    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El Pleno del Consejo Insular de Mallorca ha dictado el 13 de junio 2024 el acuerdo que transcribo literalmente a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Antecedentes:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. El Pleno del Consell Insular de Mallorca dictó el día 13 de diciembre de 2018 el acuerdo de nombrar nuevos miembros del CEM para cada uno de los grupos que determina el Reglamento de organización y funcionamiento y en representación de las diferentes entidades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. De acuerdo con este reglamento los sectores, entidades y organismos que proponen los miembros pueden revocarlos y substituirlos en cualquier momento. Entre las causas de esta revocación están la pérdida de la condición de representantes de dichas entidades u organismos que los propusieron. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. Las diferentes entidades y organismos han presentado los motivos de cese, las nuevas designaciones de sus representantes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Fundamentos jurídicos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. El artículo 2 del Decreto 10/2003, de 14 de febrero, de regulación de los consejos escolares insulares y de los consejos escolares municipales de las Islas Baleares, regula la representación de los miembros de los consejos escolares insulares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. El Pleno del Consejo de Mallorca, en sesión del día 12 de julio de 2018, aprobó el Reglamento nuevo de organización y funcionamiento (ROF) del Consejo Escolar de Mallorca (BOIB núm. 132, 23 de octubre de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. El artículo 7 del ROF del CEM establece la composición del Consejo Escolar de Mallorca (CEM).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. El artículo 8 del ROF del CEM dispone que los miembros son nombrados por el Pleno del Consejo Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;5. El artículo 8.8 del ROF del CEM, expone que todos los consejeros y las consejeras del CEM ejercen el cargo por un periodo de 4 años sin perjuicio de los cambios que se produzcan por el cese anticipado de alguno de los miembros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;6. Los artículos 8.9, 8.10 y 8.11 del ROF del CEM, prevén el cese de los cargos de consejeros y consejeras.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Por ello, propongo que el Pleno adopte los siguientes acuerdos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. Disponer el cese como miembros del CEM las personas que seguidamente se indican, agradeciéndoles su colaboración:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Grupo A. Representantes del profesorado&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Enseñanza pública&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;UOB&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Titular: Aleix Font Gomila&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. Notificar este acuerdo a las personas interesadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. Publicar este acuerdo en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Contra este acuerdo que pone fin a la vía administrativa, se puede interponer, alternativamente los siguientes recursos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;a) Directamente, el recurso contencioso administrativo ante el &lt;em&gt;Juzgado Contencioso Administrativo de Palma que corresponda&lt;/em&gt; en el plazo de dos meses, a partir del día siguiente de recibir esta notificación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;b) El recurso de reposición potestativo ante el Pleno, en el plazo de un mes, contado a partir del día siguiente de recibir esta notificación. Contra la desestimación expresa de este recurso de reposición, se puede interponer el recurso contencioso administrativo ante el &lt;em&gt;Juzgado Contencioso Administrativo de Palma&lt;/em&gt; &lt;em&gt;que corresponda&lt;/em&gt; en el plazo de dos meses, a partir del día siguiente de recibir la notificación de la desestimación de dicho recurso de reposición.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Si ha transcurrido un mes desde la interposición del recurso de reposición potestativo y no se ha recibido la notificación de resolución expresa, se entenderá desestimada por silencio e interponer el recurso contencioso administrativo ante el &lt;em&gt;Juzgado Contencioso Administrativo de Palma que corresponda&lt;/em&gt; sin limitación de tiempo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;No obstante lo anterior, se puede interponer, en su caso, cualquier otro recurso que considere oportuno. Todo ello de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa y la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas.&lt;span style="display: block; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt;&lt;span style="display: block; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
