&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interesado:&lt;/strong&gt; UTE SE VEDRÁ&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ACUERDO DE RESOLUCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En fecha 25 de junio de 2024 se realiza informe técnico del siguiente tenor literal:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;“&lt;strong&gt;INFORME TÉCNICO DE MEDIOAMBIENTE&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Proposición de servicios mínimos ante la convocatoria de huelga de los trabajadores del servicio de recogida de residuos, limpieza viaria, limpieza de litoral y gestión de Posidonia del municipio de Sant Josep de sa Talaia, convocada con inicio día 28 de junio de 2024 a las 2:30h, de carácter indefinido.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Exp. 6463/2024&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1. ANTECEDENTES RELEVANTES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. En fecha 31 de octubre de 2014 se formaliza contrato administrativo de servicio de recogida de residuos, limpieza viaria, limpieza de litoral y gestión de Posidonia del municipio de Sant Josep de sa Talaia entre el Ayuntamiento de Sant Josep de sa Talaia y la empresa UTE Es Vedrà, con NIF U57882649, en modalidad de concesión, por una duración de diez años a contar desde el inicio del servicio en fecha 1 de mayo 2015.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. En fecha 12 de junio 2024 se comunica convocatoria de huelga indefinida a partir de las 2:30 horas del día 28 de junio ante la Consejería de Empresa, Empleo y Energía de la Administración autonómica por parte de la Federación de CCOO de Habitat Illes, acordado en asamblea del 7 de junio de 2024 de trabajadores/as de la empresa UTE Es Vedrà dedicada a la contrata de servicio de recogida de residuos, limpieza viaria, limpieza de litoral y gestión de Posidonia del municipio de Sant Josep de sa Talaia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. En fecha 14 de junio 2024 con registro de entrada 2024-E-RC-6020, la Fundación Tribunal de Arbitraje y Mediación de las Islas Baleares (TAMIB) presenta ante el Ayuntamiento de Sant Josep de sa Talaia la Cédula de citación para el acto de Mediación en fecha 18 de junio 2024 a las 9:15 horas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. En fecha 18 de junio 2024 las partes comparecientes al acto de mediación, como solicitantes el representante de la Federación CCOO Habitat Illes y los miembros del comité de huelga, y como no solicitante la UTE Es Vedrà y el Ayuntamiento de Sant Josep de sa Talaia, acuerdan suspensión de acto de Mediación hasta el próximo día 21 de junio 2024 a las 9:00 horas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. En fecha 21 de junio 2024 el acto de mediación finaliza con el resultado SIN ACUERDO.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2. FUNDAMENTOS LEGALES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El artículo 28 de la Constitución Española reconoce&lt;strong&gt; &lt;/strong&gt;el derecho a la huelga de los trabajadores para la defensa de sus intereses, sujeto a limitaciones y restricciones en su ejercicio derivadas de su conexión con otras libertades, derechos o bienes constitucionalmente protegidos. De este modo el párrafo segundo del artículo 28 dispone que la Ley que regule el ejercicio de este derecho establecerá las garantías precisas para asegurar el mantenimiento de los servicios esenciales de la comunidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A estos efectos, el artículo 10 del Real Decreto ley 17/1977, de 4 de marzo de Relaciones de Trabajo atribuye a la autoridad gubernativa la competencia para acordar las medidas necesarias para asegurar el funcionamiento de los servicios esenciales. En relación a esta autoridad gubernativa, dado que los servicios de recogida y transporte de residuos urbanos y la limpieza viaria son de competencia municipal según resulta del artículo 25.2b) y 26.1a) i b) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local, será el municipio&amp;nbsp;de Sant Josep de sa Talaia la habilidad para dictar y fijar los servicios mínimos necesarios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El artículo 23 del Pliego de las Cláusulas Administrativas del contrato con la UTE Es Vedrà, establece que:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;“&lt;em&gt;En caso de convocatoria de huelga general, el contratista está obligado a comunicar este hecho dentro de los plazos indicados por la legislación vigente. Además, la empresa tendrá que garantizar los servicios mínimos indispensables y esenciales por el funcionamiento de los servicios o los que se establezcan por parte de las Administraciones. En caso de discrepancia, se podrán adoptar las medidas oportunas por parte del Ayuntamiento, para garantizar el funcionamiento de los servicios.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;A la finalización de la huelga, la empresa presentará un informe con la valoración detallada de los servicios no prestados y su coste económico. Este coste se descontará de la siguiente factura o bien se compensará con la realización de otros trabajos, de acuerdo con lo que determine el Ayuntamiento.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;En los casos de interrupción, cese total o parcial de las prestaciones objeto del servicio, por cualquier causa, el adjudicatario vendrá obligado a poner a disposición, en las 24 horas siguientes al requerimiento efectuado, todo su material e instalaciones para garantizar la prestación de los servicios que se consideren esenciales. Estos equipamientos podrán ser manipulados por el personal de la empresa que voluntariamente se preste a hacerlo, o por el que expresamente se habilite.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Si la interrupción de la actividad fuera imputable al contratista, se le repercutirá el mayor coste ocasionado en el Ayuntamiento, para la correcta prestación de los servicios, sin perjuicio de las sanciones a que diera lugar.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;En los casos de huelga general o conflicto laboral, cierre patronal o cualquier otra forma&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;de alteración de la normalidad de la relación laboral, en que no se ejecuten todos o cualquiera de los servicios contratados, el Ayuntamiento podrá realizarlos con los medios que considere oportunos, ajustándose a las normas legales y reglamentarias que regulen estas situaciones.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se propone los siguientes servicios mínimos que, considerando el carácter esencial para la comunidad de los servicios públicos afectados, se plantean valorando los condicionantes específicos del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3. PROPUESTA DE SERVICIOS MÍNIMOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3.1&amp;nbsp; Ámbito de la huelga (municipio, plazos y servicios afectados)&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La huelga se ha convocado con un plazo indefinido, desde el dia 28 de junio a las 02:39 horas, y afecta a todos los servicios relacionados con la recogida de residuos, limpieza viaria y limpieza de litoral para la totalidad del municipio de Sant Josep de sa Talaia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los servicios afectados son los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Servicio de recogida de fracción rechazo (domiciliaria y a establecimientos)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Servicio de recogida de fracción orgánica (domiciliaria y a establecimientos)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Servicio de recogida de fracción de papel-cartón (domiciliaria y a establecimientos)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;

	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Servicios extras (desbroce, hidrolimpieza, limpieza con vapor, recogida de vertidos)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3.2 Recogida de fracción resto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La huelga empezará a finales de junio lo que coincide con la temporada alta turística cuando la generación de residuos se cuadruplica comparado con la temporada baja. El total de las toneladas recogidas en julio del año pasado ascendía a casi 4.000 tn, lo que equivale a una generación diaria de aproximadamente 130 toneladas. Aproximadamente el 57% del total de residuos generados constituye la fracción resto, de la cual 70% pertenece a lo generado por los ciudadanos a recoger en los contenedores de la vía pública.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La capacidad de los contenedores de la fracción resto está dimensionada en función de la generación máxima a esperar durante los meses de julio y agosto suponiendo una frecuencia máxima de recogida diaria. La saturación diaria de los contenedores públicos de la fracción resto asciende a 80 hasta 100% durante la temporada alta dependiendo de la ubicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En relación a la recogida de la fracción resto se tiene que tener en cuenta su alto nivel de putrefacción, descomposición y fermentación debido a las elevadas proporciones de materia orgánica que todavía contiene y el textil sanitario como pañales, compresas y tampones. Una exposición a temperaturas altas y acumulaciones de residuos fuera de contenedores, atrae a insectos y roedores y pueden provocar proliferación de plagas, que a su vez constituyen un vector de patógenos y de enfermedades, acompañada por malos olores cuya velocidad de producción aumenta en función de la temperatura.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para evitar graves trastornos a la ciudadanía, el &lt;strong&gt;servicio mínimo de recogida domiciliaria de la fracción resto se tendrá que prestar con una frecuencia de 48 horas&lt;/strong&gt;. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En relación al servicio de recogida a grandes productores hay que destacar la alta ocupación del sector de hostelería durante los meses de julio/agosto que el año pasado sobrepasó el 90% de la capacidad y la generación de residuos durante los meses de julio y agosto alcanzó su máximo. La gran mayoría de los cuartos de basura de los establecimientos tienen dimensiones reducidos con un espacio limitado para el almacenaje de residuos. Una acumulación de residuos en los exteriores de los establecimientos conllevaría los mismos riesgos sanitarios como detallados para los contenedores públicos debido a su exposición a la intemperie. No obstante, una correcta separación de residuos por parte de los productores singulares podrá reducir de forma importante la generación de la fracción resto, por lo que se podrá establecer un &lt;strong&gt;servicio mínimo de recogida de la fracción resto a productores singulares de 2 veces a la semana&lt;/strong&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3.3&amp;nbsp; Recogida fracción orgánica&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los contenedores de la fracción orgánica en vía pública tienen capacidad aproximada para absorber la generación de materia orgánica durante 3-4 días. No obstante, la materia orgánica es fácilmente degradable por los microorganismos que contiene, especialmente cuando esté expuesta a altas temperaturas. Por ello, es necesario recogerla y gestionarla lo más rápido posible, para evitar la generación de lixiviados (líquidos debido a la fermentación) y de malos olores. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Igualmente hay que tener en cuenta un posible aumento de impropios durante la duración de la huelga debido a una sobresaturación de los contenedores de rechazo. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las estadísticas muestran que, en el mes de julio de 2023, el 80% de la fracción orgánica recogida provenía de productores singulares, con lo cual se hace evidente una mayor necesidad de recogida de fracción orgánica para esto servicio. Por todo ello, se establece un &lt;strong&gt;servicio mínimo de recogida de la fracción orgánica de 3 veces por semana para la recogida domiciliaria y 4 veces por semana para productores singulares&lt;/strong&gt;. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3.4. Recogida envases ligeros y papel / cartón&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La recogida de papel y cartón y la recogida de envases ligeros generados a domicilios se realiza en temporada alta con una frecuencia de 6 días y 5 días, respectivamente, a la semana. Estas fracciones representan aproximadamente el 14,5% de los residuos recogidos, pero al ser residuos&amp;nbsp; con una densidad muy baja (pesan poco y ocupan mucho de espacio), el servicio tiene que mantener unas frecuencias elevadas para evitar saturaciones de contenedores y los perjuicios que puedan derivarse, como el riesgo de incendio (puesto que ambas fracciones son altamente combustibles, y atendiendo a los últimos incendios ocurridos al vertedero de la isla) o para el tráfico (puesto que residuos que queden fuera de los contenedores pueden ser desplazados por el viento con facilidad hasta las vías, debido a su baja densidad). En cuanto a los envases ligeros, una acumulación excesiva alrededor de los contenedores puede ser motivo de accidentes de diferentes tipos como cortes con envases de aluminio o de otros metales, además de los restos orgánicos que pueden contener, dando lugar a molestias por malos olores. Debido a que la capacidad de los contenedores públicos no permite bajar la frecuencia establecida sin que se produzca sobresaturación, se propone unos &lt;strong&gt;servicios mínimos para la recogida domiciliaria una frecuencia de 3 días a la semana para envases ligeros y para el papel-cartón&lt;/strong&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para el servicio de recogida a grandes productores se puede determinar una frecuencia menor debido a que se deben almacenar en el interior de los establecimientos y aunque la mayoría disponen de un espacio reducido para su almacenamiento, no se verá afectada la seguridad viaria o de la ciudadanía en general. No obstante, atendiendo al carácter indefinido de la huelga, &lt;strong&gt;se proponen unos servicios mínimos de una recogida mínima una vez a la semana para envases ligeros y papel-cartón de productores singulares&lt;/strong&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3.5. Recogida vidrio&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La recogida del vidrio a Productores Singulares (PS) y la recogida domiciliaria se realiza mediante contenedores ubicados en la vía pública, aunque mediante contenedores de tipologías diferentes (contenedores VACRIs de doble gancho para los productores singulares y contenedores EASY para la ciudadanía). Son servicios son separados y se realizan 3 veces a la semana para los VACRIs y 2 veces a la semana para los EASY. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Aunque no se trata de una frecuencia muy alta, el no prestar este servicio puede suponer un riesgo para la seguridad ciudadana. La presencia de envases de vidrio fuera de los contenedores (en las calzadas y aceras) puede ser motivo de accidentes de diferentes tipos como cortes o lesiones, corporales o materiales, especialmente en zonas turísticas en pleno verano. Además, en zonas no urbanas, la presencia de vidrio puede suponer un riesgo de incendio forestal bajo radiación solar, atendiendo a que hay productores o contenedores públicos que se encuentran en interfase urbana-forestal o a arcenes de caminos. También puede suponer un riesgo de proliferación de plagas debido a que los envases de vidrio pueden contener lixiviados orgánicos, un atractivo para los vectores de plagas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Atendiendo al carácter indefinido de la huelga, &lt;strong&gt;se proponen unos servicios mínimos de recogida de la fracción de vidrio de una vez a la semana tanto domiciliaria como a productores singulares.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3.6.&amp;nbsp; Repaso, recogida de voluminosos y animales muertos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los servicios de recogida de residuos interrumpidos por la huelga afectan a la recogida de todas las fracciones (fracción resto, orgánica, papel/cartón, envases y vidrio), tanto en lo que se refiere a la recogida domiciliaria de contenedores en vía pública como a la recogida puerta a puerta de productores singulares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cabe hacer hincapié en el servicio de repaso de los contenedores públicos, igualmente afectado por la huelga, que tiene que efectuarse previamente a la propia recogida para eliminar todos los residuos que puedan haberse acumulado en la zona alrededor de los contenedores debido a que cualquier objeto depositado al lado de un contenedor podría caerse por debajo al levantarlo y, por lo tanto, obstaculizar la devolución del contenedor a su sitio. Hay que tener en cuenta que la operación de la recogida domiciliaria se efectúa de forma semiautomática mediante recolector superior, operado únicamente por un conductor sin disponer de medios para despejar la zona de recogida en caso de que fuese necesario. &lt;strong&gt;Por todo ello, resulta imprescindible que se efectúe el servicio de repaso previo a cada ruta de recogida independientemente de la fracción que se recoja.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Igualmente, se verá afectado por la huelga el servicio de recogida de voluminosos porque su presencia en la vía pública genera un riesgo de accidentes para el tránsito y para los peatones, por lo que debe efectuarse siempre y cuando afecten a la seguridad vial. Lamentablemente, el vertido incontrolado en espacios públicos, especialmente al lado de contenedores públicos, constituye uno de los problemas más graves para la gestión municipal de residuos. Especialmente durante los meses de verano y en zonas remotas se realiza una recogida de voluminosos a diario. Para evitar grandes aglomeraciones de residuos durante la huelga, &lt;strong&gt;se proponen unos servicios mínimos de recogida de voluminosos con una frecuencia mínima semanal de dos recogidas&lt;/strong&gt;, sin prejuicio a actuaciones puntuales e inmediatas en caso de que se produzca un riesgo alto de accidentes por la presencia de residuos voluminosos o similares en vías públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;También forma parte del servicio la recogida de animales muertos que se encuentran en la vía pública. Se trata de un servicio puntual, pero improrrogable para garantizar el mantenimiento de la salud pública, tratándose de cadáveres de alto nivel de descomposición. Especialmente durante los meses de verano con temperaturas altas y bajo la influencia de radiación solar, constituyen un foco infeccioso de alto riesgo. &lt;strong&gt;El servicio de recogida de animales muertos se deberá prestar según las necesidades que se presenten.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3.7. Limpieza viaria&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Limpieza manual, vaciado de papeleras y limpieza mecanizada&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Es uno de los servicios con mayor visibilidad, y se divide en limpieza urbana (dentro de cascos urbanos) y viaria (limpieza de vías interurbanas y arcenes de carreteras principales). Se efectúa con una frecuencia 7/7 por peones de limpieza manual y mecanizada con maquinaria de barrido. El servicio de limpieza urbana además es el encargado de vaciar papeleras. A las papeleras no se realiza recogida selectiva, por&amp;nbsp;lo&amp;nbsp;que contiene una parte orgánica, que puede propiciar la proliferación de plagas y vectores infecciosos, al igual que en el caso de los contenedores. El servicio de limpieza urbana incluye la retirada de excrementos, que pueden ser fuente de patógenos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El establecimiento de los servicios mínimos para el vaciado de papeleras y la limpieza de barrido se debe realizar por zonas en función de sus características distinguiendo entre zonas sensibles (accesos a centros sanitarios, calles afluentes a centros educativos, zonas de juegos infantiles), zonas con muy alta presión humana, y otras zonas, reduciéndolo de esta forma a las necesidades esenciales y estrictamente necesarias. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Se proponen servicios mínimos de limpieza viaria manual y mecanizada y de vaciado de papeleras variables en función de la zona del municipio y la presión humana&lt;/strong&gt;. Las frecuencias correspondientes quedan reflejadas en la tabla 3 del Apartado 4. Resumen de Servicios Mínimos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Servicio de baldeo y limpieza con agua a presión y vapor&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los tratamientos de limpieza con agua a presión o con vapor y el baldeo se efectúa según necesidad para la limpieza de manchas, la eliminación de vómitos, de restos de excrementos y otros restos incrustados a la vía pública, y que pueden convertirse en fuentes de organismos patógenos. A tal efecto, el contrato incluye un número de jornadas anuales para cada servicio que se consuma mayoritariamente durante la temporada media y alta. Durante los meses de julio y agosto estos servicios pueden llegar a prestarse diariamente por la alta presión humana en las zonas más turísticas del municipio, en las zonas de Playa den Bossa y de Cala de Bou. La gran afluencia de personas en dichas zonas está originada por la presencia de los establecimientos de ocio nocturno más importantes de la isla lo que produce un ensuciamiento excesivo y característico para estas zonas (manchas de bebidas o similar, vómitos, gran acumulación de envases etc.).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;No se establecen frecuencias mínimas ni para la limpieza con agua a presión ni con vapor, pero se requiere un servicio disponible para poder atender a las necesidades urgentes&lt;/strong&gt; que se presenten para poder proceder a la eliminación de ensuciamientos que por sus características potencialmente infecciosas pueden perjudicar a la salud de las personas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Debido al carácter indefinido de la huelga y para paliar el efecto de residuos y suciedad incrustados y evitar una acumulación incontrolable de residuos en las zonas más turísticas, se establece una &lt;strong&gt;frecuencia mínima para efectuar el baldeo en Playa den Bossa y Cala de Bou de 1 vez a la semana&lt;/strong&gt;, que queda reflejada en la tabla 3.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Limpieza de contenedores&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La limpieza de contenedores se realiza interiormente de forma mecanizada con vehículos específicos para estos servicios, los denominados lavacontenedores. La limpieza exterior se realiza manualmente con agua a presión. Ambos servicios cuentan con jornadas específicas y adicionales durante los meses de julio y agosto para paliar los efectos de una elevada putrefacción debida a las altas temperaturas de verano cuando la presión humana llega a su máximo del año mediante eliminación de lixiviados tanto en el interior como en la capa exterior de los contenedores y en el suelo al alrededor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;No se establecen frecuencias mínimas para la limpieza con agua a presión, pero se requiere un servicio disponible para poder atender a las necesidades urgentes&lt;/strong&gt; que se presenten para poder proceder a la eliminación de ensuciamientos que por sus características potencialmente infecciosas pueden perjudicar a la salud de las personas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En resumen, el servicio de limpieza viaria, que también está afectado por la huelga, no puede quedar desatendido, hay que efectuarlo con una frecuencia mínima adecuada según tipología del servicio y teniendo en cuenta las circunstancias de cada zona, con un enfoque especial en zonas con mayor afluencia de personas, atendiendo a que la huelga se ha convocada en temporada alta. Además, hay que recoger en todo momento la materia orgánica susceptible de descomposición cuando, por alguna circunstancia, la haya&lt;strong&gt;. También se tienen que efectuar aquellas actuaciones de carácter inmediato que, de no hacerse, pueden suponer un riesgo para la seguridad de la ciudadanía, como pueden ser, en casos de accidentes en la calzada, los vidrios rotos, los vertidos de aceite, o producido por fenómenos meteorológicos adversos o similar. &lt;/strong&gt;Los servicios mínimos de limpieza establecidos quedan reflejados en la tabla 3: Servicios Mínimos Limpieza Viaria y Litoral.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3.8. Limpieza playas / Vaciado puntos limpios&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las playas de la costa de Sant Josep de sa Talaia constituyen un entorno natural único y atractivo tanto para los turistas como para los residentes por su belleza especial con aguas transparentes y arenas blancas. Una gran parte de este medio natural está protegido por las figuras del Parque natural de Ses Salinas y de las Reservas marinas. Una limpieza regular de estas zonas no se limita a la preservación de la imagen sino constituye una medida de protección del medioambiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los servicios que se realizan habitualmente consisten en el vaciado diario de los puntos limpios en las entradas de las playas (papeleras selectivas), una limpieza manual de la playa y en caso de playas urbanas se realiza una criba mecanizada operativa diariamente. Adicionalmente, al principio de la temporada se efectúa la retirada de la Posidonia en las playas más turísticas y se la devuelve al final de octubre. Durante la temporada, las retiradas se limitan a actuaciones puntuales en caso de acumulaciones debido a vientos o corrientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los servicios mínimos que se proponen se limitan a servicios esenciales para evitar trastornos importantes en el medio rural y garantizar la seguridad y salud de las personas en la playa. Por lo tanto, no se incluyen ni la retirada de la Posidonia ni la cribada de la arena. No obstante, una acumulación de residuos en la playa puede afectar de forma sensible al medioambiente como a la salud pública. Su presencia en la arena puede ser motivo de accidentes de diferentes tipos como cortes con cascos de vidrio, envases de aluminio o de otros metales. En caso de los envases de plástico, se desplazan fácilmente por el viento y en caso de no recogerlos terminarán en el mar donde afectarán de forma sensible al ecosistema marino. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Para paliar estos efectos, se determina una frecuencia mínima para la limpieza manual de 2 veces cada semana en todas las playas del municipio y un servicio de emergencia en caso de que resulte necesaria la retirada de residuos concretos por motivos de seguridad o salud.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los Puntos Limpios ubicados en las playas del municipio se vacían de forma ordinaria 14 veces a la semana durante la temporada alta (2 veces cada día). La materia orgánica susceptible de descomposición favorece la transmisión de enfermedades infecciosas y puede estar contendida en todas las fracciones que se recogen en los puntos limpios de la playa debida a una mala separación de las fracciones (habitual en zonas con gran afluencia de turistas) o restos de comida en los envases ligeros. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Además, la cercanía de estos puntos al mar y la posible acumulación de grandes cantidades de residuos en los puntos limpios en caso de que no se vacíen de forma regular (teniendo en cuenta que la limpieza ordinaria de la playa de ha reducido de forma drástica), hacen necesario el vaciado diario de los Puntos Limpios como parte de los servicios mínimos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Por lo tanto, se establece una frecuencia mínima de 7 veces a la semana para el vaciado de los puntos limpios.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3.9. Necesidades especiales de recogida y limpieza: Eventos y zonas sensibles&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Necesidades especiales en eventos&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La huelga coincide con diversas actividades municipales organizadas en distintos lugares del municipio. Algunas de ellas son:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Festival “El festín”: del 28 al 30 de junio y del 5 al 7 de julio en Sant Jordi de ses Salines.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Mercado Artesanal de Sant Josep: todos los sábados en Sant Josep de sa Talaia hasta final de temporada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Solpost a Caló de s'Oli: todos los sábados por la tarde en Cala de Bou hasta final de temporada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estos eventos requerirán una recogida puntual de contenedores de todas las fracciones instaladas únicamente a efectos de la fiesta.&amp;nbsp; Este servicio incluye la limpieza y la recogida de residuos que puedan haberse dispersados en la zona donde se realiza el evento. En caso de que persista la huelga más allá de dos semanas, y que tenga lugar algún otro acontecimiento lúdico de estas características, se tendrá que hacer la recogida total de la basura generada, ya sea el mismo día o el día siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Necesidades especiales en zonas sensible&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Es necesario garantizar la máxima asepsia y limpieza en torno a los centros sanitarios, centros de personas mayores, centros educativos, así como en las áreas de parques infantiles y establecimientos de alimentación y supermercados donde se distribuyan productos perecederos. &lt;strong&gt;Hay que efectuar el servicio de limpieza viaria habitual en estas zonas, incluyendo el vaciado diario de papeleras.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Asimismo, se debe prever el vaciado de contenedores de Productores singulares que puedan afectar a grupos de personas vulnerables, como pueden ser personas mayores o niños. En este caso concreto, &lt;strong&gt;hay que mantener la frecuencia habitual de recogida de todas las fracciones de residuos para los siguientes productores singulares: Residencia de Can Raspalls y Campamento de Cala Jondal&lt;/strong&gt;. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3.10. Consideraciones finales en relación a los servicios mínimos &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Necesidades de recogida de residuos y limpieza viaria y servicios mínimos&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las frecuencias actualmente establecidas para la recogida de residuos, la limpieza viaria y el resto de servicios afectados por la huelga, se consideran bien ajustadas a las necesidades de municipio para garantizar un buen servicio a la ciudadanía sin que esto suponga un sobredimensionamiento o un sobrecoste de los mismos. En este sentido, cabe destacar que cualquier reducción de las frecuencias actuales, especialmente en temporada turística, supondrán una prestación deficiente de los servicios de recogida de residuos y de limpieza viaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Consecuentemente, una duración prolongada de la huelga y de lo servicios mínimos que se presten, se considera insostenible en relación a la limpieza, higiene y salubridad pública. Así pues, en caso de prolongarse la huelga más allá de 2 semanas, se considera necesario revisar los servicios mínimos propuestos en base a los resultados obtenidos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Ejecución completa de rutas y recorridos durante la prestación servicios mínimos &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para que los servicios mínimos sean eficaces a la hora de evitar las consecuencias que han motivado su establecimiento, la recogida de todas las fracciones (rechazo, fracción orgánica y selectiva) y la limpieza tienen que efectuarse de forma completa durante cada una de las jornadas mínimas determinadas. Por ejemplo, con una frecuencia establecida de tres días a la semana, todos los contenedores pertenecientes a la fracción y tipo de recogida tienen que vaciarse tres veces a la semana.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para aquellos servicios mínimos propuestos que supongan una prestación que no sea diaria, se debe garantizar una distribución razonable y alternada de las prestaciones, para evitar en la medida posible la concentración de días sin servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Condicionantes del servicio a la finalización de la huelga y resumen servicios mínimos&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cuando se finalice la huelga, y a la hora de arrancar los servicios habituales, se deberá tener en cuenta las capacidades de almacenamiento en los destinos de aportación de las fracciones, del área ambiental de Cana Putxa para el triaje de las fracciones resto, orgánica y envases y la planta de transferencia para el almacenamiento intermediario de las fracciones de vidrio y papel. Especialmente en lo que se refiere a las fracciones de envases, del papel y del vidrio dichas plantas insulares operan en temporada alta a una capacidad de 80 hasta 100% sin que exista alternativa para el tratamiento o almacenamiento posterior a la recogida. Para evitar distorsiones en el funcionamiento de las plantas de tratamiento, que además pueden llegar a causar molestias importantes de malos olores o presencia de residuos en la vía pública para los vecinos alrededor de dichas instalaciones, será de vital importancia que se cumplan las frecuencias establecidas y que se recoja la totalidad de los residuos generados de la fracción correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Incumplimiento de los servicios mínimos&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El incumplimiento de la obligación de atender a los servicios mínimos será sancionado en conformidad con el previsto en los pliegos y la normativa contractual, así como en el resto de la normativa aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;4. RESUMEN SERVICIOS MÍNIMOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Desde las autoridades públicas se respeta el derecho a la huelga y se entiende que sus consecuencias tienen que ser notables en la calle para que se evidencie la esencialidad e importancia del servicio. No obstante, en ningún caso debería permitirse que el espacio público se convierte en un espacio insalubre y caótico, inmanejable e incontrolable provocando riesgos graves para la salud y para la seguridad de los ciudadanos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por este motivo, se consideran debidamente motivados los servicios mínimos propuestos en el presente informe, ya que estos no suponen ninguna limitación de los derechos que la normativa reguladora de la huelga reconoce al personal en esta situación, reconociendo también el derecho de la comunidad a la prestación de servicios esenciales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo lo anterior, se &lt;strong&gt;ACUERDA&lt;/strong&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;PRIMERO.- FIJAR&lt;/strong&gt; los servicios mínimos estipulados en los apartados anteriores resumidos en las tablas 2, Servicios mínimos recogida residuos y 3, Servicios Mínimos Limpieza Viaria y Litoral, con indicación del porcentaje respecto al servicio ordinario contratado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;SEGUNDO.-&lt;/strong&gt; El incumplimiento de la obligación de atender a los servicios mínimos será sancionado de conformidad con lo previsto en los pliegos y demás normativa contractual así como en el resto de normativa aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;TERCERO.-&lt;/strong&gt; No procederá limitación del ejercicio del derecho de huelga fuera de lo establecido en el presente Acuerdo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;CUARTO.- NOTIFICAR&lt;/strong&gt; el presente Acuerdo a los interesados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;QUINTO.- PUBLICAR&lt;/strong&gt; esta resolución en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
