    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Antecedentes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. El día 25 de abril de 2024 se publicó en el Boletín Oficial de las Islas Baleares núm. 55 la Resolución del consejero de Empresa, Empleo y Energía de 22 de abril de 2024 por la cual se aprueba la convocatoria para conceder subvenciones para la implementación de planes de igualdad y la ejecución de acciones de igualdad, fomento y asesoramiento para la implementación de estos planes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. Los servicios técnicos de la Dirección General de Trabajo y Salud Laboral han evaluado las solicitudes, conforme a los criterios, formas y prioridades de valoración establecidos en la convocatoria, y se puede decir que los solicitantes que figuran en el anexo 1:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- Han presentado la solicitud y la documentación del proyecto dentro del plazo previsto en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- Están al corriente de las obligaciones con la Seguridad Social y con la Administración tributaria, tanto estatal como autonómica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- Pueden ser beneficiarios de la subvención objeto de convocatoria por su naturaleza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3. En fecha 17 de julio de 2024 la Comisión Evaluadora, examinadas la solicitudes, ha emitido informe de evaluación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;4. La subvención propuesta se distribuye en las cantidades especificadas en el anexo 1, por cada beneficiario, al aplicar el 100 % al coste considerado como elegible (IVA excluido), según el que prevé el apartado séptimo de la convocatoria de la subvención, y con un importe máximo subvencionable por beneficiario en los programas 1 y 2 de 7.000 euros, IVA excluido, y un importe máximo subvencionable por beneficiario en el programa 3 de 50.000 euros, IVA excluido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;5. Hay crédito adecuado y suficiente para atender los expedientes que figuran en el anexo 1, en las partidas presupuestarias 19601 322B01 47000 00 23090 y 19601 322B01 48000 00 23090 del presupuesto de la Comunidad Autónoma de las Islas Baleares vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;6. Las ayudas concedidas en el marco de esta convocatoria constituyen ayudas de Estado sometidos a la norma de las ayudas de minimis, por lo cual a estos beneficiarios se les tiene que aplicar la norma de las ayudas de minimis que determina que el importe total de las ayudas de minimis a una única empresa no puede ser superior a 300.000 euros durante cualquier periodo de tres años (artículo 3 del Reglamento [UE] n.º 2023/2831 de la Comisión, de 13 de diciembre de 2023, relativo a la aplicación de los artículos 107 y 108 del Tratado de funcionamiento de la Unión Europea a las ayudas de minimis ―Diario Oficial de la Unión Europea de 15 de diciembre de 2023, DOUE-L-2023-2831―).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. Ley Orgánica 3/2007, de 22 de marzo, para la igualdad efectiva de mujeres y hombres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. La Ley 11/2016, de 28 de julio, de igualdad de mujeres y hombres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3. La Ley 38/2003, de 17 de noviembre, general de subvenciones (BOE n.º 276, de 18 de noviembre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;4. El Decreto Legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el Texto refundido de la Ley de subvenciones (BOIB n.º 196, de 31 de diciembre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;7. La Ley 12/2023, de 29 de diciembre, de presupuestos generales de la Comunidad Autónoma de las Islas Baleares para el año 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;8. El Decreto 75/2004, de 27 de agosto, por el cual se despliegan determinados aspectos de la Ley de finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Islas Baleares (BOIB n.º 122, de 31 de septiembre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;13. La Orden del consejero de Trabajo y Formación de 4 de mayo de 2005, por la cual se aprueban las bases reguladoras de las subvenciones en materia de trabajo y formación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;14. El Plan Estratégico de Subvenciones de la Comunidad Autónoma de las Islas Baleares para los ejercicios 2024-2026, aprobado por el Acuerdo del Consejo de Gobierno de 19 de abril de 2024 (BOIB núm. 52, de 20 de abril de 2024).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;15. El Decreto 12/2023, de 10 de julio, de la presidenta de las Islas Baleares, por el cual se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares modificado por el Decreto 16/2023, de 20 de julio; por el Decreto 17/2023, de 23 de agosto; por el Decreto 1/2024, de 4 de enero, y por el Decreto 4/2024, de 17 de mayo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;16. En fecha 17 de julio de 2024 la Comisión Evaluadora, examinadas la solicitudes, ha emitido informe de evaluación en que se concluye:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;a) La aprobación de la concesión de la subvención a las entidades beneficiarias que figuran en el anexo 1, y por el importe individual indicado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;b) La inadmisión de la solicitud de la subvención a las entidades que figuran en el anexo 2, por incumplimiento de los requisitos establecidos en el apartado 2.2 y 2.4 de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;c) La aceptación del desistimiento de la solicitud de la subvención a las entidades que figuran en el anexo 3.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Propuesta de resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Propongo al consejero de Empresa, Empleo y Energía que dicte una resolución en los términos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. Aprobar la concesión de la subvención a las entidades beneficiarias que figuran en el anexo 1, y por el importe individual indicado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. Inadmitir las solicitudes de la subvención a las entidades que figuran en el anexo 2, por incumplimiento de los requisitos establecidos en el apartado 2.2 y 2.4 de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3. Aceptar los desistimientos de las solicitudes de la subvención a las entidades que figuran en el anexo 3.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;4. Autorizar y disponer un gasto global de 315.806,75 euros a favor de las entidades que figuran en el anexo 1, con cargo a las siguientes partidas presupuestarias del presupuesto vigente de la Comunidad Autónoma de las Islas Baleares:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- 19601 322B01 47000 00 23090&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- 19601 322B01 48000 00 23090&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;5. Conceder un plazo de diez días hábiles para que los interesados hagan, si procede, las alegaciones que consideren oportunas. En caso de que no se presenten alegaciones se entenderá que los interesados están conformes con el contenido de la propuesta y que aceptan la subvención y la propuesta se elevará a definitiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;6. Informar a los beneficiarios de lo siguiente: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;a) El pago de la subvención únicamente se puede hacer efectivo una vez dictada la resolución correspondiente y justificada de manera suficiente la realización de la actividad subvencionada, mediante la presentación de la documentación a la cual se hace referencia en el apartado decimosexto de la Resolución de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;b) Las inversiones objeto de las solicitudes tienen que ser ejecutadas y pagadas en el periodo comprendido entre el 1 de enero de 2024 y el 31 de octubre de 2024 (ambos incluidos).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;c) El plazo para justificar la realización de las actividades subvencionadas y para solicitar el pago de la subvención finaliza el 10 de noviembre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;d) La falta de justificación en los términos y en los plazos que establece esta Resolución, la modificación significativa del proyecto presentado sin que esta Consejería la haya aprobado previamente, y también la desviación de las subvenciones o la aplicación diferente a la que establece la norma determinan la revocación de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
