    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El apartado 8.3. de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 18 de abril de 2023 por la que se aprueba la convocatoria para la Protección de variedades autóctonas en riesgo de Erosión Genética, para el año 2023, especifica que la resolución expresa se notificará a los interesados mediante su publicación en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt;&lt;em&gt; &lt;/em&gt;de acuerdo con los términos previstos en el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El vicepresidente en Materia Agraria del FOGAIBA, con fecha 7 de junio de 2024, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;em&gt;&lt;strong&gt;"INFORME, PROPUESTA Y RESOLUCIÓN&lt;/strong&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. Con fecha 20 de abril de 2023, se publicó el BOIB núm. 50 la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba, para el año 2023, la convocatoria de ayudas destinadas al fomento y la protección de variedades autóctonas en riesgo de erosión genética. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. Con fecha 27 de junio de 2023, se publicó el BOIB núm. 87 la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la que modifica la Resolución de la presidenta del FOGAIBA, de 18 de abril de 2023, por la que se aprueba, para el 2023, la convocatoria de las ayudas destinadas al fomento y la protección de variedades autóctonas en riesgo de erosión genética. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3. Con fecha 25 de enero de 2024, se publicó el BOIB núm. 12 la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se modifican varias convocatorias de subvenciones del FOGAIBA, correspondientes a las intervenciones que prevé el Plan estratégico de la PAC 2023-2027 de España ( PEPAC), para la ayuda de la Unión financiada el FEAGA y por el FEADER. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;4. Con fecha 27 de abril de 2024, se publicó en el BOIB núm. 56 la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la que se incrementa el crédito de la Resolución de la presidenta del FOGAIBA por la que se aprueba la convocatoria, para el año 2023 , de las ayudas destinadas al fomento y protección de variedades autóctonas con riesgo de erosión genética. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;5. Con fecha 18 de mayo de 2024, se publicó en el BOIB nº 66 la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la que se incrementa el crédito de la Resolución de la presidenta del FOGAIBA por la que se aprueba la convocatoria, para el año 2023, de las ayudas destinadas al fomento y protección de variedades autóctonas en riesgo de erosión genética. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;6. De conformidad con el apartado sexto de la enmendada Resolución, el plazo de presentación de solicitudes de la convocatoria terminó día 30 de junio de 2023. Se registraron un total de 186 solicitudes de ayuda por la convocatoria de 2023. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;7. El 20 de febrero de 2024 se publica en el BOIB nº 25 la Resolución de denegación a los beneficiarios de las ayudas, Rd1 conjunta de la sección II, por el incumplimiento del requisito previsto en el apartado 7 del punto tercero de la convocatoria de estar al corriente de las obligaciones tributarias. En esta resolución hay 5 expediente de la línea de ayudas destinadas al fomento y protección de variedades autóctonas en riesgo de erosión genética. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;8. El 20 de abril de 2024 se publica en el BOIB núm. 52 la Resolución de denegación de beneficiarios de las ayudas, Rd1 de fecha 9 de abril de 2024, por el incumplimiento del requisito previsto en el apartado tercero del punto 1.b de la convocatoria de inscripción a alguna asociación o agrupación de agricultores y/o productores que tenga como objetivo la conservación o el mantenimiento de los cultivos en peligro de erosión genética y cumplan las obligaciones que se deriven. En esta resolución de denegación existen 15 expedientes de de la línea de ayudas destinadas al fomento y la protección de variedades autóctonas en riesgo de erosión genética. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;9. El 20/05/2024 se notificó mediante publicación en la página web del FOGAIBA, la propuesta provisionales de resolución de concesión y/o denegación y se concedió el plazo legalmente establecido para presentar alegaciones. El plazo ha finalizado sin haber ninguna alegación al respecto. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;10. Por otra parte, la administración de oficio ha detectado dos errores en el anexo II: &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;- En el expediente núm 122 (4004605) el importe correspondiente a las higueras era erróneo, por haber omite un cero. El importe que figuraba en la propuesta era 108,00€ cuando el importe correcto debía ser 1.080,00€. Por lo que, el importe total por este solicitante aumenta a 12.230,00€. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;- En el expediente núm. 140 (4004767) figuraba dos veces la variedad de vid escursac, y se ha corregido aumentado la superficie solicitada. El importe propuesto a conceder no varía por ser de aplicación la limitación de 3ha/variedad que ya se notificó con la propuesta. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Estas correcciones de errores han sido incorporadas en los anexos de esta resolución. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;11. Los interesados que figuran en el anexo I cumplen totalmente con los requisitos de la ayuda y por ello se resuelve conceder la superficie comprometida, tal y como se detalla en el anexo I. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;12. Los interesados del anexo II cumplen parcialmente con los requisitos de la ayuda y por ello se resuelve conceder la superficie que cumple (superficie comprometida) y se indica en la mesa de motivos de incumplimiento de cada recinto afectado. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;13. Los interesados del anexo III no tienen superficie admisible para la línea de ayudas de protección de variedades autóctonas en riesgo de erosión genética y por este motivo se resuelve denegar la ayuda por estos expedientes. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;14. En total se resuelve conceder 163 expedientes con un importe total de 4.457.105 (cuatro millones cuatrocientos cincuenta y siete mil ciento cinco euros), existiendo crédito adecuado y suficiente según el aumento publicado en el BOIB núm. 66 de 18 de mayo de 2024. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. Resolución de la Presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 20 de abril de 2023 por la que se aprueba la convocatoria para el año 2023 al fomento y la protección de variedades autóctonas en riesgo de erosión genética y sus posteriores modificaciones. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. La Orden 10/2023 de la consellera de Agricultura, Pesca y Alimentación, de 5 de abril de 2023, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco de las intervenciones para el desarrollo rural de las Islas Baleares 2023-2027. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Informe y propuesta de resolución &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Por todo ello, se informa favorablemente y propone al vicepresidente en Materia Agraria del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. Conceder la superficie de compromiso de los anexos I, II, III y IV que supone un total de 163 concesiones y una suma total de 4.457.105,00 € (cuatro millones cuatrocientos cincuenta y siete mil ciento cinco euros). &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. Autorizar y disponer el gasto señalado en cada uno de los beneficiarios con los porcentajes de cofinanciación detallados en el anexo IV y V respectivamente. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3.
