&lt;p style="margin-bottom: 0, 0pt; margin-top: 3, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-top: 3, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 4&amp;nbsp;de junio&amp;nbsp;de 2024, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom: 0, 0pt; margin-top: 3, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha 6 de abril de 2023, se publica en el BOIB núm. 43, la Orden de la consejera de Agricultura, Pesca y Alimentación por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco de las intervenciones para el desarrollo rural de las Islas Baleares 2023-2027. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;2.Con fecha 15 de abril de 2023, se publica en el BOIB núm. 48, la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la que se aprueba la convocatoria, para el año 2023, de las ayudas destinadas para el fomento de pastos para el aprovechamiento de la ganadería ecológica. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;3.Con fecha 30 de mayo de 2023, se publica en el BOIB núm. 71, la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la que se modifica la Resolución de la presidenta del FOGAIBA de 27 de febrero de 2023, de convocatoria, para el año 2023, de las ayudas correspondientes a las intervenciones en forma de pagos directos que prevé el Plan estratégico de la PAC (PEPAC), así como otras resoluciones de convocatoria de ayudas que prevén las intervenciones en el desarrollo rural. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;4.Con fecha 30 de junio de 2023, se han recibido 162 solicitudes por la ayuda destinada para el fomento de pastos para el aprovechamiento de la ganadería ecológica. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;5.Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;6.Con fecha 9 de abril de 2024, se publica en el BOIB núm. 47 la Resolución de denegación a los beneficiarios de las ayudas, Rd2 conjunta de la Sección II, por el incumplimiento del requisito previsto en el apartado 7 del punto tercero de la convocatoria de estar al corriente de las obligaciones tributarias. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;7.Con fecha 11 de mayo de 2024, se publica en el BOIB núm. 62 la Resolución de concesión de las ayudas destinadas para el fomento de pastos para el aprovechamiento de la ganadería ecológica. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;8.Los órganos gestores han detectado errores en la concesión de la ayuda y por tanto procede la revisión y se estima oportuno promover de oficio la modificación parcial de la resolución de concesión antes mencionada. Concretamente, el beneficiario Mestre Vadell, Gaspar Josep (Exp. AERA 108) . En el Anexo I de la presente resolución se detallan los importes concedidos con los porcentajes de cofinanciación correctos. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;9.El artículo 109.2 de la Ley 39/2015, de 1 de octubre de procedimiento administrativo común de las administraciones públicas, establece que las administraciones públicas, podrán, asimismo, rectificar en cualquier momento, de oficio oa instancia de los interesados, los errores materiales, de hecho o aritméticos o existentes en sus actos. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;10.Dado todo esto, y con el fin de subsanar los errores detectados, se modifica parcialmente la resolución de concesión del beneficiario de las ayudas, de fecha 11 de mayo de 2024, tal y como se detalla en el anexo.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;2.Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 12 de abril de 2023 por la que se aprueba la convocatoria para el año 2023 de las ayudas destinadas para el fomento de pastos para el aprovechamiento de la ganadería ecológica, publicada en el BOIB núm. 48 de día 15 de abril de 2023. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;3.Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 5 de diciembre de 2023 por la que se modifican varias convocatorias de subvenciones del FOGAIBA, correspondientes a las intervenciones que prevé el Plan estratégico de la PAC 2023 -2027 de España (PEPAC) para la ayuda de la Unión financiada por el FEAGA y por el FEADER, publicada en el BOIB núm. 167 de 9 de diciembre de 2023. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;4.Punto segundo, apartado 2 de la convocatoria en lo referente a la financiación de las ayudas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom: 0, 0pt; margin-top: 3, 0pt; text-align: justify"&gt;&lt;strong&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;Informe y Propuesta de Resolución &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-top: 3, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;Por todo esto, se informa &amp;nbsp;y&lt;/em&gt;&lt;em&gt;&amp;nbsp;se &lt;/em&gt;&lt;em&gt;&amp;nbsp;propo&lt;/em&gt;&lt;em&gt;ne&lt;/em&gt;&lt;em&gt;&amp;nbsp;al vicepresidente &lt;/em&gt;&lt;em&gt;en Materia Agraria del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-top: 3, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;1.Modificar parcialmente la resolución de concesión publicada en el BOIB nº. 62 de 11 de mayo de 2024, tal y como se detalla en el anexo I de esta resolución. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-top: 3, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;2.Notificar la Resolución a los interesados en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-top: 3, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;Interposición de recursos &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-top: 3, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;Contra esta resolución -que no agota la vía administrativa- se puede interponer recurso de alzada ante la consellera de Agricultura, Pesca y Medio Natural, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
