lo que dispone el artículo 57 del citado Real Decreto Legislativo 2/2004.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Directiva 2000/60/CE del Parlamento Europeo y el Consejo, de 23 de octubre de 2000,&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;determina un marco comunitario de actuación en el ámbito de la política de aguas que incluye el&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;principio de recuperación de costes en servicios relacionados con el agua.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De acuerdo con el artículo 44 de la Normativa del Plan hidrológico de la Demarcación Hidrográfica de las Illes Balears, aprobado por Real Decreto 49/2023, de 24 de enero, la administración competente en materia de suministro de agua, en virtud del principio de recuperación de costes en la prestación de los servicios del agua, y teniendo en cuenta las proyecciones económicas a largo plazo, debe establecer los mecanismos oportunos para fomentar su consumo responsable y hacer repercutir los costes de los servicios relacionados con la gestión de&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;agua a los diferentes usuarios finales, incluyendo los costes ambientales y del recurso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las contraprestaciones económicas establecidas coactivamente que se perciban por la prestación de los servicios públicos a que se refiere el apartado 4 del artículo 20 del Real Decreto Legislativo 2/2004, realizada de forma directa mediante personificación privada o mediante gestión indirecta, tendrán la condición de prestaciones patrimoniales de carácter público no tributario conforme a lo previsto en el artículo 31.3 de la Constitución&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 2. Hecho imponible&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Constituye el hecho imponible de la tasa la prestación de servicios públicos por distribución de agua&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;potable y alcantarillado:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) La actividad municipal, técnica y administrativa de control de las condiciones necesarias para autorizar las conexiones a la red de agua potable y acometidas a la red de alcantarillado y drenaje.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) La prestación de los servicios de abastecimiento de agua potable y evacuación de aguas residuales, aguas pluviales a través de la red de alcantarillado municipal y su tratamiento para su depuración y retorno en la calidad adecuada al medio. Quedan incluidos los derechos de conexión de líneas y colocación y utilización de contadores e instalaciones análogas, cuando los servicios o suministros sean prestados por el Ayuntamiento, en los términos especificados en las tarifas contenidas en el artículo 6 de la presente Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Quedan excluidas de la aplicación de la Tasa las fincas declaradas ruinosas o que tengan la condición de solar o terreno.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 3. Sujetos pasivos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Son sujetos pasivos de la tasa, en concepto de contribuyentes, las personas físicas y&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;jurídicas, así como las entidades a las que se refiere la Ley General Tributaria que soliciten o&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;resulten beneficiadas o afectadas, por los servicios de distribución de agua y alcantarillado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Cuando los suministros o servicios regulados en esta Ordenanza sean solicitados o&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;recibos por ocupantes de viviendas y locales distintos de los propietarios de los inmuebles, éstos&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;propietarios tendrán la condición de sujeto pasivo sustituto del ocupante o usuario de las viviendas o locales del contribuyente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los sujetos pasivos sustitutos del contribuyente podrán repercutir las cuotas de la tasa sobre beneficiarios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 4. Responsables&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Responden solidariamente de las obligaciones tributarias todas las personas que sean causantes de una infracción tributaria o que colaboren en su comisión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Los coparticipantes o cotitulares de las Entidades jurídicas o económicas a las que se refiere la Ley General Tributaria responderán solidariamente en proporción a sus respectivas&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;participaciones de las obligaciones tributarias de estas entidades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. En el caso de sociedades o entidades disueltas y liquidadas, sus obligaciones tributarias&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;pendientes se transmitirán a los socios o partícipes en el capital, que responderán de ellas&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;solidariamente y hasta el límite del valor de la cuota de liquidación que se les hubiera adjudicado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 5.- Bonificaciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. De acuerdo con el artículo 16 del del Real Decreto Legislativo 2/2004 sobre el contenido de las ordenanzas fiscales, en las ordenanzas fiscales deben contener las exenciones, reducciones y bonificaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. A todos los efectos, no se aplicarán exenciones, bonificaciones ni reducciones para la determinación de la deuda&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;tributario que los sujetos pasivos deban satisfacer para esta tasa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. A pesar de lo dispuesto en el apartado anterior, será posible la aplicación de reducción de las tarifas&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;cuando los sujetos pasivos acrediten una escasa capacidad económica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 6.- Cuota Tributaria&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La cuantía de la tasa se determinará aplicando las siguientes tarifas :&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 7.- Acreditación y período impositivo&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La tasa se devenga cuando se inicia la prestación del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Cuando se soliciten los servicios referidos en la tarifa cuarta del artículo anterior, se exigirá el&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;depósito previo de la tasa cuando se formule la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 8.- Régimen de declaración y de ingreso&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La tasa por servicios detallados en la tarifa cuarta se exigirá en régimen de autoliquidación. A estos efectos, cuando se solicita la prestación del servicio se presentará debidamente cumplimentado el impreso de autoliquidación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La tasa por recepción de los suministros detallados en las tarifas primera, segunda y tercera se determinará aplicando sobre los consumos las cuantías que en dichas tarifas se&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;contienen.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El cobro de las tasas de abastecimiento de agua se realizará mediante recibos trimestrales y la tasa de alcantarillado mediante recibo anual, que deberán pagarse por domiciliación bancaria oa las entidades bancarias colaboradoras, a elección del contribuyente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El importe del recibo que no se haya hecho efectivo dentro del período de pago en voluntaria&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;señalado oportunamente, dará lugar al corte o precintado del suministro por falta de&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;pago y en todo caso se exigirá el cobro por la vía de apremio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El cargo de la deuda en la cuenta bancaria designada por el interesado se efectuará dentro de la primera quincena del bimestre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Transcurrido dos meses en los que se ponen al cobro los recibos por suministro&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;regulados en esta Ordenanza, se iniciará el período ejecutivo que comporta la acreditación del&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;recargo de apremio y de los intereses de demora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 9.- Notificaciones de las tasas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La notificación de la deuda tributaria en los supuestos de servicios singulares se realizará en&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;el interesado, en el momento en que se presenta la autoliquidación, con carácter previo a la&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;prestación del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Pese a lo previsto en el apartado anterior, si una vez verificada la autoliquidación resultara&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;incorrecta, se practicará liquidación complementaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Cuando el interesado solicite el alta en el registro de usuarios y así se autorice, se le notificará la&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;inclusión en la matrícula de contribuyentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Anualmente, en la segunda quincena del mes de enero, se expondrá al público en el tablero&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;de anuncios del Ayuntamiento el censo de contribuyentes que tienen esta condición en referencia a fecha de 1 de enero.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. De la cuota que bimestralmente se liquidará por consumos del período anterior el interesado&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;puede obtener información personal, escrita, telefónicamente o por Internet durante la quincena&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;anterior a aquélla en que se procederá al cobro de la tasa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Para poder obtener información telefónica, será necesario que previamente el interesado haya aportado una contraseña identificativa particular.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 10.- Infracciones y sanciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El régimen de infracciones y sanciones viene regulado de acuerdo con la Ordenanza de los servicios de&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;abastecimiento de agua potable y de alcantarillado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las infracciones y sanciones en materia tributaria se regirán por lo dispuesto en la Ley General&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Tributaria, su normativa de desarrollo y en el Reglamento General de Recaudación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Disposición transitoria&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De acuerdo con la Ordenanza de los servicios de abastecimiento de agua potable y alcantarillado, la primera suscripción de contrato para un inmueble, desde la entrada en vigor de la Ordenanza, está exenta de cuota de conexión, siempre que ya exista suministro previo de agua. De acuerdo con la disposición adicional primera de la Ordenanza, esta disposición tiene su duración hasta que se hayan formalizado los contratos a las personas abonadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;DISPOSICIÓN DEROGATORIA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Quedan derogadas todas las ordenanzas y modificaciones que puedan contradecir la normativa regulada en el presente texto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Disposición final&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. Esta Ordenanza entrará en vigor al día siguiente de su publicación íntegra en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. Publicar el presente acuerdo de la ordenanza en el tablón de anuncios Municipal y en el BOIB para su exposición pública durante un plazo de 30 días, en los que los interesados podrán examinar el expediente y presentar las reclamaciones que consideren oportunas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. En caso de que se presenten estas reclamaciones, serán resueltas por el Pleno de la Corporación. En caso contrario, se entenderá como definitivo el acuerdo de aprobación provisional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. Publicar el texto íntegro de la ordenanza en el BOIB para su entrada en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra el presente Acuerdo, se interpondrá recurso contencioso-administrativo, ante la Sala de lo Contencioso-Administrativo del Tribunal Superior de Justicia de Baleares con sede en Palma, en el plazo de dos meses a contar desde el día siguiente a la publicación del presente anuncio, de conformidad con el artículo 46 de la Ley 29/1998, de 13 de julio, de la Jurisdicción Contencioso-Administrativa&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
