    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El Concejal Delegado de las Áreas de Movilidad y Fiestas, ha resuelto lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En fecha 1 de junio de 2024, en el BOIB núm. 74, se publicó la convocatoria extraordinaria 2024 para la obtención del permiso municipal de conductor de auto-taxi, aprobada por el Decreto del Concejal Delegado del Área de Servicios Movilidad y Fiestas núm. 2024-20239 de fecha 29 de mayo de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Visto el contenido del expediente donde consta el informe del técnico de servicios jurídicos de fecha 20 de junio de 2024, con el siguiente literal:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;“&lt;span style="color:#202124"&gt;&lt;em&gt;En relación con el expediente relativo a la rectificación de errores materiales, de hecho o aritméticos, emite el siguiente informe-propuesta de resolución, de conformidad con lo fijado en el artículo 175 del Reglamento de Organización, Funcionamiento y Régimen Jurídico de las Entidades Locales, aprobado por Real Decreto 2568/1986, de 28 de noviembre, por el que se aprueba el, en base a los siguientes,&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#202124"&gt;&lt;em&gt;&lt;strong&gt;ANTECEDENTES DE HECHO &lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;Único.-&lt;/strong&gt;&lt;/em&gt;&lt;em&gt; Que en fecha 1 de junio de 2024 se publicó en el BOIB número 74 la convocatoria extraordinaria del examen para obtener el permiso municipal de conductor de antotaxi en el municipal de Andratx 2024.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;LEGISLACIÓN APLICABLE&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;La Legislación aplicable al asunto es la siguiente:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;- Los artículos 40 y 109 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;- Los artículos 21 y 22 de la Ley 7/1982 de 2 de abril, Reguladora de las Bases de Régimen Local.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#202124"&gt;&lt;em&gt;Se ha detectado un error material en el apartado&lt;strong&gt; cuarto Tribunal Calificador y Procedimiento&lt;/strong&gt; de la Convocatoria extraordinaria del examen para obtener el permiso municipal de conductor de antotaxi en el municipal de Andratx 2024. &lt;/em&gt;&lt;/span&gt; &lt;span style="color:#202124"&gt;&lt;em&gt;Visto cuanto antecede, se considera que el expediente ha seguido la tramitación establecida en la Legislación aplicable procediendo su aprobación al Alcalde por el artículo 21 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases de Régimen Local.&lt;/em&gt;&lt;/span&gt; &lt;span style="color:#202124"&gt;&lt;em&gt;Por ello, de conformidad con lo fijado en el artículo 175 del Reglamento de Organización, Funcionamiento y Régimen Jurídico de las Entidades Locales, aprobado por Real Decreto 2568/1986, de 28 de noviembre, el que suscribe eleva la siguiente propuesta de resolución:&lt;/em&gt;&lt;/span&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#202124"&gt;&lt;em&gt;&lt;strong&gt;INFORME-PROPUESTA DE RESOLUCIÓN&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#202124"&gt;&lt;em&gt;&lt;strong&gt;PRIMERO.&lt;/strong&gt; Rectificar el error material, de hecho o aritmético de acuerdo con lo fijado en el artículo 109 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, sufrido en la convocatoria extraordinaria del examen para obtener el permiso municipal de conductor de antotaxi en el municipal de Andratx 2024.&lt;/em&gt;&lt;/span&gt; &lt;span style="color:#202124"&gt;&lt;em&gt;Concretamente en el apartado &lt;strong&gt;CUARTO. TRIBUNAL CALIFICADOR Y PROCEDIMIENTO. &lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#202124"&gt;&lt;em&gt;En el siguiente sentido:&lt;/em&gt;&lt;/span&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#202124"&gt;&lt;em&gt;Donde dice:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#202124"&gt;En el ejercicio de las facultades que me confiere la vigente legislación y de acuerdo con el Decreto núm. 4769/2023 de fecha 19 de junio de 2023, del establecimiento de las Áreas de Gestión de la Organización Municipal y Otorgamiento de las Delegaciones Genéricas a los Concejales, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#202124"&gt;&lt;strong&gt;RESUELVO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#202124"&gt;&lt;strong&gt;PRIMERO.-&lt;/strong&gt; Aprobar la corrección de error material del apartado &lt;strong&gt;CUARTO. TRIBUNAL CALIFICADOR Y PROCEDIMIENTO&lt;/strong&gt; de la convocatoria extraordinaria 2024 para la obtención del permiso municipal de conductor de auto-taxi, aprobada por el Decreto del Concejal Delegado del Área de Servicios de Movilidad y Fiestas núm. 2024-2039 de fecha 29 de mayo de 2024, conforme el artículo 109 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, en los siguientes términos:&lt;/span&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
