Ayuntamiento de Eivissa, acordó aprobar inicialmente la Ordenanza reguladora de la prestación patrimonial de carácter público no tributario de los servicios de abastecimiento de agua potable y alcantarillado del Ayuntamiento de Eivissa.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Que una vez concluído el plazo de información pública de la citada Ordenanza, queda aprovada&amp;nbsp;definitivamente de forma automática por transcurrir el plazo de información pública sin la presentación de alegaciones contra el texto aprovado inicialmente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Mediante el presente, se publica el texto íntegro de la Ordenanza reguladora de la prestación patrimonial de carácter público no tributario de los servicios de abastecimiento de agua potable y alcantarillado del Ayuntamiento de Eivissa, para su general conocimiento, de conformidad con el artículo 103 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares, en relación con el artículo 113 de la misma ley, al efecto de su entrada en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Contra este acuerdo, que agota la via administrativa, se puede interponer recurso contencioso administrativo delante de la Sala contenciosa administrativa del Tribunal Superior de Justicia de las Islas Baleares en el plazo de dos meses, a contar desde el día&amp;nbsp; siguiente a la publicación en el Boletín Oficial de las lslas Baleares, de conformidad con el que se establecen los artículos 10 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdición contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;ORDENANZA REGULADORA DE LA PRESTACIÓN PATRIMONIAL DE CARÁCTER PÚBLICO NO TRIBUTARIO DE LOS SERVICIOS DE ABASTECIMIENTO DE AGUA POTABLE Y ALCANTARILLADO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Artículo 1&lt;/strong&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Fundamento y naturaleza&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Es objeto de esta Ordenanza regular las prestaciones patrimoniales de carácter público no tributarias y tarifas correspondientes a la prestación de los servicios de abastecimiento de agua potable y alcantarillado de las zonas urbanas del municipio de Ibiza, todo esto en uso de las atribuciones conferidas por los artículos 31, 133 y 142 de la Constitución y de la potestad reglamentaria conferida por los artículos 4, 84 y 105 de la Ley 7/1985, de 2 de abril, reguladora de las Bases de Régimen Local, la naturaleza jurídica de la cual es establecida en el apartado 6 del artículo 20 del Texto refundido de la Ley reguladora de Haciendas Locales, aprobado por Decreto Legislativo 2/2004, de 5 de marzo, en la redacción aprobada por la disposición final doceava de la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;De acuerdo con el que dispone el mencionado artículo 20.6, las contraprestaciones económicas establecidas coactivamente que se perciban por la prestación de los servicios públicos objeto de esta ordenanza, realizada de forma directa mediante personificación privada o mediante gestión indirecta, tienen la consideración de prestaciones patrimoniales de carácter público no tributario de acuerdo con el que prevé el artículo 31.3 de la Constitución, constituyendo ingreso propio del gestor de estos servicios, en conformidad con el que dispone la disposición adicional primera de la Ley 58/2003, de 17 de diciembre, General Tributaria, en relación con el artículo 289.2, de la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público, por la cual se trasponen al ordenamiento jurídico español las Directivas de Parlamento Europeo y de Consejo, 2014/23/UE y 2014/24/UE, de 26 de febrero de al 2014.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;En concreto, tendrán tal consideración aquellas exigidas por la prestación de servicios, en régimen de concesión, sociedades de economía mixta, entidades públicas empresariales, sociedades de capital íntegramente público y otras fórmulas de derecho privado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Sin perjuicio del que establece el artículo 103 de la Ley de Contratos de Sector Público, las contraprestaciones económicas a que se refiere este apartado se regularán mediante ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Los servicios regulados en la presente ordenanza se gestionan en régimen de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Artículo 2&lt;/strong&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Presupuesto de hecho legitimador&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Constituye el presupuesto de hecho legitimador la prestación por este Ayuntamiento del servicio de abastecimiento de agua potable y alcantarillado de las zonas urbanas del municipio de Ibiza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;En conformidad con la legislación vigente y por razones higiénico-sanitarias, los servicios de abastecimiento de agua potable y alcantarillado de la red de saneamiento se declaran de recepción obligatoria para aquellas zonas, sectores o calles donde se encuentre instalado lo primero. Si no lo está, los que desean utilizarlo tendrán que costear su instalación desde la finca que lo tiene que disfrutar hasta el punto en que la Sección Técnica determine para la conexión en la red de alcantarillado de saneamiento. En atención al carácter de servicio de recepción obligatoria, la obligación de contribuir por ambos servicios nace por el sol hecho de estar abonado al servicio de abastecimiento de agua potable, cuando la zona, sector o calle donde se ubica la vivienda, industria o local tenga conexión con el servicio de alcantarillado de la red de saneamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Artículo 3&lt;/strong&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Personas obligades al pago&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Están obligados al pago por los servicios regulados en esta ordenanza las personas físicas o jurídicas y las entidades a que se refiere el artículo 35.4 de la Ley 58/2003 General Tributaria que soliciten o resulten beneficiadas de los servicios o actividades, prestados o realizados por este Ayuntamiento, por sí o a través de entidad concesionaria, a que se refiere el artículo anterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Artículo 4&lt;/strong&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Responsables&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;En relación con la responsabilidad solidaria y subsidiaria de las prestaciones patrimoniales, se estará a aquello que se ha fijado en el artículos 41, 42 y 43 de la Ley 58/2003, de 17 de diciembre, General Tributaria, de acuerdo con la remisión a esta norma efectuada por el artículo 10 de la ley 47/2003, de 26 de noviembre, General Presupuestaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Artículo 5&lt;/strong&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Exenciones y bonificaciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;No se concederá exención ni bonificación en la exacción de las tarifas contenidas en la presente ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Artículo 6&lt;/strong&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Tarifas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;6.1. Las tarifas por el servicio de abastecimiento de agua potable serán las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;6.1.1. Se establecen las siguientes tarifas en concepto de derechos de acometida por alta en el servicio a las viviendas unifamiliares, apartamentos y plazas hoteleras:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Cada vivienda, apartamento, chalé, oficina, local comercial o industrial, equivale al término usuario/a.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Por hoteles, hostales, pensiones o cualquier otro tipo de establecimiento turístico, cada 4 plazas equivale a una vivienda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Para las urbanizaciones y obras dadas de alta como un solo abonado, mientras se desarrollan y se construye la infraestructura, se aplicará la tarifa del bloque 3.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Si en estas urbanizaciones, hay viviendas construidos y con cédula de habitabilidad concedida, la aplicación de la cuota a estos viviendas será la general por bloques, siempre que se hubiera presentado la documentación exigida por la normativa en vigor ante el concesionario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;En comunidades de propietarios sin contador divisionario se aplicará la cuota de servicio al contador general, así como para cada uno de los usuarios/se que la integran.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Se considera usuario a toda unidad de viviendas, apartamentos, chalé, y en cada cuatro plazas de hotel, hostal, pensiones o similares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;El corte o precinto del contador por falta de pago y/o por baja temporal implicará, en el momento de la rehabilitación, el pago de 84,00 euros por cada vivienda, apartamento o local comercial y por cada cuatro plazas hoteleras suministradas por un contador en concepto de cuota de reconexión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;6.2. Las tarifas por el servicio de alcantarillado serán las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;6.2.1. La tarifa correspondiente a la concesión de la licencia o autorización de acometida en la red de alcantarillado de saneamiento se exigirá por una sola vez y consistirá en la cantidad fija de 210,36 euros por vivienda, apartamento, local y cada cuatro plazas hoteleras. Los consumos derivados de grifos comunitarios estarán exentos del pago.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;6.2.2. La tarifa a exigir por la prestación de servicio de alcantarillado se determinará en función de la cantidad de agua, mesurada en metros cúbicos, utilizada por el usuario/a mediante el servicio de abastecimiento. Para el caso de viviendas y locales sin contador del Servicio Municipal de Aigües, se aplicará cuota fija mensual.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Se establecen las siguientes tarifas por cuota de consumo de servicio de alcantarillado:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Para responder de posibles impagos de los caudales de agua suministrados, cada peticionario del servicio tendrá que depositar una fianza equivalente a las cuotas de servicio de tres periodos según las tarifas en vigor en cada momento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Dichas cantidades serán devueltas a la finalización del contrato de no tener pendientes recibidas por suministro.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Artículo 7&lt;/strong&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Cobro&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;El cobro de las tarifas se hará mediante recibos trimestrales, excepto los de los viviendas y locales sin contador, que será mediante recibos anuales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Para los grandes consumidores, excluyendo a viviendas, si estos lo solicitan de manera voluntaria al servicio, el abono de las tarifas podrá ser mensual.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Las contraprestaciones económicas establecidas coactivamente que se perciban por la prestación de los servicios públicos a que se refiere esta ordenanza, realizadas de manera directa mediante personificación privada o mediante gestión indirecta, tendrán la condición de prestaciones patrimoniales de carácter público no tributario conforme al que se prevé en el artículo 31.3 de la Constitución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;En concreto, tendrán tal consideración aquellas exigidas por la explotación de obras o la prestación de servicios, en régimen de concesión, sociedades de economía mixta, entidades públicas empresariales, sociedades de capital íntegramente público y otras fórmulas de Derecho privado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Sin perjuicio del que se establece en el artículo 103 de la Ley de Contratos del Sector Público, las contraprestaciones económicas a que se refiere este apartado se regularán mediante ordenanza. Durante el procedimiento de aprobación de esta ordenanza las entidades locales solicitarán informe preceptivo de aquellas Administraciones Públicas a las cuales el ordenamiento jurídico les atribuyera alguna facultad de intervención sobre estas.&lt;/span&gt;&lt;/span&gt;​​​​​​​&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Artículo 8&lt;/strong&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Devengo y normas de gestión&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;8.1. Servicio de abastecimiento de agua potable&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Se merita la tarifa y nace la obligación del pago de la misma desde el momento en que se inicie la prestación del servicio o la realización de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Los sujetos pasivos sustitutos del contribuyente formularán las declaraciones de alta y baja en el censo de sujetos pasivos, en el plazo que hay entre la fecha en que se produzca la variación en la titularidad de la finca y el último día del mes natural siguiente. Estas últimas declaraciones tendrán efecto a partir de la primera liquidación que se practique una vez finalizado el plazo de presentación de las mencionadas declaraciones de alta y baja.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;La inclusión inicial en el censo se hará de oficio una vez concedida la licencia de acometida en la red.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Las tarifas exigibles se liquidarán y recaudarán trimestralmente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;En el supuesto de licencia de acometida, el contribuyente formulará la oportuna solicitud y el servicio, una vez concedida aquella, practicarán la liquidación que sea procedente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;8.2. Servicio de alcantarillado&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Se merita la tarifa y nace la obligación del pago de la misma desde el momento en que se inicie la prestación del servicio o la realización de la actividad, entendiéndose iniciada la misma:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;En la fecha de presentación de la oportuna solicitud de la licencia de acometida, si el sujeto pasivo la formula expresamente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Desde que tenga lugar la efectiva acometida en la red de alcantarillado de saneamiento municipal. El devengo se producirá con independencia que se haya obtenido o no la licencia de acometida y sin perjuicio del inicio del expediente administrativo que se pueda instruir para su autorización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Los servicios de evacuación de excretas, aguas negras y residuales, tienen carácter obligatorio para todas las fincas del municipio que tengan fachada en las calles, plazas o vías públicas en que haya red de alcantarillado de saneamiento, siempre que la distancia entre la red y la finca no exceda de cien metros, y se meritará la tarifa a pesar de que las personas interesadas no procedan a efectuar la conexión a la red.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Los sujetos pasivos sustitutos del contribuyente formularán las declaraciones de alta y baja en el censo de sujetos pasivos por el presente servicio, en el plazo que hay entre la fecha en que se produzca la variación en la titularidad de la finca y el último día del mes natural siguiente. Estas últimas declaraciones tendrán efecto a partir de la primera liquidación que se practique una vez finalizado el plazo de presentación de estas declaraciones de alta y baja. La inclusión inicial en el censo se hará de oficio una vez concedida la licencia de acometida en la red.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Las tarifas exigibles por este servicio se liquidarán y recaudarán por los mismos periodos y en los mismos plazos que los recibos de suministro y consumo de agua.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;En el supuesto de licencia de acometida, el contribuyente formulará la oportuna solicitud y el servicio, una vez concedida aquella, practicarán la liquidación que sea procedente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;VIGENCIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;La presente ordenanza, aprobada por el Pleno de este Ayuntamiento de Ibiza, tendrá efectos a partir de la entrada en vigor del nuevo contrato de concesión de servicio de abastecimiento de agua y alcantarillado del municipio de Ibiza, y continuará en vigor hasta que se acuerde su modificación o derogación expresa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
