    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;ANTECEDENTES DE HECHO &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Primero.- &lt;/strong&gt;El Reglamento regulador para la organización, instalación y montaje de mercados periódicos y temporales en el término municipal de Calvià ( BOIB nº 158 de 9/11/2004. Corrección de errores en BOIB nº 175 de 9/12/2004), en su artículo 12, establece como mercado periódico el mercado tradicional en Calvià Vila ( frecuencia semanal; cada lunes).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Segundo.-&lt;/strong&gt; Por Decreto de Alcaldía de fecha 7 de enero de 2008, se instauró el mercado tradicional de Son Ferrer ( frecuencia semanal; cada viernes).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Tercero.- &lt;/strong&gt;Por Decreto de Alcaldía de fecha 8 de abril de 2013 se instauró el mercado tradicional de Peguera ( frecuencia semanal; cada martes) y Santa Ponça ( frecuencia semanal; cada sábado). &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Cuarto.-&lt;/strong&gt; Por lo tanto, en la actualidad, los mercados periódicos del término son los siguientes: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ol class="lower-roman" start="1"&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Mercado tradicional en Calvià Vila ( frecuencia semanal, cada lunes). &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Mercado tradicional en Peguera ( frecuencia semanal, cada martes). &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Mercado tradicional en Son Ferrer ( frecuencia semanal, cada viernes). &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Mercado tradicional en Santa Ponça ( frecuencia semanal, cada sábado)&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ol&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Quinto.-&lt;/strong&gt; Consta informe de la sección de Comercio de fecha 12/06/2024. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;VALORACIÓN JURÍDICA &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Primero.- &lt;/strong&gt;La Ley estatal 7/1996, de 15 de enero, de Ordenación del Comercio Minorista define la venta ambulante o no sedentaria como aquella “realizada por comerciantes, fuera de un establecimiento comercial permanente”. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Segundo.- &lt;/strong&gt;De acuerdo con &lt;strong&gt; &lt;/strong&gt;el artículo 44 de la Ley 11/2014, de 15 de octubre, de Comercio de las Illes Balears, la venta ambulante o no sedentaria es aquella “realizada fuera de un establecimiento comercial permanente, de manera habitual, ocasional, periódica o continuada, en los perímetros o lugares debidamente autorizados, en instalaciones comerciales desmontables o transportables, incluyendo los camiones tienda”. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Tercero.- &lt;/strong&gt;En el artículo 45 de la mencionada ley 11/2014, se establecen las modalidades de venta ambulante. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Cuarto.- &lt;/strong&gt;El artículo 13.2 del Reglamento regulador para la organización, instalación y montaje de los mercados periódicos y temporales en el término municipal de Calvià ( BOIB nº 158 de 9/11/2004. Corrección de errores en el BOIB nº 175 de 9/12/12004), establece las competencias de Alcaldía, entre ellas: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;“ a.- El establecimiento,delimitación y supresión de los mercados temporales periódicos”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Quinto.- &lt;/strong&gt;El artículo 17 del Reglamento municipal, en el punto 1.h establece la posibilidad de que por Alcaldía se puedan autorizar por su interés y atractivo, una serie de productos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Sexto.- &lt;/strong&gt;El artículo 88.6 de la Ley 39/2015 dispone que “la aceptación de informes o dictámenes servirá de motivación a la resolución cuando se incorporen al texto de la misma”. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Examinada la normativa anterior, al amparo de los artículos 13 y 17 del reglamento municipal y demás normativa aplicable, en virtud de las facultades conferidas en el artículo 21 de la Ley 7/1985, de 2 de abril, de Bases de Régimen Local, y en virtud de la delegación conferida por decreto de Alcaldía de fecha 12/01/2024&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;/div&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;RESUELVO &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;PRIMERO.- ESTABLECER &lt;/strong&gt;los nuevos mercados temporales periódicos que, con frecuencia semanal, se celebrarán en el municipio de Calvià, según el siguiente detalle: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;MERCADO SEMANAL DE EL TORO&lt;/strong&gt;; todos los miércoles, en las vías y zonas públicas que se determinan en el Anexo I adjunto, que forma parte integrante de la presente resolución. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;MERCADO SEMANAL DE PALMANOVA; &lt;/strong&gt; todos los domingos, en las vías y zonas públicas que se determinan en el Anexo I adjunto, que forma parte integrante de la presente resolución. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;MERCADO SEMANAL DE MAGALUF;&lt;/strong&gt; todos los jueves, en las vías y zonas públicas que se determinan en el Anexo I adjunto, que forma parte integrante de la presente resolución. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;La organización, instalación, procedimiento de adjudicación, derechos y obligaciones, así como lo referido al régimen sancionador, estos mercados se regirán por lo establecido en el Reglamento municipal vigente, las bases aprobadas para la concesión de las autorizaciones correspondientes, y demás normativa municipal, autonómica y estatal vigente que resulte de aplicación. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;SEGUNDO.-&lt;/strong&gt; El&lt;strong&gt; periodo de presentación de solicitudes &lt;/strong&gt;de estos mercados para &lt;strong&gt;este primer año (2024)&lt;/strong&gt; será desde el día siguiente a la publicación de la presente resolución en el Boletín Oficial de las Illes Balears ( BOIB) y durante un plazo de diez días hábiles. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Para los años posteriores, el periodo de presentación de solicitudes se ajustará a lo establecido en las bases de concesión de las autorizaciones para los mercados periódicos ( BOIB nº 179, de 17 de octubre), o sus posteriores modificaciones. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;TERCERO.- AUTORIZAR&lt;/strong&gt; para los tres mercados las siguientes categorías: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1.- ALIMENTACIÓN. Frutas y verduras. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2.- ALIMENTACIÓN. Pan y repostería. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3.- ALIMENTACIÓN. Charcutería y conservas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4.- ALIMENTACIÓN. Frutos secos, encurtidos y golosinas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;5.- ALIMENTACIÓN. Carnes “al ast” y comidas preparadas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;6.- PLANTAS. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;7.- PRODUCTOS ARTESANALES Y ECOLÓGICOS NO COMESTIBLES. Los productos artesanales con carta de artesano vigente otorgada por el Consejo Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;8.- TEXTIL. Ropa interior. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;CUARTO.- ORDENAR &lt;/strong&gt;la publicación de la presente resolución en el BOIB, en el tablón de anuncios municipal y en la página web municipal. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;PIE DE RECURSO&lt;/strong&gt;. -Lo que traslado a Vd. a los efectos que procedan, significándole que, contra la presente resolución, que pone fin a la vía administrativa, cabe interponer, con carácter potestativo, recurso de reposición ante el mismo órgano que la ha dictado, de acuerdo con lo dispuesto en el art. 123 de la Ley 39/2015, de 1 de octubre, de Procedimiento Administrativo Común de las Administraciones Públicas. El plazo para interponerlo es de un mes a contar desde el día siguiente al de la recepción de la presente notificación, no pudiendo, en este caso, interponer recurso contencioso-administrativo hasta que se haya resuelto expresamente el de reposición o se haya producido la desestimación presunta del mismo. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El recurso de reposición deberá presentarse en el Registro General de este Ajuntament o en las dependencias y medios a que se refiere el art. 16.4 de la Ley 39/2015 antes citada, y se entenderá desestimado cuando no se resuelva y notifique en el plazo de un mes, a contar del día siguiente a su interposición, quedando en este caso expedita la vía contencioso-administrativa. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;De no utilizar el recurso potestativo de reposición, cabe interponer directamente recurso contencioso-administrativo, conforme a lo establecido en el artículo 123 anteriormente citado, y en los artículos 45 y siguientes de la Ley 29/98, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa, ante los Juzgados de lo Contencioso-Administrativo de los de Palma de Mallorca en el plazo de dos meses, a contar desde el día siguiente al de la recepción de la presente notificación. Ello sin perjuicio de cualquier otro recurso o acción que se estime pertinente. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
