&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El 3 de julio de 2021 se publicó la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (Programa MOVES III) mediante la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 2021, modificada por la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 3 de agosto de 2022 (BOIB núm. 103, de 6 de agosto de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Las personas o entidades que figuran en el anexo de esta Resolución presentaron una solicitud de subvención en el marco de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Los titulares de los expedientes que aparecen en el anexo han presentado un escrito en el que indican que desisten de la citada solicitud de subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El consejero de Empresa, Empleo y Energía es el órgano competente para resolver el procedimiento dado el Decreto 12/2023, de 10 de julio, de la presidenta de les Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de les Illes Balears (modificado por el Decreto 16/2023, de 20 de julio, de la presidenta de les Illes Balears), competencia delegada en el director general de Economía Circular, Transición energética y Cambio Climático por la Resolución del consejero de Empresa, Empleo y Energía de 20 de julio de 2023 de delegación de competencias y de suplencia de los órganos directivos de la Consejería (BOIB núm. . 103, de 22 de julio de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El Decreto legislativo&amp;nbsp;2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de subvenciones (BOIB núm.&amp;nbsp;196, de 31 de diciembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. El artículo 94, de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, prevé que la Administración, en el supuesto de renuncia de la persona interesada a sus derechos, aceptará la renuncia completamente y resolverá el procedimiento declarando esta circunstancia, con indicación de los hechos producidos y normas aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. La Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 2021 por la que se aprueba la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (Programa MOVES III) en el marco del Plan de Recuperación, Transformación y Resiliencia Europeo (BOIB núm. 88, de 3 de julio de 2021), modificada por la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 3 de agosto de 2022 (BOIB núm. 103, de 6 de agosto de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Por todo ello, dicto la siguiente,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. Aceptar el desistimiento de la solicitud de subvención presentada por los beneficiarios de los expedientes que aparecen en el Anexo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. Declarar concluido el procedimiento y por tanto, archivar el expediente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. Publicar esta Resolución en el &lt;em&gt;Boletín Oficial de les Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Empresa, Empleo y Energía en el plazo de un mes a contar desde el día siguiente de la publicación, de acuerdo con los artículos&amp;nbsp;123 y 124 de la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo&amp;nbsp;57 de la Ley&amp;nbsp;3/2003, de 26 de marzo, de régimen jurídico del Administración de la Comunidad Autónoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;También puede interponerse directamente un recurso contencioso administrativo ante la Sala de lo Contencioso Administrativo del Tribunal Superior de Justicia de les Illes Balears en el plazo de dos meses a contar desde el día siguiente de la publicación de la resolución, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
