    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Comisión Insular de Ordenación del Territorio y Urbanismo, en sesión de día 24 de julio de 2024, ha adoptado el acuerdo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;«Visto el expediente relativo a la Modificación puntual de las Normas Subsidiarias de Sencelles para la incorporación de un Sistema General en suelo rústico, de equipamiento comunitario destinado a cementerio en Biniali, en el trámite de aprobación definitiva previsto en el artículo 54 de la Ley 12/2017, y en el artículo 101.2 a) del Reglamento general de la Ley 12/2017, de 29 de diciembre, de urbanismo de las&lt;/span&gt;&lt;em&gt; &lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Illes Balears para la isla de Mallorca, y de acuerdo con el dictamen de la Ponencia Técnica de Ordenación del Territorio y Urbanismo, esta Comisión Insular acuerda aprobar definitivamente la modificación puntual mencionada con las prescripciones siguientes:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;1. En referencia a la deficiencia 4 del acuerdo de la CIOTU de 26 de marzo de 2021, se modifica la ficha de SG-Cementerio de Biniali de acuerdo con las prescripciones siguientes:&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Queda modificado el apartado de “ordenación urbanística”. Allí donde dice &lt;/span&gt;&lt;em&gt;“zona Agrícola-ganadera y suelo rústico general SRG y Área de Protección Territorial APT”&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; tiene que decir &lt;/span&gt;&lt;em&gt;“Sistema General Cementerio (SG-Cementerio)&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;.”&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Queda modificado el apartado de “normas urbanísticas”. En la casilla clasificación, donde dice &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;“SG-Cementerio”,&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; tiene que decir &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;“suelo rústico&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se añade al apartado de “normas urbanísticas” una nueva casilla de calificación &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;SG - Cementerio (Sistema General de Servicios de Infraestructuras art. 135 NOS).&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

			&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:inherit; font-size:10px"&gt;En cuanto a las servidumbres aeronáuticas del Aeropuerto de Palma:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-family:inherit; font-size:10px"&gt;El ámbito se encuentra incluido en las Zonas de Servidumbres Aeronáuticas correspondientes al Aeropuerto de Palma de Mallorca, no encontrándose afectadas por las Servidumbres Aeronáuticas del Aeropuerto de Son Bonet. En el plano que se adjunta como Anexo I a este informe, se representan las líneas de nivel de las superficies limitadoras de las Servidumbres Aeronáuticas del Aeropuerto de Palma de Mallorca que afectan a este ámbito, las cuales determinan las alturas (respecto al nivel del mar) que no debe sobrepasar ninguna construcción, equipos de aire acondicionado, cajas de ascensores, carteles, remates decorativos, etc.), modificaciones del terreno u objeto fijo (palos, antenas, aerogeneradores incluidas las palas, carteles, etc.), así como el gálibo de viario o vía férrea.&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-size:10px"&gt;Cualquier emisor radioeléctrico u otro tipo de dispositivo que pudiera dar origen a radiaciones electromagnéticas perturbadoras del normal funcionamiento de las instalaciones radioeléctricas aeronáuticas, aunque no vulnere las superficies limitadoras de obstáculos, requerirá de la correspondiente autorización de acuerdo con lo que prevé el artículo 16 del Decreto 584/72 de servidumbres aeronáuticas. Igualmente deberá indicarse que, dado que las servidumbres aeronáuticas constituyen limitaciones legales al derecho de propiedad por razón de la función social de ésta, la resolución que a estos efectos se evacuara sólo podrá generar derecho a indemnización cuando afecte a derechos ya patrimonializados.&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:inherit; font-size:10px"&gt;En cuanto a la normativa sobre autorizaciones en materia de Servidumbres Aeronáuticas:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-family:inherit; font-size:10px"&gt;Al encontrarse la totalidad del ámbito de estudio incluida en las zonas y espacios afectados por servidumbres aeronáuticas, la ejecución de cualquier construcción, instalación (palos, antenas, aerogeneradores -incluidas las palas-, medios necesarios para la construcción (incluidas las grúas de construcción y similares) o plantación, requerirá acuerdo favorable previo de la Agencia Estatal de Seguridad Aérea (AESA), conforme a los artículos 30 y 31 del Decreto 584/72 modificado por Real Decreto 297/2013.&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-size:10px"&gt;- Se propone la limitación de la velocidad a 30 km/h en los tramos inmediatos a los accesos al Cementerio y la colocación de bandas o resaltos que contribuyan a la pacificación del tráfico.&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-size:10px"&gt;- Las nuevas edificaciones se diseñarán adaptadas al entorno. La integración armónica con el entorno se procurará adoptando una arquitectura no estridente, sencilla y racional. Se emplearán tipologías, acabados y coloraciones no estridentes y tradicionales.&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-size:10px"&gt;- Diseño y dimensionado adecuado de las instalaciones, especialmente en lo que se refiere a su altura. Las nuevas construcciones tendrán las dimensiones mínimas para dar respuesta a las necesidades funcionales y en ningún caso superarán los 3,75 metros de altura.&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-size:10px"&gt;- Creación de una pantalla verde en todo el perímetro del recinto, a base de especies vegetales autóctonas de bajo requerimiento hídrico, preferentemente existentes en el entorno cercano, con una altura mínima de 3 metros y frondosidad suficiente para minimizar la intervisibilidad y disminuir el impacto acústico.&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-size:10px"&gt;- La iluminación del recinto dirigirá siempre hacia el suelo, utilizando siempre luminarias LED. La altura máxima de los báculos, se limitará a 3 metros.&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-size:10px"&gt;- En la medida de lo posible se minimizará la superficie pavimentada que se limitará a las zonas peatonales que serán, siempre que sea posible, de pavimento drenante. El vial de acceso de vehículos y la zona de aparcamiento se realizará con material drenante debidamente compactado, sin perjuicio de que en lugares de mayor tráfico se pueda estabilizar con cal o similar.&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-size:10px"&gt;- Los espacios libres de la parcela, los espacios entre las edificaciones que se proyecten y las zonas muertas del área de aparcamiento se ajardinarán con especias y arbolado autóctono con bajo requerimiento hídricos y de mantenimiento.&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-size:10px"&gt;- Se recomienda la instalación de paneles fotovoltaicos por producción de ACS o por autoconsumo (preferentemente situados en el suelo en una zona de poco impacto visual). Toda la iluminación será de LED.&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-size:10px"&gt;- Se diseñarán los edificios para minimizar las pérdidas de calor y propiciar mecanismos que minimicen la entrada directa del sol. Se trata de potenciar los mecanismos naturales por la regulación de la temperatura del interior de los edificios.&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-size:10px"&gt;- Se recomienda la construcción de un aljibe para la recogida y reutilización de aguas pluviales para el riego y labores de limpieza.&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-size:10px"&gt;- Las nuevas construcciones que estén dotadas de suministro de agua han de prever medidas de ahorro de agua como cisternas con dispositivos para economizar el agua, instalación de fontanería de bajo consumo, etc&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-size:10px"&gt;- El nuevo recinto se acondicionará para poder realizar recogida selectiva, con espacio suficiente para ubicar contenedores para los diferentes tipos de residuos.&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:inherit; font-size:10px"&gt;En cuanto a las servidumbres aeronáuticas del Aeropuerto de Palma:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-family:inherit; font-size:10px"&gt;El ámbito se encuentra incluido en las Zonas de Servidumbres Aeronáuticas correspondientes al Aeropuerto de Palma de Mallorca, no encontrándose afectadas por las Servidumbres Aeronáuticas del Aeropuerto de Son Bonet. En el plano que se adjunta como Anexo I a este informe, se representan las líneas de nivel de las superficies limitadoras de las Servidumbres Aeronáuticas del Aeropuerto de Palma de Mallorca que afectan a este ámbito, las cuales determinan las alturas (respecto al nivel del mar ) que no debe sobrepasar ninguna construcción, equipos de aire acondicionado, cajas de ascensores, carteles, remates decorativos, etc.), modificaciones del terreno u objeto fijo (palos, antenas, aerogeneradores incluidas las palas, carteles, etc.), así como el gálibo de viario o vía férrea.&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-family:inherit; font-size:10px"&gt;Cualquier emisor radioeléctrico u otro tipo de dispositivo que pudiera dar origen a radiaciones electromagnéticas perturbadoras del normal funcionamiento de las instalaciones radioeléctricas aeronáuticas, aunque no vulnere las superficies limitadoras de obstáculos, requerirá de la correspondiente autorización de acuerdo con lo que prevé el artículo 16 del Decreto 584/72 de servidumbres aeronáuticas. Igualmente deberá indicarse que, dado que las servidumbres aeronáuticas constituyen limitaciones legales al derecho de propiedad por razón de la función social de ésta, la resolución que a estos efectos se evacuara sólo podrá generar derecho a indemnización cuando afecte a derechos ya patrimonializados.&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-size:10px"&gt;&amp;nbsp;&lt;/span&gt;&lt;strong&gt;&lt;span style="font-size:10px"&gt;En cuanto a la normativa sobre autorizaciones en materia de Servidumbres Aeronáuticas:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-family:inherit; font-size:10px"&gt;Al encontrarse la totalidad del ámbito de estudio incluida en las zonas y espacios afectados por servidumbres aeronáuticas, la ejecución de cualquier construcción, instalación (palos, antenas, aerogeneradores -incluidas las palas-, medios necesarios para la construcción (incluidas las grúas de construcción y similares) o plantación, requerirá acuerdo favorable previo de la Agencia Estatal de Seguridad Aérea (AESA), conforme a los artículos 30 y 31 del Decreto 584/72 modificado por Real Decreto 297/2013.&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-family:inherit; font-size:10px"&gt;Servidumbre relativa al Ámbito de Protección Territorial (APT) de Carreteras.&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-family:inherit; font-size:10px"&gt;Servidumbre de 8 m. a su lado Oeste relativo al camino de Consell, que pertenece a la “red vial local o rural” de acuerdo con la Ley 5/1990, de 24 de mayo, de Carreteras.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La publicación de este acuerdo se hace en reserva de la aprobación del Acta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Contra este acuerdo, que agota la vía administrativa, se puede interponer recurso contencioso administrativo delante de la Sala Contenciosa Administrativa del Tribunal Superior de Justicia de las Illes Balears, en el plazo de dos meses, contadores a partir del día siguiente a la publicación del presente acuerdo. Todo eso de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa. No obstante lo anterior, se puede ejercitar, si es el caso, cualquier otro recurso que se estime pertinente.&lt;/span&gt;&lt;/p&gt;
