    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La directora del Servicio de Empleo de las Illes Balears ha formulado la propuesta de resolución siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Hechos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.&amp;nbsp; En fecha 21 de agosto de 2021 se publicó en el BOIB 111, la Resolución del consejero de Modelo Económico, Turismo y Trabajo, y Presidente del Servicio de Empleo de las Illes Balears por la cual se aprueba la convocatoria de subvenciones con el objeto de financiar especialidades formativas dirigidas a trabajadores preferentemente desempleados, (SOIB Formación para desempleados), durante el periodo 2022-2024&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.&amp;nbsp;&amp;nbsp; Las empresas que constan en el anexo de esta Resolución&amp;nbsp; han presentado una solicitud de subvención y pago de las prácticas en el plazo de un mes desde que han acabado las prácticas todos los alumnos asignados a la misma empresa, junto con la documentación relacionada en la convocatoria mencionada en el punto anterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.&amp;nbsp; En relación a las entidades mencionadas en el anexo de esta Resolución, se ha revisado la documentación que ha de acompañar la solicitud de acuerdo con la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Igualmente se ha comprobado que todas las empresas están al corriente del cumplimiento de sus obligaciones con la Seguridad Social y de las obligaciones con la administración del Estado y con la Hacienda de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;También se ha comprobado en la base de datos del sistema de información de los servicios públicos de empleo, las horas de prácticas no laborales realizadas en la empresa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.&amp;nbsp; Respecto de la competencia, el artículo 9.4.i) del Decreto 22/2020, de 24 de julio, por el que se aprueba el Texto consolidado del Decreto de aprobación de los Estatutos del Servicio de Empleo de las Illes Balears, prevé entre las funciones del presidente de Servicio de Empleo de las Illes Balears,la concesión de ayudas y subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El Decreto 12/2023, de 10 de julio, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 94,, de 10 de julio), modificado por el Decreto 16/2023, de 20 de julio (BOIB núm. 102, de 20 de julio), y por el Decreto 17/2023, de 23 de agosto (BOIB núm. 117, de 24 de agosto) establece que las competencias en materia de trabajo están atribuidas a la actual Consejería de Empresa, Empleo y Energía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por otra parte, es aplicable la Resolución del presidente del Servicio de Empleo de las Illes Balears (SOIB) de 24 de octubre de 2023, de delegación de competencias y firma a los órganos directivos del SOIB (BOIB núm. 145, de 26 de octubre).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Resolución del Consejero de Modelo Económico, Turismo y Trabajo, y Presidente del Servicio de Empleo de las Illes Balears&amp;nbsp; por la que se aprueba la convocatoria de subvenciones con el objeto de financiar las especialidades formativas dirigidas a trabajadores preferentemente desempleados, (SOIB Formación para desempleados), durante el periodo 2021-2023.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;&amp;nbsp; &amp;nbsp;«25. Prácticas profesionales no laborales en empresas&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;(...)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Antes de empezar las prácticas, la empresa en la que se lleven a cabo ha de comunicar a los representantes legales de los trabajadores el acuerdo de prácticas y la relación de los alumnos que participen en las mismas. Se debe firmar un convenio entre el centro de formación y la empresa, y los alumnos en prácticas se deben identificar mediante el documento correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;(…)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se podrá destinar a las empresas la cantidad de 3 euros por alumno y hora de prácticas para compensar&amp;nbsp; su ejecución. Esta compensación se otorgará mediante concesión directa de acuerdo con el Real Decreto 357/2006, de 24 de marzo. Con este fin, la empresa ha de presentar una solicitud de subvención y pago de las prácticas según el modelo normalizado, en le plazo de un mes des de que hayan acabado las prácticas todos los alumnos asignados a la misma empresa, junto con la documentación siguiente, de acuerdo con los modelos que se encuentran en la web:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Declaración responsable, de acuerdo con los modelos establecidos en la web del SOIB, según si el importe de la ayuda solicitada es superior o inferior o igual a 3.000 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De conformidad con el articulo 28.2 de la Ley 39/2015, de 1 de octubre, y el articulo 61 del Real decreto 203/2021, de 30 de marzo, por el que se aprueba el Reglamento de actuación y funcionamiento del sector público por medios electrónicos, en el caso que la ayuda solicitada supere los 3.000 euros el SOIB puede obtener los certificados acreditativos que la persona interesada está al corriente de las obligaciones con&amp;nbsp; la Agencia Tributaria estatal y con la Seguridad Social, así como la verificación de los datos de identidad (DNI), excepto en el caso de oposición expresa de la persona interesada, que se ha de hacer constar en el modelo de solicitud. En&amp;nbsp; caso de que no se autoricen estas consultas, junto con la solicitud de ayuda ha de aportar la documentación acreditativa de estar al corriente de las obligaciones anteriores, así como una copia del documento de identidad, si cabe.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Copia autentica de la tarjeta de identificación fiscal de la entidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Declaración responsable de veracidad de los datos bancarios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Copia autentica del poder de representación de la persona que firma la solicitud.»&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El artículo 38 del Decreto 75/2004, de 27 de agosto, por el que se desarrolla la Ley de Finanzas y de las leyes de presupuestos de la Comunidad Autónoma de Las Illes Balears dispone que la Administración de la Comunidad Autónoma de las Illes Balears, previamente a la concesión de subvenciones, comprobará de oficio que sus beneficiarios estén al corriente de las obligaciones con la Hacienda de la Comunidad Autónoma. Corresponde a las unidades de gestión económica comprobar y certificar la situación de los beneficiarios ante la Hacienda de la Comunidad Autónoma de las Illes Balears, sin perjuicio de que el titular de la sección presupuestaria designe a otros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Propuesta de resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Propongo al consejero de Empresa,Empleo y Energía, y Presidente del Servicio de Empleo de las Illes Balears, que dicte una resolución en los términos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Aprobar la concesión de una subvención a favor de las empresas beneficiarias que constan en el Anexo de esta Resolución para compensar las prácticas profesionales no laborales correspondientes a especialidades formativas dirigidas a trabajadores desempleados para el período 2022-2024.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Autorizar y disponer un gasto por un importe global de 6.480,00 euros a favor de los beneficiarios que constan en el Anexo de esta Resolución, de los cuales, 6.120,00 euros con cargo a la partida presupuestaria 76101 322D06 47000 00 24111 y&amp;nbsp; 360,00 euros con cargo a la partida presupuestaria 76101 322D06 48000 00 24111 de los presupuestos vigentes de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Reconocer la obligación y proponer el pago por un importe global de 6.480,00 euros a favor de los beneficiarios que constan en el Anexo de esta Resolución, de los cuales, 6.120,00 euros con cargo a la partida presupuestaria 76101 322D06 47000 00 24111 y&amp;nbsp; 360,00 euros con cargo a la partida presupuestaria 76101 322D06 48000 00 24111 de los presupuestos vigentes de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Publicar esta Resolución en el Boletín Oficial de las Illes Balears y en la página web del Servicio de Empleo de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo esto, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Manifestar la conformidad con la propuesta de resolución y dictar resolución en los mismos términos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta Resolución, que agota la vía administrativa, se podrá interponer recurso de reposición ante el Consejero de Empresa,Empleo y Energía en el plazo de un mes a partir del día siguiente a su publicación en el Boletín Oficial de las Illes Balears, de acuerdo con lo dispuesto en el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB nº 44, de 3 de abril), y del artículo 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;También se puede interponer un recurso contencioso-administrativo ante el Juzgado Contencioso-Administrativo, en el plazo de dos meses a partir del día siguiente a su publicación en el Boletín Oficial de las Illes Balears, de acuerdo con lo que establece el artículo 46 de la Ley 29/1998, de 13 de julio, por la que se regula la competencia contencioso-administrativa (BOE nº 167, de 14 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
