![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aprobada inicialmente la modificación de la Ordenanza Fiscal Reguladora de la tasa por la prestación de servicios y realización de actividades en las instalaciones deportivas municipales, una vez finalizado el plazo de exposición pública sin que se haya formulado reclamación alguna, de conformidad con lo que establece el artículo 17.4 del Real Decreto Legislativo 2/2004, de 5 de marzo, por el que se aprueba el texto refundido de la Ley reguladora de las Haciendas Locales, queda definitivamente aprobado. Lo que se hace público a los efectos prevenidos en el artículo 17.4 del citado Real Decreto Legislativo, con la publicación íntegro de la ordenanza fiscal modificada:</span></p> <p style="text-align:center"><strong>ORDENANZA FISCAL REGULADORA DE LA TASA POR LA PRESTACIÓN DE SERVICIOS Y REALIZACIÓN DE ACTIVIDADES EN LAS INSTALACIONES DEPORTIVAS MUNICIPALES</strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><strong>Artículo 1.</strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamento y naturaleza</strong></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Al amparo de lo previsto en los artículos 57 y 20.4 o) del texto refundido de la Ley Reguladora de las Haciendas Locales aprobado por Real Decreto Legislativo 2/2004, de 5 de marzo (TRHL), de conformidad con lo dispuesto en los artículos 15 a 19 de este texto legal, este Ayuntamiento establece la tasa por la prestación de servicios y la realización de actividades en las instalaciones deportivas municipales que se regirá por la presente Ordenanza fiscal.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><strong>Artículo 2.</strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Hecho imponible</strong></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Constituye el hecho imponible de la tasa la utilización privativa o aprovechamiento especial del dominio público local, así como la prestación de servicios públicos o la realización de actividades administrativas de competencia local en las instalaciones deportivas municipales.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><strong>Artículo 3.</strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Sujetos pasivos</strong></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Son sujetos pasivos de la tasa, en concepto de contribuyentes, las personas físicas y jurídicas, así como las entidades a que se refiere el artículo 35.4 de la Ley 58/2003, de 17 de diciembre General Tributaria, que disfruten, utilicen o aprovechen especialmente el dominio público local en beneficio particular; así como quienes soliciten o se beneficien de la prestación de servicios o la realización de actividades en las instalaciones deportivas municipales.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><strong>Artículo 4.</strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Responsables</strong></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">1. Son responsables tributarios las personas físicas y jurídicas determinadas como tales en los artículos 41 y 42 de la Ley 58/2003, de 17 de diciembre, General Tributaria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La derivación de responsabilidad requerirá que, previa audiencia del interesado, se dicte acto administrativo, en los términos previstos en la Ley General Tributaria.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><strong>Artículo 5.</strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Cuota tributaria</strong></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">1. margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><strong>Artículo 7.</strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Régimen de declaración y de ingreso</strong></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">1. El pago de las tarifas por los usuarios que no tienen ningún abono se efectuará en el momento de la solicitud del servicio y/o actividad o en el momento de entrada en el recinto deportivo para la utilización de dichas instalaciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El pago se realizará en las oficinas municipales y/o en las instalaciones deportivas situadas en el recinto.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Los importes recaudados se ingresarán mensualmente en las cuentas restringidas abiertas a este objeto y se liquidarán en la Tesorería municipal con la periodicidad que determine el Ayuntamiento.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><strong>Artículo 8.</strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Infracciones y sanciones</strong></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">1. Las infracciones y sanciones en materia tributaria se rigen por lo que disponen los artículos 178 y siguientes de la Ley 58/2003, de 17 de diciembre, General Tributaria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.
