    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la cual se convocan subvenciones para Inversiones a las explotaciones agrícolas, para los años 2015-2019, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt;&amp;nbsp;de acuerdo con los términos que prevee el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), en cumplimiento del que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del Procedimiento Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente en Materia &amp;nbsp;Agraria del FOGAIBA, con fecha de 26&amp;nbsp;de mayo&amp;nbsp;de 2024, dicta lo siguiente:&amp;nbsp;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;“ &lt;/em&gt;&lt;/strong&gt;&lt;strong&gt;&lt;em&gt;EXPEDIENTE NÚMERO: INEA2015_2/065&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. Con fecha 24 de noviembre de 2015, con núm. de registro de entrada 1947/2015 ANTONIO RIUTORT CLADERA con DNI ***7224** en nombre y representación de TALAPI S.A.T con NIF V57310716 presentó en el registro del FOGAIBA una solicitud de ayuda para poder acogerse a la línea de ayudas para inversiones en las explotaciones agrarias, al amparo de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias, publicada en el BOIB núm. 106 de 16 de julio de 2015. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. La citada ayuda se concedió mediante Resolución del vicepresidente del FOGAIBA de 5 de abril de 2018, por un importe de 109.713,16 euros, cofinanciado por el FEADER en un 53,00%, por el MAPAMA 14,10%, y por el CAIB 32,90%, de acuerdo con la siguiente distribución:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;58.147,97 euros &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;con&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;c&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;r&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;go&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;a la línea FEADER &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;15.469,56 euros &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;con&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;c&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;r&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;go&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;a la línea MAPAMA&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;36.095,63 euros &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;con&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;c&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;rgo&amp;nbsp;a la CAIB.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. La citada Resolución de concesión de la ayuda fue notificada al interesado mediante BOIB núm. 46 de 14 de abril de 2018. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. Con fecha 31 de julio de 2018 con número de registro de entrada L95E19891, el interesado presentó solicitud de pago parcial de la ayuda concedida, la cual, una vez revisada la documentación presentada fue pagada parcialmente a la interesado por un importe de 41.485, 26 euros (Resolución de pago del director gerente del FOGAIBA de día 30 de enero de 2019) de acuerdo con la siguiente distribución:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;21.987,19 euros &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;con&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;c&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;r&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;go&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;a la línea FEADER &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.849,42 euros &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;con&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;c&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;r&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;go&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;a la línea AGE&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;13.648,65 euros &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;con&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;c&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;rgo&amp;nbsp;a la CAIB.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5. Con fecha 21 de febrero de 2019 el interesado presentó en el registro de FOGAIBA la documentación correspondiente para solicitar un cambio de maquinaria por su explotación por motivos de cambio de cultivo. Y en fecha 4 de noviembre de 2019 se requiere al beneficiario para que presente solicitud de pago final dentro del plazo de 15 días hábiles. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. En consecuencia, y sin recibir la correspondiente solicitud de pago final, se consideró que el beneficiario había incumplido lo establecido en el punto duodécimo, apartado 1 y 2 de la Convocatoria y por ello se procedió a la revocación de la resolución de concesión y al inicio de procedimiento de reintegro. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7. Con fecha 25 de noviembre de 2021 se envió el correspondiente Acuerdo de inicio de revocación de la resolución de concesión de la ayuda y de inicio de procedimiento de reintegro al interesado. Tras comprobar por parte de la administración que el acuerdo de inicio no había sido notificado se alertó de un error en el correo electrónico del beneficiario. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8. Con fecha 11 de enero de 2021 se volvió a enviar el Acuerdo de inicio de revocación de la resolución de concesión de la ayuda y de inicio de procedimiento de reintegro. Transcurrido el plazo de diez días naturales estipulados en la ley 39/2015, de 1 de octubre de procedimiento administrativo común sin que el interesado acceda a su contenido ésta se entenderá rechazada. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9. El interesado presenta alegaciones en el Acuerdo de inicio de revocación de la resolución de concesión de la ayuda y de inicio de procedimiento de reintegro del vicepresidente en materia agraria del FOGAIBA de fecha 24 de noviembre de 2020. La documentación adjunta es la siguiente:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Factura de&amp;nbsp;fecha 5 de d&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ici&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;embre de 2017 p&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;o&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;r un importe&amp;nbsp;de 6.569,00 euros. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Factura de fecha 22 de mar&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;zo&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de 2019 p&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;o&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;r un importe&amp;nbsp;de 17.892,88 euros.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;10. Se aceptan las alegaciones y el solicitante no presenta la solicitud de pago requerida en el año 2019.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;11. Una vez transcurrido el plazo mencionado no han presentado la documentación requerida, por lo que debe revocarse la ayuda de acuerdo con el artículo 92.1 del Reglamento de la Ley de subvenciones. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;12. El artículo 21.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas establece la obligación de la Administración a dictar resolución expresa ya notificarla. En su párrafo segundo especifica que “En los casos de prescripción, renuncia del derecho, caducidad del procedimiento o desistimiento de la solicitud, así como la desaparición sobrevenida del objeto del procedimiento, la resolución consistirá en la declaración de la circunstancia que concurra en cada caso, con indicación de los hechos producidos y las normas aplicables”. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;13. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que “Pertoca la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. &lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Propuesta de Resolución de Revocación parcial&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Por todo lo expuesto anteriormente, este Servicio informa favorablemente y propone al vicepresidente en materia agraria del FOGAIBA que dicte una resolución en los siguientes términos: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.- Revocar parcialmente la resolución de ayuda concedida al beneficiario por el importe y con el plazo detallado en el anexo de esta resolución, que es un total de 1 expediente, que comienza y termina por TALAPI SAT. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.- Archivar el expediente de referencia. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.- Notificar esta Resolución al interesado, informándole que contra ésta podrá interponer recurso de alzada ante el consejero de Agricultura, Pesca y Medio Natural en el plazo de un mes a contar a partir del día siguiente al de la su notificación, de acuerdo con lo establecido en el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la administración de la Comunidad Autónoma de las Illes Balears y en los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las Administraciones Públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
