    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Hechos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. &lt;/span&gt;La Orden de la Consejera de Administraciones Públicas y Modernización de 1 de junio de 2020 por la que se aprueban las funciones de los puestos de trabajo de la Consejería de Administraciones Públicas y Modernización y de la Escuela Balear de Administración Pública (de ahora en adelante, EBAP) dispone, en el artículo 3, que en el caso de vacante de Jefes de Departamento o de Servicio o en ausencia de la persona titular, tiene que asumir las funciones el Jefe o la Jefa de Departamento o de Servicio que designe el órgano directivo al cual está adscrito el puesto de trabajo, todo esto sin perjuicio del régimen ordinario de suplencias que, si se tercia, se establezca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Además, dispone que en el resto de puestos de trabajo vacantes o en ausencia de la persona titular, asume las funciones la persona que ocupa el puesto de trabajo inmediatamente superior jerárquicamente, en conformidad con los anexos 2 y 4 de la orden mencionada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. &lt;/span&gt;&lt;span style="color:#000000"&gt;El &lt;/span&gt;&lt;span style="color:#000000"&gt;artículo 12 &lt;/span&gt;&lt;span style="color:#000000"&gt;de l&lt;/span&gt;&lt;span style="color:#000000"&gt;o&lt;/span&gt;&lt;span style="color:#000000"&gt;s &lt;/span&gt;&lt;span style="color:#000000"&gt;Estatutos de &lt;/span&gt;&lt;span style="color:#000000"&gt;la&lt;/span&gt;&lt;span style="color:#000000"&gt; E&lt;/span&gt;&lt;span style="color:#000000"&gt;BAP,&lt;/span&gt;&lt;span style="color:#000000"&gt; aprobados por el Decreto 31/2012, de 13 de abril, &lt;/span&gt;&lt;span style="color:#000000"&gt;establece&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;que&lt;/span&gt;&lt;span style="color:#000000"&gt; «La Dirección Gerencia es el órgano unipersonal directivo de l&lt;/span&gt;&lt;span style="color:#000000"&gt;a&lt;/span&gt;&lt;span style="color:#000000"&gt; EBAP y asume la dirección, la administración y la gestión ordinaria del ente, tal como establece el artículo 20 de la Ley 7/2010». &lt;/span&gt;&lt;span style="color:#000000"&gt;Por otro lado,&lt;/span&gt;&lt;span style="color:#000000"&gt; entre las atribuciones &lt;/span&gt;&lt;span style="color:#000000"&gt;de este órgano&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;está&lt;/span&gt;&lt;span style="color:#000000"&gt; la dirección del personal de l&lt;/span&gt;&lt;span style="color:#000000"&gt;a EBAP, como también cualquier otra que no esté expresamente reservada al resto de órganos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. Por razones de operatividad, se considera conveniente aprobar un régimen de suplencias en caso de vacante o de ausencia,&lt;/span&gt;&lt;span style="color:#000000"&gt; enfermedad o cualquiera otro impedimento&lt;/span&gt;&lt;span style="color:#000000"&gt; de&lt;/span&gt;&lt;span style="color:#000000"&gt;l Jefe o la Jefa del Departamento de Formación y Selección para garantizar en todo momento la continuidad de las funciones atribuidas a la persona titular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. El artículo 13 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. El artículo 32 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad&lt;/span&gt;&lt;span style="color:#000000"&gt; Autónoma de las &lt;/span&gt;&lt;span style="color:#000000"&gt;Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. &lt;/span&gt;&lt;span style="color:#000000"&gt;El art&lt;/span&gt;&lt;span style="color:#000000"&gt;ículo&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;3 de &lt;/span&gt;&lt;span style="color:#000000"&gt;l&lt;/span&gt;&lt;span style="color:#000000"&gt;a&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;Orden de la &lt;/span&gt;&lt;span style="color:#000000"&gt;C&lt;/span&gt;&lt;span style="color:#000000"&gt;onsejera de Administraciones Públicas y Modernización de 1 de junio de 2020 por la &lt;/span&gt;&lt;span style="color:#000000"&gt;que&lt;/span&gt;&lt;span style="color:#000000"&gt; se aprueban las funciones de los puestos de trabajo de la Consejería de Administraciones Públicas y Modernización y de la Escuela Balear de Administración Pública&lt;/span&gt;&lt;span style="color:#000000"&gt; (BOIB núm. &lt;/span&gt;&lt;span style="color:#000000"&gt;103&lt;/span&gt;&lt;span style="color:#000000"&gt;, de 6 &lt;/span&gt;&lt;span style="color:#000000"&gt;de junio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. &lt;/span&gt;&lt;span style="color:#000000"&gt;El Decreto 31/2012, de 13 de abril, por el cual se aprueban los Estatutos de la Escuela Balear de Administración Pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Por todo esto, dicto la siguiente &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Aprobar el régimen de suplencia del Jefe o la Jefa&lt;/span&gt;&lt;span style="color:#000000"&gt; del Departamento de Formación y Selección de la Escuela Balear de Administración Pública en los términos &lt;/span&gt;&lt;span style="color:#000000"&gt;que se indican a continuación, y designar suplentes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;a) El jefe o jefa del Servicio de Gestión Administrativa y Económica, en el ejercicio de las funciones relativas al área de gestión económica y asuntos generales atribuidas al jefe o a la jefa del Departamento de Formación y Selección. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;b) El jefe o jefa de sección de Gestión Económica en el ejercicio de las funciones relativas al área de gestión económica atribuidas al jefe o jefa de Departamento de Formación y Selección.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;c) El jefe o la jefa del Servicio de Formación y Gestión del Personal, en el ejercicio de las funciones relativas al área de &lt;/span&gt;&lt;span style="color:#000000"&gt;formación en línea e innovación atribuidas al jefe o la jefa del Departamento de Formación y Selección. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;d) El jefe o la jefa del Servicio de Selección en el ejercicio de las funciones relativas al área de selección atribuidas al jefe o la jefa del Departamento de Formación y Selección.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;e) El jefe o la jefa del Servicio de Régimen Jurídico, en el ejercicio de las funciones relativas al área jurídica atribuidas al jefe o a la jefa del Departamento de Formación y Selección.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;f) El jefe o la jefa del Servicio de Provisión, en el ejercicio de las funciones relativas al área de provisión atribuidas al jefe o la jefa del Departamento de Formación y Selección.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;g) El jefe o la jefa del Servicio &lt;/span&gt;&lt;span style="color:#000000"&gt;d&lt;/span&gt;&lt;span style="color:#000000"&gt;e Asesoramiento Jurídico de Selección y Provisión &lt;/span&gt;&lt;span style="color:#000000"&gt;de &lt;/span&gt;&lt;span style="color:#000000"&gt;la &lt;/span&gt;&lt;span style="color:#000000"&gt;EBAP, en el ejercicio de las funciones relativas al área jurídica de selección y provisión atribuidas al jefe o la jefa del Departamento de Formación y Selección.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;h) El jefe o la jefa del Servicio d&lt;/span&gt;&lt;span style="color:#000000"&gt;e&lt;/span&gt;&lt;span style="color:#ce181e"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;Gestió&lt;/span&gt;&lt;span style="color:#000000"&gt;n&lt;/span&gt;&lt;span style="color:#000000"&gt; Formativa &lt;/span&gt;&lt;span style="color:#000000"&gt;y&lt;/span&gt;&lt;span style="color:#000000"&gt; Administrativa,&lt;/span&gt;&lt;span style="color:#ce181e"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;en el ejercicio de las funciones relativas al área de seguridad y emergencias atribuidas al jefe o la jefa del Departamento de Formación y Selección. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;i) El jefe o la jefa de &lt;/span&gt;&lt;span style="color:#000000"&gt;Estudi&lt;/span&gt;&lt;span style="color:#000000"&gt;os&lt;/span&gt;&lt;span style="color:#000000"&gt; I, en &lt;/span&gt;&lt;span style="color:#000000"&gt;el ejercicio de las funciones relativas al área de formación general, continua &lt;/span&gt;&lt;span style="color:#000000"&gt;y&lt;/span&gt;&lt;span style="color:#000000"&gt; interadministrativa atribuidas al jefe o la jefa del Departamento de Formación y Selección. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;j) El &lt;/span&gt;&lt;span style="color:#000000"&gt;jefe o la jefa de &lt;/span&gt;&lt;span style="color:#000000"&gt;Estudi&lt;/span&gt;&lt;span style="color:#000000"&gt;os&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;III, &lt;/span&gt;&lt;span style="color:#000000"&gt;en &lt;/span&gt;&lt;span style="color:#000000"&gt;el ejercicio de las funciones relativas al área de lenguas atribuidas al jefe o la jefa del Departamento de Formación y Selección. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;k) El asesor o la asesora técnica en el ejercicio de sus funciones, atribuidas al jefe o la jefa del Departamento de Formación y Selección. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. &lt;/span&gt;&lt;span style="color:#000000"&gt;Dejar sin efectos la Resolución de la dirección gerencia de la Escuela Balear de Administración Pública de 5 de julio de 2021 por la que se aprueba el régimen de suplencia y se designan las personas suplentes del jefe o la jefa del Departamento de Formación y Selección, de los jefes de servicio o de los jefes de estudio de la Escuela (BOIB núm. 92. de 10 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. &lt;/span&gt;&lt;span style="color:#000000"&gt;Ordenar la publicació&lt;/span&gt;&lt;span style="color:#000000"&gt;n&lt;/span&gt;&lt;span style="color:#000000"&gt; d&lt;/span&gt;&lt;span style="color:#000000"&gt;e esta R&lt;/span&gt;&lt;span style="color:#000000"&gt;esolució&lt;/span&gt;&lt;span style="color:#000000"&gt;n&lt;/span&gt;&lt;span style="color:#000000"&gt; en el &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;B&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;oletín&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; Oficial de l&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;s Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
