CAIB CAIB 2024-06-21 CAIB ![CDATA[Información pública expropiación sistema general viario SG-SR CI-VI destinado a la apertura de una Ronda desde la rotonda de la Plaza Madrid hasta la rotonda de Via Palma]] es ![CDATA[<p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">El Pleno del Ayuntamiento de Manacor en sesión celebrada el día 10 de junio de 2024 adoptó el siguiente acuerdo:</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><strong>«Antecedentes</strong></span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">El Plan General (PG) de Manacor entró en vigor el día 1 de enero de 2022 , mediante su publicación en el BOIB número 1 , de día 1 de enero.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">El Plan General de Manacor incorpora una serie de actuaciones aisladas que tiene que ejecutar el Ayuntamiento de Manacor entre las cuales se encuentra la identificada con el código SG-SR CI-VI (4001) destinada a la apertura de una nueva ronda. Esta actuación está programada , desde el punto de vista temporal , dentro del primer cuatrienio según las previsiones del Programa de Actuación del Plan General</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">Así mismo el Programa de Actuación del PG prevé la adquisición de los terrenos a través del ejercicio de la potestad expropiatoria o mediante otro medio admitido en Derecho, puesto que los terrenos afectados no son de titularidad municipal.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">La arquitecta municipal de planeamiento urbanístico ha procedido a emitir documentación donde se describen en sus aspectos materiales y jurídicos los terrenos que tienen que ser objeto de expropiación con identificación de sus titulares. El TAG Jefe del Servicio de urbanismo ha informado favorablemente el inicio del expediente de expropiación forzosa</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><strong>Fundamentos jurídicos</strong></span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">2°) Iniciar expediente de expropiación forzosa por el procedimiento ordinario para la adquisición de los terrenos delimitados en el Plan General de Manacor con el código SG-SR-CI-VI ( 4001) destinada a la apertura de una Ronda desde la rotonda de la Plaza Madrid hasta rotonda de Vía Palma, incluida dentro del primer cuatrienio de la programación temporal del Plan General de Manacor</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">3°) Reconocer, al amparo del dispuesto en el Art. 10 de la LEF en relación al art. 67 de la Ley 12/2017 de urbanismo de las Islas Baleares, la declaración de utilidad pública para proceder a la expropiación forzosa de los terrenos destinados a SG-SR-CI-VI ( 4001) destinada a la apertura de una Ronda desde la rotonda de la Plaza Madrid hasta rotonda de vía Palma, incluida dentro del primer cuatrienio de la programación temporal del Plan General de Manacor con el código SG-SR CI-VI ( 4001)</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif;
