&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Las asociaciones de ganaderos de razas autóctonas cumplen una importante función de preservación zootécnica, porque cuentan con una información genética única indispensable para el mantenimiento de la raza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La reserva genética que constituyen las razas autóctonas de Menorca tiene que ser protegida, no tan solo por su valor intrínseco y de adaptación al medio, sino también por el bagaje que comportan por el hecho de formar parte de la cultura de Menorca y por su presencia en diferentes lugares fuera de nuestro territorio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El Plan Estratégico de Subvenciones (PES) para el ejercicio 2024 (aprobado por el CEX reunido en sesión de carácter ordinario de 4 de diciembre de 2023 y modificado por Acuerdo del CEX reunido en sesión de carácter extraordinario de 22 de diciembre de 2023, BOIB núm. 10 de 20 de enero de 2024) establece la previsión de la actividad subvencionadora en la línea de fomento de actividades de interés general, dentro del marco normativo establecido para la concesión de subvenciones. Una de las líneas de subvención incluidas en este PES es la ayuda a las asociaciones de ganaderos de razas autóctonas de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El artículo 6 del Reglamento UE núm. 2022/2472 de la comisión de 14 de diciembre de 2022, por el cual se declaran determinadas categorías de ayuda en los sectores agrícola y forestal y en zonas rurales compatibles con el mercado interior en aplicación de los artículos 107 y 108 del Tratado de funcionamiento de la Unión Europea, dice que para conseguir un efecto incentivador de las ayudas, el beneficiario tiene que presentar por escrito una solicitud de ayuda antes de empezar a trabajar en el proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Departamento de Economía y Servicios Generales quiere apoyar a las asociaciones de razas autóctonas durante el año 2024 para las actuaciones llevadas a cabo desde el día de presentación de las solicitudes hasta día 31 de diciembre de 2024, para compensar el coste de los gastos relacionados con la gestión de los libros genealógicos y la mejora genética, para obtener productos primarios de calidad, y también, contribuir a los gastos derivados de las tareas que realizan las asociaciones para promocionar estos productos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El presupuesto del Consejo Insular de Menorca para el año 2025, como en los últimos años, contará con un crédito por importe de 30.000 € para apoyar a la convocatoria de ayudas a las asociaciones de ganaderos de razas autóctonas para el año 2024. Las actuaciones se tendrán que llevar a cabo durante el 2024. La concesión de las ayudas y su justificación tendrán lugar dentro del 2025 y, por lo tanto, la aplicación del gasto se incluirá en el presupuesto del CIM para el año 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. El artículo 2.2 de la Ley 8/1999, de 12 de abril, de atribución de competencias a los consejos insulares de Menorca y de Ibiza y Formentera en materia de agricultura, ganadería, pesca y artesanía, dice que son funciones de los consejos insulares de Menorca y Formentera, que pueden desarrollar en su ámbito territorial, entre otros, las actuaciones en materia de agricultura y ganadería. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El artículo 70.12 de la Ley Orgánica 1/2007, de reforma del Estatuto de autonomía de las Islas Baleares, determina las competencias propias de los consejos insulares, entre las cuales se encuentran la agricultura, la ganadería y la pesca. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El artículo 73 de la mencionada ley dice que corresponde a los consejos insulares, en las materias que el Estatuto los atribuye como propias, el ejercicio de la actividad de fomento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Vista la propuesta de la consejera ejecutiva del Departamento de Economía y Servicios Generales;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consejo Ejecutivo, por unanimidad de los seis miembros presentes (señor Vilafranca Florecido, señora Reynés Calvache, señor Gornés Hachero, señora Torrent Pallicer, señora Taltavull Fernández y señor Delgado Díaz) y en votación ordinaria, adopta los acuerdos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primero.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Aprobar las bases que rigen la convocatoria de las ayudas del CIM para las asociaciones de razas autóctonas de Menorca para el año 2024 y sus anexos, que acompañan esta propuesta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segundo.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Aprobar, simultáneamente, la convocatoria correspondiente a 2024, que se regirá por las bases a que hace referencia el punto anterior, de acuerdo con las condiciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Importe global máximo de las ayudas y crédito presupuestario: estas ayudas se convocan condicionadas a la aprobación del presupuesto del Consejo Insular de Menorca para el año 2025. Los importes máximos son los que se indican más abajo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta aportación está condicionada a la cobertura futura según la aprobación del presupuesto del Consejo Insular de Menorca para el año 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El importe máximo a que se destina la convocatoria únicamente podrá ampliarse, sin necesidad de nueva publicación, en el supuesto de aportaciones expresas de terceros para contribuir a la financiación del objeto de la convocatoria y que se hayan concretado posteriormente a su aprobación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; El importe individual máximo de la ayuda por asociación de raza autóctona será de 12.000&amp;nbsp;€ (el beneficiario final de estas ayudas serán las pequeñas y medias explotaciones agrarias que estén integradas en las asociaciones de razas autóctonas).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) El plazo de presentación de solicitudes es de un mes a partir del día siguiente de haberse publicado la convocatoria en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) La instrucción de esta convocatoria corresponde a la veterinaria del Departamento de Economía y Servicios Generales del Consejo Insular de Menorca Gemma Sintes Coll. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Bases que rigen la concesión de ayudas del Departamento de Economía y Territorio del Consejo Insular de Menorca para el fomento de la raza autóctona de Menorca&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1. Objecto&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El Consejo Ejecutivo aprobó el Plan Estratégico de Subvenciones del Consejo Insular de Menorca (PES) del año de la convocatoria. El PES establece la previsión de la actividad subvencionadora en la línea de fomento de actividades de interés general, dentro del marco normativo establecido para la concesión de subvenciones. Una de las líneas de subvención incluidas en este PES es la ayuda a las asociaciones de ganaderos de razas autóctonas de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El objeto de esta convocatoria es apoyar a las actividades que lleven a cabo las asociaciones de ganaderos de razas autóctonas de Menorca, con el objeto de compensar el coste de los gastos relacionados con la gestión de los libros genealógicos y la mejora genética, para obtener productos primarios de calidad, y también, para los gastos derivados de las tareas que llevan a cabo las asociaciones para promocionar estos productos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las ayudas se concederán de acuerdo con el Reglamento (CE) núm. 2472/2022 de la Comisión, de 14 de diciembre de 2022, por el cual se declaran determinadas categorías de ayuda en los sectores agrícola y forestal y en zonas rurales compatibles en el mercado interior en aplicación de los artículos 107 y 108 del Tratado de funcionamiento de la Unión Europea. También se tendrán en cuenta las previsiones del Real Decreto 1625/2011, de 14 de noviembre, por el cual se establecen las bases reguladoras de las subvenciones destinadas al fomento de las razas autóctonas españolas, modificado por el Real Decreto 181/2015, de 13 de marzo, y por el Real Decreto 663/2023, de 18 de julio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El periodo subvencionable de las actividades ejecutadas será entre el día de presentación de la solicitud y día 31 de diciembre de 2024, según lo que establece el artículo 6.1 del Reglamento UE núm. 2472/2022, que dice que la aplicación de este reglamento será exclusivamente en las ayudas que tenga un efecto incentivador.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En cumplimiento del artículo 9.1 y 11.1 del Reglamento (CE) núm. 2472/2022, el número de registro del documento validado por la aplicación SANI (programa informático específico para las comunicaciones de ayudas en la Comunidad Europea) es SA.114074.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. Finalidad&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La finalidad de esta convocatoria es contribuir al mantenimiento de las razas autóctonas de Menorca, que se tienen que proteger dado su valor añadido y su adaptación en el territorio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. Financiación e importe máximo&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las ayudas que se otorguen en el marco de estas bases se pagarán con cargo a las partidas y por el importe máximo que se establezcan en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cuando el importe de las solicitudes de ayudas sea superior a la cantidad máxima fijada en la convocatoria se priorizarán las solicitudes en función de los criterios objetivos para la concesión de las ayudas establecidas en estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El importe de las subvenciones en ningún caso puede ser de una cuantía tal que, aisladamente o en concurrencia con otras subvenciones, ayudas, ingresos o recursos, supere el coste de la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. Actividades subvencionables: requisitos y condiciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Según dice el artículo 27 del Reglamento UE 2022/2472, y el Real Decreto 1625/2011, las actividades subvencionables serán:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Gastos administrativos derivados de la creación y mantenimiento de libros genealógicos, incluidas las del local u oficinas, ordenadores y material informático y su mantenimiento o actualización, de la adquisición de material no inventariable y la contratación, y los gastos de personal técnico y administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Gastos derivados del desarrollo del programa de mejora, controles de rendimientos para hacer las evaluaciones genéticas de los animales y los programas de difusión de mejora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Son objeto de subvención los gastos realizados desde el día de la presentación de la solicitud hasta día 31 de diciembre del año de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Cuando el importe del gasto subvencionable supere la cuantía de 15.000 € en caso de suministro de bienes de equipación o prestación de servicios por empresas de consultoría o asistencia técnica, el beneficiario tiene que solicitar como mínimo tres ofertas de proveedores diferentes, con carácter previo a la contratación del compromiso para la prestación del servicio o la entrega del bien, excepto cuando por las características especiales de los gastos subvencionables no haya en el mercado un número suficiente de entidades que lo suministren o lo ofrezcan, o cuando el gasto se haya realizado anteriormente a la solicitud de subvención, cuando así se haya establecido. Se tiene que justificar que el precio pagado por el servicio no es superior al precio de mercado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El IVA no se puede subvencionar, salvo cuando no sea recuperable por el beneficiario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5. Régimen de compatibilidad con otras ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Las subvenciones que se rigen por estas bases son de carácter voluntario y eventual y se pueden anular, revocar y reintegrar en todo momento por las causas previstas en la Ley o en estas bases; no generan ningún derecho a la obtención de otras subvenciones en años posteriores, y no se pueden alegar como precedente. Así mismo, las ayudas que se otorguen en conformidad con estas bases son compatibles con la concesión de otras ayudas, sin perjuicio de la obligación de las entidades beneficiarias de comunicarlo al Consejo Insular de la forma establecida en estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El importe de las subvenciones que se concedan no puede superar en ningún caso el límite del 100% del importe total de la actividad objeto de subvención, de manera aislada o en concurrencia con otras ayudas que, con la misma finalidad, pueda recibir el beneficiario de cualquier administración pública o de otra entidad pública o privada, nacional o internacional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El importe de la ayuda en ningún caso podrá superar, aisladamente o en concurrencia con otras subvenciones o ayudas otras administraciones públicas o entes públicos o privados, nacionales o internacional, el coste total de la actividad objeto de subvención, ni los límites establecidos en el art. 26.8 del Reglamento (CE) núm. 2472/2022 de la Comisión, de 14 de diciembre de 2022, por el cual se declaran determinadas categorías de ayuda en los sectores agrícola y forestal y en zonas rurales compatibles en el mercado interior en aplicación de los artículos 107 y 108 del Tratado de Funcionamiento de la Unión Europea.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La obtención concurrente de ayudas otorgadas por la misma finalidad por otras administraciones o entes públicos y privados, nacionales o internacionales, o de pagos de regímenes de aseguramiento que cubran el mismo objeto o finalidades de estas ayudas, cuando el importe total de las subvenciones percibidas por cada beneficiario supere el coste de toda la actividad subvencionable que se tenga que desarrollar, dará lugar a la reducción proporcional que corresponda en el importe de las subvenciones reguladas en esta convocatoria, hasta ajustarse a este límite. Si, además, la suma de las subvenciones supone una intensidad de la ayuda superior a los porcentajes máximos establecidos en la normativa estatal o comunitaria aplicables, se reducirá hasta el límite mencionado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. Requisitos de los beneficiarios&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Pueden acogerse a las ayudas las asociaciones de ganaderos que estén constituidas como personas jurídicas y que cumplan los requisitos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Que no tenga ánimo de lucro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Que estén reconocidas oficialmente para la gestión del libro de la raza autóctona por la autoridad competente, según los requisitos establecidos en el artículo 4 y la parte I del anexo I del Reglamento (UE) 2016/1012.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Que cumplan lo que establece el Reglamento (UE) 2016/1012 del Parlamento Europeo y del Consejo, 8 de junio de 2016, relativo a las condiciones zootécnicas y genealógicas para la cría, el comercio y la entrada a la Unión de animales reproductores de raza pura, porcinos reproductores híbridos y su material reproductivo, y por el cual se modifican el Reglamento (UE) núm. 652/2014 y las directivas 89/608/CEE y 90/425/CEE del Consejo y se derogan determinados actas en el ámbito de la cría animal (anexo I).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Que cumplan lo que establece el Real Decreto 45/2019, de 8 de febrero, en relación con las normas zootécnicas aplicables a los animales reproductores de raza pura, porcinos reproductores híbridos y su material reproductivo, por el cual se actualiza el Programa nacional de conservación, mejora y fomento de las razas ganaderas y se modifican los reales decretos 558/2001, de 25 de mayo; 1316/1992, de 30 de octubre; 1438/1992, de 27 de noviembre, y 1625/2011, de 14 de noviembre (anexo I).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) Que cumplan los requisitos exigidos por el artículo 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, y los artículos 9 y 10 del Decreto Legislativo 2/2005,de 28 de diciembre, por el cual se aprueba el Texto refundido de la Ley de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f) Que no han estado sujetos a una orden de recuperación pendiente después de una decisión previa de la Comisión que haya declarado una ayuda ilegal e incompatible con el mercado interior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Las explotaciones ganaderas integradas en la asociación, como beneficiarios finales de esta subvención, tienen que cumplir los requisitos siguientes (anexo V):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Como beneficiario de una ayuda inferior a 3.000 € y según lo que prevé el artículo 24.4 del Real Decreto 887/2006, de 21 de julio, por el cual se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, general de subvenciones, declarar que está al corriente del pago de las obligaciones tributarias de carácter estatal, insular y local, y con la Seguridad Social, previstas en las disposiciones vigentes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Los requisitos exigidos por los artículos 13.2, 13.3, 13.3 bis de la Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Que sean titulares de explotaciones ganaderas en actividad y que las explotaciones tenga la condición de PIME, de acuerdo con el artículo 2.52 y el anexo I del Reglamento (CE) núm. 2472/2022 de la Comisión, de 14 de diciembre de 2022, por el cual se declaran determinadas categorías de ayuda en los sectores agrícola y forestal y en zonas rurales compatibles con el mercado interior en aplicación de los artículos 107 y 108 del Tratado de funcionamiento de la Unión Europea.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Que la explotación esté inscrita en el Registro general de explotaciones ganaderas (REGA).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) No tener la consideración de empresa en crisis, de acuerdo con el artículo 2.59 del Reglamento (UE) número 2022/2472, de la Comisión, de 14 de diciembre de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f) Que la explotación no esté sujeta a una orden de recuperación pendiente después de una decisión previa de la Comisión que haya declarado una ayuda ilegal e incompatible con el mercado interior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Sin embargo, no pueden ser beneficiarios:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Las personas físicas o jurídicas en las cuales concurra alguna de las prohibiciones establecidas en el art. 10 del Decreto Legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el Texto refundido de la Ley de subvenciones, y el art. 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones. (Anexo II)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Las personas físicas o jurídicas que, en el momento que el órgano instructor dicte la propuesta de resolución definitiva de la convocatoria, no estén al corriente en el cumplimiento de sus obligaciones tributarias y con la Seguridad Social ante la Administración General del Estado y con las obligaciones tributarias con el Consejo Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;(El hecho de estar al corriente con las obligaciones tributarias del Consejo Insular de Menorca se verificará de oficio por la Tesorería del Consejo Insular)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Las personas físicas o jurídicas que hayan sido sancionadas o condenadas en los últimos tres años, mediante resolución administrativa firme o sentencia judicial de carácter firme, por haber ejercido o tolerado prácticas laborales consideradas discriminatorias por razón de sexo o de género en conformidad con lo que dispone el artículo 11 de la Ley 11/2016, de 28 de julio, de igualdad de mujeres y hombres. A tal efecto, las entidades solicitantes tienen que presentar, junto con la solicitud de la ayuda, una declaración responsable del hecho de no haber estado nunca objeto de sanciones administrativas firmes ni de sentencias firmes condenatorias (anexo II).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7. Presentación de las solicitudes &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Las solicitudes se tienen que presentar formalizadas electrónicamente mediante el modelo normalizado que se adjunta como anexo 1 de estas bases y que se encuentra en la sede electrónica www.cime.es.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. A la solicitud, se ha de adjuntar la documentación siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Documentación administrativa &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Si el solicitante es persona jurídica, escritura de constitución o modificación, estatutos o reglamento interno de funcionamiento inscritos en el registro correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) CIF del solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Si fuera necesario en conformidad con sus estatutos, certificado del acuerdo adoptado por el órgano de gobierno de la entidad para solicitar la ayuda y designar representante. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Acreditación de la representación si la solicitud se presenta en nombre de otro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) NIF del representante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f) Certificado de la Dirección General de Agricultura, Ganadería y Desarrollo Rural que acredite que la asociación está reconocida oficialmente para la gestión del libro genealógico de la raza. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;g) Declaración responsable firmada por el solicitante o por su representante legal de no estar sometido a ninguno de las circunstancias que determinan la imposibilidad de obtener la condición de beneficiario o entidad colaboradora de las subvenciones públicas recogidas en el art 10 del Decreto Legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el Texto refundido de la Ley de subvenciones (anexo II).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;h) Declaración responsable firmada por el solicitante o por su representante legal relativa a las subvenciones o ayudas obtenidas y solicitadas otras instituciones públicas o privadas para realizar la misma actividad (anexo III).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;i) Documento de designación de cuenta bancaria de la empresa o de su representante, según el modelo facilitado por Consejo Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;j) Certificado en que conste que está al corriente de las obligaciones tributarias ante la Administración del Estado, con la Seguridad Social y con el Consejo Insular. Se puede autorizar al Consejo Insular de Menorca a comprobar el cumplimiento de estas obligaciones (anexo I). La comprobación de estar al corriente de las obligaciones tributarias con el Consejo Insular se comprobará de oficio. Si el importe se la subvención solicitada es inferior a 3.000 euros la entidad solicitante puede sustituir estos certificados por una declaración responsable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;k) Documentación que acredite la condición de PIME de las explotaciones integradas a las asociaciones que puede consistir en una declaración responsable de los titulares de la explotación y que se tiene que ajustar al contenido de estas bases. (Anexo V) .&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;l) Documentación acreditativa, en su caso, que no se puede recuperar ni compensar el importe asumido como IVA objeto de petición de ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Documentación específica&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;m) Certificado emitido por el secretario de la asociación en que conste el censo de animales vivos inscritos en el libro genealógico, calificados para su raza y el número de explotaciones ganaderas con código REGA que la integran, que tiene que coincidir con el número de Anexos V presentados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los beneficiarios pueden autorizar el Consejo Insular de Menorca a comprobar el cumplimiento de las obligaciones tributarias y de la Seguridad Social. Estas comprobaciones se llevarán a cabo en la medida que el Consejo Insular de Menorca disponga de los convenios adecuados que se lo permitan (anexo I).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se exime de presentar la documentación a que hacen referencia las letras a, b, c, d, e y h en el supuesto de que esta ya conste en los archivos del Consejo Insular. En este caso se tiene que hacer constar expresamente en la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. De acuerdo con el artículo 28.3 y el artículo 53 c de la LPACAP, las personas interesadas no tienen la obligación de presentar documentos originales, salvo que, con carácter excepcional, la normativa reguladora aplicable exija lo contrario. En cualquier caso, las personas interesadas son responsables de la veracidad de los documentos que presenten (art. 28.7 de la LPACAP).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el artículo 28.5 de la LPACAP, excepcionalmente, cuando la relevancia de un documento del expediente aportado por el interesado lo exija, o existan dudas derivadas de la calidad de la copia, el CIM puede solicitar de manera motivada la autenticación de las copias aportadas por la persona interesada, por lo cual puede requerir la exhibición del documento o de la información original.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Por el hecho de presentarse a esta convocatoria la persona interesada presta al CIM los consentimientos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Para consultar y comprobar la veracidad de la documentación y de los datos presentados por el interesado que tenga en su poder otras administraciones públicas, principalmente mediante las plataformas de interoperabilidad, las redes corporativas u otros sistemas electrónicos habilitados a tal efecto y a los cuales el CIM tenga acceso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Para consultar la existencia y veracidad de la documentación y de los datos que eventualmente el interesado haya considerado oportuno no presentar acogiéndose al derecho de no hacerlo por el hecho de que hayan sido elaboradas por las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los mencionados consentimientos solo se considerarán otorgados cuando no conste en el expediente la oposición expresa a la mencionada consulta o cuando la ley especial que sea aplicable al caso requiera el consentimiento expreso, en este último caso será obligatorio que la Administración lo requiera y que el interesado lo preste. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. La solicitud y toda la documentación transcrita en el punto 2 de la base 7 se tienen que presentar, dentro del plazo establecido en la convocatoria, de acuerdo con las indicaciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por medios electrónicos de acuerdo con lo que establece el art. 14.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, en el registro electrónico del Consejo Insular de Menorca (www.cime.es) o a cualquier otro registro electrónico de los establecidos en el artículo 16.4 de la Ley 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si algún solicitante presenta la solicitud presencialmente, se le requerirá para que lo enmiende mediante su presentación electrónica. A estos efectos, y de acuerdo con el que establece en el artículo 68.4 de la misma ley, se considera como fecha de presentación de la solicitud el día en que haya tenido lugar la enmienda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Si la solicitud o la documentación fueran incorrectas o incompletas, el Consejo Insular de Menorca requerirá la rectificación o el complemento necesarios. Si en el plazo de diez días hábiles, contados desde el día siguiente de haber recibido el requerimiento de enmienda de la solicitud, la persona interesada no hace la rectificación reclamada o no presenta la documentación requerida, se entenderá que ha desistido en su petición en conformidad con el artículo 68 de la LPACAP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8. Prelación y valoración de las solicitudes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En la concesión de las subvenciones previstas se tendrá en cuenta el censo de animales inscritos en el libro genealógico, y el número de explotaciones ganaderas en las cuales se llevan a cabo las actividades subvencionables. Estas explotaciones ganaderas, que forman parte de cada asociación, tienen que estar inscritas en el registro de explotaciones ganaderas (REGA).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No se podrán tener en cuenta los asociados integrantes de las asociaciones, que no sean titulares o representantes, de una explotación con código REGA, ni los que, cumpliendo este requisito, no hayan presentado el Anexo V, en el momento de solicitar la ayuda, este documento (anexo V), servirá para acreditar el requisito.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La ayuda se otorgará en función de la puntuación obtenida por la suma de puntos de los apartados a) y b): &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) número de animales vivos, inscritos en el libro genealógico:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Cuantía de las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La cuantía de la subvención está limitada en función del tipo de actuación que se solicite:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Por creación o mantenimiento del libro genealógico: 100&amp;nbsp;% del gasto subvencionable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Por la implantación y desarrollo de los programas de mejora, controles de rendimientos por evaluaciones genéticas y programas de difusión de mejora: hasta el 70&amp;nbsp;% del gasto subvencionable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El total de la subvención no podrá superar el coste total de la actividad objeto de subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Si el importe global que se subvencione, después de aplicar la base 8, es superior al crédito disponible, este se repartirá proporcionalmente entre los solicitantes que cumplan los requisitos y según los criterios de reparto señalados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El importe máximo que podrá recibir cada asociación beneficiaría será de 12.000&amp;nbsp;€; en cualquier caso, para el beneficiario final (explotación agraria) será inferior a 3.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10. Comisión evaluadora de las ayudas &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La comisión evaluadora es el órgano colegiado a quien corresponde examinar las solicitudes presentadas y emitir el informe que tiene que servir de base para elaborar la propuesta de resolución que tiene que formular el órgano instructor competente. Su creación y el nombramiento de sus miembros vendrá establecida para cada convocatoria, de acuerdo con estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El objeto de la Comisión Evaluadora es examinar los expedientes de ayudas, que tendrán que ir acompañados de informe técnico, y emitir un informe que tiene que servir de base para elaborar la propuesta de resolución. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La Comisión Evaluadora tiene que estar integrada por personas que cumplan los criterios de competencia profesional y experiencia. Su composición será la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Presidenta: la consejera ejecutiva del Departamento de Economía y Servicios Generales&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Secretario/aria: uno/a funcionario/aria del Departamento&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Un número de vocales no inferior a tres, designados en la resolución de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Para que la Comisión Evaluadora se entienda válidamente constituida, se requerirá la presencia del presidente, del secretario y de la mitad, al menos, de sus miembros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;11. Procedimiento y órganos competentes para la concesión de las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Las ayudas se concederán, de acuerdo con los principios de objetividad, transparencia, igualdad, no discriminación y publicidad, por medio del procedimiento de concurrencia competitiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El expediente se iniciará con la aprobación de la convocatoria correspondiente, posteriormente las bases y la convocatoria de estas ayudas se tienen que comunicar, mediante el aplicativo web de notificación de la Comisión Europea, y quedará a disposición del público de forma normalizada, según establece el anexo III del Reglamento 2022/2472.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vez la Comisión envíe un aviso de recepción con el número de identificación de la ayuda, el texto de la convocatoria y el resto de la documentación que se requiera, con la referencia de la identificación mencionada, se comunicará a la Base de datos Nacional de Subvenciones (de ahora en adelante BDNS) y se publicará en el BOIB la mencionada identificación, conjuntamente con las bases y la convocatoria, en cumplimiento del art. 20.8 de la Ley general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La instrucción corresponde a un funcionario del Departamento de Economía y Servicios Generales que tiene que realizar de oficio todas las actuaciones necesarias para la determinación, el conocimiento y la comprobación de los datos en virtud de los cuales se tiene que dictar resolución sobre la concesión de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Previamente a la tramitación de la concesión de estas ayudas, el instructor tiene que comprobar que son compatibles con otros ajustes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Las solicitudes presentadas dentro del plazo establecido en la convocatoria se someterán al examen de la Comisión Evaluadora. Si la solicitud no cumple los requisitos establecidos en la convocatoria o falta la documentación exigida, se tiene que requerir al solicitante, para que en un plazo de diez días hábiles enmiende el defecto o aporte la documentación preceptiva, con la advertencia que, si no lo hace, se lo tendrá por desistido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Una vez examinadas las solicitudes por la Comisión Evaluadora, y después de que esta haya emitido su informe, el instructor elevará la correspondiente propuesta de resolución al consejero/a ejecutivo/va competente, el/la cual dictará resolución sobre la concesión o denegación de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Cuando la cuantía de la ayuda propuesta por el órgano instructor sea sustancialmente inferior al solicitado, se podrá instar el beneficiario a reformular su solicitud a fin de ajustar los compromisos y las condiciones de la subvención otorgable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. La resolución del expediente de otorgamiento de las subvenciones tiene que ser expresa y motivada, y tiene que fijar, con carácter definitivo, la cuantía específica de cada una de las subvenciones concedidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. El plazo máximo para dictar y notificar la resolución expresa de concesión de subvención será de seis meses contados desde la fecha de finalización del plazo de presentación de solicitudes. No obstante lo anterior, este plazo se podrá reducir si se establece expresamente en la convocatoria de las ayudas. El silencio administrativo tendrá carácter desestimatorio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. La resolución del expediente de concesión o denegación de las ayudas se tiene que remitir a la BDNS en cumplimiento del art. 20.8 de la LGS y se tiene que publicar en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; a los efectos de notificación (art. 45.1 b de la LPACAP).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. La concesión de la ayuda se puede instrumentar mediante la formalización de un convenio de colaboración con la entidad beneficiaria en el cual se determinen los derechos y las obligaciones de las partes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12. Abono de las ayudas &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Las subvenciones se harán efectivas en el plazo máximo de 60 días desde el momento que se compruebe que la justificación presentada se ajusta a los requisitos exigidos en las bases de la convocatoria y siempre que la disponibilidad de tesorería lo permita. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En el momento del pago el beneficiario tendrá que acreditar que está al corriente con el cumplimiento de las obligaciones tributarias y de la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. No se podrá hacer el pago de la subvención mientras el beneficiario no se encuentre al corriente con el cumplimiento de sus obligaciones tributarias y ante la Seguridad Social y de las obligaciones tributarias con el Consejo Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. No se abonarán las ayudas a las personas o entidades sujetas a una orden de recuperación pendiente después de una decisión previa de la Comisión que haya declarado una ayuda ilegal e incontable con el mercado interior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Respecto a las obligaciones tributarias y con la Seguridad Social, hay que regirse por lo que establece la base 6. Sin embargo, la entidad beneficiaria puede sustituir los certificados que se señalan por una declaración responsable de estar al corriente en el cumplimiento de las obligaciones mencionadas cuando el importe de la subvención concedida en la convocatoria no supere los 3.000 € (art. 11 f TRLGSIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13. Justificación de los gastos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Las entidades beneficiarias están obligadas a justificar la totalidad del proyecto presentado en la convocatoria antes de día 31 de marzo del año posterior al de la convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Para la justificación, se tiene que presentar una cuenta justificativa simplificada, de acuerdo con el artículo 75 del Reglamento de la Ley general de subvenciones, que contienda los siguiente documentos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Memoria justificativa del cumplimiento de las actividades presentadas para la concesión de la subvención, con indicación de las actividades realizadas y de los resultados obtenidos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Relación nominativa de los gastos efectuados y detalle de otros ingresos y subvenciones que hayan financiado la actividad (anexo IV). Todos los gastos que se relacionen en este documento tienen que ser facturas que cumplan los requisitos y las formalidades legales y tienen que contar con los justificantes de pago bancario correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En la fase de comprobación del gasto realizado se solicitará al beneficiario la presentación de los justificantes que se crean oportunos para obtener una evidencia razonable sobre la adecuada aplicación de la subvención. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Si la documentación presentada es incompleta o incorrecta, el servicio responsable pedirá al beneficiario que haga la rectificación oportuna en el plazo improrrogable de diez días hábiles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El Consejo Insular de Menorca podrá inspeccionar las actividades subvencionadas, sin perjuicio de las competencias que puedan corresponder, por normativa legal o reglamentaria, a otros organismos o instituciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. En el caso de recibir cualquier subvención pública, se tienen que librar los justificantes de la subvención recibida y los conceptos por los cuales se ha recibido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Si el gasto justificado es inferior al importe del presupuesto solicitado y subvencionado, se procederá a la reducción proporcional de la subvención concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Son gastos subvencionables los efectivamente pagados antes de que acabe el plazo de justificación de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. Si una vez transcurrido el plazo establecido para la justificación, esta no se ha presentado, se tiene que requerir el beneficiario para que la presente en un plazo improrrogable de 15 días. Este requerimiento tendrá, así mismo, la consideración de inicio del expediente de revocación o reintegro que corresponda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14. Obligaciones de los beneficiarios&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Los beneficiarios tienen que cumplir las obligaciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Hacer constar, de manera expresa, el apoyo del Consejo Insular Menorca, en la realización de las actividades subvencionadas (en caso de actividades que tengan lugar después de la convocatoria) &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Comunicar al CIM la aceptación de la subvención en los términos en que esta se conceda. En cualquier caso la subvención se entenderá aceptada tácitamente una vez transcurridos quince días hábiles desde que el beneficiario haya recibido la notificación de la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Haber realizado la actividad objeto de subvención en el plazo fijado en estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Llevar a cabo las actividades que fundamenten la concesión de las ayudas y justificar la realización, en los plazos y en las condiciones establecidos en estas bases y en la resolución de concesión de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) Comunicar al Consejo Insular de Menorca la solicitud y la obtención de subvenciones y ayudas para la misma finalidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f) Comunicar inmediatamente al Consejo Insular de Menorca cualquier eventualidad que altere o que dificulte gravemente el desarrollo del proyecto subvencionado, en particular si se pueden derivar retrasos en la ejecución o si pueden afectar el coste total. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;g) Acreditar, cuando el Consejo Insular se lo solicite, que se encuentran al corriente de las obligaciones tributarias y con la Seguridad Social. La acreditación no será necesaria en el supuesto de que se haya autorizado expresamente el Consejo Insular a consultarlo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;h) Proporcionar la información sobre la actividad subvencionada que le requiera el Consejo Insular de Menorca. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;i) Someterse a las actuaciones de comprobación que efectúen el Consejo Insular de Menorca y el resto de organismos competentes para la fiscalización de las cuentas públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;15. Revocación y reintegro de las ayudas. Criterios de graduación de posibles incumplimiento&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el caso de incumplimiento total o parcial de las obligaciones de los beneficiarios de estas ayudas se iniciará el expediente de revocación y consiguiente reintegro de las ayudas según corresponda. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cuanto a la revocación y el reintegro de las ayudas, se aplicarán los artículos 43 y 44 del TRLS y el resto de normativa aplicable. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el supuesto de que no sea procedente la revocación total de la ayuda concedida, se podrá aplicar un porcentaje de aminoración en función de la naturaleza del mencionado incumplimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Este porcentaje se tiene que fijar con el informe previo del instructor y la notificación al beneficiario y se tendrá que valorar, en todo caso, el grado de incumplimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si la entidad beneficiaria ha cumplido de forma significativa sus obligaciones, si de la documentación presentada se deduce que ha tenido voluntad de cumplimiento y que se han conseguido las finalidades de la ayuda, se tiene que llevar a cabo una revocación parcial de la ayuda, y como tal, la pérdida al derecho de cobro parcial de la ayuda, de acuerdo con la aplicación del siguiente criterio de gradación siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; En caso de que se haya ejecutado totalmente el proyecto, pero la documentación justificativa del gasto subvencionable del presupuesto presentara deficiencias porque es inadecuada, porque no se ajusta a los requisitos de las bases o por no haberse ejecutado la totalidad del presupuesto inicial subvencionable, el importe de revocación parcial de la ayuda tiene que coincidir con el importe de la ayuda no justificada o justificada incorrectamente. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) En el supuesto de que el beneficiario no justifique en el plazo establecido el importe de la concesión otorgada, se aminorará la subvención correctamente justificada con un 1% por cada día de retraso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Si el beneficiario no hace constar, de manera expresa, el apoyo del CIM se aminorará en un 1% el importe de la subvención correctamente justificada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el supuesto de que se hayan hecho unos pagos anticipados, la persona beneficiaria tendrá que reintegrar las cantidades recibidas que hayan acontecido indebidas más el interés de demora, el cual se contará desde el pago de la subvención, total o parcial, hasta la fecha de resolución mediante la cual se acuerde el reintegro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si el importe de la suma de la ayuda más el resto de otras ayudas, subvenciones, ingresos o fondos propios que hayan financiado la realización del proyecto supera el presupuesto total de ejecución de este, el importe de la revocación parcial de la subvención tiene que ser igual a la cantidad que exceda del presupuesto ejecutado mencionado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las cantidades que se tengan que reintegrar tienen la consideración de ingresos de derecho público y les es aplicable la vía de apremio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La obligación de reintegro establecida en este artículo es independiente de las sanciones que, si procede, sean exigibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;16. Infracciones y sanciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En el caso de incurrir, la presente convocatoria, en una actuación que fue informada como incumplimiento muy grave, en la convocatoria anterior, se considerará que este hecho constituye una infracción administrativa en materia de subvenciones y será de aplicación lo establecido en el título IV de la Ley 38/2003, de 17 de noviembre, General de Subvenciones y en título V del Decreto Legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el Texto refundido de la Ley de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El órgano competente para imponer las sanciones que se deriven de infracciones de lo establecido en estas bases y de la normativa aplicable en materia de subvenciones es el consejero ejecutivo competente por razón de la materia en el caso de infracciones leves y graves y el Consejo Ejecutivo en caso de infracciones muy graves, en conformidad con lo establecido en el art. 69 de la Ley 4/2022, de 28 de junio, de consejos insulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;17. Información sobre las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En cumplimiento del artículo 9.3 del Reglamento (CE) núm. 2472/2022 de la Comisión, de 14 de diciembre de 2022, por el cual se declaran determinadas categorías de ayuda en los sectores agrícola y forestal y en zonas rurales compatibles en el mercado interior en aplicación de los artículos 107 y 108 del Tratado de Funcionamiento de la Unión Europea, el Consejo Insular de Menorca publicará en la web:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;la información resumida relativa al artículo 9.1&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;el texto completo de cada una de las ayudas previstas en el apartado 9.1&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En cumplimiento del artículo 9 del Reglamento (CE) núm. 2472/2022 de la Comisión, de 14 de diciembre de 2022, por el cual se declaran determinadas categorías de ayuda a los sectores agrícola y forestal y en zonas rurales compatibles en el mercado interior en aplicación de los artículos 107 y 108 del Tratado de Funcionamiento de la Unión Europea, el Consejo Insular de Menorca tiene que cumplir lo que disponen sus apartados 1, 2 y 3.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;18. Otras disposiciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Recursos administrativos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los acuerdos del Consejo Ejecutivo por los cuales se aprueban las bases y las convocatorias y se conceden o deniegan las ayudas no agotan la vía administrativa y son susceptibles de interponer recurso de alzada ante el Pleno del Consejo Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las resoluciones de los consejeros ejecutivos por las cuales se conceden y deniegan las ayudas, no agotan la vía administrativa, son recurribles en alzada ante el Consejo Ejecutivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Normativa general aplicable&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En todo aquello no previsto expresamente en estas bases rigen las disposiciones que sean aplicables al Consejo Insular de Menorca en materia de subvenciones, especialmente las contenidas en las normas siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ley 38/2003, de 17 de noviembre, general de subvenciones&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Decreto Legislativo 2/2005, de 28 de noviembre, por el cual se aprueba el Texto refundido de la Ley de subvenciones de la comunidad autónoma de las Illes Balears (BOIB núm. 196 de 31 de diciembre de 2005)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Real Decreto 887/2006, de 21 de julio, por el cual se aprueba el Reglamento de la Ley 38/2003&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ley 4/2022, de 28 de junio, de consejos insulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra este acuerdo, que no agota la vía administrativa, puede interponerse un recurso de alzada ante la Comisión de Gobierno, por delegación del Pleno del Consejo Insular de Menorca (Acuerdo de 31-7-2023, BOIB núm. 109 de 5-8-2023), en el plazo de un mes a partir del día siguiente en que se haya publicado, de acuerdo con el artículo 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El mencionado recurso se entenderá desestimado, si no se notifica la resolución correspondiente, cuando hayan transcurrido tres meses des de su interposición. Contra la desestimación del recurso de alzada por silencio administrativo se puede interponer recurso contencioso administrativo ante el Juzgado Contencioso Administrativo de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
