&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Hechos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1. En el &lt;em&gt;Boletín&lt;/em&gt;&lt;em&gt; Oficial de las &lt;/em&gt;&lt;em&gt;Illes&lt;/em&gt;&lt;em&gt; Ba&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;lears&lt;/span&gt;&lt;/em&gt; &lt;span style="background-color:#ffffff"&gt;nº&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;155, de&lt;/span&gt; &lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;29 de noviembre de 2022,&lt;/span&gt;&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;se publicó la Orden 30/2022&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;del consejero de Modelo Económico, Turismo y Trabajo por la que se establecen las bases reguladoras y se aprueba la convocatoria para la concesión de ayudas &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;de minimis&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt; para la modernización&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;y la innovación en la higiene y en&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;la limpieza de los establecimientos de alojamiento turístico, destinada a la compra de mecanismos de elevación de camas, para&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;cumplir&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;el artículo 37 bis de la Ley 8/2012, del Turismo&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;de las Illes Balears, en el marco del Plan de Recuperación, Transformación y Resiliencia financiado por la Unión Europea Next Generation EU.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:#ffffff"&gt;2. En el&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt; Boletín&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt; Oficial de las &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Illes&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt; Balears &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;nº&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;26, de 28 de febrero de 2023, se publicó la Resolución del consejero de Modelo Económico, Turismo y Trabajo por la cual se modifica la convocatoria mencionada en el punto anterior en el sentido de ampliar el plaz&lt;/span&gt;o de presentación de solicitudes y de modificar la composición de la Comisión Evaluadora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3. De acuerdo con lo que se expone en la Orden 30/2022 y en el punto 5 de la convocatoria, esta está sometida al régimen &lt;em&gt;de minimis&lt;/em&gt; establecido en el Reglamento (UE) 1407/2013 de la Comisión Europea, de 18 de diciembre de 2013, relativo a la aplicación de los artículos 107 y 108 del Tratado de &lt;span style="color:#000000"&gt;funcionam&lt;/span&gt;&lt;span style="color:#000000"&gt;i&lt;/span&gt;&lt;span style="color:#000000"&gt;ent&lt;/span&gt;&lt;span style="color:#000000"&gt;o&lt;/span&gt;&lt;span style="color:#000000"&gt; de la Unión Europea &lt;/span&gt;&lt;span style="color:#000000"&gt;en&lt;/span&gt;&lt;span style="color:#000000"&gt; las ayudas &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;de minimi&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;s&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;. En consecuencia, las ayudas previstas son compatibles con el mercado interior y, a la par, restan exentas de la obligación de notificación establecida en el artículo 108, apartado 3, del Tratado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. En el&lt;em&gt; Boletín&lt;/em&gt;&lt;em&gt; Oficial de las Illes Balears&lt;/em&gt; nº 162, de 28 de noviembre de 2023, se publicaron las resoluciones por las que se conceden las subvenciones en el marco de la convocatoria de subvenciones mencionada. A las personas que figuran en el anexo de estas resoluciones se les concedió una subvención y se autorizó y dispuso un gasto por los importes individuales que se indicaban en las resolucione&lt;span style="background-color:#ffffff"&gt;s, que se indican también en el anexo de esta propuesta de resolución, con cargo a la partida presupuestaria 12201/G/751C01/77000/00 MR071&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;de los presupuestos de la Comunidad Autónoma de las Illes&lt;/span&gt; Balears para el año 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Los expedientes de concesión de subvenciones en los cuales se concedía una subvención por importe igual o superior a 30.000 euros fueron fiscalizados de conformidad por la Intervención de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5&lt;span style="color:#000000"&gt;. &lt;/span&gt;&lt;span style="color:#000000"&gt;Tal como se hizo constar en las resoluciones de concesión, de acuerdo con el punto 15 de la convocatoria, el periodo de ejecución de las acciones subvencionables finaliza a los dos meses desde la publicación &lt;/span&gt;&lt;span style="color:#000000"&gt;de la resolución de concesión &lt;/span&gt;&lt;span style="color:#000000"&gt;en &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;el Boletín&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; Oficial de las Illes Balears&lt;/em&gt;&lt;/span&gt;. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6. Tal como se hizo constar en las resoluciones de concesión, de acuerdo con el punto 16 de la convocatoria, el plazo para la justificación de la subvención es de un mes a contar desde el día siguiente al de la conclusión del plazo de ejecución establecido en el punto anterior. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;7. En fecha 8 de marzo de 2024 se requirió a los beneficiarios que no habían presentado la documentación justificativa o la habían presentado con deficiencias que presentaran toda la documentación exigida como justificación, otorgándoles un plazo de quince días hábiles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;8. No consta que ninguno de los beneficiarios que se indican al anexo hayan presentado la documentación justificativa de las ayudas concedidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;9. El&lt;span style="color:#000000"&gt; &lt;/span&gt;14&lt;/span&gt;&lt;span style="color:#000000"&gt; de mayo de 2024, &lt;/span&gt;&lt;span style="color:#000000"&gt;el consejero de Turismo, Cultura y Deportes &lt;/span&gt;&lt;span style="color:#000000"&gt;dictó la resolución &lt;/span&gt;&lt;span style="color:#000000"&gt;por la &lt;/span&gt;&lt;span style="color:#000000"&gt;que&lt;/span&gt;&lt;span style="color:#000000"&gt; se inicia el procedimiento de revocación &lt;/span&gt;&lt;span style="color:#000000"&gt;total&lt;/span&gt;&lt;span style="color:#000000"&gt; de subvenciones concedidas en el marco de la convocat&lt;/span&gt;&lt;span style="color:#000000"&gt;o&lt;/span&gt;&lt;span style="color:#000000"&gt;ri&lt;/span&gt;&lt;span style="color:#000000"&gt;a de referencia&lt;/span&gt;&lt;span style="color:#000000"&gt;, &lt;/span&gt;&lt;span style="color:#000000"&gt;con&lt;/span&gt;&lt;span style="color:#000000"&gt; relación a las subvenciones concedidas mediante &lt;/span&gt;&lt;span style="color:#000000"&gt;las resoluciones publicadas &lt;/span&gt;&lt;span style="color:#000000"&gt;en &lt;/span&gt;&lt;span style="color:#000000"&gt;el&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; Boletín&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; Oficial de las Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;n&lt;/span&gt;&lt;span style="color:#000000"&gt;º&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;162&lt;/span&gt;&lt;span style="color:#000000"&gt;,&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de &lt;/span&gt;&lt;span style="color:#000000"&gt;28&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de &lt;/span&gt;&lt;span style="color:#000000"&gt;noviembre&lt;span style="color:#000000"&gt; &lt;/span&gt;de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;10. A todas las personas que se relacionan en el anexo de esta propuesta de resolución se les notificó la resolución de inicio del procedimiento de revocación total, en la que se indicaba el importe que se tenía que revocar y se les otorgaba un plazo de diez días para presentar alegaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;No consta que se hayan presentado alegaciones en el plazo establecido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;11&lt;/span&gt;. De acuerdo con el artículo 17.1 de la Orden 30/2022 del consejero de Modelo Económico, Turismo y Trabajo por la cual se establecen las bases reguladoras de esta convocatoria, corresponde la revocación total de la subvención si, posteriormente a la resolución de concesión de la subvención, la persona beneficiaria no justifica la realización del proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En consecuencia, dado que las personas beneficiarias que aparecen en el anexo de esta propuesta de resolución han presentado la documentación justificativa de las ayudas concedidas&lt;span style="color:#000000"&gt;, &lt;/span&gt;&lt;span style="color:#000000"&gt;corresponde &lt;/span&gt;&lt;span style="color:#000000"&gt;revocar&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;totalmente&lt;/span&gt;&lt;span style="color:#000000"&gt; l&lt;/span&gt;&lt;span style="color:#000000"&gt;a&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;res&lt;/span&gt;&lt;span style="color:#000000"&gt;oluci&lt;/span&gt;&lt;span style="color:#000000"&gt;ón&lt;/span&gt;&lt;span style="color:#000000"&gt; de concesión&lt;/span&gt;. Por eso, en el anexo se indica el importe de la actuación subvencionable justificado, el importe de la ayuda justificada y el importe de la ayuda que se tiene que revocar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. La Ley 38/2003, de 17 de noviembre, general de subvenciones, y el Reglamento de esta, aprobado por el Real Decreto 887/2006, de 21 de julio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. El Texto Refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. La Ley 14/2014, de 29 de diciembre, de Finanzas de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. La Ley 12/2023, de 29 de diciembre, de Presupuestos Generales de la Comunidad Autónoma de las Illes Balears para el año 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5. La Ley 4/2021, de 17 de diciembre, de medidas extraordinarias y urgentes para ejecutar las actuaciones y los proyectos que se tienen que financiar con fondos europeos en el marco del Plan de Recuperación, Transformación y Resiliencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6. El Decreto 75/2004, de 27 de agosto, de desarrollo de determinados aspectos de la Ley de Finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;7. El Decreto 12/2023, de 10 de julio, de la Presidenta de las Illes Balears, por el cual se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8. La Orden 30/2022&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;del &lt;/span&gt;&lt;span style="color:#000000"&gt;consejero de Modelo Económico, Turismo y Trabajo por la cual se establecen las bases reguladoras y se aprueba la convocatoria para la concesión de ayudas &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;de minimis&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; p&lt;/span&gt;&lt;span style="color:#000000"&gt;ara&lt;/span&gt;&lt;span style="color:#000000"&gt; la modernizació&lt;/span&gt;&lt;span style="color:#000000"&gt;n&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;y la innovación&lt;/span&gt;&lt;span style="color:#000000"&gt; en la higiene &lt;/span&gt;&lt;span style="color:#000000"&gt;y en&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;la limpieza&lt;/span&gt;&lt;span style="color:#000000"&gt; de l&lt;/span&gt;&lt;span style="color:#000000"&gt;o&lt;/span&gt;&lt;span style="color:#000000"&gt;s &lt;/span&gt;&lt;span style="color:#000000"&gt;establecimientos&lt;/span&gt;&lt;span style="color:#000000"&gt; de &lt;/span&gt;&lt;span style="color:#000000"&gt;alojamiento&lt;/span&gt;&lt;span style="color:#000000"&gt; turístico, destina&lt;/span&gt;&lt;span style="color:#000000"&gt;da&lt;/span&gt;&lt;span style="color:#000000"&gt; a la compra de mecanism&lt;/span&gt;&lt;span style="color:#000000"&gt;o&lt;/span&gt;&lt;span style="color:#000000"&gt;s de elevación de camas, p&lt;/span&gt;&lt;span style="color:#000000"&gt;ara&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;cumplir&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;el artículo&lt;/span&gt;&lt;span style="color:#000000"&gt; 37 bis de la &lt;/span&gt;&lt;span style="color:#000000"&gt;Ley&lt;/span&gt;&lt;span style="color:#000000"&gt; 8/2012, del &lt;/span&gt;&lt;span style="color:#000000"&gt;T&lt;/span&gt;&lt;span style="color:#000000"&gt;urism&lt;/span&gt;&lt;span style="color:#000000"&gt;o&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de l&lt;/span&gt;&lt;span style="color:#000000"&gt;as Illes Balears, en el marco del Plan de Recuperación, Transformación y Resiliencia financiado por la Unión Europea Next Generation EU. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Propuesta de resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Propongo al consejero de Turismo, Cultura y Deportes que dicte una resolución en los términos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;1.&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;Revocar totalment las subvenciones concedidas mediante las res&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;oluci&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;on&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;e&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;s&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; por las cuales se &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;conceden las subvencione&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;s &lt;/span&gt;a les personas beneficiarias que se indican en el anexo y por el importe en él detallado, &lt;span style="color:#000000"&gt;en el marco de la &lt;/span&gt;&lt;span style="color:#000000"&gt;convocatoria para la concesión de ayudas &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;de minimis&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; p&lt;/span&gt;&lt;span style="color:#000000"&gt;ara&lt;/span&gt;&lt;span style="color:#000000"&gt; la modernizació&lt;/span&gt;&lt;span style="color:#000000"&gt;n&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;y la innovación&lt;/span&gt;&lt;span style="color:#000000"&gt; en la higiene &lt;/span&gt;&lt;span style="color:#000000"&gt;y en&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;la limpieza&lt;/span&gt;&lt;span style="color:#000000"&gt; de l&lt;/span&gt;&lt;span style="color:#000000"&gt;o&lt;/span&gt;&lt;span style="color:#000000"&gt;s &lt;/span&gt;&lt;span style="color:#000000"&gt;establecimientos&lt;/span&gt;&lt;span style="color:#000000"&gt; de &lt;/span&gt;&lt;span style="color:#000000"&gt;alojamiento&lt;/span&gt;&lt;span style="color:#000000"&gt; turístico, destina&lt;/span&gt;&lt;span style="color:#000000"&gt;da&lt;/span&gt;&lt;span style="color:#000000"&gt; a la compra de mecanism&lt;/span&gt;&lt;span style="color:#000000"&gt;o&lt;/span&gt;&lt;span style="color:#000000"&gt;s de elevación de camas, p&lt;/span&gt;&lt;span style="color:#000000"&gt;ara&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;cumplir&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;el artículo&lt;/span&gt;&lt;span style="color:#000000"&gt; 37 bis de la &lt;/span&gt;&lt;span style="color:#000000"&gt;Ley&lt;/span&gt;&lt;span style="color:#000000"&gt; 8/2012, del &lt;/span&gt;&lt;span style="color:#000000"&gt;T&lt;/span&gt;&lt;span style="color:#000000"&gt;urism&lt;/span&gt;&lt;span style="color:#000000"&gt;o&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de l&lt;/span&gt;&lt;span style="color:#000000"&gt;a&lt;/span&gt;&lt;span style="color:#000000"&gt;s Illes Balears&lt;/span&gt;&lt;span style="color:#000000"&gt;, en el marco del Plan de Recuperación, Transformación y Resiliencia financiado por la Unión Europea Next Generation EU, &lt;/span&gt;&lt;span style="color:#000000"&gt;publicadas&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;el &lt;/span&gt;&lt;span style="color:#000000"&gt;28&lt;/span&gt;&lt;span style="color:#000000"&gt; de &lt;/span&gt;&lt;span style="color:#000000"&gt;noviembre&lt;/span&gt;&lt;span style="color:#000000"&gt; de 202&lt;/span&gt;&lt;span style="color:#000000"&gt;3&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;en &lt;/span&gt;&lt;span style="color:#000000"&gt;el&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; Boletín&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; Oficial de las Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;n&lt;/span&gt;&lt;span style="color:#000000"&gt;º&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;162&lt;/span&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. Notificar esta resolución a las personas beneficiarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Manifestar la conformidad con la propuesta de resolución y dictar resolución en los mismos términos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Turismo, Cultura y Deportes en el plazo de un mes a contar desde el día siguiente al de la notificación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;También se puede interponer directamente un recurso contencioso-administrativo ante la sala de lo contencioso-administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente al de su publicación, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
